16. Brief facts of the case: -

The Station House Officer at Police Station of Janak Puri Police station received a complaint pertaining to the
crime of selling opium drug to the complainant, Mr. Rahul Tewari who is also the first hand witness of the
crime. On the 4th of August 2020, when the complainant went to the shop “shree ram pan” for purchasing
cigarette, at around 12:30 pm, there the complainant saw that Mr Chaurasia who is the owner of the shop was
giving a small packet to one his customer and when the complainant asked about the packet from Mr Chaursia in
reply he told the complainant that it was 2g of Opium which he was selling to his customers. Mr Chaurasia also
tried to sell the opium to the complainant.
Upon receiving such information, a formal letter was sent to the judicial magistrate first class for investigation.
17. Brief procedure of Investigation followed by the Investigating Officer
The information pertaining to the Non Cognizable offence u/s 17(a) of the Narcotic Drugs and Psychotropic Substances
Act, 1985 was received by the complainant in written form at around 1 pm on 04/08/2020. After that a letter was
forwarded to the magistrate asking for the permission to investigate further on the Information. SI Sanjay Kumar was
appointed as the Investigation Officer. After receiving the warrant of arrest and search and seizure memo the IO along
with his team visited the shop against which the complaint was filed. The IO reached the shop at 2pm and started the
investigation by searching for the evidence and at that moment only the accused Mr Chaurasia took a bag from the shop
and tried to run outside the shop, but he was caught by one of the police officer and after the police looked inside the
bag, they found 10 packets of opium drug 2g each, so started searching for more evidence and then they found 2 more
packets of opium drug in the drawer where the accused used to keep the money of the shop. There was a CCTV installed
in the bank which was beside the shop covering different views of the bank and the shop. The IO duly collected the CCTV
footage of the day of the crime. Thereafter, the IO interrogated the security who used to sit in front of the bank in order
to check if they could provide any relevant information. After carrying out the investigation at the shop, the IO along with
his team of officers arrested the accused and the all the evidences were sent to the Janak Puri police station

This is to inform you that I Rahul tewari on 04/07/20 purchased a cigarette around 12:30 pm from Ram Pan Bhandar,
when I was lighting the cigarette I saw Mr Chaurasia handing a small packet to one of his customer, I used to buy
cigarette from his shop on a daily basis and 2-3 times I have seen Mr Chaurasia giving small packets to his customers, so I
used to ask him that what was in the packet which you gave to the customer, he used to ignore my question but on
04/08/20 he told me that it was 2g of opium which he sells to his customers whenever they asks for it. So he offered me
to try it as it’s a very small quantity which he was selling, in reply I denied his offer and told him that this is illegal and you
cannot sell it without a license, but he ignored the fact.

It is prayed that a complaint may kindly be registered and strict action taken against the person who is selling these illegal
drug and be brought to the books and tried as per the law.

STATEMENT AS RECORDED:
I am the security Guard of HDFC Bank which is located in C2c 316, Janakpuri,
Delhi – 110058. I had been there working there for 10 years and my shift starts from 9 am in the morning till 9 pm in the
evening and I have to sit on the front gate of the bank. On 04/08/20, I saw that the Police had come in the shop beside the
bank which is the pan shop from where I used to take my cigarettes from the pan shop beside the bank and sometimes I
used to see Mr chaurasia giving a small packets to some particular customers, so I asked about the packet and in reply he
told me that it was opium and he sells it to his particular customers who pay him a good amount of money, he said that you
cannot afford this to buy so don’t bother yourself in thinking about these stuff.
So on 04/08/20 I went to the Shree Ram Pan shop for buying a cigarette and at that time police came and entered the shop.
Police showed Mr chaurasia the warrant to search his shop and after seeing the warrant Mr Chaurasia took a bag and tried
to run out from the shop but one of the police officer caught him and when the police officer checked his bag they found
10 packets of opium drug weighing 2gram each.
After getting the opium drug from the bag the police continued their search inside the shop and in the drawers where Mr
chaurasia used to keep the money there the police found to more packets of opium which were seized by the police officer.
Then they arrested Mr Chaurasia and took him to the police station.
