The development of a legal system and its processes is a sine qua non for the
sustainable growth of industry, society, and public policy. One of the core tenets of any
such evolved legal system is dispute resolution. Conventionally, the practice of litigation
before courts of law involved inflexible proceedings and lengthy courtroom exchanges,
often to the detriment of the parties to the dispute. This paved the way for alternate
forms of dispute resolution such as arbitration, negotiation, and mediation, which served
as quicker and more flexible proceedings out of court. It also allowed parties to retain
flexibility and autonomy.
Alternative Dispute Resolution (ADR) mechanisms such as arbitration and negotiation
can be traced back to 3000 years. However, the last 100 years have witnessed a boom
in the demand for more efficient, cost-effective, and decisive resolution of disputes. The
legal community of the modern world has developed a variety of methods to meet the
commercial needs of the 21st century. Consequently, the widespread use of alternative
dispute resolution mechanisms can be observed in both domestic and international
business. Legal professionals across industries are expected to possess a nuanced
understanding of not just traditional private law, but also processes such as commercial
mediation, domestic and international arbitration, investor-state dispute resolution, and
enforcement of settlements and arbitral awards through domestic courts.
The LL.M. in Dispute Resolution provides students with a holistic understanding of both
domestic and international dispute settlement processes. It equips legal practitioners
with not just a theoretical understanding of the law, structure, and policy of alternative
dispute settlement, but also the best practices essential for lawyers who are looking to
expand their skill set in the field of Dispute Resolution, including ADR.
The sharp increase in both the number of governmental and private institutions offering
ADR services as well as the number of disputes being resolved through ADR
mechanisms has resulted in this field of law being in constant state of flux. There are
frequent revisions to conventions and treaties governing international dispute resolution
as well as domestic laws governing arbitration and mediation processes with India alone
amending its Arbitration and Conciliation Act of 1996 thrice since 2015.
This dynamic nature of the law combined with technological advancements and
changing dimensions of global commerce requires legal practitioners to constantly
adapt and remain updated with a complex network of laws, rules, regulations, and
industry standards. It is in this backdrop that the LL.M. in Dispute Resolution, delivered
through the blended learning format, has been designed as the perfect addition to any
legal practitioner’s repertoire.

This program will bring the industry and academic experience of JGLS faculty members

analysing complex dispute settlement processes. A comprehensive examination of
domestic and international arbitration, investor-state dispute resolution, mediation, and
allied processes, through interdisciplinary and cross-jurisdictional perspectives will
enable students to become better dispute settlement practitioners.
Students enrolled in the program will take a deep dive into the varied stages of dispute
resolution- from the initiation of a dispute until the enforcement of successful
settlements and awards. The design of the program is contiguous, with one course
segueing into the next to provide an uninterrupted learning process. Therefore, each
course plays a crucial role towards the goal of preparing, managing, and delivering
dispute settlement solutions in practice.
Students will have the opportunity to understand the full range of dispute settlement
laws and procedures. The topics shall range from the theory and evolution of
international law and ethical issues in ADR to practical elements of drafting effective
dispute resolution clauses and planning dispute strategies in complex commercial
cases.

DISSERTATION
The dissertation is a compulsory course. The choice of topic and title must have a
nexus with the program and shall be approved by the JGLS Dissertation Committee.
A supervisor shall be appointed for each student on an advisory basis. The
dissertation process, including submission of topics and preliminary drafts,
discussions with supervisors, and review by the supervisor and the JGLS Dissertation
Committee shall continue in parallel with courses of the LL.M. program.
