ASWSUV By-Law Amendment on Election Timing

This document proposes amending By-law section 672.01 regarding time constraints for initiatives, referendums, and constitutional amendments. The amendment fixes spelling errors in the existing by-law, changing "filled" to "filed," "forth" to "forty," uncapitalizing "Amendments," and adding "or Constitutional amendments" for clarity. If passed, it would update section 672.01 with these corrections.

By Senators Whitling and Brown
25 January 2008

AN ACT Amending By-law {section 672.00, sub-section 672.01}

BE IT ENACTED BY THE ASWSUV SENATE:

Sec. 1. 672.01 reads as follows:

Time Constraints:
A. Initiatives – Should an initiative measure be filled with the Election Board more
than forth (40) school days before an already scheduled general, primary, or special
election, or after such has already occurred, the Senate shall call a special election
which shall take place within twenty (20) school days of the filing of the measure.
B. Referendums and Constitutional Amendments – Should a referendum or
Constitutional amendment be put forth by the Senate more than forty (40) school
days prior to an already scheduled general, primary, or special election, or after such
has already occurred, the Senate shall call a special election which shall take place
within twenty (20) school days of the passage of the referendum by the Senate.

Sec. 2. 672.01 will be changed to:

Time Constraints:
A. Initiatives – Should an initiative measure be filed with the Election Board more than
forty (40) school days before an already scheduled general, primary, or special
election, or after such has already occurred, the Senate shall call a special election
which shall take place within twenty (20) school days of the filing of the measure.
B. Referendums and Constitutional amendments – Should a referendum or
Constitutional amendment be put forth by the Senate more than forty (40) school
days prior to an already scheduled general, primary, or special election, or after such
has already occurred, the Senate shall call a special election which shall take place
within twenty (20) school days of the passage of the referendum or Constitutional
amendment by the Senate.

STATEMENT OF FACT:
This amendment fixes several spelling errors. First, it changes “filled” to “filed” and “forth” to “forty.”
Second, it un-capitalizes “Amendments” and adds “or Constitutional amendments” to the end of section B.
