Case Analysis
I. Introduction
Schools are the second place after home where student’s behavior and
future educational success are molded. At schools there are many factors
that can influence the teaching and learning process that may take place.
Teaching and learning can only happen if there are presence of teacher,
students, material and context of time and place. The learner is the center of
the educative process. On the other hand the teacher is the one who will
facilitate, nurture, and guide the students in his/her studies. A good teacher
and actions to be taken on his part in the classroom play a vital role in
provoking effective and efficient learning on the part of the students. But what
if the teacher is the reason why the learner gave up his studie?
II. Background
Libudon National High School belongs in Schools Division of the City of
Mati and this where the case came from. It happened on November 8, 2019.
While the Filipino teacher of Grade 8 was having her class, a group of grade
8 students sitting at the back were giggling while watching something.
Another teacher who is the Guidance-in-charge in the school passed by and
wonder why does students were giggling while their Filipino Teacher was
teaching. She silently sneaked at their back and she saw that the group of
male students were watching pornography on the cellphone. She immediately
call the attention of the Filipino teacher and inform her about what happened.
The Guidance-in-Charge had a meeting together with the adviser of Grade 8,
Filipino teacher and the principal. Afterwards they called the attention of the
grouped of grade 8 students. Upon asking the students as to where did they
get the video, they answered that during their jamboree in Manay, one of our
male teachers in LNHS who joined the jamboree forced them to receive the
video. The male teacher told them to not tell to anyone and they watched it as
sort of “lingaw2”.
After the principal knew the male teacher that they were referring to, she
called immediately his attention. The principal told the teacher to not do it
again. She also told him that she wants to reprimand the teacher but she pity
him.
The school conducted a meeting together with the parent, the students,
Guidance-in-charge and the principal. After the meeting, one of the Grade 8
students dropped out of school. Even though the teachers were asking him to
continue his education but he refused. According to him he was humiliated
since his classmates keep on teasing him and he can’t the teachers anymore
because of what incident. His mother told him that he was very ashamed
during the meeting while listening to what his son has done.
III. Critical Analysis
Based on the said case, it is very clear that the male teacher violates the
DepEd Order 42, s. 2012 known as Child Protection Policy. This policy is all
about Protecting Children in School from Abuse, Violence, Exploitation,
Discrimination, Bullying and other forms of abuse. The students were abused
psychologically particularly sexual abuse and emotional maltreatment. The
teacher also violated the students in sexual violence particularly forcing the
child to watch obscene publications and indecent shows. In the same manner
he also violated Republic Act No. 7610 known as An Act Providing for
Stronger Deterrence and Special Protection against abuse, exploitation and
discrimination, and for other Purpose.
IV. Recommendation
As a principal, he/she must be firm in his/her decision. It is fine to be
humane but in this case the student gave up his studies because of
humiliation. This is not a minor case that’s why it should be dealt accordingly.
As teachers it is a must for us to be oriented not just in our duties and
obligations as a teacher but also this DepEd Order 42, s. 2012 and Republic
Act No. 7610 because we are liable on what we do in school and ignorance of
the law excuses no one.
