were in violation of the Arizona Landlord Tenant Act {See Ex. 3}{Article 2 33-1321 (C) &

(E)} to charge $1,200 against my Security Deposit (See Ex. 1) for damage that was either
25 present at the time of move-in (See Exhibit 4-4.2) or considered normal wear and tear. The
property manager and owner kept no move-in or move-out inventory (confirmed by owner’s

agent on Ex. 7) to compare conditions before move-in and after move-out. To come to the
27 charge of $1,200 an inoperable company (Ex.6) represented by one of the Defendants’ son
(name and number seen on bid in Ex. 5). After mailing me a check on or around March 10th

for the remainder of my deposit, I immediately disputed the charges and also held the check

1 until a solution could be met. After realizing the unlikelihood of any satisfactory outcome, I
deposited the check on 6/25/23, only to be notified by my bank that these funds were
2 removed from my bank due to a STOP PAYMENT being placed on the check (See Ex. 10).
3 This was most damaging as I expected to have the funds there for bills and also to use for the
filing of this case. Overdraft fees are sure to continue piling, at the time of this filing I’ve
4 been charged a single $35 fee.
