1. INTRODUCTION

Purpose

This document describes the procedure upon which Lemay Painting And Renovation (LPR)
will comply with Anglo American: 45 Main Street Health and Safety Specifications. This
Health & Safety Plan is in accordance with the requirements layout in the Occupational
Health and Safety Act and its Regulations where reference is made to the Construction
Regulation of 2014.

This document is defined as the Management System that is implemented for the
managing of Health and Safety on the project, which includes ensuring subcontractor’s
compliance with the same standards at Anglo American

Scope

This OHS plan covers the requirements for the eliminating and mitigating accidents and
injuries in all Lemay Painting and Renovations controlled projects within LPR and where
LPR has control over any construction and maintenance activity.
This scope also addresses legal compliance, hazard identification and risk control,
promoting a health and safety culture amongst those working on Lemay Painting and
Renovations and those affected by the activities taking place in and around them within
the project.
The aim of this document is to present the health and safety aspects that will be controlled
and managed on the project.

General project description and Principal work activities to be :

Renovations of the 3th & 7th floor of building 45 Main Street.

Description of the site and access:

The deliveries will come through the gate on Fox Street and the vehicle will exit via the
gate on Ntemi Piliso Street.
There will be one primary entrance to the site that may be used for deliveries on site. The
main entrance to the site will be via Fox Street.
All personnel’s who will be accessing site will have access cards visible on themselves, and
will have attended the Anglo American induction and a Lemay Safety Briefing on site rules.
All personnel involved in the project will be obligated to a criminal record, and only those
without a criminal record will be permitted access on the site. Every Morning and at
random moments, a breathalyser test will conducted on any person entering the site. Zero
tolerance to alcohol detection on site.
The material delivered on site will be conveyed by goods on B1 to site. Direction signs will
be displayed.

Detection of existing services:

As soon as possible after the handing over of the site, Lemay Painting and Renovation will
start detection of existing services. Overhead and underground services will be protected
and isolated when and if Lemay Painting and Renovations may need to conduct work in
that area. Some but not relative to all, floors that have been isolated, will be confirmed
before any work may commence on site.

Establishment of construction camp:


We as Lemay Painting and Renovations will stored our materials in the storeroom located
in B1 Fox entrance, some in lay down area that will also located in B1 on Ntemi Piliso exit.
Solid barricading covered with shade nets will be used to demarcate our lay down area.

Sanitary and solid waste bins:

Lemay Painting & Renovations employees and subcontractors will use the existing toilets
and urinal on 7th floor. Change rooms will be located in 7 th floor and eating rooms as well.
We will not provide our employees with showers as they are staying closer to site, we will
send through a signed letter with all information. These facilities will be used for the
duration of project. Waste will be removed from site using a rubble shoot that deposit the
rubble direct to the skip placed on Ferreira Street. Shooters will be placed on an acute
angle. Weigh-leave will be applied to get the permission to place the skip bins on Ferreira
Street. Waste containing dust will be sprayed with water to subtract dust, shooter will have
door and lock on top (3th & 7th) to control when exchanging skips. Flagmen will control
traffic when exchanging skips. Hazardous waste will placed in wheel bins labelled
HAZARDOUS WASTE, and it will be disposed by Inter waste Pty Ltd. No spillages will be
allowed on site. Shutter boards will be placed underneath the skip bins to protect the
paving and solid barricading to protect the by-passers. Proper signage will be displayed to
direct and warn the public.

Setting out of works:


The works will be set out, in accordance to the Anglo American specifications which will be
in the form of Site Instructions and drawings, and the OHS Act, regulations and applicable
code of practices.

Site clearance:
Material obtained from clearing and grubbing and demolition of existing structures shall be
dumped in a controlled and approved manner on the approved dumpsite.

Waste Management:
All demolition material will be disposed of in a manner that is for “Green Building” this
means that all the material taken off the site will either be recycled, re-used, or disposed
of as the last resort. All material being demolished will be kept on record and submitted to
the waste management client assigned to the project.

Erection of site office:


The existing old offices will be used as the Site Office, where all construction
administration will take place. The Anglo American will provide LPR with a vacant office
space to ensure office establishment, where all visitors to the construction site will initially
report to when they are visiting the site.

Connection to existing services:


Existing services will be detected and protected and isolated. The passenger lifts on the
construction floors will be disconnected to ensure that there are not being used, as this will
pose a danger to the other occupants of the building.

Construction:
The Construction/ Renovations and Refurbishments will be conducted by subcontractors,
and will be according to the Client’s specifications and applicable legislations.

Mechanical and electrical work:


Sub-Contractors will be appointed to conduct this work. Isolation of all electrical works on
the site will be done by a subcontractor and will be confirmed as so.
Clearance of site on completion:
Upon completion of project, the site will be cleared and tidied up and Lemay Painting and
Renovations will remove their establishments (site office and site campus).

Project Timescale:

The project is estimated to run for approximately 07 months.

3. DEFINITIONS

The following definitions will apply to the Health and Safety Management Plan in
accordance with Construction Regulations as defined in the Occupational
Health and Safety Act 2003.

• A contractor who intends to carry out any construction work other than work
completed in Regulation 3(1), must at least seven(7) days before that work is to
be carried out notify the provincial director in writing in a form similar to
Annexure 2 if the intended construction work will –
(a) Include excavation work;
(b) Include working at height where there is risk of falling;
(c) Include the demolition of a structure;
(d) Include the use of explosive to perform construction work.
• A contractor who intends to carry out construction work that involves
construction of a single storage dwelling for a client who is going to reside in
such dwelling upon completion, must at least seven(7) days before that is to be
carried out notify the provincial director in writing in a form similar to Annexure 2

HAZARD IDENTIFICATION, RISK Each contract that LEMAY gets involved with, will
ASSESSMENT AND RISK CONTROL do a Method Statement & Risk Assessment to
identify the hazards, assess the risks and control
measures and safe working procedures by a
competent person in writing.
‘APPROVED INSPECTION AUTHORITY Means an inspector authority approved by the
chief inspector:
Provided that an inspector authority approved by
the chief inspector with respect to any particular
service shall be an approved inspection authority
with respect to that service only;
‘BIOLOGICAL MONITORING” Means a planned program of periodic collection
and analysis of body fluid, tissues, excreta, or
exhaled air in order to detect exposure to or
absorption of any substance or organism by
persons;
THE ACT Includes any Regulation set out in the
Occupational Health and Safety Act, 85 of 1993
“THE PRINCIPLE CONTRACTOR” Means the contractor appointed by the client and
holds the administrative control of the
construction work.
“THE DESIGNER” Means and/or consists of a number of different
persons traditionally referred to as the
professional team e.g. engineers, architects etc.
“BUILDING INCLUDES” Any structure attached to the soil, any building or
structure or part thereof which is in the process of
being erected or any prefabricated building or
structure not attached to the soil.
“CHIEF EXECUTIVE OFFICER” Means in relation to a body corporate or
enterprise conducted by the state, the person who
is responsible for the overall management and
control of the business of such body corporate or
enterprise.
“CHIEF INSPECTOR” Means the officer designated under section 27 as
the chief inspector and includes any officer acting
as chief inspector.
“COUNCIL” Means the advisory council for occupational
health and safety established by section 2.
“DANGER” Means anything which may cause injury or
damage to persons or property.
“DEPARTMENT” Means the department of labour.
“EMPLOYEE” Means any person who works, is employed by the
company and who receives or is entitled to
receive any remuneration or who works under the
direction or supervision of the employer.
“EMPLOYER” Means any person who employs or provides for
any person and remunerate that person or
expressly or tacitly undertakes to remunerate
them.
“EMPLOYERS ORGANIZATIONS” Means an employer organization as defined in
section 1 of the labour relations act, 1956 (act 28
of 1956)
“EMPLOYMENT OR EMPLOYED” Means employment or employed as an employee.
‘EXPLOSIVES” Means any substance or article as listed in Classic
– Explosives in the South African Bureau of
Standards Code of Practice for the Identification
and Classification of Dangerous Substances and
Goods, SABS 0228
HAZARDS Means a source of exposure to danger which may
cause injuries to employee or damage to property.
“HEALTH AND SAFETY COMMITTEE” Means a committee under section 19
“HEALTH AND SAFETY EQUIPMENT” Means any article or part thereof which is
manufactured, provided or installed in the interest
of the health and safety of any person.
“HEALTH AND SAFETY REPRESENTATIVE” Means a person designated in terms of section 17
(1)
“HEALTH AND SAFETY STANDARD” Means any standard irrespective of whether or not
it has the force of law which in applied for the
purpose of the act will in the opinion of the
minister promote the attainment of an objective of
this act.
“HEALTH” Means free of illness or injury attributable to
occupational causes.
“INCIDENT” Means an incident as contemplated in section 24
(1)
“INDUSTRIAL COURT” Means the industrial court referred to in section
17 of the Labour Relations Act (28 of 1956)
RISK Means the probability that injury or damage may
occur.
EMPLOYEE Means any person who works, is employed by the
company and who receives or is entitled to
receive any remuneration or who works under the
direction or supervision of the employer.
EMPLOYER Means any person who employs or provides for
any person and remunerate that person or
expressly or tacitly undertakes to remunerate
them.
CHIEF EXECUTIVE OFFICER Means in relation to a body corporate or
enterprise conducted by the state, the person who
is responsible for the overall management and
control of the business of such body corporate or
enterprise.
Means a person designated under section 28 of
INSPECTOR the OHS act 85 of 1993
Any work declared to be listed under section 11.
“LISTED WORK”
Means any institution or body contemplated in
“LOCAL AUTHORITY” section 84 (1) f of the provincial government act
1961 (act 32 of 1961)
Any regional services council established under
section 3 of the regional services council act 1985
(act 109 of 1985)
Any other institution or body or the holder of any
office declared by the Minister by notice in the
Gazette to be a local authority for the purpose of
this act.
Means any article or combination of articles
“MACHINERY” assembled, arranged or connected and is used or
intended to be used for conveying any form of
energy to perform work or which is used or
intended to be used whether accidentally or not
for developing, receiving, storing, containing,
confining, transforming, transmitting, transferring
or controlling any form of energy.
Means an installation where
“MAJOR HAZARDS” -more than the prescribed quantity or any
substance is or may be kept whether permanently
or temporarily or
-any substance is produced, processed, used,
handled or stored in such a form and quantity that
it has the potential to cause a major incident.
Means an occurrence of catastrophic proportions
“MAJOR INCIDENT” resulting from the use of plant or machinery or
from the activities at a workplace.
Includes, refers and applies to an agent,
“MANDATORY” contractor or its contractors for work but without
derogating from his status in his or her own right
as an employer or user.

“MINISTER” Means the minister of labour.


Includes occupational health, occupational
“OCCUPATIONAL HEALTH” medicine and biological monitoring.
Means an occupational health practitioner or a
“OCCUPATIONALPRACTITIONER” person who holds a qualification in occupational
health recognized by the South African medical
and dental council as referred in the medical,
dental and supplementary health service
practitioners act 1994 (act 56 of 1994) or the
South African nursing council as referred to in the
nursing act 1987 (act 50 of 1987)
Means the anticipation, recognition, evaluation
“OCCUPATIONAL HYGIENE” and control of conditions arising in or from the
workplace which may cause illness or adverse
health effects to a person.
Means the prevention, diagnosis and treatment of
“OCCUPATIONAL MEDICINE” injuries and adverse effects associated with a
particular type of work.
Means a medical practitioner as defined in the
“OCCUPATIONAL MEDICINE medical, dental and supplementary health
PRACTITIONER” services practitioners act 1974 (act 56 of 1974)
who has a qualification in occupational medicine
or equivalent qualification which is recognized as
such by the South African Medical and Dental
council referred to in said act.
Means an office as defined in section 1 (1) of the
“OFFICE” basic conditions of employment act 1983 (act 3 of
1983)
Means an officer or employee as defined in
“OFFICER” section 1 (1) of the public service act 1984 (act
111 of 1984)
Means any biological entity which is capable of
“ORGANISM” causing illness in a person.
Includes structures, buildings, fixtures, fittings,
“PLANT” implements, equipment, tools and appliances as
well as anything used for any purpose in
connection with such plant.
Includes any building, vehicle, vessel, train or
“PREMISES” aircraft.

“PRESCRIBED” Means prescribed by the regulation.


Means the used with reasonable care and with
“PROPERLY USED” due regard to any information, instructions or
advice supplied by the designer, manufacturer,
importer, seller or supplier.
Means practicable having regards to
“REASONABLE PRACTICABLE” -the severity and scope of the hazards or risks
concerned
-the state of knowledge reasonably available
concerning the hazard or risk and of any means of
mitigating the hazard or risk
-the availability or suitability of means to remove
or mitigate the hazard or risk
- And the cost of removing or mitigating the
hazard or risk in relation to the benefit deriving
there from.

“REGULATION” Means a regulation made under section 43


“REMUNERATION” Means any payment in which money or in kind or
both, made or owing to any persons in pursuance
of such person’s employment.
“RISK” Means the probability that injury or damage may
occur.
“SAFE” Means free from any hazard.
Includes
“SELL” -offer or display for sale or import into the republic
for sale or
-exchange or donate or lease or offer or display
for leasing.
means a shop as defined in section I (1) of the
“SHOP” Basic Conditions of Employment Act, 1983 (Act
No. 3 of 1983);
means any provision occurring
“STANDARDS” -in a specification, compulsory specification, code
of practice or standard method as defined in
section I of the Standards Act, 1993 (Act No. 29 of
1993); or
-in any specification, code or any other directive
having standardization as its aim and issued by an
institution or organization inside or outside the
Republic which, whether generally or with respect
to any particular article or matter and whether
internationally or in any particular country or
territory, seeks to promote standardization.
Any solid, liquid, vapour, gas or aerosol, or
“SUBSTANCE” combination thereof.

“THIS ACT” Includes any regulation.

Means a trade union as defined in section 1 of the


“TRADE UNION” Labour Relations Act, 1956 (Act No. 28 of 1956).
in relation to plant or machinery, means the
person who uses plant or machinery for his own
benefit or who has the right of control over the
“USER” use of plant or machinery, but does not include a
lesser of, or any person employed in connection
with, that plant or machinery.
Means work as an employee or as a self-employed
person, and for such purpose an employee is
deemed to be at work during the time that he is in
“WORK” the course of his employment, and a self-
employed person is deemed to be at work during
such time as he devotes to work as a self-
employed person.
Means any premises or place where a person
“WORKPLACE” performs work in the course of his employment.
CONSTRUCTION DEFINITIONS
Means competent person who acts as a
“AGENT” representative for a client;
Means the steepest angle of a surface at which a
“ANGLE OF REPOSE” mass of loose or fragmented material will remain
stationary in a pile on a surface, rather than
sliding or crumbling away.
Means machinery, appliances or other similar
“BULK MIXING PLANT” devices that are assembled in such a manner so
as to be able to mix materials in bulk for the
purposes of using the mixed product for
construction work.
“THE CLIENT” Means any person for whom construction work is
being performed.
“COMPETENT PERSON/S” Means any person who –has in respect of the
work or task to be performed the knowledge,
training, experience and, where applicable,
qualifications specific to that work or task:
Provided that where appropriate qualification and
training are registered in terms of the provisions
of the National Qualification Framework Act, 2000
( Act No 67 of 2000), those qualifications and that
training must be regarded as the required
qualification and training; and;
(b) is familiar with the Act and with the application
regulations made under the Act;
‘ CONSTRUCTION MANAGER’ Means a competent person responsible for the
management of the physical construction
processes and the coordination, administration
and management of resources on a construction
site;
‘ CONSTRUCTION SITE’ Means a workplace where construction work is
being performed;
‘ CONSTRUCTION SUPERVISOR’ Means a competent person responsible for
supervising construction activities on a
construction site;
means a vehicle used for means of conveyance
“CONSTRUCTION VEHICLE” for transporting persons or material or persons
and material, on and off the construction site for
the purposes of performing construction work;
means any work in connection with
“CONSTRUCTION WORK” -The erection, maintenance, alteration,
renovation, repair, demolition or dismantling of or
addition to a building or any similar structure; or
-the construction, erection, maintenance,
demolition or dismantling of any bridge, dam,
canal, road, railway, runway, sewer or water
reticulation system; or the moving of earth,
clearing of land, the making of excavation or
moving of earth, clearing of land, the making of
an excavation, piling, or any similar civil
engineering structure or type of work;
Means a document who performs construction
‘CONSTRUCTION WORK PERMIT’ work;

‘DEMOLITION WORK’
An employer, as defined in section 1 of the Act,
“CONTRACTOR” who performs construction work and includes
principal contractors.
In relation to any structure includes drawings,
“DESIGN” calculations, design details and specifications.
means a competent person who -
“DESIGNER” -prepares a design;
-checks and approves a design;
-Arranges for any person at work under his/her
control to prepare a design, including an
employee of his/she is the employer;
- designs temporary work, including its

-Architects and engineers contributing to, or
having overall responsibility for the design;
-Build services engineers designing details for
fixed plant;
-Surveyors specifying articles or drawing up
specifications;
-Contractors carrying out design work as part of a
design and build project;
- a contractor carrying out design work as part of
a design and building project; or
-Interior designers, shop-fitters and landscape
architects.
means the application of scientific information
“ERGONOMICS” concerning humans to the design of objects,
systems and the environment for human use in
order to optimize human well-being and overall
system performance;
means the making of any man-made cavity,
“EXCAVATION WORK” trench, pit or depression formed by cutting,
digging or scooping;
Means a tool that is activated by an explosive
“EXPLOSIVE ACTUATED FASTENING charge and that is used for driving bolts, nails and

means the identification and documenting of
existing or expected hazards to the health and
“HAZARD IDENTIFICATION” safety of persons, which are normally associated
with the type of construction work being executed
or to be executed;
Means any potential exposure to falling either
‘FALL RISK’ from, off or into;
Means a file, or other record containing the
“HEALTH AND SAFETY FILE” information in writing required by these
Regulations;
Means any toxic, harmful, corrosive irritant or
asphyxiate substance or a mixture of substance
“HAZARDOUS CHEMICAL SUBSTANCE
for which an occupation exposure limit is
(HCS)”
prescribed or not but which creates a hazard to
health.
Means a site, activity or project specific
“HEALTH AND SAFETY PLAN” documented plan in accordance with client’s
health and safety specification;
Means a site, activity or project document
‘HEALTH AND SAFETY SPECIFICATION’ prepared by the client pertaining to all health and

“TUNNELING” natural surface of the earth for the purpose other
than searching for or winning of a mineral.

4. GENERAL HEALTH AND SAFETY PROVISION

Responsibilities.

Lemay Painting and Renovation’s Occupational Health & Safety Policy is signed by the Managing
Director and is prominently displayed at every site office. The form of undertaking in respect of
the Occupational Health and Safety Act, 85 of 1993, bound in part of the Tender document.

Implementation of Health and Safety System:

Lemay Painting and Renovations will implement a Health and Safety system for the project. The
implementation of the H&S system will be conducted in such a manner that all workers
understand and are able to implement health and safety in the daily work and life. A site Health
and Safety File with Plan and Programme will be opened for the project and copies of all relevant
and statutory documents will be kept therein. The primary Health and safety file that is within
the Passport 360 system will be kept online and will be updated on a daily basis, and per
required. All subcontractors coming onto the Anglo American site will subjected to the Passport
360 safety file, and no hard copy safety files will be kept on site. Only a Lemay safety file will be
on site which covers all the subcontractors on the site.

Notification of Intention to Commence Construction Work:

Notification to the “Provincial Director” of Construction Work to be carried out, 7 days before the
commencing on any construction work.

Notification of Intention to carry out Construction Work.

Notification Pro Forma. This document will be completed and sent to the nearest Department of
Labour and if one or more of the below items apply:
 The demolition of a structure exceeding 3 m in height; or
 The use of explosives; or
 The dismantling of fixed plant at a height > 3m; or where
 The duration will exceed 30 days or involve more than 300 person days; and if it,
 Includes excavation work deeper than 1 m; or
 Working at a height greater than 3m above ground level or a landing.
A copy of the notification letter to the Provincial Director shall be forwarded to Anglo American
for their records and shall be made available to an Inspector, Project Engineer or employee.

Principal Contractor’s Appointment by the Client:


a. Agreement with Mandatory. This document is to be completed between Lemay Painting
and Renovations, and Anglo American
b. The above shall also be imposed upon all sub-contractors.

By-Laws
The designer shall take cognisance of the By-Laws of the relevant local authority.
A weigh-leave shall be applied for with the Traffic Department, to ensure road safety to the
public

Safety Plan
Lemay Painting and Renovations shall ensure that the safety plan is implemented and
maintained from the date of commencement and for the duration of the construction work.
The Anglo American shall conduct audits to ensure the implementation and maintenance of the
safety plan.

Site Safety File


Lemay Painting and Renovations shall compile a comprehensive safety file as contemplated in
CR 5 (7) and (8), the Health and Safety file shall be in the form of the Passport 360 on KBC.
However, a site specific safety file that will be relevant to 55 Marshall Project, will be kept on
site as a hard copy safety file, that will be inclusive of all subcontractors.
The check list Addendum D shall be used as an index to compile the site safety file.
The site safety file shall be kept on site at all times.
Construction work shall be stopped if the site safety file is not available on request.
The site safety file shall be handed over to Anglo American for final audit upon completion of the
work.

Legal Appointments

In terms of the Occupational Health and Safety Act, Act 85 of 1993 and the Construction
Regulations, accountability for the safety of persons employed on the project must be delegated
in writing. The appointed personnel shall comply with that standards as per required by Anglo
American safety specifications.
The safety officer and the Contract Manager shall, as per required by Anglo American, ensure
they are registered with the SACPCMP.
Lemay Painting & Renovations shall appoint, in writing, the CEO as the person responsible for
the health and safety of all persons on the site and he shall ensure that all persons on site
comply with the requirements of his Safety Plan and the requirements of the Occupational
Health and Safety Act and Regulations, and the Anglo American safety standards.
The Lemay Painting and Renovation’s CEO may in terms of Section 16.1 designate any of his
duties to a person under his control.

Responsible Person to Supervise Health And Safety On Site

Company employees will be appointed by the management to attend to requirements as lay out
by the Act and Regulations will hold down these positions on a full time basis while performing
their original duties for which they are employed for.
The owner acknowledges that all management personnel (responsible for health and safety) will
have undergone Health and Safety Management Course and is registered with a statutory body.

Copy of the Act

Lemay Painting and Renovations shall ensure that copy the Occupational Health & Safety Act
and the relevant regulations are available on site in terms of General Administration Regulation
4.
Lemay Painting and Renovations shall ensure that a copy of the Health and Safety standard that
is incorporated into these Regulations in terms of Section 44, are available on site.

Project Manager

The Project Manager shall ensure that the health and safety plan has been approved for the
project and adequate resources are made available for occupational health and safety to his/her
employees making sure performance reports of occupational health and safety are
communicated back to the management team and workforce within the company to promote a
proactive occupational health and safety culture making safety the prime item of everyday life
be it in the workplace or the home environment. All the project managers will be registered with
the SACPCPM.

Engineers and Professional team

The professional team should see to it that there are adequately design safe solutions and
structures for which there is an acceptable environmental impact study done to integrate safety,
health, environmental, risk and quality assessment as part of the design process; and to ensure
throughout the design stage that the structure is safe to construct, capable of being operated
safely and execution plans prepared which anticipate and account for all significant health and
safety risks associated with the scope of work.

Contracts Manager

The contracts manager will lead by example in implementation of the health and safety
ensuring that all contractors as well as his/her sub- contractors are competent to perform their
work to the best of their ability being of the highest quality and ensuring that the risks
associated with the work have been identified and appropriate controls have been identified. To
oversee contributions to health and safety improvements in the execution of the project and the
implementation of all risks and hazards are controlled and findings recorded analysis register
and such findings be communicated to the workforce. To ensure that the requirements as per
clients minimum requirements are met and adhered to.

Safety Professional

The Safety Professional forms part of the company and is employed on a full time basis to assist,
advice and report back to management on his/her findings and in so doing shall be appointed a
competent Safety officer on a part-time or full time basis. Upon commencement of each project
and shall do inspections regularly.
The safety personnel shall adhere to the requirements by Anglo American safety specifications.

Construction Works Supervisor

Construction works supervisor and Sub – Ordinates shall be appointed on a full time basic to
assigned project in writing with at least two years’ experience or more and MAY NOT be
removed from the project to attend other matters until the project has been fully completed and
signed off by the Client, where he/she shall conduct toolbox talks and risk assessment meetings
at each commencement of work or at the start of each day’s activities which shall be
communicated to the workforce and findings be recorded and approved. He/she shall ensure
approved work method statements and safe working procedures are drawn up and are applied
to the work to be performed.
New risk assessments are done prior to each new tasks and such findings be recorded onto
analysis register and attendance register completed. He/ She shall see to it that enforcement of
all aspects of health and safety and be held liable for seeing that correct usage and application
of personal protective equipment is carried out and will ensure the emergency evacuation
procedures are known to all and good housekeeping is maintained always. Any incidents/
accidents are recorded and reported immediately to him and or management and the safety
department or safety personnel involved in the project along with a full investigation to the
matter arising and ensure inspections are concisely carried out during the course of the working
day/shift. To ensure that weekly man-hours are completed and submitted to the projects Safety
Officer. He/ She must ensure the competency of all subcontractors and stop work if the risk
factor is far too great or safety and lives are being compromised.
Risk assessment of a Competent Person

A competent person shall be appointed by the 8.1 in writing before the commencement of each
project to assist in the control of risks that are found on the project within the framework of the
company which shall be kept in the project health and safety site file.

Health and Safety Representatives

For every twenty (20) there shall be one (1) Safety Representative nominated, trained and
certified to assist the Safety Professional in his/her functions and shall be appointed in writing.
This person/s shall be elected by means of a bait system by his/ her colleagues to represent
them and carry out their duties as stated Section 17 of the Occupational Health and Safety Act
as well as General Administration Regulations. The designated person/s shall conduct daily
inspection within his/her area of responsibility and record his/her findings. The designated
person/s shall be permitted to partake in Health and Safety Committee meetings and report to
management and workforce on his or her findings and agenda minutes of meetings.

Competency of Responsible Person

Team leaders and Artisans shall undergo safety management training and shall be nominated in
writing and will be trained and certified to assist in the safety of projects.
A competent person is a person who has the necessary knowledge, skill, training and
qualifications to carry out their duties.

Health and Safety Organogram

Lemay Painting and Renovations shall submit an organogram, outlining the Site Health and
Safety Team as required and as related to the relevant appointments by the OHS Act. In the
case where appointments have not been made, the organ gram shall reflect the position. The
organogram shall be updated, when there is a change in the site team. Anglo American shall be
notified of the changes. See attached Organogram as Annexure B

5. OBJECTIVES AND TARGETS

• Comply with the Clients safety specifications.


• Comply with the Principle Contractors safety specifications.
• Lemay Painting and Renovations is committed to implementing client specific safety
specification on their projects and to see that this forms an integral part of our projects
• We intend to make the Client specification part of other Contractors and Suppliers
operating procedures.
• Comply with the rules and regulations set out by the Occupational Health & Safety Act,
Act 85 of 1993
• Comply with all Labour Laws laid down the government of the Republic of South Africa
• Comply with the Health and Safety Policies and Procedures of the company.
• The CEO and management of the company shall commit themselves to obtaining the
highest objectives and targets in health and safety.
• The Company believes in a safe working environment for all parties involved.
• Training on all level which includes health and safety is important to all and shall be
performed safely.
• Prevention of incidents and accidents is the responsibility of the company as a whole, to
prevent them from happening.
• To comply with a 90% monthly SHERQ audit pass rate.
• To strive for zero tolerance rate or less than the Disabling Injury Frequency Rate (D.I.F.R.)
 To obtain compliance with Lemay Painting and Renovations Health and Safety Policy.
 To empower all employees to organize accident prevention at his or her own level on
site.
 To eliminate/reduce incidents
 To ensure safety training forms part of the work culture.
 To assist, advise and train each other to ensure a safe and healthy working environment

6. PLANNING AND PROCEDURES

The procedures to be used for the project are in accordance with the clients Safety manual
Planning for site safety is attached (Annexure C)

HEALTH AND SAFETY PLAN


Lemay Painting and Renovations is to provide to Anglo American with a health and safety plan in
accordance with the Clients health and safety specification. The health and safety plan is to be
submitted for approval to the principal contractor management and client’s safety agent before
commencing of any works.

IMPLEMENTATION OF THE OCCUPATIONAL HEALTH AND SAFETY SPECIFICATION

LEMAY PAINTING AND RENOVATIONS is committed to comply with the Clients standards in
implementing a Health and Safety Specification on the project/s.

7. EVALUATION OF PERFORMANCE AGAINST KEY INDICATORS

The occupational health and safety performance of employees and sub-contractors will be
measured/checked/ recorded against the set objectives and according to schedule. See
Annexure D (Inspections and Audit Schedule)

8. APPLICATION OF THE HEALTH AND SAFETY SPECIFICATION

 Compensation of Occupational Injuries and Diseases Act 130 of 1993 (C.O.I.D.A.)


The letter of good standing will be available on site for reference purposes as proof of
good standing. LEMAY PAINTING AND RENOVATIONS will ensure all Contractors also
comply with the above requirements defined in the COIDA.
A letter of good standing shall be made available on all project/s for the sole purpose of
reference as proof that Lemay painting and Renovations in good standing with or any
compensation fund registered under the Compensation of Occupational Injuries and
Disease Act.

 Legal liability insurance

Legal liability Insurance of R10 000 000.00 has been taken out and a certificate of good
standing is placed in the Health and Safety file.

 Occupational Health and Safety Policy is attached for reference purposes (Annexure
A) this policy statement will be contained in the safety manual and from part of the
induction and yearly re-induction and other training programs.
All employees who form part of the company are important.
They are important to the company and their families.
Every employee has the right to a healthy and safe working environment and has the
right to return home safely every day without injury.
We LEMAY PAINTING AND RENOVATIONS shall all times strive to maintain a safe and
healthy workplace and environment for all
Each and every employee including management is responsible for carrying out his/ her
duties in a safe and healthy manner without injuries to others.

 SAFETY COMMITTEE MEETINGS

A health and safety committee meetings shall be held on a monthly basis with the involvement
of the Principal Contractor and its appointed members to discuss issues of health and safety.
Members of the committee should include the all Safety Personnel and Foremen of the company
assigned to the project. With finding to be communicated back to employees and actioned by
management

• HAZARD IDENTIFICATION & RISK ASSESSMENT (HIRA)

The Safety Professional along with the Management Team and Construction Supervisors shall
prior to the commencement of project perform a hazard identification and assess the risks
involved, a copy of which shall be filed in the company safety manual on the project based on
their findings, a copy of the HIRA shall be made available for viewing to the client. and in the
following matter based on activities to be performed within Lemay Painting and Renovations
(Pty) ltd: Scaffolding, ladders, power tools, Actuated explosive tools, hand tools, heights, P.P.E.,
work environment, erecting and demolishing, noise, dust, packing and stacking, housekeeping,
driven machinery, facilities, wheelbarrows, public safety, firefighting prevention and any other
The Company will ensure that a Hazard Identification prior to the commencement of any
construction work is performed, and the assessed risk shall form part of the health and safety
plan applied on site.

Lemay Painting and Renovations will ensure that all HIRA’s conducted will be
communicated to all personnel and contractors through the site training program and
that these training sessions will be presented by the competent person regarding the
hazard and related work procedures before any work commences. All personnel involved
will sign on the attendance register.

The HIRA Team that will be established will comprise members as follows:
i. Construction Manager
ii. Safety Officer
iii. Risk Assessor
iv. Construction Supervisor
v. Health and Safety Representative

Attached Annexure E, the baseline and Task Identification and format of the Risk
Assessment (RA) are included.

Based on the activities carried out on all projects, hazard investigation and Risk
Assessments (HIRA’s) will be done. Examples of which are, but not limited to:

8.1 METHOD STATEMENT

Method statement form part of the risk Process and will be conducted in accordance with
the Risk Process described above. (Annexure E)

8.2 HEALTH AND SAFETY COMMUNICATION

Toolbox talk Meetings will be held weekly.


Risk assessments will be communicated before work commences. (Thereafter monthly)
Proof of attendance will be on the document itself.
All employees are required to attend weekly toolbox Talk Meetings as specified.
The purpose of these meetings is to communicate basic necessary Health and Safety
measures.
8.3 HELATH AND SAFETY TRAINING/INDUCTION

Training of personnel is a legal requirement and a necessity and is acknowledged as such


The Training planning Matrix shall be provided upon request. (Annexure F)
Special arrangements will be made to ensure all information is achieved

8.3.1 INDUCTION TRAINING

All employees including management entering new project/s shall be required to


sit for health and safety induction presentation along with certified copies of RSA
IDs or passports, valid Medical fitness certificate from an Occupational Medical
Practitioner in the form of Annexure 3
Induction training will be attended at the Client’s premises. All records will be kept
at the Safety file

8.3.2 AWARENESS TRAINING

Awareness training e.g. Toolbox talks shall be conducted to highlight and coach
employees on the risks and hazards on site.
Weekly awareness training will be conducted using Toolbox Talk documents,
which shall be conducted by the site supervisors. (Annexure G)

8.3.3 COMPETENCY

The employee/s or apprentice/s who has been provided with in-house training by
the company for the usage of tools, material, handling and operational
instructions and those tools that he/she is allowed to operate by the team leaders
shall assisted by company letter and signed off the CEO of the company with
further outsourced training to be accompanied. Training shall be identified
through the Risk Assessment Process and conducted through this process will be
kept on file as proof of competency and training that all management,
supervisors, appointed persons, operators of machinery and lifting equipment.

8.3.4 FIRST AID AND HEALTH & SAFETY REPRESENTATIVE TRAINING

All first aiders and safety representatives shall be trained, certified, designated in
writing and declared medical fit to carry out their duties, should they not be
already be in possession of training and have a three year valid certificate of
competency.
All safety representatives elected and designated, including first aiders, will be
trained should they not already be in possession of a valid certificate of training
proving competence.

8.3.5 FALL ARREST EQUIPMENT


Fall arrest and systems involves working at heights where there is a risk of falling
from, off or into. Any person/s working at such a height or higher is to be trained
in the implementation of fall protection, rescue and use of systems, certified and
declared medically fit to do so.

8.3.6 GENERAL
All activities involving suppliers, professionals, management, employees and
office staff that involved within the company’s health, safety, risk, environment
and quality policies and procedures shall be training in all aspects of their duties
putting health and safety at the frontline before commencing any workplace.
8.4 GENERAL RECORD KEEPING

LEMAY will ensure that all the Health and Safety records, required by the Occupational
Health and Safety Act, 85 of 1993 and its Regulations are kept for reference purposes
and auditing, as in accordance with the OHS Act

8.4.1 INTERNAL AUDITS

Internal audits will be conducted a minimum once per month by the part time/ full
time SAFETY OFFICER, as well as the appointed safety consultant. The Results will
be tabled and discussed at the SUBCONTRACTORS / SAFETY meeting. The Audits
to be conducted by the appointed by Safety Officers shall be conducted of the
audit schedule attached as per Annexure D Records of the audits will be
forwarded to the relevant persons and shall be filed on the safety file for
reference purposes.

8.4.2 EXTERNAL AUDITS

External audits will be done by the appointed Client Safety Agent once a month
(Jones Consultants). Results of the audits will be communicated to the employees
and findings corrected within seven days.

8.4.3 STATISTICS

The Safety Officer shall ensure that a monthly DIFR (Disabling Injury Frequency
Rate) is done and is kept on site for inspection by the Principle Contractor or by a
Department of Labour inspector as set out by the Occupational Health and Safety
Act.

8.4.4 GENERAL INSPECTION, MPNITORING AND RECORDING

The company shall keep all records of inspections and investigations undertaken
during the contract for the duration as specified in the Occupational Health and
Safety Act that is up to five (5) years in safe keeping.

8.5 INCENTIVES

There is an incentive scheme but this is based on individual performances.

8.6 PENALTIES

Non-compliance with the client safety specifications can result in work stoppages and
possible expulsion from site until the problem has been remedied including costs

8.7 EMERGENCY PROCEDURES

LEMAY PAINTING AND RENOVATIONS will make available to the Project Engineer a
detailed Emergency Plan to tie into the evacuation plan already in place in the client’s
premises. (Annexure H)

ACTION IN THE EVENT OF AN EMERGENCY

Emergencies are situations involving leakage or spillage of any quantities of petroleum


products, fires no matter how small, bomb scares and explosions.

If an emergency situation arises, the responsible person on-site person raises an alarm
indicating an emergency situation or if you personally detect any emergency situation,
i.e.: product leakage or fire, no matter how small, raise the alarm promptly and report it
immediately to the Responsible Person. In the case of some work sites where a
responsible person may not be available, it is LEMAY’S responsibility to immediately alert
the official authorities, i.e.: police, fire department, etc., if an emergency situation arises.
For that purpose, on arrival at the premises, acquaint yourself with the telephone
numbers of the authorities. After alerting the authorities contact the Anglo – American.

8.8 FIRST AID BOX AND CONTENTS

LEMAY PAINTING AND RENOVATIONS will ensure that all working areas are
adequately provided with first aid attendants whether there are fifty (50) employees or
less engaged on the contract. The First Aid attendant will be trained in accordance with
the requirements set out in the OHSA with recognised and accredited service providers
as defined above.

Proof of training attended (certificate) will be attached to the written acceptance of


appointment. It will be the first aid attendant’s responsibility to ensure the contents of
the first aid boxes are monitored and inspections record on the contents of the first aid
box register.

The first aid box will be adequately stored by the first aider/Supervisor always and will
be accessible to all.
However each contractor who employs more than 5 persons on site will provide their own
first aid box. If more than 10 they will then provide their own first aider

 8.13 ACCIDENT AND INCIDENT REPORTING AND INVESTIGATION

Should an incident occur, the Contractor will immediately submit the necessary claims on
behalf of himself and the employer to the relevant authorities? Copies of all claims and
relevant documentation shall be forwarded to the Engineer. The Project Engineer will be
notified within 12-hours of the occurrence. It is acknowledged that the client reserves
the right to participate in all investigations of accidents or incidents.

When an accident/incident needs to be investigated, the appointed competent Incident


Investigator will conduct the said investigation. The procedure to be followed will be in
accordance with OHSA requirements (Annexure I – Recording and Investigation of
incident form.)

LEMAY PAINTING AND RENOVATIONS will ensure that the results of all investigations
are communicated to the employees engaged through incident recall and prescribed
meetings. The investigations will be kept for record purposes in accordance with the
prescribed requirements set out in the OHSA and LEMAY PAINTING AND
RENOVATIONS’s specifications procedures.

 HAZARDS AND POTENTIAL HAZADOUS SITUATIONS

LEMAY PAINTING AND RENOVATIONS will ensure that all other contractors are warned of
hazardous or potentially hazardous situations, which may prevent them from effectively
performing their duties, which includes the placement of adequate signs. Special risks that may
be encountered during this project are the following:

o Concrete work
o Hazardous chemical substances in cement and additives may give rise to skin irritation
or dermatitis
o Noise and dust (silica) during cutting and breaking
o Use of potentially hazardous plants (grinders, concrete breakers) during cutting and
breaking
o Existing of pumps, pipes and electrical cables
o Brickwork
o Hazardous chemical substances in cement mortars and plasters
o Control of traffic
o Access to the site is from a major road and this will be controlled

 Personal Protective Equipment and Clothing

LEMAY PAINTING AND RENOVATIONS will comply with OHSA requirements to provide PPE.

LEMAY PAINTING AND RENOVATIONS will through the Risk Assessment process identify the
specific PPE needs per activity and then issue the PPE accordingly. (Reference to the OHSA
General Safety Regulation 2 – Employer to provide Personal Protective Equipment)

Should PPE be lost or stolen, then the employee will be issued with a new set of PPE and internal
investigation and corrective actions as per company policy taken.

Should PPE be worn out or damaged, the user shall return to worn or damaged PPE and will be
issued with a replacement set. Training in the use of this will be provided. LEMAY will ensure
that his employees are trained in the use and maintenance of their PPE to ensure effectiveness
of its use.

8.15.1HARD HATS

All employees of LEMAY PAINTING AND RENOVATIONS will wear hard hats in areas where
appropriate hazard notices are displayed. Hard hats will not be painted of holes drilled into it or
otherwise defaced.

8.15.2EYE PROTECTION

Suitable eye protection will be worn in areas where appropriate hazard notices are displayed, or when
working with hazardous chemicals, chipping, breaking, drilling, arc welding, cutting with oxy-acetylene
equipment of similar activities are taking place. Full face shield to be worn when using a grinder.

8.15.3HEARING PROTECTION

Suitable hearing protection will be worn in areas where appropriate hazard notices are displayed, in
areas where noise levels exceed 85 decibels e.g. working with jackhammers, grinding, demolition or
other similar activities.

8.15.4FOOT PROTECTION

All employees of LEMAY PAINTING AND RENOVATIONS will wear undamaged, laced up safety boots
or safety shoes, suitable for the intended purposes, in prescribed areas where appropriate hazard
notices are displayed.

8.15.5HAND PROTECTION

All employees of LEMAY PAINTING AND RENOVATIONS will wear suitable protective gloves in areas
where appropriate hazard notices are displayed or when handling hot or hazardous materials or
chemicals.

8.15.6CLOTHING

All employees of LEMAY PAINTING AND RENOVATIONS will wear long sleeved work suits when
working on site. No loose clothing will be allowed where machines are being used. PPE will be provided
to visitors.

8.16 SECURITY
Only authorised persons will be allowed access to the site. No persons will be allowed onto the site
outside normal working hours with the exception of the necessary security staff.

LEMAY PAINTING AND RENOVATIONS will not allow their employees to visit or trespass on any part
of the premises other than their place of work.

LEMAY PAINTING AND RENOVATIONS will not allow their employees to remove from the premises
anything, including there equipment and employee's own tools.

LEMAY PAINTING AND RENOVATIONS will not allow their employees to use short cuts through the
premises.

LEMAY PAINTING AND RENOVATIONS will not take, firearms or liquor into the premises.

LEMAY PAINTING AND RENOVATIONS is responsible for the safe keeping, distribution and issuing of
drawings and technical information.

8.17 SAFETY SIGNAGES

LEMAY PAINTING AND RENOVATIONS in conjunction with the appointed safety personnel shall
assess the Health and Safety Signage requirement in relation to the Risk Assessments conducted.
Signage will be placed at strategic positions on the site works.

LEMAY PAINTING AND RENOVATIONS will also maintain the signage to ensure its effectiveness
always and under all conditions. Signage, which cannot be repaired, will be replaced.

8.18 ROAD TRAFFIC CONTROL

Road signs will be supplied for the control of traffic where required to the satisfaction of the Client, the
Engineer and the Provincial Authority.

LEMAY PAINTING AND RENOVATIONS will ensure that drivers of CONSTRUCTION vehicles are in
possession of a valid driver’s license and shall produce the license on request.

LEMAY PAINTING AND RENOVATIONS will not permit any driver to be in control of a vehicle at work
while under the influence of any intoxicating substances such as alcohol or drugs.

All vehicles of LEMAY PAINTING AND RENOVATIONS will display a name board bearing the
Contractor’s name. Hired vehicles shall bear an identifying sticker.

8.19 PERMITS

 LEMAY PAINTING AND RENOVATIONS will ensure that access to site works is restricted to
construction personnel.
 All attempts will be made to restrict spectator access.
 Access to the site shall be by Anglo-American authorisation on the prescribed form.
 Special permits for hot work and isolation permits will be applied for the Project Engineer
prior to commencing with the activity.

8.20 CONTRACTORS AND SUPPLIERS

LEMAY will enter into an Agreement with Mandatory in terms of Section 37(2) of the Occupational
Health and Safety Act, 85 of 1993, with all contractors appointed

LEMAY will ensure the contractors are issued with the Client Safety Specification where reasonably
practicable.
Health and Safety Officer will assist and ensure the contractors engaged comply with all of these
requirements and adhere to the requirements set out in the OHSA.
Contractors will be stopped from working in the event of unsafe conditions and activities being
observed.
All contractors shall be covered by THEIR OWN Safety Plan and will be audited by the Health and
Safety Officer

8.21 WASTE AND POLLUTION PREVENTION

All excess waste material from the building will be removed and placed inside the skips. Removing or
empting of skips will be done by appointed service provider and the safety officer will manage the
process. Nuisance dust will be controlled (How? - Dust masks issued to employees)

8.22 SMOKING/ NAKED FLAMES

LEMAY will ensure that all employees are made aware that for the purpose of the contract, designated
SMOKING AREA’S will be identified on site with all necessary requirements and signage. It is each
person's responsibility to ensure that he does not smoke or use naked flames such as matches or
cigarette lighters

9. HEALTH AND SAFETY IN PRACTICE

9.1 Commencement of work

On Client Premises:

LEMAY will not commence with work of any description until in possession of the required valid work
permit issued by Anglo-American

LEMAY is fully responsible, in terms of the OHS ACT and Regulations, for health and safety of its
workforce and for taking the necessary precautions to ensure that all work can carry out under safe
conditions.

On Customer Premises:

LEMAY is fully responsible, in terms of the OHS ACT and Regulations, for the health and safety of its
workforce and for taking the necessary precautions to ensure that all work can carry out under safe
conditions, especially where flammable products may be present creating a risk of fire or explosion.
When in doubt as to the safety of the conditions surrounding the work, ALL CONTRACTORS will report
to the responsible person.

9.2 DEMOLITION

 All demolitions works will be supervised by a competent person, a detailed task based
risk assessment will be conducted, communicated to all person involved before.
 No demolition works will proceed without the approval of Construction Manager together
with the appointed Safety Officer.

9.3 OPENINGS IN FLOORS

All openings in floors will be covered by solid boards to prevent fallings, and clear marking (e.g. warning
signage) will be in place for identification. All areas with openings of more three in one place shall be
barricaded and warning sign prohibiting entrance to be displayed.

9.4 STACKING OF MATERIAL AND HOUSEKEEPING

LEMAY will ensure that all stacking will be supervised by a competent person, and that clearly defined
and allocated storage areas are provided for and identified, and that materials being stored within this
area are stacked in accordance with sound stacking principles of sort-by-sort, access to be maintained,
level surface, and the height will not exceed three times the base width.

HOUSEKEEPING

LEMAY will ensure that CONTRACTORS will not leave any material lying around which can cause
damage to property or injury to person.

LEMAY will not allow material to be thrown or dropped from elevated positions.

LEMAY will not allow the indiscriminate dumping of waste, rubbish or scrap. The site responsible person
will indicate where such material can be deposited prior to removal from the site.

Housekeeping shall be maintained in accordance with the client requirements always.

9.5 Hazardous Chemicals Substances

LEMAY will ensure the necessary training and information regarding the use and storage of HCS is
provided, and that the use and storage of HCS is carried out as prescribed by the HCS Regulations.

Furthermore, LEMAY will ensure that all chemicals brought to site have a Material Safety Data Sheet
(MSDS) and the users are made aware of the Occupational hazards and precautions that need to be
taken when using the chemical.

The Fist Aider will be made aware of the MSDS and how to treat HCS incidents appropriately.

Information of all HCS shall be displayed on where they stored and all persons on site shall have access
to such information.

9.6 PLANT AND MACHINERY

Hired Plant and Machinery


LEMAY will ensure the following criteria are adhered to when considering hired plant and machinery:

 Only approved hire companies shall supply equipment to the site.


 Hired plant will be checked for safety compliance prior to being accepted for use on site.
 Should hired equipment be accompanied by an operator, LEMAY will ensure that the
operator’s competency be verified, have valid medical fitness certificate and the operator
undergoes an induction training session.
 LEMAY will ensure the operators of hired plant attend weekly toolbox talks together with
CONTRACTORS site personnel.

LEMAY will ensure that all operators have the correct PPE when they are on site.

General Machinery
In accordance with Construction Regulation 23 d(i & ii), LEMAY will:

 Ensure a competent person be appointed as defined in the above clause form the
Occupational Health and Safety Act, 85 of 1993 and Regulations, to service and maintain all
machinery in use on site.
 LEMAY will ensure that records are maintained of all services conducted.

Transport of Persons

 No personnel will be permitted to travel on any plant or equipment on the site works.
 Road Safety principals shall be adhered to on and off site.

9.7 LIFTING APPLIANCES

LEMAY will not allow loads to be left suspended from unattended lifting
Appliances.
LEMAY will not permit any untrained, inexperienced personnel to operate lifting
apparatus/gear or carry out lifting operations.

LEMAY will not traverse loads over existing facilities without the consent of the site
responsible person

9.8 MACHINE GUARDING

All power tools and machinery driven by belts, gears, ropes, chains, couplings and similar
devices shall be adequately guarded. LEMAY will prohibit the use of any equipment with a
damaged, missing or inadequate guard.

9.9FIRE EQUIPMENT

LEMAY will ensure that all fire equipment to be used on site comply with the following:

 Extinguishers will be placed in positions to ensure fast and easy access is maintained
always.
 Placement of all extinguishers will be depicted with the required pictograms.
 Extinguishers will be serviced once annually, and after discharge or visible signs of
depressurisation.
 LEMAY will ensure all employees are adequately trained in the safe use of the extinguishers.
 LEMAY will ensure a person is appointed to inspect the extinguishers on a monthly basis
and the results of which are to be entered into a register designed for that purpose.

9.10 WORKING AT HIEGHTS /FALL PROTECTION

Work involving scaffolding and work at heights will comply with the requirements set out in the
Construction regulation 2014 pertaining to these activities with reference to the SANS10085 code of
practice.

Fall protection planning will be done in conjunction with the risk assessment process. A person trained
and deemed fit shall be appointed as a fall protection planner.

All persons working at height shall wear hard hat with chin straps.

Scaffolding

All scaffolds will be erected under the control of a appointed competent scaffold supervisor and erected
by competent scaffold erectors.

False Work/Formwork for Structures

Work involving scaffolding and work at heights will comply with the requirements set out in the
Construction regulation 2014 pertaining to these activities with reference to the SANS10085 code of
practice.

Ladders and Ladder work

The following requirements will be complied with regarding Ladders and Ladder work:
 Ladders will be clearly numbered and inspected on the register provided.
 A competent person shall be identified and appointed as the ladder inspector.
 Ladders will be secured at the top and choked at the base to prevent slipping.
 Proper storage shall be provided for all ladders when not in use.

Working in elevated positions:


o Ensure that all ladders are properly secured or 'footed' before use.

o Ensure that all ladders and scaffold boards are of acceptable design and kept in good
condition.

o Use safety belts and/or other safety appliances when required.

o Always wear a hard hat with chin straps when working on elevated positions.

o Use aluminium ladders on site.

o Ensure that materials (roof sheets, etc.) are securely fastened down at the end of each
day and during windy conditions.

9.11 LIGHTING AND POWER

LEMAY’S sub-contractor will ensure lighting circuits and power circuits are fitted with suitable earth
leakage systems is accordance with the client, which will include the following activities:

 Earth Leakage system will be tested monthly


 Malfunctions will be repaired immediately or replaced
 Lighting will be so positioned as not to interfere with construction activities.

9.12 PORTABLE ELECTRICAL TOOLS

LEMAY will ensure the following procedure is adhered to regarding Portable Electrical Tools:

 Minimum compliance with legislation.


 Only competent persons will be permitted to conduct routine and monthly inspections on the
equipment.
 Persons competent to inspect the equipment shall be appointed in writing.
 Persons who are trained to operate such equipment shall be appointed and will be the only
authorised person to operate the equipment.
 LEMAY will ensure operation of the equipment is in accordance with the approved Risk
Assessment and Safe Working Procedure set out.
 All users shall undergo regular awareness training to ensure compliance.
 LEMAY will ensure that CONTRACTORS use the required PPE and clothing is provided
and maintained.

 LEMAY will not use any electrical hand tool in hazardous areas
 LEMAY will not use trailing leads in the premises without adequate protection. All such
leads shall be fully unwound and visible whilst in use. No joints will be permitted in trailing
leads
 LEMAY will make sure if you use explosive tools in Client's premises that you have got
permission from the site responsible person and/or that you have ensured that you can use
them safely

9.13 HOT WORKS PERMIT

IF these are required Lemay shall authorise it

• Welding, soldering or brazing


• Grinding
• Drilling
• Steel Chipping
• Concrete breaking
• Live electrical work
• Use of electrical power tools

LEMAY will only use contractors deemed competent by an approved training service provider
may issue Hot Work/Confined Space Entry Permits. Contractors are to be authorised by the client
to issue Hot Work/Confined Space Entry Permits.

9.14 PUBLIC HEALTH AND SAFETY

In the interest of public safety, LEMAY will ensure that all persons who may be affected by the work
being conducted on site are informed and kept aware of the dangers, which may arise from the work
being conducted on site.
The awareness will be in the form of posters and inductions for visitors to site and warning signs.
Hoarding will be erected to form a physical barrier between the works and persons other than
contractor and sub-contractor employees

9.15 NIGHT WORK

No night work is expected on this project at this stage, should it be required the following will be
adhered to:

 Sufficient lighting
 Regular breaks
 Extra risk assessments and safe work procedure for night work activities.

9.16 FACILITIES FOR SAFE KEEPING / EATING AREAS

LEMAY will provide the following welfare facilities to their employees:

 Toilets.
 Changing rooms
 Hand wash facility
 Drinking water

NB: These facilities are located on 7th floor.

Waste bins will be strategically placed on Ferreira Street and emptied regularly.

9.17 DO’S AND DON’T’S FOR CONTRACTORS

The following is a brief summary of rules and regulations that will apply to work done on the clients or
on Client's premises. Particular emphasis is placed on safety, accident and anti-pollution prevention
procedures.

LEMAY will comply with the Rules and Regulations in all respects as failure to do so may result in the
cancellation of contracts and/or legal action by the Chief Inspector, Occupational Health and Safety, in
the Department of Labour.

1. General:

1.1 LEMAY will make sure that you all are fully conversant with the OHS ACT and Regulations as
amended. The relevant sections of this Act govern work on client or Client’s premises.

1.2 LEMAY will make sure that all employees observe the provisions of the OHS ACT and client
contract requirements or special Rules and Regulations in accordance with the conditions of
Contract.

1.3 LEMAY will comply with the provisions of the Compensation for Occupational Injuries and
Diseases Act (COID Act).
1.4 LEMAY will provide their employees with approved safety hats, safety-boots, protective
clothing, goggles, safety belts and any other safety equipment deemed necessary, which must
be worn at all times when dictated by work conditions or regulation.

1.5 Personal hygiene will be encouraged among the staff. Some petroleum products, as well as rust,
sludge, etc., coming in contact with the skin or clothing may be highly toxic and must be washed
off to prevent dermatitis. This is particularly so in the case of gasoline with lead compounds,
solvents and other petroleum derived products. LEMAY will provide their employees with
adequate protective equipment.

1.6 LEMAY will encourage their employees to use skin barrier creams and hand cleaners as contact
of the skin with petroleum products may cause a serious inflammatory condition called
dermatitis.

1.7 LEMAY will keep their working areas neat and tidy, and clean up after the job.

1.8 LEMAY will provide their own tools and equipment, which will at all times be maintained in good
working order.

1.9 LEMAY will ensure that any employees apparently under the influence of alcohol or drugs are not
permitted on the premises.

1.10 LEMAY will ensure that any theft, accident or unusual occurrence is reported to the site
Responsible Person immediately.

9.17 TEMPORARY STRUCTURES:

LEMAY will ensure complete safety of the work and personnel through all
stages of construction, demolition or revamp.

LEMAY will ensure adequate protection of temporary or uncompleted


structures against damage.

9.18 OHS ACT RESPONSIBILITIES:

Further in terms of Section 37(2) of the Occupational Health and Safety Act 85 of
1993 (the Act) it is hereby agreed that:

In terms of this Section, LEMAY will be responsible for the full and
Proper implementation of the terms and provisions of the Act and its regulation in
The area of which the work is to be undertaken for the.

LEMAY will be responsible for the well being, in relation to health and
Safety, of all persons coming upon/into such area in accordance with that regulation,
Subject to any directives issued by management of the company.

The work to be done is as described in this document.

LEMAY will undertake to report any hazard to


Health and safety which exists or arises during the contract work in the area
Concerned and over which the contractor will have no control.

LEMAY will issue all necessary and appropriate safety/health equipment


To all persons working or coming into the area.

Fall Protection Plan


1. Goal:

The goal is to eliminate the risk of falling from heights and safe guard workers and
objects from falling from heights

2. Philosophy:

The falling protection plan aims to prevent incidents that are often seriously disabling or
fatal. Hazard training is no substitute for falling – some unusual activity or occurrence
may cause the person to take up or be put into an unusual position.

3. Policy:

It is the policy of LEMAY to provide protection over all hazardous areas where the
possibility of falling exists. Where this is impractical because of the nature of the work
conducted on heights, some other suitable means of protecting shall be provided

4. At all times it will be ensured that:

4.1 All Unprotected openings in floors, edges, slabs, hatchways and stairways are
adequately guarded, fenced or barricaded or that similar means are used to
safeguard any person from falling through such openings;
4.2 No person works in an elevated position, unless such work is performed safe as if
working from a scaffold or ladder;
4.3 Notices are conspicuously placed at all openings where the possibility exist that a
person might fall through such openings;
4.4 Fall prevention and fall arrest equipment is –
1. Suitable and of sufficient strength for the purpose for which is being used
having regard to the work being carried out and the load including any
person, it is intended to bear, and
2. Securely attached to a structure or plant and structure or plant and the
means of attachment thereto is suitable and sufficient strength and
stability for the purpose of safety supporting the equipment and any
person who is liable to fall (life line);
4.5 Fall arrest equipment shall only be used where it is no reasonably practicable use
fall prevention equipment; and
4.6 Suitable and sufficient steps shall be taken to ensure, as far as is reasonably
practicable, that in the event of a fall by any person, the fall arrest equipment the
surrounding environment does not cause injury to the person.

5. PROCEDURE AND REGULATIONS:

1. Ladders
 See that the ladder cannot slip
 Ensure ladders are tied near the top
 Keep rungs and footwear clean
 Use both hands when climbing or descending
 Ladders staked, to prevent slipping outwards and sideways
 Set ladders at the correct angle, 300mm out to every 1,200mm up
 Always check ladders before and after use, report any defects immediately
 Never use a make-shift ladder
 Do not use ladders with cracked or broken rungs or other defects
 Do not overreach from a ladder – always move it
 Do not stand a ladder on a drum or box or other unsteady bases
 Never overload a ladder, or support it by its bottom rung on a plank
 Do not use ladders that are too short

6. Scaffold: Scaffold Specifications

All scaffolding used on site will be erected in accordance with


SANS 10085-1-2004

6.1 Tube Scaffolding


Completely self-supporting tube scaffolding according to supplier’s specifications
with adequate provision for handrails, toe-boards and bracing.

6.2 Multiple Towers


When more than one tower is required, such towers should be interconnected with
stabilising bars.

7. Scaffold Platforms

7.1 Every platform is boarded in such a manner that materials and tools are prevented
from falling through.
7.2 When working level exceeds 2m above ground level, handrails, at least 900mm high,
but less than 1 100mm high must be provided, with toe-boards on all sides at least
150mm high.
7.3 Working platforms should be kept free from waste and other obstructions and
maintained so as to be non-slippery.
7.4 No other platform can be used on the working platform.
7.5 Convenient and safe access must be provided to every platform and if ladders are
used, they should be firmly supported at the base, secured at the top and extend at
least 900mm beyond the top of the platform.
7.6 Board supports must be placed at 2m intervals.

8. Working on Scaffolding

8.1 Do not remove or interfere with the scaffolding in any way –


Especially ties, guardrails, toe-boards and ladders. Alterations to
Scaffolding should only be made by authorised persons.
8.2 Do not use a scaffold while it is being erected or dismantled or in
Any way incomplete. Look out for warning notices.
8.3 Report any deficient scaffolding as soon as possible.
8.4 When stacking materials, always leave passageway at least two
Boards wide for other people to pass.

8.5 See that materials are always properly stacked and not in danger
Of falling. Erect brick guards where required.
8.6 Do not overload a scaffold. Position stacks at the standards, not
Between them.
8.7 Do not leave tools or materials lying around on platforms.
8.8 Materials should never be thrown, tipped or dropped from
Heights; they should always be lowered or disposed of through a
Properly constructed chute.
8.9 Never climb up or down scaffolding. Always use the ladders or
Stairs provided.
8.10 Ensure that ladders are properly secured at the top and bottom.
8.11 If a ladder has any rungs missing or split, report this to your
Foreman and see that it is replaced. Do not climb the ladder.
8.12 Ladder rungs should not be used to support either the ladder or
Run-up boards for carriers
8.13 All ladders giving access to scaffolds or elevated areas must,

HEIGHTS: AT 3 METERS OR HEAD HEIGHT AND ABOVE FALL PROTECTION MUST BE USED

on WCL 22 to the Compensation Commissioner within 14 days of diagnosis/exposure (section 24 incidents)
