On 16 December 2012 an incident involving gang rape and murder of a 23 year old girl took

place in Delhi, better known as ‘The Nirbhaya Case’.The brutality in the case was so horrific that
it forced the common man to wake up and raise their voice by way of protests which emerged in
several parts of the country. The victim died after 13 days of the incident. It is completely
impossible to put in words the amount of pain suffered by her in these 13 days. It can just be
understood by the statement of the doctor who treated her,he said, “It was a foregone conclusion
from day one that she will not survive because of the nature of injuries.”
Several new laws were made, old laws were amended, commissions were formed giving people
the assurance that this was one dark chapter, which although will remain in their memories for
lifetime but such an incident would not take place ever again. But little did they know that this
incident just marked the beginning of a series of such cases.
Again on 28 November 2019,in Hyderabad, a 26-year-old veterinary doctor was gang raped and
this time the body was found burnt under a bridge. This again caused outrage in several parts of
the country. Protesters across India demanded stricter laws against rapists.
As a result the government of Andhra Pradesh passed a bill named Disha Act that to award death
penalty for rapists within 21 days after the crime is committed.
These are just the instances of the cases involving sexual violence which got high coverage but
in India the cases of violence against women is unfortunately very high. Considering the fact that
most of the cases don’t even get reported still the number of cases registered daily is frightening.
Violence against women not only includes sexual violence but domestic violence as well.
According to the latest statistics:”In 2020, between March 25 and May 31, 1,477 complaints of
domestic violence were made by women. This 68-day period recorded more complaints than
those received between March and May in the previous 10 years.”1
As we are living in the 21st century, it is dubbed as age of scientific temperament, literacy rate
has increased, the economy is growing faster than ever, people are realizing their rights and are
now in no way going to tolerate the infringement of their right and personal liberty. But with this
dynamic change, the status of women seems to be same as it was before. with the transformation
of society violence against women was expected to be vanished but the figures seems to be
contrary .Now different forms of violence have proliferated against women whether it be sexual
harassment at the workplace, acid attacks ,trafficking, stalking , voyeurism etc. even the girl
child who in the Indian society is considered as “the gift of the providence” are being subjected
to the wanton lust and vicious appetite of the lowest of all men. The heinousity reflected in the
commission of these crime against women demands the response from the courts, legislature and
by the society .we are required to address whether subsequent criminal law amendments,
government initiatives and social reforms are capable to deal with these rampant menace that
women of this country face every day or not?
