LEAVE & LICENSE AGREEMENT
THIS AGREEMENT made at Mumbai, on this Tuesday of 26th FEBRUARY
2024, BETWEEN DEEPIKA SINGH , an adult, Indian Inhabitant, 202 A WING
AARC RESIDENCY VEERA DESAI ROAD ANDHERI WEST 400053
hereinafter called the "LICENSORS" (which expression shall whenever the context
so required or admits means and includes his heirs, executors, administrators
and assigns) of the One Part and NEHA ARSHIYA BAIG AND ROHIT VADHER
AND SHYAM SUNIL PANCHMTIA , hereinafter called the "LICENSEES" (which
expression shall whenever the context so required or admits means and
includes their heirs, executors, administrators and assigns) of the Other Part.
WHEREAS the LICENSOR is the lawful Owner of And otherwise well
sufficiently entitled to and seized and possessed of FLAT NO 202 A WING
AARC RESIDENCY VEERA DESAI ROAD ANDHERI WEST Mumbai - 400053,
hereinafter referred to as the "Said Premises".
AND WHEREAS the LICENSEES being in need of NON Residential Premises
has approached the LICENSOR with a request to permit the LICENSEES to
occupy the said PREMISES by LEAVE and LICENSE for the purpose of
Residential use only for a period of 11 months commencing from
26/02/2024 to 25/01/2025.
AND WHEREAS the LICENSOR has agreed to allow the LICENSEES to use
and occupy the said premises temporarily for a period of 11 months as
mentioned hereinabove on certain terms and conditions.
NOW THIS AGREEMENT WITNESSETH AND IT IS HEREBY AGREED BY
AND BETWEEN THE PARTIES AS UNDER:
1. The LICENSORS Hereby grant Leave And LICENSEES to the
LICENSEES to use and occupy the said premises, for a period of 11
months from the 26/02/2024 2024 till 25/01/2025 of the
premises i.e. FLAT NO 202 A WING AARC RESIDENCY VEERA DESAI
ROAD ANDHERI WEST 400053
2. That the LICENSEES shall pay to the Licensors a sum of 50,000/ (Rupees
FIFTY THOUSAND Only) as monthly compensation to the Licensor As the
LICENSEES AND DIPOSIT IS Rs.1,00,000/-(ONE LAKH Only)
3. It is agreed by and between the parties the LICENSEES shall have no
right of tenancy, sub-tenancy & / or any right, title and interest in the
said PREMISES or shall not sublet, re-let or underlet the said Premises
or any portion thereof.
4. In addition to the License fee mentioned above, the LICENSEES shall
pay the Electricity Bill / telephone bill/ as well as cable T.V. and car /
bike parking charges in the said Premises / society as per bills received
from the concerned department. The LICENSEES shall ensure that such
bills are regularly paid and that is shall not default in respect thereof. All
bill copies will be handed over to the LICENSOR after paying it
regularly.
5. The LICENSOR shall pay the municipal and other taxes and
maintenance charges in respect of the said Premises to the said society.
6. The LICENSEES shall use the said premises and shall see that the
same is used in full and responsible manner and shall make good to the
LICENSOR all such damages or loss as the LICENSOR may sustain
whether the same be caused by the LICENSEES or LICENSEES visitors
to the said Premises. The said Pemises would be handed over to

7. The LICENSEES shall observe the rules, regulations and bye-laws of the
Society so far and to the extent he is required to be observed by the
LICENSEES as the occupant of the said Premises or any part
thereof. The LICENSEES shall not do, omit or suffer to be done anything
whereby the LICENSOR right to hold the said Premises is prejudice
avoided, forfeited or extinguished or jeopardized in any manner.
8. That the LICENSEES shall not do anything which is not permissible or
is prohibited under law or is in contravention of bye-law, rules and
regulations of the Housing Society Ltd., or any orders of Central / State
or Local authorities. Also, the LICENSEES shall not store any narcotics
such as Liquor, Bhang or Explosives such as RDX, Crackers or any type
of fire arms, etc. which is prohibited by laws of the Government and the
LICENSEES shall not allow any person of immoral reputation or allow
any immoral business in the said Premises.
9. The LICENSEES also hereby undertakes not to use the address of the
said Premises for the purpose of Income-Tex, Sales-Tax, and Excise
Department or for any other purpose related to the State/Central
Government/B.M.C/Bank Loans, and or any other such authority.
10. The LICENSOR and the LICENSEES hereby agree that the original key
of the said Premises would be with the LICENSOR and whereas the
duplicate key will be with the LICENSEES and on no account the
LICENSEES will change the said lock.
11. The LICENSOR shall not in any events be responsible or liable for any
loss or damage to any goods or property of the LICENSEES whatsoever
to be the cause of such loss or damage.
12. That the day-to-day and minor repairs such as fuses, leakages of water
taps, maintenance etc. to be done by the LICENSEES at their own cost.
The LICENSEES further hereby agree and confirm that in case of any
breakage, damage, loss to existing Fittings / Fixtures in the Said
Premises, he shall make good these articles and / or repay the cost of
the damage incurred to this articles as may be mutually decided by the
parties hereto.
13. It being agreed that the LICENSOR shall be at all times in complete
possession control and dominion of the said Premises and every part
thereof and the LICENSEES shall not be or claim to be in possession of
any kind whatsoever of the said Premises or any part thereof. The
LICENSOR or his duly authorized agents shall have the right to enter
into or upon the Licensed said Premises or any part thereof at mutually
agreed time for the purpose of Inspection.
14. It is Agreed between the Parties that at time of Renewal there will be 5%
increase in the rent
15. This Agreement shall be within the provision of Section 24 of the
Maharashtra Rent Control Act, 1999 and the LICENSEES undertakes to
honor the provisions of section 24 of the said Maharashtra Rent Control
Act, 1999. The LICENSOR shall be entitled to approach the competent
for getting possession of the said premises, after the expiry of this
Agreement as per the provisions contained herein, in case the
LICENSEES failing or refusing to hand over the charge of the said
Premises and this Agreement shall be subject to exclusive jurisdiction of
court at Mumbai.
16. On the expiration or earlier determination of this Agreement the
LICENSEES shall handover the vacant and peaceful possession of
the said Premises to the LICENSOR.

handover the peaceful possession of the said Premises on the

and the parties are in Mumbai, hence, it is subject to Mumbai
Jurisdiction.
IN WITNESS WHEREOF the parties hereto have set their respective hands on
the original and one more duplicate copy of this Agreement hereof the day and
year first hereinabove mentioned.
