Name Release Criteria in VEN ONA Translations
For the remainder of the names, detennination regarding the release/protection of the
names is based on the following analysis. Truenames are protected if they are contained in the
body of a message in an ambiguous or questionable context. In such cases, the personal privacy
[Link] outweighs the public's right to information which could lead to unfair speculation about
the individual. In other instances truenames are released because personal privacy is not at issue.
For example, if a message says that Jones may be approachable, Jones is protected because there
is no factual inforn1ation about Jones's involvement in espionage. Likewise if Jones's name
appears surrounded by unrecovered text so that no context can be established for the name, the
name is protected. On the other hand, if Jones is identified simply as an atomic bomb scientist or
the message says that Jones provided documents to a KGB agent, Jones is released. To contrast,
if Jones is identified by a codename in the body of a message and is only identified by truename in
a U.S. government-written footnote, Jones is protected in the footnote.
During the review of material for the second release, it was decided these rules needed to
be fine tuned due to the difference in the names included in the messages. It was determined that
foreign diplomats and officials have a diminished right to privacy due to the public exposure
demanded by their positions. A private citizen of a foreign country, however, is entitled to the
same privacy rights as a citizen of the U.S. Privacy rights are negated, however in the following
circumstances:
--Because we do not consider the protection of Soviet citizens in these KGB messages, we
also release the names of citizens of Soviet-aligned countries (e.g., Yugoslavia, Czechoslovakia)
even if identified in a footnote or appearing in an ambiguous context.
--In addition, notorious people, those associated with the assassination of Trotsky/attempt
to free his assassin from a Mexican prison and "illegals" are not deemed to require personal privacy
protection.
By applying this analysis the name of an individual may be protected in some contexts and
not others, but this ensures consistency regarding the criteria used and ensures that release is not
made of infonnation which would cause a clearly unwamanted invasion of personal privacy.

have not been incorporated into the main list because of a change of software that precluded
our ability to incorporate them in alphabetical order.)
In reaching our decision on whether to protect names under (b )(6), we took the FBI
recommendations into account because a previous governmental release of a name in an
espionage context or the notoriety of a person would override an individual's privacy
intrests.
The notation (b7c) beside a name indicates FBI's suggestion that the name be
protected.
