Amendments to Pesticide Residue Regulations

This document amends a previous notification regarding pesticide residue limits in food. It removes chlorpyrifos, chlorpyrifos-methyl, and paraquat from the list of allowed pesticides, and sets new lower detection limits for analytical methods to test for these substances in different types of foods. Notification of the Ministry of Public Health

Issued by virtue of the Food Act B.E. 2522
Re: Food Containing Pesticide Residues (Pesticide Residues in Food) (No.3)

It deems appropriate to amend the notification of the Ministry of Public Health,
Re: Food Containing Pesticide Residues (Pesticide Residues in Food).
By the virtue of the provisions in the first phase of Section 5 and Section 6 (2) (3)
and (9) of the Food Act B.E. 2522 (1979), the Minister of Public Health hereby issues the
notification as follows:
Clause 1. The definition in Clause 3 of the Notification of the Ministry of Public
Health (No 387) B.E. 2560 (2017) Re: Food Containing Pesticide Residues (Pesticide Residues in
Food), dated 18th August 2017, having text of “Type 4 Hazardous Substance” shall be
repealed and replaced with the following texts
“Type 4 Hazardous Substance” means the hazardous substance which is
not allowed to be produced, imported, exported or possessed in accordance with the
Notification of the Ministry of Industry on The List of Hazardous Substances issued under the
Hazardous Substance Act B.E. 2535 (1992).
Clause 2. Clause 4 of the Notification of the Ministry of Public Health (No 387)
B.E. 2560 (2017) Re: Food Containing Pesticide Residues (Pesticide Residues in Food), dated
18th August 2017, shall be repealed and replaced with the following texts
“Food Containing Pesticide Residues shall be complied with standard
that shall not contain any pesticide define as Hazardous Substances Type 4 under the
Hazardous Substance Act B.E. 2535 (1992) prescribed in Annex 1 of this Notification, except
those other pesticides specified as follows:
(1 ) Detected pesticide residues in food shall not exceed the Maximum
Residue Limit (MRL) prescribed in Annex 2 of this Notification,
(2) Detected pesticide residues in food, that does not specified in the List
No. 2 annexed to this Notification, shall not exceed the limits recommended by Codex
Alimentarius Commission, Joint FAO/WHO Food Standards Programme,

(3) Where no MRLs specified in (1) and (2), detected pesticide residues in
plant or animal shall not exceed 0.01 milligrams of pesticide residue per kilogram of the
food (default limit), unless default limits for plant specified in Annex 3 of this Notification,
(4) Detected Extraneous pesticide residues in food shall not exceed the
Extraneous Maximum Residue Limit (EMRL) prescribed in Annex 4 of this Notification.”
Clause 3. The following content as No.83 to No.87 is added to Annex 1 of
Notification of the Ministry of Public Health No.387 B.E. 2560 (2017) Re: Food Containing
Pesticide Residues (Pesticide Residues in Food), dated 18th August 2017, as follow:
83. Chlorpyrifos
84. Chlorpyrifos-methyl
85. Paraquat
86. Paraquat dichloride
87. Paraquat [bis (methyl sulfate)] or Paraquat methosulfate
Clause 4. No.1 Chlorpyrifos and No.23 Paraquat from Annex 2 Maximum Residue Limit
(MRL) Attachment of Notification of the Ministry of Public Health No. 387 B.E.256 0 (2017 ) Re:
Pesticide Residues in Food, dated 18th August 2017 shall be repealed
Clause 5. The annex 5 of the Notification of the Ministry of Public Health No.387
B.E. 2560 (2017) Re: Food Containing Pesticide Residues (Pesticide Residues in Food), dated
18th August 2017, shall be repealed and replaced with the annex 5 of this Notification.
Clause 6. This Notification have come into force from 1 June 2021 onwards.

The analytical methods for pesticide residues in food resulting from the use of
pesticides in agriculture

The analytical methods for pesticide residues in food resulting from the use of
pesticides in agriculture shall be one of the following:
1. Analytical methods issued by National Organizations or International
Standards Organizations, or published in the manuals or publications which are
internationally recognized.
2. Performance characteristics of pesticide residue analytical methods must be
accurate and reliable. Method validation is performed by a collaborative study or single
laboratory based on international guidelines. The result shall be in document comply with
the latest version of ISO/IEC 17025.
The analytical methods of pesticide defined as Hazardous Substance Type 4
under the Hazardous substance Act B.E. 2535 (1992) prescribe in Annex 1 of Notification of
the Ministry of Public Health No 387 B.E 2560 (2017) Re: Food Containing Pesticides in
food).The level should be limited by the sensitivity of the analytical methods. The detected
level of pesticide residues in food shall be lower than the Limit of Detection (LOD] and The
LOD value shall be specified in an Annex;
