APPLICATION U/S 8 READ WITH SECTION 11 AND 37 OF THE RERA ACT

RESPECTFULY SHOWETH:

1. That the project namely” 63 GOLF DRIVE” ( HEREIN REFERED AS” PROJECT”)
RERA REGISTRATION NO 248 OF 2027 DATED 26/09/2017, Valid up to 25.09. 2022 in
area 5.90 acres affordable group housing colony situated in sec 63 –a village
ullahwas tehsil & district gurguram Haryana by the respondent namely M/s
SUNRAYS HEIGHTS PVT LTD HEREIN AFTER REFERED AS THE PROMOTER ) .
[Link] the development work of the project comprising of 9 towers having 850
residential units consisting of 1, 2 and 3 bhk commenced on16/09/2016 .
3 the completion date Of the project as declared at the time of registration Of
the project with HRERA herein after called as AUTHORITY , LAPSED ON
15/03/2020 .
4 Further as per HARERA notification no. 9/3-2020 dated 26.05.2020, an extension of 6 months
grace on account o force majeure due to covid 19 outbreak is granted for the projects having
completion/due date on or after 25.03.2020. Thus after considering the race period the project was
supposed to be completed and handed over the allottee lasted by 16/03/2021.
5. The promoter failed to adhere to the timelines declared by it for the completion of the project
and the progress if the work is 90% whereas the date of completion i.e 16/09/2020 has already
lapsed .
6 The association of Allottees have expressed seeks intervention of this Hon’ble authority to
complete the project under the appropriate provision if RERA Act and has approached the hon’ble
authority for guidance and appropriate directions in the matter .
7 since it is not permissible for the prmoter to get further extension of registration of the project
undr sec 6 of the rera act , the only course available to facilitate the completionof this project is
under section 8 of the rera act , wherein it ha beenprovided that upon lapse of the registration or on
revocation of the registration under this act the authority ma consult the appropriate government to
take such action as it may eem fit including the carrying out the remaining development wirk
through the competent authority or the association of allottee or in any ither maneer as may be
determinded by the authority .
