GIFT DEED
THIS DEED OF GIFT IS MADE AT THANE on this _12th day of July 2021
BETWEEN Smt. Rajeshree Rajan Sawant, Age: 62 years, (Pan No.
BDGPL5632W) residing at Flat No. 303, Ground Floor, in Ganesh Apartment
Co-Op. Housing Society Ltd., Village Thane, Naupada, Thane (West)
hereinafter called “THE DONOR” respectively (which expression shall unless
it be repugnant to the context or meaning thereof be deemed to mean and
include her heirs, executors, administrators and assigns) of the party of the
FIRST PART;

Smt. Anjali Rajan Sawant , Age: 40 years, (Pan No. BDGPN8712L)
residing at Flat No. 303, Ground Floor, in Ganesh Apartment Co-Op. Housing
Society Ltd., Village Thane, Naupada Thane (West) hereinafter called “THE
DONEE” (which expression shall unless it be repugnant to the context or
meaning thereof be deemed to mean and include her heirs, executors,
administrators and assigns) of the party of the SECOND PART;
1] WHEREAS the “THE DONOR” is seized and possessed of and/or
otherwise sufficiently entitled to the flat premises bearing Flat No. 303,
Ground Floor, in Ganesh Apartment Co-Op. Housing Society Ltd.,
Village Thane, Naupada Thane (West), totally admeasuring 525 sq ft.
of Built up area and the said flat is located in a building known as
“Ganesh Apartment" constructed upon a piece and parcel of land
bearing Survey No. 120, Hissa No. 17, lying being and situate at
Naupada,Thane (West) within the limits of Thane Municipal
Corporation and Registration district, Thane, hereinafter referred as
the “SAID PREMISES”.
2] AND WHEREAS THE DONOR herein became the owner of the Said
Premises by virtue of Development Agreement dated 03 July 2009,
executed between M/s. Ganesh Enterprises, the Partnership Firm and
Party of the first Part herein. The said Development Agreement is
notorized before the Notarized Advocate Shri. Abhishek Lote bearing R.
No. 32961 dated 7th July 2009.
3] AND WHEREAS “THE DONOR” and “THE DONEE” are mother and
daughter respectively and hence the Donee is the family member of
the Donor;

4] AND WHEREAS the “THE DONOR” being the Daughter of the
Donee, she desires to grant the said premises to the Donee as a Gift
in consideration of natural love and affection as hereinafter mentioned;
6) AND WHEREAS the market value of the said premises is
Rs.54,00,000/- (Rupees Fifty-Four lakhs only) and the stamp paid on
this Instrument of Gift as provided in Article 34 (Proviso) of Bombay
Stamp Act, 1958.
NOW THIS DEED WITNESSETH that the “THE DONOR” without any
monetary consideration and in consideration of natural love and affection
which the “THE DONOR” bear to the Donee do hereby grant and transfer by
way of gift the said premises and more particularly described in the Schedule
hereunder written together with all the liberties, privileges, easements and
advantages appurtenant thereto And all the estate, right, title, interest use,
inheritance, possession, benefit, claims and demand whatsoever of the “THE
DONOR” To Have And To Hold the same unto and to the use of the Donee
absolutely but subject to the payment of all taxes, rates, assessments, dues
and duties now and hereafter chargeable thereon to the Government or
Municipality or other Local Authority.
AND the “THE DONOR” does hereby covenant with the DONEE –
[a] That the “THE DONOR” now has in themselves, good right, full power
and absolute authority to grant the said premises granted as gift in the
manner aforesaid.
[b] The Donee may at all times hereafter peaceably and quietly enter
upon have occupy, possess and enjoy the said premises every part
thereof to and for her own use and benefit without any suit, lawful
eviction, interruption, claim or demand whatsoever from or by the
“THE DONOR” or their heirs, executors, administrators and assigns or
any person or persons lawfully claiming or to claim by, from under or
in trust for the “THE DONOR”.

[c] That the said premises are free and clear and freely and clearly and
absolutely and forever released and discharged or otherwise by the
“THE DONOR” and well and sufficiently saved, kept harmless and
indemnified of and from and against all former and other estate, titles,
charges and encumbrances whatsoever, had made, executed,
occasioned or suffered by the “THE DONOR” or by any other person
or persons lawfully claiming or to claim by, from, under or in trust for
the “THE DONOR”.
[d] AND FURTHER that the “THE DONOR” and all persons having or
lawfully claiming any estate or interest whatsoever to the said
premises or any part thereof from under or in trust for the “THE
DONOR” or his heirs, executors, administrators and assigns or any of
them shall and will from time to time and at all times hereafter at the
request and cost of the Donee do and execute or cause to be done and
executed all such further and other acts, deeds, things, conveyances
and assurances in law whatsoever for better and more perfectly
assuring the said premises and every part thereof unto and to the use
of the Donee in the manner aforesaid as by the Donee, his heirs,
executors, administrators and assigns or counsel in law shall be
reasonably required.
IN WITNESS WHEREOF the “THE DONOR” as well as the Donee (by way
of acceptance of the said gift) have put their respective hands the day and
year first hereinabove written.

Flat No. 303, Ground Floor, in Ganesh Apartment Co-Op. Housing Society
Ltd., Village Thane, Naupada, Thane (West), totally admeasuring 525 sq ft.
of Built up area and the said flat is located in a building known as “Ganesh
Apartment" constructed upon a piece and parcel of land bearing Survey No.
120, Hissa No. 17, lying being and situate at Mouje Naupada, Thane (West)

within the limits of Thane Municipal Corporation and Registration district,
Thane, IN WITNESS WHEREOF the parties hereto have hereunto set and
subscribed their respective hands on the day and year written hereinabove.
