AFFIDAVIT

I HARSH BIHANI son of Sushil Kumar Bihani having its office at KITCHEN APPLIANCES
INDIA LIMITED (KAIL) 3A, 3rd Floor Mukti World, 9/3B, Leela Roy Sarani, P.O. Ballygunge
P.S. Gariahat, Kolkata -700 019, aged about 32 years by Cast Hindu, by Occupation Service do
hereby solemnly affirms and declare as follows that :-

1. I am the original owner of the below scheduled landed property of M/S KITCHEN
APPLIANCES INDIA LIMITED (KAIL) having its office at Mukti World, 3A, 3rd Floor, 9/3B,
Leela Roy Sarani, P.O. Ballygunge P.S. Gariahat, Kolkata 700 019 and competent to affirm this
affidavit/ on behalf of the said Company.

2. That the said Company hold urbanisable land with old building/Structure at Premises No. 3A,
Hari Mohan Ghosh Road, Kolkata – 700 019, within Ward No. 80 of Kolkata Municipal
Corporation, P.O & P.S. Gardenreach, as described in Annexure "A" hereto attached and intend to
construct a residential building over the said premises being No 3A, Hari Mohan Ghosh Road,
Kolkata 700 019, within Ward No. 80 of Kolkata Municipal Corporation, P.O & P.S. Gardenreach.
3. That the said Company intend(s) to procure a No Objection Certificate in respect of the said
landed property to be granted by the Competent Authority ULC Kolkata under the provisions of the
Urban Land (Ceiling and Regulation) Act, 1976, read with section 4, Sub-section 4 of the Kolkata
Municipal Corporation Building Rules, 1990.

4. That save and except the property described in the Annexure "A" herein below, the said Company
did not hold as on 17.02.1976 and do not hold since then till date any vacant land or land with
building in any Urban agglomeration as defined in the Urban Land (Ceiling and Regulation) Act,
1976.

5. That the said Company is liable to file a statement u / s. 22 of the Urban Land (Ceiling and
Regulation) Act, 1976 as and when the existing buildings / structures are demolished before the
Competent Authority (ULC) Kolkata.

6. That the said Company became owner of the present landed property with effect from 12th
January 2023.

7. That no other land or land with building has been acquired and owned by Paras the said
Company since 17.02.1976 within any urban agglomeration.

[Link] the said Company intends to make construction of the proposed building in the following
manner :-

➤Total No. of Flats / dwelling units : 929 Sqmt

➤Total area of Flat / dwelling units : 78062.3 Sqmt

➤The Plinth are of the Biggest Flat /


Dwelling unit in the proposed construction : 120.39 Sqmt

➤Future Mode of use of the Building

building / Bank Finance : Residential

9. That area of plinth of such dwelling unit in the proposed construction will be kept within 300
square meters in terms of Section 29 of the aforesaid Act.

10. That a tank to the extent of NIL sq. meters, Garden to the extent of NIL sq. meters, 9465.65
passage or access and road to the extent of 9465.65 sq. meters remain(s) at the site and in the event
of any change in nature, character and area of such tank, garden, passage or access road vacant land
so emerged and excess vacant land, if any, within the purview of the Urban Land (Ceiling and
Regulation) Act, 1976 will be taken in the re-determination by the prescribed authority.
11. That any omission incorrectness in the above statement/statements even if bonafide and if the
below mentioned land is declared ceiling surplus as per the provisions of the U.L.(C&R) Act, 1976,
after issuance of the desired NOC, then the Competent Authority, shall have the absolute right to
rescind, cancel or withdraw the NOC with retrospective effect and the permission, if any, granted
with regard to construction and also take such other action/actions in respect thereof as may be
deemed fit and proper as per the U.L.(C&R) Act, 1976 and in that case the said Company shall/will
be liable for all costs and consequences thereof.

12. That the Affidavit shall be binding upon me as well as my four successors and assignees.

13. That the above statements as made are true to the best of my knowledge and belief.

ANNEXURE -"A"

ALL THAT piece and parcel of land measuring an area measuring about 10 Acres 1 Bigha 13
Cottahs 10 Chittaks 9.36 square feet, equivalent to 42789.40 square meter (more or less), with
building and structures having several dwelling units, boundary wall, path ways, etc. situate, lying
at and being the Premises No3A, Hari Mohan Ghosh Road,, within Ward No. 80 of Kolkata
Municipal Corporation, P.O & P.S. Gardenreach, Kolkata - 700 019.
