Dear Sir,
Reg : Disbursement Letter dated________________________ (“Disbursement Letter”) executed by
and between the persons specified in schedule I attached hereto as Borrower(s) and PNB
Housing Finance Limited;
Sirs,
I/We, bring the Borrower(s) as mentioned in Schedule I attached hereto (“Borrower(s)), do herby
solemnly declare and state as follows:
1. I/We say that I am/ we are competent to make this declaration,
2. I/We declare that I/we am/are absolutely seized and possessed of and otherwise well and
sufficiently entitled to the immovable property described in the Schedule II hereinafter defined as
(“property”)
3. I/We say the PNB Housing Finance Limited, a company incorporated under the provision of the
Companies Act, 1956 and having registered office at 9 th Floor, Antriksh Bhawan, 22 Kasturba Gandhi
Marg, New Delhi (hereinafter referred to as the “PNBHFL”) has, at my/our request, granted/agreed
to grant to the Borrower a Loan on the terms and conditions stated/contained in the disbursement
letter.
4. I/we hereby deposited with you the original title deeds of my/our property situated at (“hereinafter
referred to as “Title Deeds”) described in the Schedule III to keep in safe custody to create equitable
mortgage as and when required by PNB Housing Finance Limited (“PNBHFL”) on the said Property
together with all building and other structure constructed/ to be constructed thereon to create such
security to secure the housing loan/loan of Rs.
_____________________________________________ (“Loan”) availed form PNBHFL. I/we have
already executed the disbursement letter dated _____________________ in related to the said
Loan.
5. I/We hereby declared that whenever memorandum of Equitable Mortgage is required to be created
in favour of PNB Housing Finance Limited (“PNBHFL”) on the said Property, the applicable Stamp
Duty and Registration Charges along with the penalty if any levied by the concerned Authority shall
be paid by me/us and the PNBHFL would not be liable for any cost/charges or interest which would
be required to be paid on account of creation of equitable mortgage.
6. I/We hereby agree to indemnify and keep the PNBHFL indemnified from any loan, damage, claim,
action cost charges and expenses which PNBHFL may suffer or incur as a result of any defect of non-
payment of Stamp Duty Registration Charges.
7. I/We declare that I/we am/are making the aforesaid declaration solemnly and sincerely believing
the same to be true and knowing well that based on the statements and declaration and PNBHFL
has granted/agreed to grant the said Loan to me/us.
