IN THE HIGH COURT OF MADHYA PRADESH

AT JABALPUR
CONC No. 3350 of 2018
(KISHAN PILLEY AND OTHERS Vs MR. IQBAL SINGH BAINS CHIEF SECRETARY AND OTHERS)

Dated : 22-05-2024
Shri Naman Nagrath - Senior Advocate with Shri Himanshu Mishra -

Advocate for petitioners.

Shri Ashish Anand Bernard - Additional Advocate General for
respondents No.1 and 2/State.

The learned Additional Advocate General submits that the Government is

in the process of complying with the order of this Court dated 28.04.2017
passed in W.P. No.7058 of 2016. That subsequent to the filing of the contempt
petition, committees were formed and solutions were sought for in order to
resolve the dispute at large. That, in view of the elections being held in the State,
they require some time to finally comply with the aforesaid order.
The same is objected to by Shri Naman Nagrath, learned senior counsel
appearing for the petitioners' counsel. He firstly contends that the order
disobeyed is of the year 2017. When the contempt petition was being
considered, undertakings were given by the State as well as the Advocate

General at the relevant point of time for compliance of the order. In fact, there
are at least three undertakings given by the respondents with regard to
compliance. In spite of the same, there has been no compliance. Hence, he
pleads that the matter be proceeded with.
On hearing learned counsels and considering the situation, we deem it just
and necessary to grant one more opportunity to the State in order to ensure
compliance of the order dated 28.04.2017 passed in W.P. No.7058 of 2016.
