Summer Sorted Competition 2023: Competition T&Cs

Stand a chance to win your share of weekly Takealot Coupons and/or weekly product prizes (i.e. limited
number of such prizes available per week, strictly on a ‘first come, first claimed’ basis, and each not
transferable nor refundable, and may not be otherwise exchanged for cash or any other item), and/or your
share of weekly Takealot Vouchers (i.e. limited number of such prizes available per week, strictly on a ‘first
come, first claimed’ basis, and each valid for three years from the date of issue and not transferable nor
refundable, and may not be otherwise exchanged for cash or any other item), in each case as described
further below (each a “Summer Sorted Coupon Prize(s)” or a “Summer Sorted Product Prize(s)” or a
“Summer Sorted Voucher Prize(s)”, respectively, and collectively the “Summer Sorted Prize(s)”) and
subject at all times to the further terms and conditions of this promotional competition (collectively
“Competition”).
Important Note: This Competition is run on the standalone web-based microsite at
takealot.light-house.online/register (i.e. accessible over the Internet via computer or on a mobile device)
(“Platform”), and is comprised of various ‘interactive Takealot Summer Sorted Challenges’ hosted on the
Platform (i.e. limited number of challenges available per week, strictly on a ‘first come, first served’ basis)
(“Summer Sorted Challenge(s)”). In order to enter and participate in the Summer Sorted Challenges via
the Platform, YOU MUST have a valid Takealot account (i.e. having already accepted Takealot’s general
terms and conditions at https://www.takealot.com/help/terms-and-conditions; including without limitation the
Takealot Privacy Policy at https://www.takealot.com/help/privacy-policy, the Takealot Returns Policy at
https://www.takealot.com/help/exchange-return-policy, and the Takealot Terms and Conditions relating to
Gift Vouchers and Coupons at https://www.takealot.com/help/promotional-codes-tcs), AND YOU MUST first
review and accept the Platform’s ‘Privacy Policy and Terms of Use’ (i.e. accessible on the Platform)
(collectively “General Entry T&Cs”). If you do not agree with the General Entry T&Cs, THEN YOU MUST
NOT enter and participate in the Summer Sorted Challenges via the Platform.

1. Promoter: This Competition is promoted by Takealot Online (RF) (Pty) Ltd (reg. no. 2010/020248/07)
(“Takealot.com”, “Takealot”, “us”, “we” or “our”).

2. Competition Period: This Competition runs weekly from 08h00 on 4 December 2023 until 23h59 on 31
December 2023, or until the allocated number of Summer Sorted Challenges and/or corresponding
Summer Sorted Prizes for the particular week runs out (i.e. if at all), whichever occurs first (each week
therein a “Competition Week”, respectively, and collectively the “Competition Period”). In the case of
a particular Competition Week, no entries will be accepted after the end of that Competition Week. In
the case of the Competition Period in its entirety, no entries will be accepted after the end of the
Competition Period.

3. Who can enter/participate: You are entitled to enter and participate in this Competition ONLY IF:

3.1. you are a natural person who is at least 18 years old, and who resides in South Africa (“Qualifying
Participant(s)”, “you”, “your”);

3.2. the particular Qualifying Participant has already accepted and is acting in full compliance with the
General Entry T&Cs; and

3.3. it is otherwise lawful for that Qualifying Participant to receive the corresponding Summer Sorted
Prize(s).

You may NOT enter and participate if you do not meet the aforesaid criteria in full nor if you are a
supplier of goods or services in connection with this Competition, nor if you are a director, member,
partner, employee, agent of, or consultant to Takealot.com or any other entity which directly or indirectly
controls or is controlled by Takealot.com, nor if you are any of the aforementioned persons’ spouse, life
partner, parent, child, brother, sister or business partner.

4. How to enter/participate:

4.1. Each Qualifying Participant that:

 4.1.1. has already accepted and is acting in full compliance with the General Entry T&Cs, will be
able to enter and participate in the Summer Sorted Challenges via the Platform (i.e. as
described further in section 5); and
4.1.2. successfully participated in and completed the particular Summer Sorted Challenge, will earn
a corresponding digital coin(s), which can then be used to claim a corresponding Summer
Sorted Prize(s) also via the Platform (i.e. as described further in sections 6 and 7).

4.2. Notwithstanding anything to the contrary:

4.2.1. Content of your entry/participation: Your entry/participation may not: (a) contain any foul
language, obscenities, defamation, hate speech or any other content we deem inappropriate
in our sole discretion; nor (b) contain any content which may be harmful to Takealot.com or
its associated companies in any way; nor (c) infringe the intellectual property or other rights
of Takealot.com, its associated companies or any third party. We reserve the right to remove
entries which we deem to be in contravention of this section 4.2.1 howsoever and
whatsoever, in our sole discretion.
4.2.2. How many times you can enter/participate: Weekly limits on Summer Sorted Challenges and
corresponding Summer Sorted Prizes will apply during each particular Competition Week,
and throughout the Competition Period.
4.2.3. Entry fees: There are no entry fees to enter and participate in this Competition, and no
additional charges involved in participating in the Summer Sorted Challenges via the
Platform.
4.2.4. Disqualification: There are certain situations in which a Qualifying Participant will be
disqualified from receipt of their corresponding Summer Sorted Prize(s), namely and to the
extent applicable as determined in our sole discretion: (a) they refuse to or cannot provide
reasonably sufficient documentation to verify their identity, or they refuse to or cannot provide
us with a completed Competition release/indemnity form, or we’re otherwise unable to
validate their Takealot account; (b) they cancel or return the applicable qualifying purchase
from Takealot (if any) before they’ve received the corresponding Summer Sorted Prize(s),
and such cancellation or return is not a ‘Not what you ordered?’, ‘Products damaged on
delivery’ or ‘Defective products’ return; or (c) they are found to have contravened any other
term or condition set out herein. In the event of disqualification of a particular Qualifying
Participant, we will be entitled in our sole discretion to select another winner, or to not award
that particular prize at all.
4.2.5. Should you at any stage act in contravention of or otherwise not comply with section 3, this
section 4 or any other term or condition herein, we reserve the right to withdraw your
entry/entries from this Competition, and we reserve the right to reject your participation in the
Summer Sorted Challenges via the Platform.

5. Summer Sorted Challenges via the Platform: To EARN a digital coin(s) you must, during the
particular Competition Week (and subject at all times to your continued compliance with the General
Entry T&Cs):

5.1. log in to the Platform using your personal mobile phone number, or via your existing personal
Google Account, or via your existing personal Facebook Account, and then register your personal
‘Summer Sorted Challenge profile’ (i.e. including without limitation by confirming your email
address used to register your valid Takealot account, and only one profile permitted per Qualifying
Participant) (“Summer Sorted Profile”);

5.2. via your Summer Sorted Profile, navigate to the ‘Earn Coins’ section of the Platform to complete as
many available Summer Sorted Challenges as you like (i.e. additional Summer Sorted Challenges
will be added to the Platform every Competition Week), and you will earn a digital coin(s) for each
Summer Sorted Challenge(s) that you successfully complete (“Earned Digital Coin(s)”);

5.3. each available Summer Sorted Challenge has its own digital coin/coins value, which in turn will
help you choose which challenge to try and complete to obtain the corresponding Earned Digital
Coins;
 5.4. you are only able to complete each Summer Sorted Challenge once at any particular time, and
after you’ve completed the particular Summer Sorted Challenge and obtained the corresponding
Earned Digital Coins, it will either no longer be visible/no longer be available to you on the
Platform, or it will go into a ‘cooldown’ mode and become available again generally on the Platform
at a randomised later stage. Furthermore: (a) once the allocated number of Summer Sorted
Challenges runs out (i.e. if at all), the same will no longer be visible or available to any Qualifying
Participant on the Platform; and (b) consequently, it is the Qualifying Participant’s responsibility to
regularly check the Platform and participate in Summer Sorted Challenges while they are still
available; and

5.5. all of the Earned Digital Coins that you successfully obtained will accumulate on your Summer
Sorted Profile and you can then decide when you want to ‘cash them out’ for a corresponding
Summer Sorted Prize(s), strictly in accordance with sections 6 and 7.

6. Summer Sorted Prizes via the Platform: To CLAIM a corresponding Summer Sorted Prize(s) using
your accumulated Earned Digital Coins you must, during the same Competition Week (and subject at all
times to your continued compliance with the General Entry T&Cs):

6.1. via your Summer Sorted Profile, navigate to the ‘Claim Rewards’ section of the Platform to view
and claim the correspondingly available Summer Sorted Prize(s) (i.e. additional Summer Sorted
Prizes will be added to the Platform every Competition Week);

6.2. each correspondingly available Summer Sorted Prize has its own digital coin/coins value, which in
turn will help you choose which prize you would like to claim using your accumulated Earned
Digital Coins. Furthermore: (a) you will only be able to claim a correspondingly available Summer
Sorted Prize that you have accumulated enough Earned Digital Coins for; and (b) once you have
claimed that Summer Sorted Prize, the digital coin/coins value thereof will be deducted from the
total number of Earned Digital Coins on your Summer Sorted Profile;

6.3. once the allocated number of Summer Sorted Prizes runs out (i.e. if at all), the same will no longer
be visible or available to any Qualifying Participant on the Platform. Consequently, it is the
Qualifying Participant’s responsibility to regularly check the Platform and claim corresponding
Summer Sorted Prizes while they are still available; and

6.4. for the avoidance of doubt: (a) Earned Digital Coins carry no monetary value whatsoever, are not
transferable nor refundable, and may not be otherwise exchanged for cash or any other item; (b) at
the end of the applicable Competition Week you will forfeit any Earned Digital Coins that you do
not redeem/do not use to claim a correspondingly available Summer Sorted Prize; and (c) you will
not be entitled to any remuneration or reward whatsoever for any such aforesaid un-redeemed
Earned Digital Coins.

7. Summer Sorted Coupon Prizes or Summer Sorted Product Prizes:

7.1. For Competition Week 1 (i.e. 4 December 2023 until 10 December 2023), the following Summer

request and validate their participant information (including name, surname, email
address, ID number, preferred delivery address, telephone number, etc.) (collectively
“Participant Information”). We will make two direct attempts within a 48-hour period to
obtain such information. Once we have received the Participant Information and
validated the particular winner, we will deliver or otherwise arrange delivery of the
corresponding prize to them as soon as possible thereafter, subject to section 4.2.4.
Proof of identity and a completed Competition release/indemnity form will be required in
order to validate the particular winner;

(d) unlimited entries into the corresponding draw to stand a chance of winning one of five

(e) the winners will be chosen from the successful entries received (i.e. five different winners
in total), by way of random draw as soon as possible during the week commencing on 11
December 2023; and
(f) the successful winners will be announced by way of direct message via their email
address used to register their Takealot account, either on the same day as the relevant
draw or the first business day thereafter. We will then send another direct message to
request and validate their Participant Information. We will make two direct attempts within
a 48-hour period to obtain such information. Once we have received the Participant
Information and validated the particular winner, we will email the corresponding voucher
prize to them as soon as possible thereafter, subject to section 4.2.4. Proof of identity
and a completed Competition release/indemnity form will be required in order to validate
the particular winner.

7.2. For Competition Week 2 (i.e. 11 December 2023 until 17 December 2023), the following Summer

draw or the first business day thereafter. We will then send another direct message to
request and validate their Participant Information. We will make two direct attempts within
a 48-hour period to obtain such information. Once we have received the Participant
Information and validated the particular winner, we will email the corresponding voucher
prize to them as soon as possible thereafter, subject to section 4.2.4. Proof of identity
and a completed Competition release/indemnity form will be required in order to validate
the particular winner.

7.4. For Competition Week 4 (i.e. 25 December 2023 until 31 December 2023), the following Summer

Information and validated the particular winner, we will deliver or otherwise arrange
delivery of the corresponding prize to them as soon as possible thereafter, subject to
section 4.2.4. Proof of identity and a completed Competition release/indemnity form will
be required in order to validate the particular winner.

(d) unlimited entries into the corresponding draw to stand a chance of winning one of five
R2,500 Summer Sorted Voucher Prizes;
(e) the winners will be chosen from the successful entries received (i.e. five different winners
in total), by way of random draw as soon as possible during the week commencing on 1
January 2024; and
(f) the successful winners will be announced by way of direct message via their email
address used to register their Takealot account, either on the same day as the relevant
draw or the first business day thereafter. We will then send another direct message to
request and validate their Participant Information. We will make two direct attempts within
a 48-hour period to obtain such information. Once we have received the Participant
Information and validated the particular winner, we will email the corresponding voucher
prize to them as soon as possible thereafter, subject to section 4.2.4. Proof of identity
and a completed Competition release/indemnity form will be required in order to validate
the particular winner.

7.5. Furthermore in the case of the aforesaid Summer Sorted Coupon Prizes, for the avoidance of
doubt:
7.5.1. each successful winner will be able to retrieve their unique coupon code and applicable
redemption instructions via instant download directly from the Platform, and directly to the
device that they’ve used to access the Platform as such;
7.5.2. it is the responsibility of the particular winner to successfully redeem their unique coupon
code via a Takealot Platform within the coupon’s stipulated validity period, and no such
coupon code will be redeemable after the end of such stipulated validity period;
7.5.3. should the total number of available Summer Sorted Coupon Prizes allocated for the
particular Competition Week run out, the same will no longer be available to claim as a prize
on the Platform; and
 7.5.4. all such Summer Sorted Coupon Prizes are subject to their respective redemption
mechanics and limitations outlined above, and otherwise subject at all times to the aforesaid
Takealot Terms and Conditions relating to Gift Vouchers and Coupons.

7.6. Furthermore in the case of the aforesaid Summer Sorted Product Prizes, for the avoidance of
doubt:
7.6.1. the products comprising each prize hamper are subject to availability at the time of awarding
winners;
7.6.2. in the event that any such product is out of stock or unavailable for any reason whatsoever,
we will then at our sole discretion provide the particular winner with an alternative product of
a reasonably similar nature, and of a reasonably similar monetary value, and otherwise
subject at all times to the aforesaid Takealot Returns Policy; and
7.6.3. each such particular winner will be selected by way of random draw, at our sole discretion,
and our decision is final and no correspondence will be entered into with a Competition
participant other than the particular winner(s).

8. Use of participant and winner information: By participating in this Competition and supplying your
corresponding personal information when registering your Summer Sorted Profile, you thereby consent
to the use by Takealot.com or a third party nominated by Takealot.com of your Participant Information
and other such personal information, so that you can be announced as a winner and the corresponding
prize can be delivered to you. The particular winner may also be asked to permit the use generally of
their image in marketing material, to participate in marketing activities, to permit Takealot the use of the
image uploaded in marketing material, and/or be present when the relevant draw is taking place or they
are announced as a winner, but they will be entitled to decline to do so. By entering this Competition,
you consent that Takealot.com can use the contents of the competition submission / your successful
entry for marketing purposes generally.

9. Unforeseen events: In the event of unforeseen circumstances or causes beyond our reasonable
control, we reserve the right to cancel this Competition (before entries are received), to change the
number or nature of the prize at any time (on notice to you), or to change the terms and conditions of
this Competition at our sole discretion (provided that, unless required due to such aforesaid unforeseen
circumstances or causes beyond our reasonable control, we will not change the conditions for
participation or conditions for being awarded the particular prize, as stated herein).

10. Terms and conditions: By participating in this Competition, you agree to all the Competition terms and
conditions set out herein and the General Entry T&Cs, without exception.

11. GENERAL DISCLAIMERS: Notwithstanding anything to the contrary:

11.1. Takealot and any supplier of goods or services in connection with this Competition cannot
and will not, for any reason whatsoever, be held liable or otherwise responsible for:
11.1.1. any Summer Sorted Challenge entries not captured; nor
11.1.2. any Summer Sorted Prize claims not captured; nor
11.1.3. any digital coins not being earned or allocated;
11.1.4. any personal information incorrectly captured by the Qualifying Participant that
could result in Summer Sorted Product Prizes not being delivered to the particular
winner(s); nor
11.1.5. any Summer Sorted Coupon Prizes not being received by the particular winner(s);
nor
11.1.6. any network connectivity, data or hardware issues experienced while participating;
nor
11.1.7. any data or airtime charges or costs incurred by anyone while participating in this
Competition.

11.2. The use of the Platform is entirely at your own risk and you assume full responsibility for
any risk or loss resulting from use of the Platform or reliance on any information on the
Platform.
11.3. Whilst Takealot and its supplier of services takes reasonable measures to ensure that the
content of the Platform is accurate and complete, Takealot and its supplier of services
makes no representations or warranties, whether express or implied, as to the quality,
timeliness, operation, integrity, availability or functionality of the Platform or as to the
accuracy, completeness or reliability of any information on the Platform. If any such
representations or warranties are made by Takealot’s representatives, Takealot shall not
be bound thereby.

11.4. Takealot disclaims liability for any damage, loss or expenses, whether direct, indirect or
consequential in nature, arising out of or in connection with your access to or use of the
Platform and/or any content therein, unless otherwise required by applicable law.

11.5. Any views or statements made or expressed on the Platform are not necessarily the views
of Takealot, its directors, employees and/or agents.

11.6. In addition to the disclaimers contained above and elsewhere herein, Takealot also makes
no warranty or representation, whether express or implied, that the information or files
available on the Platform are free of viruses, spyware, malware, trojans, destructive
materials or any other data or code which is able to corrupt, destroy, compromise, disrupt,
disable, harm, jeopardise or otherwise impede in any manner the operation, stability,
security functionality or content of your computer system, computer network, hardware or
software in any way. Consequently, by participating in this Competition, you accept all risk
associated with the existence of such viruses, destructive materials or any other data or
code which is able to corrupt, compromise, jeopardise, disrupt, disable, harm or otherwise
impede in any manner the operation or content of a computer system, computer network,
any handset or mobile device, or your hardware or software, save where such risks arise
due to the gross negligence or wilful misconduct of Takealot, its employees, agents or
authorised representatives. Takealot thus disclaims all liability for any damage, loss or
liability of any nature whatsoever arising out of or in connection with your access to or
