OWNER-CONTRACTOR AGREEMENT

KNOW ALL MEN BY THESE PRESENTS:

This AGREEMENT was made and entered this 15th day of


SEPTEMBER 2024.

MR RODERICK MENDOZA AND MRS ANNA DAY MENDOZA, of


legal age, Filipino, from BONGABON, NUEVA ECIJA as the
OWNER.

-and-

Arch. Joshua A. Salvador, both of legal age,


Filipino and a resident of GENERAL MAMERTO NATIVIDAD,
NUEVA ECIJA and herein referred to as the CONTRACTOR.

WITNESSETH:

WHEREAS, the OWNER intends to finish their


RESIDENTIAL PROJECT wherein the CONTRACTOR hereby agrees
to undertake the construction of the said Project with
the scope as follows;

1. Installation of Ceiling
2. Installation of Switches and Outlets
3. Installation of Electrical Panel Box with Breakers
4. Painting of Interior and Exterior Walls
5. Painting of Ceiling
6. Tiles Installation
7. Kitchen Counter top with cover underneath
8. Fixtures Installations
9. Shower Heaters
10. Shower Enclosures
11. Toilet Doors

WHEREAS, the said project is to be built at the


OWNER’S lot located at BONGABON, NUEVA ECIJA at a total
projects cost of ONE MILLION FIVE HUNDRED FIFTY THOUSAND
PESOS (Php 1,550,000.00), Philippine Currency and the
corresponding type of building materials that shall be
utilized will be clearly indicated in the building plans
and specifications to be provided by the CONTRACTOR.

NOW, THEREFORE, for and in consideration of the


foregoing agreement and covenant, the OWNER and the
CONTRACTOR have agreed to the following terms and
conditions that shall govern the said construction:

1. THAT, the CONTRACTOR hereby agrees to build for


the OWNER, that aforementioned, and the said
amount shall cover all the expenses for labor and
construction material, and all others works
agrees upon orally and as reflected in the
building plans and specifications;
2. THAT, the contractor shall finish the said
project within 150 - 180 Calendar days but will
extend by reason of unwanted weather condition,
additional works, that could impede the
construction, from the time the building permit
shall have been obtained and the construction
started;
3. That the change or addition in the described
scope of work shall be deemed as a change order
and shall be subject to the approval of the owner.
Both parties shall confirm the quantities and
cost of the change order before the
implementation or purchasing.

4. That, the application for the permanent


electrical meter, water service connection, and
occupancy permit is to be provided and do apply
by the Owner. All costs and expenses of the
application shall be for the account of the Owner.
The time involved in the application process
shall not affect the schedule of the phases nor
the schedule of payment described herein.

5. THAT, in consideration of this agreement, the


respective duties and responsibilities if the
Contractor and the Owner are describes herein
below:

RESPONSIBILITIES OF THE CONTRACTOR

1. Preparation and submission of working drawings


based on the approved preliminary designs set
forth in detail the work required for the project,
presented in the form of floor plans, elevations,
selection as well as details of important parts
of construction together with schedule and notes.
2. Preparation and submission of comprehensive
specifications describing the type and quality of
materials and finishing with which the project is
to be constructed.
3. Assist the owner, provide plans and other related
documents necessary documents in securing a
building permit.

4. Execution of the construction, purchasing of


materials based on approved and agreed bill of
materials, building plans and specifications.
RESPONSIBILITIES OF THE OWNER

1. Provide full information as to his intentions,


objections, and requirements for the project.
2. Give order and objection to the contractor if he
observed or otherwise becomes aware of any
defects in the construction or non-compliance
with the plans and specifications.
3. The owner is responsible for the availability of
funds as payment for the construction of the
project as agreed upon in the schedule of
payments.

4. The owner is responsible for the payment for any


change order, addition, or alteration to the
original plan to be computed by the Architect of
Record.

5. Any additional amount on the Bill of Materials


indicated price being the owner’s choice will be
shouldered by the owner, and 10% of the
additional price of those materials will be added
as labor cost.

SCHEDULE OF PAYMENTS

1. The OWNER agrees to pay the CONTRACTOR for the


construction of the Project with a total amount of
ONE MILLION FIVE HUNDRED FIFTY THOUSAND PESOS (Php
1,550,000.00), Philippine Currency. Simultaneously
upon having agreed to the Progress Billing being
presented by the contractor overtime.

2. Upon signing of this agreement, a sum to 35%


mobilization payment of the above-mentioned
contract amount or equivalent to FIVE HUNDRED FORTY
TWO THOUSAND FIVE HUNDRED PESOS (542,500.00) Phil.
Currency which will include the ceiling framing
installation, Electrical wirings on ceiling and
Ceiling covering.

3. Upon completion of the above-aforementioned work of


the project, a payment in the sum of FOUR HUNDRED
SIXTY FIVE THOUSAND PESOS (465,000.00) Phil.
Currency as 2 nd payment which includes painting on
ceiling, tiles installation, electrical wiring for
outlets and switches and painting of exterior.
4. Upon completion of the above-aforementioned work of
the project, a sum of FOUR HUNDRED SIXTY FIVE
THOUSAND PESOS (465,000.00) Phil. Currency as 3rd
payment which includes Installation of Outlets,
Switches, Painting of Interior walls, Lighting,
Installation of Fixtures, Kitchen Counter, Shower
Heaters and Shower Enclosures.

5. After which the 5% retention amount of ONE HUNDRED


SEVENTY FOUR THOUSAND THREE HUNDRED PESOS
(174,300.00) Phil. Currency will be given by the
OWNER to the CONTRACTOR as Postdated Check dated 2
month after the day of turnover.

SUCCESSORS AND ASSIGNS

The OWNER and the CONTRACTOR bind themselves,


their partners, successors in interest, and their legal
representatives and assign to respect the terms and
conditions of this agreement.

IN WITNESS WHEREOF. We have hereunto signed


our names on this __ day of _________, 202_, here at
Cabanatuan City, N.E.
