TITLE OF THE CAUSE:

Application for Mental Stability/ Disorder Test Of The

Respondent And File The Report In The Court

MAY IT PLEASE YOUR HONOUR:

1. The Respondent above-named has been attending the

captioned matter since 2016 before the Hon’ble Court at

Thane, which was subsequently transferred to the Hon’ble

Court at Belapur in 2023.


2. The Petitioner has been filing numerous applications,

including those seeking Brain Mapping and warrants for the

children. Additionally, the Petitioner has threatened the

Respondent in the presence of the Court-appointed

Counsellor, stating that he would kill himself as well as the

children if the matter were to be decided against him or if the

court proceedings did not favour him.

3. The dispute has been initiated solely by the Petitioner, based

on baseless allegations that the Respondent is involved in an

extramarital affair with her colleague. The Petitioner has

failed to provide any proof or evidence to support these

allegations. The only instance referenced by the Petitioner is

that the Respondent received a gift from her colleague upon

the birth of their new-born baby. This incident has been

exaggerated by the Petitioner, and he has unjustly subjected

the Respondent to mental harassment and legal terror in an

attempt to compel her to prove her innocence. Such actions

reflect the Petitioner’s unhealthy mentality and irrational

behaviour.

4. The Petitioner’s conduct demonstrates signs of mental

instability and disorder, which is yet to be medically and


legally established. It is in the interest of justice that the

Petitioner’s mental stability be assessed by a qualified

medical practitioner. It is increasingly challenging for the

Respondent to attend court proceedings due to the

Petitioner’s erratic behaviour. Moreover, the Petitioner has

already authored a suicide note dated 16/07/2017, further

highlighting the urgent need for a mental health assessment.

5. In light of the foregoing circumstances, it is most respectfully

prayed before this Hon’ble Court as follows:

5.1Direct the Petitioner to cooperate with the Respondent for the

production of a comprehensive mental health report, specifically

addressing the Petitioner’s mental stability.

5.2Direct or recommend a qualified medical practitioner or mental

health expert who can evaluate the Petitioner’s mental stability

and furnish a detailed report to both the Respondent and this

Hon’ble Court. Alternatively, this Hon’ble Court may appoint

an appropriate expert or authority for the same purpose.

5.3Order that the court proceedings be stayed until the submission

of the Petitioner’s mental health report, after which the

proceedings may continue accordingly.


5.4Pass any other orders as this Hon’ble Court deems just, fair, and

proper in the facts and circumstances of the present case.
