SW NO.1 - PRELIMINARIES
GENERALLY
A GENERAL INFORMATION
All directions, obligations and instructions in this General Conditions and Preliminaries (the
Preliminaries) are directed at the Contractor unless otherwise specifically stated to the otherwise.
The Contractor shall ensure that all such directions, obligations and instructions are complied with
whether by himself or his servants, agents, workmen or and subContractors. These requirements
form part of the Contractor's obligation and responsibility under this Contract.
The Contractor is deemed to have included or allowed for compliance with all requirements herein in
the Contract Sum, regardless of whether or not specific stipulations on such inclusion have been
made in the Clauses herein.
The prices inserted herein shall be for full compliance with the intent of each item and apply to the whole of the
Works under this contract.
Within two (2) weeks from the contract commencement date, the Contractor shall provide a detailed breakdown of
their pricing into the following categories:
a. mobilisation costs, i.e. costs incurred at the outset of the contract;
b. time related costs, i.e. costs applied equally over the contract duration;
c. removal costs, i.e. costs incurred at the tail-end of the contract ; and
d. other lump sum items, or one-off payable costs shall be identified, and the
amount and time upon which payment falls due shall be identified
The detailed breakdown and mode of payment, after rationalisation, and upon agreement and acceptance by the
Architect/S.O shall form the basis for the valuation of Preliminaries under interim certificates.
The Architect/S.O shall have the right to withhold payment, in whole or in part, or to totally omit
any items covered under the preliminaries which the Contractor has failed to provide, or which are
inadequately provided. The contract sum shall be accordingly adjusted for any such reductions or
omissions which the Architect/S.O deem necessary due to the non-compliance by the Contractor.
This is without prejudice to any rights and remedies which the Employer may possess under or in
connection with the contract.

SW NO.1 - PRELIMINARIES
A SCOPE OF WORK
The Contract comprises generally the supply of all labours, materials, tools, plant, equipment and everything
else necessary including temporary works of any nature, for the proper execution, completion and
maintenance of the Works in conforming with the Drawings, this Specification and the Conditions of Contract.
The following works are EXCLUDED in this contract, separately appointed by the Employer:-
1) Piling Works - undertaken by Piling Contractor
2) External Equipment - to be awarded under separate package
3) Infrastructure Works - to be awarded under separate package
4) Mechanical and Electrical Works - to be undertaken by Specialist Contractors
4) Furniture and fixture - to be direct purchased by the Employer
All Works shall be executed in accordance with the Specification and Contracts Documents and to the satisfaction
of the Architect/S.O.
The complete scope of works can be gauged from the tender drawings.
The Contractor is to allow in their tenders for all contingencies they deem they may require in order to comply
with the sectional completion programme and must provide for multiple gangs and suitable construction techniques
and equipment.
B ALTERNATIVE TENDERS
Provision has been made in the Summary of Tender to these Schedule of Works for the submission of TWO (2)
ALTERNATIVE TENDERS:-
The award of the tender to the Contractors will be solely at the discretion of the Employer.
No claim for any loss and/or expense whatsoeve shall be entertained in the event the Employer carries out all or
part of the above said works.

SW NO.1 - PRELIMINARIES
A COMPLETION
Time for completion of this Contract is important and completion within the contracted period is essential.
The Contractor shall be charged Liquidated and Ascertained Damages, at the rates stipulated in the
Appendix to the condition of Contract, if the time for completion of any at the rates stipulated in
the Appendix to the condition of Contract, if the phase is exceeded and no extension of time has
been granted by the Architect/S.O.
B SEQUENCE OF CONSTRUCTION
It is a condition of this Contract that the works are to be carried out and completed in the sequence
and sections. The sequencing of sectioned completion, priority for area for completion, lines of
division of sectional completion and the extend of the works are to be determined by the
Architect/S.O.
The Contractor shall make every endeavour to programme the sequence of works to comply with the
sectional completion and to ensure proper execution of the works for the completion of the building
work construction.
The right is reserved to the Employer to require that the sequence of construction of the various
sections to be varied from the order stated in the tender and no claims will be considered on this
account.
The Contractor shall work in close co-ordination and liaison with other Contractors appointed by the
Employer who may, at one time or the other, during the currency of this Contract, be operating
around and in the vicinity of the site. The Contractor shall take account of the work programme of
these other Contractors in the planning and programming of the Contract works.
The Contractor shall, in particular, liaise with these other Contractors on matters of shared access,
common security, keeping roads, accessways and drains free of debris and mud. The Contractor
shall co-ordinate all related work to minimise obstructions and hindrances. The Contractor shall
agree and share the cost of maintenance of all roads and accessways, or other common facilities.
Within one week of the Architect so instructing, the Contractor shall remove all materials and rubbish
that are in the working areas of these other Contractors in order that their works are not impeded.

SW NO.1 - PRELIMINARIES
A SITE LOCATION
The site is located at Lot 213, 214, 215, 216, 217 & 218, Pekan Bukit Changgang, Daerah Kuala Langat,
Selangor Darul Ehsan.
The Contractor is to refer to the Key Plan for the exact location, dimensions and area of the site and he must
accept the site "as found on the date of possession".
B VISIT TO SITE
The Contractor shall visit the site of the works and shall by independent inquiry and observation ascertain the
following in connection with the works:-
a. the nature, character and extent of the works
b. local conditions
c. the means of access to and from and within the site of the works
d. the extent of working space available
e. the conditions affecting labour and materials
f. the conditions affecting the storage of materials, the positioning of shed, stores, site offices,
temporary buildings
g. the character of the soil or strata and the nature of subsoil upon which the works are to be executed. The
Contractor is to bore trial holes at their own expenses if they deem it necessary.
h. all other information which may in any way be relevant or necessary to enable the Contractor to estimate
accurately the cost of the works.
No claims made on the ground of failure to visit the site and/or of want of any of the aforesaid
matters or other like information which might financially affect the Contract, will be considered.
C SITE POSSESSION
In giving the Contractor possession of the Site, it shall not to be deemed that he is to have
extensive possession but only a limited possession. Such possession will enable him to perform
the works comprised in this Contract. The Employer may at any time take possession of any portion
of the ground or intended site of the works for the purpose of carrying on any other work, or for any
purpose whatsoever. The site may be handed over in parts but without any compensation. No
extension of time will be granted to the Contractor in complying with the above requirements.
D SITE INSPECTION
Immediately after taking possession of the site and before commencing any work, the Contractor shall
check actual levels and dimensions against those shown on the the Contractor shall be held to accept
all levels and drawings and immediately inform the Architect/S.O in the event of any alleged
discrepancy. If no communication has reached the Architect/S.O., the Contractor shall be held to
accept all levels and dimensions and no claims for extra payments in this connection will be entertained.
The Contractor shall allow for the assistance of a Licensed Land Surveyor to carry out a site survey before
work commences, and to assist in establishing boundaries and setting out the works as required by the
Architect/S.O and shall cause copies of the survey drawings to be distributed to the Employer and his
Consultants.
The licensed Land Surveyor shall carry out another site survey to confirm the final levels upon
completion of the formation levels to indicate achievement of levels upon completion and to complete
'As Built' setting out levels and formation levels including providing all pegs, templates, instruments
and labour necessary for so doing and as required by the Architect/S.O for checking the work. Five (5)
sets of the endorsed 'As Built' drawings shall be submitted to the Architect/S.O for reference.

A EXISTING SERVICES
The Contractor shall take all necessary steps to ascertain the exact positions of existing cables, pipes,
ducts, sewers, service mains and the like, and shall uphold, protect and maintain the same during
excavations and make good or pay for making good all damage or loss arising out of such damage.
The information given or shown on any drawings are for guidance only and does not relieve the
Contractor from any responsibilities should the information given or shown be incorrect.
In cases where the services are to be temporarily terminated or diverted, the Contractor shall give the necessary
notices to the appropriate Authorities and arrange for the work to be carried out and pay all charges in connection
therewith.
B ADJOINING PROPERTIES
The adjoining sites include various buildings and structures and care must be taken to ensure that
no vibrations or other disturbances shall affect the adjointing buildings and structures during the
course of work.

that no vibration or other disturbances shall affect such construction works during the course of
building operations.
Ensure that the security of adjacent property is not lessened due to work activities. Take measures
to prevent trespass from adjoining properties.
Damages or other disturbances caused to the adjoining buildings and structures shall be made good
to the satisfaction of the Architect/S.O. Pay for any compensation claimed.
Make every effort to reduce noise, vibration, dust or any other interference that may be caused
by the Works. Install as directed by the Architect/S.O, and without additional cost, duct sheets,
temporary screens, etc. and adopt measures necessary for the mitigation of noise, vibration, dust, etc.
Prior to commencement of the Works, the Contractor shall arrange for a joint survey and
inspection of the site, neighbouring properties , footpaths, roads, fences and other fittings,
fitments and structures, including carrying out verticality checks. This shall be carried out together
with the owners of adjoining buildings and structures, Employer's Representative(s), Architect,
Engineer, other work-related Contractors, and the Insurance Company from which the relevant
insurance policies are taken.
Photographs shall be taken, dated and referenced with notes of their existing conditions, with
special features highlighted and annotated and included in a report to be submitted to the
Architect. Two (2) sets of the report shall be submitted to the Architect/S.O and one (1) copy
provided to the Insurance Company.

A UNSPECIFIED ITEMS
Ensure that any and all materials , goods and components which are left to the choice of the Contractor
are of good quality, fit for their intended purpose and in compliance with good engineering and building
practice.
Unless specific requirements, performance criteria, etc are indicated, self-finished and
decorative materials shall be subject to the selection and approval of the Architect/S.O.
B APPROVED EQUIVALENT
Where the term "approved equivalent" is appended to specification clauses or descriptions in the
Schedule of Works for materials or components to be incorporated into the works, it shall mean
materials and components of equal or better quality, standards, manufacture and capable of
performing in all respects to specified requirements, subject always to the approval of the
Architect/S.O.
Where equivalents are offered, the Contractor shall submit relevant details with their tenders.
The word “Fix Only”, where used in the Specifications and Schedule of Works in connection with any material or
goods supplied by Nominated Suppliers shall be understood to include for :-
a. Cost of labour and supervision, including on-costs such as but not restricted to :
(i) ovetime and non-productive time
(ii) incentive and bonus payment
(iii) travelling time and expenses
(iv) annual and public holidays
(v) disbursements arising from Employment, Health, Safety or Welfare Laws and Regulations, CIDB Act, etc.
b. cost of mechanical and non-mechanical plant, equipment and tools including operator, fuel, oil and
maintenance
c. taking delivery of materials, assisting in unloading, handling including double handling, storage on or off-site,
paying all storage costs, protecting and returning package.
d. laying out materials on site for selection and approval by the Architect/S.O before laying and/or fixing.
e. movement and installation, hoisting, cutting, fitting and fixing materials in final position including all sundry
items
f. co-ordinating interfacing details and providing all details of pre-drilling and building penetrations.
g. all cutting, assembling, hoisting fitting and fixing materials in final position, including allowances for breakage
and wastage

Model or brand of materials specified, including suppliers and/or manufacturers listed in the
Specifications or described in the Schedule of Works are preferred materials and suppliers and/or
manufacturers.
The Contractor is at liberty to propose alternative brand and/or model in substitution of specified
model/brand and/or suppliers/manufacturers. All alternative materials or finishes offered shall be
of “approved equivalent” as specified in the earlier clause on “Approved Equivalent “, and shall
offer substantial savings to qualify them for acceptance.
Acceptance and/or rejection of alternative materials and finishes shall be the sole discretion of the
Architect/S.O. In the event that alternative materials and finishes are accepted, these shall be
interpreted as substitute materials and shall be dealt with in the manner as stipulated under the
clause for “SUBSTITUTE MATERIALS” later in this SW No. 1.
B DIMENSIONS
Figured dimensions on the drawings shall be followed in all cases. Where dimensions are omitted or
in doubt, the Contractor shall seek clarification from the Architect.
It will be assumed that adequate information had been given to the Contractor for due and proper
performance of all works under this Contract. The Contractor shall submit a written request to the
Architect for any additional information he may require.
Any negligence or failure on the part of the Contractor in obtaining reliable information pertaining
to any matter which may affect the proper execution and completion of the Works shall not relieve
him of his liabilities or responsibilities in executing, completing and handing over the Works or any
Sections thereof in accordance with the Conditions of Contract.
Allow herein for complying with any items in the Specifications involving expense, if not already
priced elsewhere in these Tender Documents.
The Contract will not be adjusted for fluctuations in prices. No claims shall be allowed for any
variation in the cost of wages, material, constructional plant, fuel, duties, taxes, temporary works
or transport or anything else whatsoever which may occur during the currency of this Contract.

FORM OF CONTRACT
A FORM OF CONTRACT
The Article of Agreement and Conditions of Contract into which the Contractor will be required to
enter in connection with this project is the Pertubuhan Akitek Malaysia (PAM), Private Edition
Without Quantities 2018 Edition), and they shall be read jointly with these Documents. Quantities
provided in the Schedule of Works are intended for guidance of the Contractor only in submitting a
tender price, and shall not be binding on the Contract.
The Contractor is referred to the full text of the undermentioned clauses of the Conditions of
Contract to which the following are short references and against which the Contractor is to provide
any sum he considers necessary in complying.
The Contractor is to note that additional clauses, if any stipulated in this Contract shall supercede
the general clauses provided in the PAM Form of Contract. If the Contractor considers that any of
the clauses of the Contract involves expenses he shall allow hereunder the money value of such
clauses. Allow for complying with each of the terms of the Schedule of Conditions summarised as
follows :-

The Contractor shall note the requirements of this clause for Architects' instruction to be in writing
and/or the subsequent confirmation in writing of oral instructions issued.
Notify the Architect in advance of any work likely to be valued on a daywork basis. No variation
works are to be carried out on a daywork basis without the written approved of the Architect.
The Contractor shall be responsible for setting out of the Works and shall provide all instruments
and attendance required by the Architect/S.O for checking the setting out. All setting out should be
done by a Registered Land Surveyor, stating that the works are as set out in the Drawings and
within the titled boundaries.
The Contractor shall be responsible for employing a registered Land Surveyor to do the setting out
and check the levels and alignments of the building during the progress of works and shall remedy at
his own expense any encroachment and any necessary making good resulting form his own incorrect
setting out.

6.0 Materials, Goods And Workmanship To Confirm To Description, Testing And Inspection
The Contractor shall not alter or amend any part of the Specification.
The Contractor shall be responsible for all defects of workmanship, whether executed by his
workmen or staff, or by the workmen or staff of any Sub-Contractor, such errors or defects to be
remedied to the satisfaction of the Architect/S.O and at the cost of the Contractor.
The Contractor shall pay the cost of preparing all samples, transport, cost of testing and any other
charges for testing of materials. In the event that the Architect/S.O allows the substitution of any
material during the course of construction, such substitution shall be accompanied by a
corresponding deduction if there is any difference in cost.
The Architect, from time to time, may delegate his authority to issue instructions which the
Architect is expressly empowered by these Conditions to act in such manner, provided that the
instruction will not cause a variation carrying time delay and/or cost implication, where in such case
the sole authority for issuing such instructions lie solely on the Architect
Sub-clause 11.6, 1st line: Delete the wording "a reasonable time" and replace with "one month".
Daywork sheets are to be signed by the Foreman-in-charge and will be countersigned by the
Clerk-of-Works of the Architect/S.O. after verification. Such signature shall only imply that the
times and materials recorded on the daywork sheets are considered to be correct but shall not imply
the works recorded constitutes as variation nor that it will be valued as a daywork basis, these
being matters at the Quantity Surveyor's discretion.
The Contractor shall submit their price statement, providing the cost of variation works within
seven (7) days of receiving an instruction from the Architect.
The price statement should contain sufficient detail, with quantities and rates, supporting
quotation, invoices, etc. to enable a proper assessment by the Quantity Surveyor.
The Contractor shall not be entitled to any extra payment or enhanced rates or additional time
solely on the ground that the re-measured quantities differ from those in these Schedule of Works.

Sub-clause 12.1 : Delete the clause in its entirety and substitute with:-
Where departures have been made from the Standard Method of Measurement, the method
adopted in the Schedule of Works will be adhered to for the purpose of ascertaining the value of
all variations.
Quantities provided in the Schedule of Works are intended for guidance of the Contractor only in
submitting a tender price, and shall not be binding on the Contract. The rates inserted by the
Contractor in the Schedule of Works, after proper rationalisation, are binding and shall, for all
purposes, be used as the Schedule of Rates for valuing variations in accordance with Clause 11.6.
The amounts included as the value of materials and goods delivered to or adjacent to the Works for
use thereon in any certificate issued under clause 30 of the Schedule of Conditions, will
a. refer to materials and goods for incorporation into the permanent work only.
b. not exceed 75 per centum of their full value, which sum will then be subject to retention.
c. irrespective of the amount retained on work, materials and goods equals the amount named in
the Appendix to these Conditions as Limit of Retention Fund, the contents of sub-clause 14.2 will
still apply to all certificates.
The right is also reserved to the Architect/S.O. to certify conditionally that the buildings are
practically completed except for such outstanding items that are yet to be attended to. These
outstanding items will be specifically listed or appended in the certificate and their cost for
rectification will be assessed at the sole judgement of the Architect/S.O. Such assessed cost may
be deducted at the discretion of the Architect/S.O. and may be withheld until such time as the
Architect/S.O. is satisfied that the outstanding items have been properly attended to, after which,
the monies withheld will be released.
Notwithstanding the above, the Architect/S.O shall at any time during the Defects Liability Period,
have the further right to instruct that immediate action be taken to remedy any circumstances that
may arise after the building have been handed over, which in the opinion of the Architect/S.O. will
threaten the safety of the occupants or would render the building unfit for human habitation and if
in the opinion of the Architect/S.O, the Contractor is not in a position to provide such immediate
remedy or is uncontactable, the Architect/S.O. may in his sole discretion engage such others to
attend to these urgent defects and such rectification cost (which shall be decided at the sole
discretion of the Architect/S.O) shall be deducted from any monies that may fall due to the
Contractor under this Contract or recovered as a debt from the Contractor.

Insert after "the Employer" on the 2nd line of Clause 19.5, the following words "at his absolute discretion
and without prejudice to the Contractor's liability to indemnify him under clause 18 of the Condition.
On the Architect’s written instruction, the Contractor shall suspend the Works or any part thereof
for such duration and the manner directed. The Contractor shall, for the duration of such
suspension, properly protect and secure the Works as required and as may be reasonably directed
by the Architect.
Any loss and expense incurred by the Contractor in giving effect to the Architect’s instruction under
this Clause shall be borne and paid by the Employer, unless such suspension is:-
(i) necessary for the proper execution of the Works;
(ii) caused by weather conditions, or any other adverse conditions, which endangers or severely
compromises the safety and quality of the Works;
(iii) default on the part of the Contractor causing the Works to be impractical to continue; and
(iv) the safety of the Works or any part thereof or the safety of adjacent buildings or properties are
adversely affected by the continued execution of the Works
Provided always that the Contractor shall give notice to the Architect in writing of his intention to
claim within twenty eight (28) days of the Architect’s instruction.
The Contractor should take all practicable steps to avoid or reduce delays on the part of Nominated
Sub-Contractors or Nominated Suppliers and to produce evidence of such undertakings.
The Contractor is to note that no EOT will be given in respect of shortage of any one building
materials, unless the shortage is a national shortage.
Raining days shall not be entitled for EOT, unless exceptionally inclement weather occurred such as
flooding and all EOT claim shall be subjected to verification by authorized Top Glove Engineer and
approved by Top Glove Management.
Any application for EOT must be made by registered post to the Architect/S.O. within two weeks of
its occurrence.

24.0 Loss And/Or Expense Caused By Matter Affecting The Regular Progress Of The Works
Written application by the Contractor to the Architect/S.O. must be made within one month
with substantiating evidence regarding the matter and all details for consideration, failing which,
no loss and expense caused by disturbance of regular progress of the works shall be allowed.
Sub-clause 30.6 : Add the following sentence at end of clause "If nothing in the measurement and valuation of
the Works submitted to the Contractor within the Period of Final Measurement is disputed by the Contractor
within three (3) months of receipt of the measurements, the measurement and valuation so submitted shall be

THE CONTRACT
The Contractor shall provide Performance Bond Guarantee of Bank operating in Malaysia, to the
Employer in a sum equal to five (5) percent of the Contract Sum, for the due observance and due
performance of the Contract under the terms of the Bond.
B DRAWINGS
The drawings issued to the Contractor for tendering purposes are listed in Appendix "A".
The Contractor shall check and examine the drawings and the accompanying tender documents to
satisfy himself that all information necessary for preparing his tender has been provided. Report any
missing drawings, documents, pages or other discrepancies to the Architect/S.O. No claims for
extra costs consequent upon non-examination of tender documents and drawings will be considered.
C CONSTRUCTION DRAWINGS
Two (2) sets of construction drawings shall be progressively issued to the Contractor for
construction purposes free of charge. Additional copies will be issued on request by the Contractor;
these will be charged to the Contractor.
Within one (1) month upon being given the official order to commence, the Contractor shall prepare
and submit to the Architect/S.O, and all Consultants, a detailed schedule with dates for timely
release of all construction drawings and details. Dates shall relate to critical times for start of
activities as per the accepted works programme.
The Contractor shall price the lithography charges for Contract Binding comprising Contract Drawings and Contract
Documents and reimburse to consultant accordingly once awarded.
The Contractor shall arrange the Contract Documents to be stamped and to bear all expenses
and any other fees incurred in the formalisation of this Contract between him and the Employer.
The Contractor shall prepare and submit to the Employer two (2) certified true copies and two (2)
original Contract Document immediately after the contract agreement has been formally executed.
The several documents (including the drawings) forming the Contract are to be taken as mutually explanatory of
one another.
Immediately report any discrepancy to the Architect/S.O. and await further instructions before proceeding with
the Works.

TEMPORARY WORKS
Adhere strictly to the access and egress points shown on the drawings or such other access and
egress points approved by the Local Authorities.
Share the access and egress points with other Contractors engaged by the Employer. No claims will
be entertained in respect of any inconvenience or hindrance met by the Contractor due to sharing of
the access and egress points with other Contractors.
Construct temporary accessways, diversions, etc. wherever the Works interfere with the free flow of traffic or
pedestrian or otherwise with the existing road.
The Contractor shall provide and maintain the following temporary buildings and services at a
position to be directed by the Architect/S.O, remove on completion of the works and pay all
charges in connection therewith unless otherwise directed by the Architect/S.O. All designs for
temporary buildings must be approved by the Architect/S.O. before construction.
These temporary structures and the fixtures therein shall remain the property of the Main
Contractor on completion:-
a. Adequate lock-up weather proofed sheds for safe storage of building materials.
b. Sanitary conveniences for the operatives, Supervisory and site staff in approved positions
and in the conformity with the requirements of the Local Authorities, maintain them in good
and hygienic conditions and deodorise ground after removal.
Upon completion of the Works, or earlier if the Architect/S.O so decides, the Contractor shall dismantle and
remove the Site Office with all fittings and furniture, within one (1) week of being so directed.
Workmen's accommodation on-site is strictly prohibited. The Contractor shall pay for all costs in connection
therewtih, providing off-site accommodation for his own and sub-contractor's workmen outside the site and
adequate transportation for all the workers. The Contractor shall also arrange for security passes for all workers.
The Contractor shall provide and maintain a new metal/timber project signboard in accordance
with details provided by Architect/S.O; complete with all signwriting, logos, lighting fixtures and wiring.
The Contractor shall maintain the existing hoardings including gates, screens, planked footways,
guard rail and gantry, for the full duration of this Contract.
The Contractor shall provide first aid kits at suitable locations on the Site and instruct an
adequate number of persons in their use.

All insurances shall be taken up by the Contractor through as Insurance Company approved by the
Employer.
Without prejudice to his liability to indemnify the Employer under Clause 18, the Contractor shall take
out a Contractor's All Risks Policy in the joint names of the Employer, the Contractor and all his
Sub-Contractors.
The Sum Insured for "Third Parties Liability" shall be RM 1,000,000.00 for any one occurrence but unlimited as to
the number of occurrences during the Period of Insurance.
Without prejudice to his liability to indemnify the Employer under Clause 18, the Contractor
shall take out, and shall cause all his Sub-Contractors to take out, Workmen's Compensation
Insurance with Common Law coverage in the joint names of the Employer and the Contractor
(and of his own Sub-Contractors, if any) against liability of the said joint parties for damages
or compensation payable under the Workmen's Compensation Ordinance or any other laws of
Malaysia in respect of or in consequence of any accident or injury to or disease sustained by
any workmen or other persons in the employment of the said joint insured parties.
For the purpose of this Contract, the sum representing the estimated earnings to be insured under
the Workmen's Compensation Insurance shall not be less than 15% of the value of Contract Sum
after deducting the amount for all P.C. Sums. If any of the workmen employed in the Works are
liable for coverage under the SOCSO Scheme then the sum insured under the Workmen's
Compensation Insurance shall be reduced by the estimated earnings of the said workmen covered by
the SOCSO Scheme.
The Contractor shall bear the full amount of the deductibles or excess.
All insurances shall be valid and cover for the whole Contract and Defects Liability Period.

The Contractor shall comply with PART VII of the Lembaga Pembangunan Industri Pembinaan
Malaysia Act 1994, and the Construction Industry (Levy Collection) Regulations 1996, and shall
submit a notification on Form CIDB L1/96 to the Lembaga not later than 14 days after the
issuance of the letter of Acceptance / Letter of Award / or any document that constitute
acceptance of a contract of works or not less than 14 days before the commencement of the
works, whichever date is earlier. Pay all fees are charged in connection therewith.
The Contractor shall register all his employees under the Social Security (SOCSO) Scheme, submit all
contributions regularly and comply with the SOCSO Regulations made under the Employee's Social
Security Act (including any amendment thereof); and cause all his Sub-Contractors to comply similarly.
The Contractor shall comply with all bye-laws issued by Municipal Board or other local authorities
throughout his work and shall meet the requirements of the Medical Officer of Health regarding
sanitation and hygiene of his installations on the site of the work, and of the employment of any
workmen whose presence on health grounds is considered undesirable by the Medical Officer of Health.
C LABOUR-ON-COSTS
The Contractor shall provide for all costs in respect of workmen, as applicable, for:-
a. Annual and Public Holidays.
b. Travelling time and expenses, such as fares and transport.
c. Non-productive time and other expenses in connection with overtime.
d. Incentive and bonus payments.
e. Any other disbursements arising from employment of labour, e.g. SOCSO.
The Contractor shall comply with all Safety, Health and Welfare Regulations pertaining to all workmen employed on
the site.
Allow for complying with statutory rules and regulations concerning the safety, health and welfare
of workmen, including workmen employed by Nominated Sub-Contractors and Specialist.
The Contractor in this relation shall provide the Architect/S.O. with his safety programme and
procedure proposal and to be ensure that all safety requirements are strictly adhered at all times.
E WORKING HOURS
Provide for working at night, on Sundays and on Public Holidays if deemed necessary (subject to the
written permission of the Architect/S.O), the Contracto shall make adequate security arrangements
and indemnifying the Employer against any claims by third parties caused by working outside normal
working hours. No claims for extra remuneration on account of working outside normal working
hours shall be entertained.
The normal working hours of the Resident Architect and the Resident Supervisory Staff are as follows:-
i. Monday to Friday - 8.00 a.m. - 5.00 p.m.
ii. Saturday - 8.00 a.m. - 12.00 noon

SW NO.1 - PRELIMINARIES
The Contractor shall provide adequate plant and equipment, including minor plant and tools, for the proper and
timely execution of the Works such as:-
a. mechanical plant and vehicles
b. non-mechanical plant
The Contractor shall include plant needed for the Contractor's proposed methods of undertaking and completing
the works.
The Contractor shall use proper and modern plant and other labour and time saving devices to ensure that the
Works are carried out diligently and expeditiously.
The Contractor shall obtain the written approval and certificates from the relevant Authorities for
all mechanical plant used on site. Ensure that the validity of such certificates is maintained
throughout the period of use. Copies of all such certificates shall be submitted to the Architect/S.O.
Unserviceable or incorrect plant and equipment shall be removed expeditiously from the site.
Provide and maintain all necessary temporary scaffolding and staging together with planks,
battens, cat-walks, gangways, ladders, etc., and pay all costs and charges in connection therewith.
The scaffolding and temporary work shall comply with the requirements of MS10.1:1975 Sirim
Code of Practice for Building Operations Code and other codes as may be required by the
relevant Authorities.
The scaffolding and temporary work shall be endorsed by the Contractor's qualified inspector
with methodology report.
The Contractor shall provide, erect, maintain and remove on completion such 'Danger',
'Warning' and 'Directional' works and safety notices as are required and directed during the
progress of the Works. No other sign or advertisement shall be displayed without the prior
written consent of the Architect/S.O. These sign boards shall be properly sited at night time.
D MATERIAL TESTS
The Contractor shall allow for all expenses and fees (including cost of packing and delivery or
specimen and test reports) for all necessary tests which the Architect/S.O may direct the
Contractor to carry out in accordance with the Specifications.
Regardless of any specified tests, the Contractor shall undertake regular tests and checks to
ensure that the work is functional and as specified, providing requisite apparatus and
equipment, including skilled and experienced staff for the purpose of carrying out tests.

SW NO.1 - PRELIMINARIES
The Contractor shall constantly provide adequate site supervisory and administrative staff for
the proper execution of the Works. Such persons shall be careful, skilled and experienced in
their several trades and callings.
The Contractor shall employ a competent and authorised Site Agent or General Foreman,
approved by the Architect/S.O, on the site. Such Agent or General Foreman shall give his full
time to the supervision and management of the works and must be able to receive and act on
behalf of the Contractor, all instructions, directions or orders issued by the Architect/S.O or his
representatives.
The Contractor shall submit As-Built Drawings showing the actual works as constructed and
incorporating all changes for the whole works in A1 size paper, progressively during construction,
as per a pre-agreed schedule, wherein the last batch of drawings shall be submitted not more than
two (2) weeks from the date of issuance of Certificate of Practical Completion.
For this purpose, the Contractor must employ the services of a Licensed Surveyor who shall
certify all drawings correct. Drawings as specified for recording as built shall be agreed with
the Architect/S.O. or his representatives.
The Contractor shall make arrangements for bi-weekly Site Meetings to be held at the site
office or elsewhere as directed by the Architect/S.O during which a senior member of his
staff and the General Foreman of the Works including those of Nominated Sub-Contractors
and Suppliers shall be required to attend. However, if the Architect/S.O deems that the
progress of the Works is slow or where problems occur on site, the Architect/S.O may require
weekly or fortnightly site meetings to be held. The Architect/S.O shall also record the
proceedings of these meetings and arrange for the reproduction and distribution of copies of
the minutes of meetings to all parties concerned before the next meeting.
The Contractor shall allow for the cost of providing six sets of monthly progress photographs
of postcard size prints in colour of the various elevations and sections of the works during the
currency of the project.
The Contractor shall submit to the Architect/S.O bi-weekly reports on the progress of the
Works, including those of the Specialist contracts indicating the number of workmen employed,
materials and goods delivered, the extent and type of plant employed, weather conditions and
generally the progress of the Works.
The progress of the works shall be represented by percentage as well as bar charts indicating actual
progress and the proposed progress for two weeks in advance. These reports are to be based on the
daily reports delivered to the Clerk-of-Works for signature.

SW NO.1 - PRELIMINARIES
The Contractor shall provide watchmen, lighting, warning lamps, guards, barriers and other
safeguards as necessary or as required by the Architect/S.O, Statutory or other Authorities
to prevent injury to all persons and property including the Works, the workmen and the public.
The Contractor shall safeguard the works and stored materials from theft, vandalism or other
damage caused by persons or animals.
The Contractor shall abide strictly with any pre-existing security arrangements employed on the site.
B SAFETY MEASURES
The Contractor shall provide and install all necessary protective netting or other measures for
the safety of workmen; protecting the public from all risks of injury, especially from flying or
dropping objects, etc. at all the stages of construction. Safety measures adopted shall satisfy
the requirements of the Local Authorities.
Allow for the provision of all necessary electricity and power for the Works at various points of the Site.
All areas with inadequate natural lighting shall be lighted with temporary lights during the construction of the
Works.
The Contractor shall provide sufficient electricity for his own works and for those of the
Sub-Contractors and for the Consultants' and his own offices.
Allow for the provision of all necessary clean and fresh water for the use on the Works at various
points of the Site.
The Contractor shall provide sufficient water for his own works and for the Specialists and
Consultants and for drinking, cleaning, sewage disposal, fire-fighting etc.
Upon taking possession of site the Contractor shall be responsible for keeping the whole of the
Works well drained and free from all water (including rain, storm, spring and running water and
water below the water Table Levels and the Contractor is to ascertain for himself the water levels
as no claims shall be entertained on the grounds that these levels are not known or water arising
from any other sources) at all to ensure that, so far as practicable, all work is carried out in the "dry".
The Contractor shall employ whatever means that may be necessary to keep the site and
excavated areas dry including baling, pumping (including power pumping), provision of temporary
drains, drainage pits, water courses and any other mean which the Architect/S.O. may direct.
The Contractor shall implement adequate measures to keep site free from surface water,
continuously over the Contract period including the construction of all additional temporary
drains and diversions, the building of walls or bunds or other forms of de-watering.

SW NO.1 - PRELIMINARIES
In addition to any other requirements mentioned elsewhere in the Contract, the Contractor
shall submit for the Architect/S.O's approval, prior to the commencement of construction or
the Works or any temporary works, detailed plans of the measures he proposes to take for the
drainage during construction of the Works and temporary works, the prevention of the
movement of eroded materials and debris from construction areas into natural watercourses
and on to adjoining land. The Main Contractor shall carry out at his own expenses all such
approved measures and any additional measures the Architect/S.O. may from time to time
require to improve their effectiveness. The operation of this Clause shall in no way absolve
the Contractor from any of his obligations under the Contract.
The Contractor is to maintain and protect public property including that of drainage, eletricity,
highway and water authorities and similar undertakings, and is to make good or pay for the
reinstatement of all damage thereto.
The Contractor shall be responsible for any damage to existing roads, kerbs, drains, crossings,
culverts, etc. caused by his workmen, vehicle or plant or that of Nominated Sub-Contractors and
Nominated Suppliers, approaching or leaving the Site, and to mantain, repair and reinstate the
aforesaid to their original condition to the satisfaction of the Architect/S.O. or restoration as a
deduction from any money due to or become due to the Contractor under this Contract.
The Contractor shall also allow for all necessary hosing down, clearing any droppings deposited
on any public roads or highways. He shall also be responsible to keep roads immediately
adjacent to the site free from mud, dirt or rubbish arising out of or in the course of or by
reason of the execution of the Works.
D FIRE PRECAUTIONS
The Contractor shall initiate and enforce strict fire prevention measures on the works; taking
special precautions to avoid the outbreak of fire.
The Contractor shall strictly comply with the Uniform Building Bye Laws (UBBL) 1984 -
Amendment 2007 particular requirements on requirements on fire prevention during construction.
All fire fighting equipment shall conform with the requirements of the Fire Department. These
shall be maintained throughout the duration of this Contract. Portable fire extinguishers of
ABC 9 kg. type shall be properly housed in a box with breakglass and provided at every
section/segment of the site where works are being carried out. At least one fire extinguisher
shall be provided at each wing on every floor to high rise buildings, the position of which shall
be determined by the Architect. Undertake regular checks to ensure that the fire-fighting
equipment are functional.
The Contractor shall take all reasonable step to prevent excavated spoil, rubbish, surplus materials,
etc. arising from the works being dumped on an area other than a recognised tipping area.

SW NO.1 - PRELIMINARIES
The Contractor shall take all precaution as deemed necessary by the Architect/S.O. and/or the
Local Authorities for the prevention of breeding of moiquito including pumping dry or bailing
out stagnant water at the site. The Contractor shall pay any charges made by the Local
Authorities for anti-malaria and anti-dengue measures taken.
The Contractor will, on completion of the work, remove as quickly as possible and convey away
from site at his own cost, all surplus materials, except those ordered to be left on site,
together with all rubbish and debris and leave the work site in a clean and perfect condition to
the satisfaction of the Architect/S.O.
On complection of the work, all plant, building appliances, apparatus or equipment are to be
removed as quickly as possible and conveyed away from the site at the sole cost of the Contractor.
All services and roads, temporary buildings, shed barriers, etc. required in the work of construction
are, unless otherwise directed, to be disconnected, dismantled, taken down and removed. All holes,
trenches and excavation in connection with the plant, etc. are to be filled in a proper manner,
levelled off ad closely turfed and the site left in a clean and orderly condition.
In the event of the Contractor not clearing away the above mentioned materials and plant
within a stipulated time the Architect/S.O. and the Employer will be empowered to perform
such work, by employing a third party for such purpose and the cost of such clearing away will
be deducted from the Contractor's Final Account. The Architect/S.O. and the Employer will not
be held responsible or liable for any material or plant left upon the site.
C PENALTY
Letter of Complaint (LOC) claim retention and Defect Inspection Notification shall be followed
and checked on if found any unsatisfactory works.
A competent full time site representative on site shall be designated to coordinate and execute
the works, failure to attend any meetings, a fine of RM250.00 will be imposed.
Provision of safety and personnel protective equipments, reflective jackets and other safety
materials, eg. Helmets, belts, boots, to your workers, failing which a fine of RM250.00 per
offence will be imposed.
No illegal immigrants are to be employed and work at the site, if any, a penalty of RM1,000.00
will be imposed.
Daily disposal off unwanted materials, rubbish to a designated place is required at the site,
failing which we may employ third party to clear it on behalf and all costs incurred shall be
deducted from any money due to you.

Where other items of cost involvement or item of monetary value related to this Contract have
not been allowed for in the SW NO.1 - PRELIMINARIES and Standard Conditions of Contract,
the Contractor shall list such item below together with their monetary values extended
accordingly in the monetary columns and carried to collection. No subsequent claims for
non-allowance of such items in the SW NO.1 - PRELIMINARIES shall be entertained should the
Contractor decide not to or fail to list such other item of costs involvement or items of
monetary value related to the Contract but which have not been allowed for in the SW NO.1 -
PRELIMINARIES and Standard Conditions of Contract of this Contract. The Architect/S.O.
and/or the Quantity Surveyor shall reserve the right to request for breakdown of all items of
cost that may be listed herein below.

3 STEEL STRUCTURE
Note: i) The Contractor shall provide a full time team at Site to plant the
anchor bolts. Setting out of anchor bolts positions shall be License
Surveyor and two (2) sets of setting out drawings endorsed by Licensed
Surveyor shall be submitted to Engineer progressively for record.
ii) Unless otherwise agreed, all steel structure shall be welded with
steel lugs. No steel structure shall be allowed to be lifted without
steel lugs. The steel lugs will remain at the steel structure after
