Facts: A et al. were charged with plunder before the Sandiganbayan. They assailed the
jurisdiction of the Sandiganbayan.

Issue: Whether the Sandiganbayan has jurisdiction

Held: No. None of the accused occupied positions corresponding to Salary Grade “27” or
higher. The Sandiganbayan has no jurisdiction over the crime of plunder unless committed
by public officials and employees occupying the positions with Salary Grade “27” or
higher, in relation to their office (pursuant to RA 8249). REPUBLIC ACT No. 8249            
February 5, 1997 AN ACT FURTHER DEFINING THE JURISDICTION OF THE
SANDIGANBAYAN, AMENDING FOR THE PURPOSE PRESIDENTIAL DECREE NO. 1606, AS
AMENDED, PROVIDING FUNDS THEREFOR, AND FOR OTHER PURPOSES
