RULES AND REGULATIONS GOVERNING:

3)FILING OF CERTIFICATES OF CANDIDACY AND
4)NOMINATION OF AND ACCEPTANCE BY OFFICIAL
CANDIDATES OF REGISTERED POLITICAL PARTIES OR
5) COALITIONS OF POLITICAL PARTIES IN CONNECTION WITH
THE MAY 9,2022 NATIONAL AND LOCAL ELECTIONS.
Q: What are political conventions?
A: These are events or gatherings when political parties nominate
their candidates for all elective positions, and the period allowed is
from September1-28, 2021.
Q: What is the significance of political conventions?
A: It is important because, if you belong to a political party, one of
the information that you need to put in your Certificate of Candidacy
is a CONA or Certificate of Nomination & Acceptance, which is
signed by authorized signatories of the political party that you belong
to.
Q: Can anyone from the political party sign the CONA?
A: No, because the signatory must be one of the authorized
signatories whose signature specimen were submitted to the
COMELEC as authorized signatories of their respective political
parties.
Also, only the Chairperson, President or the Secretary General
of the political party can submit the list of signatories.
Failure to submit this list will result in the declaration of their
nominees as independent candidates.
Q: What is a Certificate of Nomination and Acceptance or
CONA?
A: It is a document in the form prescribed by the COMELEC,
under path and filed with the Certificate of Candidacy of a candidate
who is nominated or endorsed by a political party.
Q: Can a political party nominate more than one candidate in
one position?
A: No, only one per position. If more than one they shall all be
declared as independent candidates.
Q: Can a person run for more than one position/office to be
filled in the same election?
A: No!
Q: What is the effect if someone does file for more than one
position/office to be filled in the same election?
A: The candidate shall not be eligible to run for any of them.
Unless he files a Statement of Cancellation to cancel one of his
COC for another position.
Q: What is a Certificate of Candidacy or COC?
A: It is a form prescribed by the Comelec, that each candidate for
a particular position fills up and submits to the COMELEC when he
intends to run for a particular position.
Q: What re are the contents?
A: Every COCs must contain the following:
1. Office aspire for, and the place for LGUs;
2. Name;
3. Age;
4. Sex
5. Civil status;
6. Place & date of birth;
7. Citizenship,(whether natural born or naturalized)
8. The political party. He belongs to
9. Name of spouse if married
10. Complete address
11. Residence and exact number of years residing therein
12. The barangay or city where he is a registered voter
13. Profession or occupation;
14. That he is eligible for said office (different offices have
different eligibilities)
15. That he is not a resident or an immigrant of another
country
16. That he has executed a sworn renunciation of foreign
citizenship (if applicable)
17. That the aspirant will file with the COMELEC, within 30
days after election day, a full, true and itemized statement
of Contributions and Expenditures (SOCE) in connection
with the election;
18. That the aspirant will support and defend the constitution
and will maintain allegiance thereto;
19. That the spirant will obey the laws, legal orders, decrees,
resolutions, rules and regulations promulgated and issued
by the duly constituted authorities;
20. That he assumes all the obligations voluntarily without
mental reservation or purpose of evasion;
21. That he gives consent to the COMELEC to collect,
disclose or share and process the personal data provided
for election and other lawful purposes;
22. That all the facts stated in his COC are true and correct
to his knowledge;
23. Whether he has been found guilty for an offense which
carries with it the accessory penalty of perpetual
disqualification to hold public office, which has become final
and executory.
Q: Can an aspirant use any name other than his legal name?
A: No. It has to be the one in the civil local registry. But he is
allowed to use one nickname or stage name.
Q: What other requirements do you need to comply for your
COC?
A: 1. You need to attach the following:
1.1 Passport-sized photo;
1.2 P30.00 Doc stamp to the origibal copy of COC
1.3 Short bio-data and/or program of government not
exceeding 100 words. (optional)
2. Notarize the COC.
Q: Where do you file the COC?
A: Depends on the elective position aspired for, the COC is filed
in 5 copies with the CONA (if party member).
Q: What happens if you filed your COC in the wrong office?
A: Deemed as not filed.
Q: Does the aspirant need to file it personally?
A: May be filed personally or through a representative. But the
representative must be duly authorized to do so. There is a
prescribed form for the Authority to File. But no COC can be filed by
mail, telegram, or fax.
Q: Can an aspirant withdraw from running in the elections?
A: Yes, at any time before election day, by filing a Statement of
Withdrawal wth the office where he filed his COC.
Q: Can the aspirant be substituted in the filed COC?
A: Yes, there can be a valid substitution. Any aspirant who,
withdraws, or dies, or was disqualified may be substituted, but
only if:
1. he belongs to a registered political party, and can only be
substituted by a member nominated by the same political
party. No substitute shall be allowed for independent
candidates.
2. Substitution must be done on or before November 15,
2021. Meaning the substitute must file his COC on or
before that date.
Q: Any covid related restrictions regarding the filing of
candidacy?
A: Yes.
1. unlike before when candidates file their COCs
accompanied by their family and supporters, the COMELEC
now only allow two(2) companions when filing their COCs,
except for the positions of President, VP and Senators,
where candidates can bring up to Three (3) companions;
2. The COMELEC may deploy the AFP and/or PNP in
coordination with the IATF in manning the receiving offices
for the filing of COCs to ensure compliance with all the
health and safety measures.
