RESOLUTION NO. 04
SERIES OF 2018
A BARANGAY RESOLUTION ADOPTING THE MUNICIPAL ORDINANCE NO. 03 SERIES
OF 2003 ALSO KNOWN AS THE “PARTIAL AMENDMENT OF MUNICIPAL ORDINANCE
NO. 05 SERIES OF 1960”
Be it ordained by the Sangguninang Bayan of Candaba, Pampanga, that:
Section I. This ordinance shall be re-titled: “AN ORDINANCE IMPOSING CURFEW HOURS
TO MINORS AND PROHIBITING THEM TO CARRY DEADLY WEAPONS SUCH AS POINTED,
BLADED, IMPROVISED DEVICE OR INSTRUMENT, GUNS (LICENSED OR UNLICENSED) OF
ANY CALIBER AND KIND, BLUNT OBJECTS AND OTHER PARAPHERNALIA THAT MAY
THREATEN LIFE OR MAY INFLICT HARM OR INJURY TO A PERSON”.
Section II. It shall be unlawful for anyone below 18 years old to loiter and wander around the town
plaza or any other public places from 10:00 PM- 4:00 AM.
Section III. It shall be unlawful for anyone below 18 years old to carry and possess deadly
weapons such as pointed, bladed, or improvised device or instrument, guns (licensed or unlicensed) of any
caliber and kind, blunt objects and other paraphernalia that may threaten life or may inflict harm or injury
to a person.
Section IV. Anyone found violating this ordinance shall suffer the penalty of doing community
work, pay a fine or both and imprisonment at the discretion of the court. The following penalties shall be
imposed on offenders:
A) FIRST OFFENSE- reprimand in the form of orientation/schooling plus blotter.
B) SECOND OFFENSE- P500.00 fine or 8 hours of community service.
C) THIRD OFFENSE- P1000.00 fine or 24 hours of community service.
D) FOURTH AND SUCCEEDING OFFENSE (HABITUAL OFFENDORS)- P2,500.00 fine plus
1 week of community service and imprisonment.
Section V. For the purpose of this ordinance, deadly weapons constitute and consist of the
following:
A) POINTED WEAPONS- shall refer to ice pick, spear or any pointed woods, stick, iron
or steel and the likes;
B) BLADED WEAPONS- shall refer to knife of any kind such as balisong, dagger, bolo,
machete, swigs army knife, hunting knife, etc;
C) GUNS- shall refer to hand guns and pistons of any kind and caliber cohether licensed
or not;
D) BLUNT OJECTS- shall refer to any objects with the likes of baseball bat, club, paddle,
arnis, dos por dos, etc;
E) IMPROVISED DEVICE OR INSTRUMENT AND OTHER PARAPHERNALIA-
shall constitute and encompass all other objects and weapons that do not fall in any of
the category stated above.
Section VI. The following shall be exempted from the ordinance. College students, workers and
minors doing or running an errand on emergency cases and situations.
Whereas, on motion of Hon. Kagawad Ronillo Bermudez (Chairman on Committee of
Peace and Order) and the majority members of the council, gave their affirmative to adopt
Municipal Ordinance No. 03 Series of 2003 also known as the “PARTIAL AMENDMENT OF
MUNICIPAL ORDINANCE NO. 05 SERIES OF 1960”.
Resolved as it hereby resolved that this resolution shall take effect immediately upon
approving and posting in conspicuous places in the barangay.
