LEAVE AND LICENSE AGREEMENT
This agreement is made and executed on 25/01/2025 at Kalyan Between,
1) Name: Mr. Akshay Suresh Darekar, Age - 30 Years, Occupation: Service, Pan
No. BXVPD9164P Indian inhabitant having his registered residential address at
B Wing, Room No. 4, Apurva Park, Ground Floor, Adharwadi Chowk, Kalyan
West, Dist. Thane, Maharashtra 421 301.
HEREINAFTER called the Licensor (which expression shall mean and include the
Licensor above named and also his/her/their respective heirs, legal heir's
successors, assigns, executors and administrators)
AND
1) Name: Mr. Alok Anil Pandit, Age - 39 Years, Occupation - Service, Pan No.
AVHPP5455E Indian inhabitant having his residential address at A/403,
Bhaskar CHS, Murlidhar Ali, Gavdevi Chowk, Kalyan (West) Thane, Maharashtra
- 421 301
2) Name: Mrs. Aaradhya Alok Pandit, Age - 39 Years, Occupation - Service, Pan
No. APZPV2729P Indian inhabitant having his residential address at A/403,
Bhaskar CHS, Near Gaondevi Mandir, Gaondevi Chowk, Kalyan (West) Thane,
Maharashtra - 421 301
HEREINAFTER called the Licensee (which expression shall mean and include
only the Licensee above named).
WHEREAS the Licensor is the lawful owner of Building No. A1, Room No.
1406, 14th Floor, Sai Sharnam CHS Ltd., Near KDMC School, Wadeghar
Villege, Kalyan (West), Thane, Maharashtra 421 301 and is presently in use,
occupation, exclusive possession and enjoyment of the said premise AND
WHEREAS the Licensee is in need of the residential accommodation and has
requested the Licensor to allow him/her to occupy the above referred premises
on Leave and License basis for a temporary period of eleven (11) months.
AND WHEREAS the Licensor on the specific request and undertaking of the
Licensee to vacate the said premises definitely on the expiry of the period of
eleven months, has agreed to do the same on the terms and conditions here
under mentioned.
NOW THEREFORE IT IS HEREBY AGREED TO DECLARED AND RECORDED BY
AND BETWEEN THE PARTIES HERETO AS FOLLOWS:-
(1) That the Licensor is the owner/ allottee of the Building No. A1, Room No.
1406, 14th Floor, Sai Sharnam CHS Ltd., Near KDMC School, Wadeghar
Villege, Kalyan (West), Thane, Maharashtra 421 301 (hereinafter referred
to as the 'SAID PREMISES')
(2) The said Licensor hereby allows the said Licensee to occupy the said premises
on the basis of Leave and License or the period of Eleven (11) months
commencing from the date of this agreement viz 25/01/2025 to 24/12/2025
(both days inclusive).
(3) That the said Licensee shall pay to the Licensor a sum of Rs.12,500/-
(Rupees- TWELVE THOUSAND FIVE HUNDRED Only) as and by way of
monthly RENT for the use and occupation of the said premises to be paid from
first 1 - 10 days of every month. And the same will be collected at the SAID
PREMISES or at any place mutually agreed by both the parties.
(4) It is expressly agreed that the Licensor shall be deemed to have the ultimate
control and full control over the possession of the said premises and the
Licensee shall not claim any right by way of sub-tenancy or any other right in
any manner whatsoever in the said premises.
(5) It is also agreed that the Licensee is occupying the said premises for
temporary period of Leave and License basis and it does not create any right,
title and interest in the said premises by way of sub-tenancy or tenancy or
otherwise. The License hereby granted to the Licensee is revocable and non
transferable one, which is to terminated on expiry of eleven (11) months as
stated hereinabove or earlier, subject to the terms and conditions as laid down
in this agreement.
(6) It expressly agreed that the Licensee shall use the said premises only for his/
her personal use and not for or any other purposes and/or not for storing any
unauthorized stock or material and or for any illegal purpose/s.
(7) That the Licensor hand over one Lock and key, one safety door key, one main
door key and one bedroom key and the same shall be returned to the Licensor
as soon as the terms of the Leave and License expire, terminated or any time
before the Licensee vacate the said premises and if any of the above lock and
keys are damaged or lost the cost of the damages or loss will be bear by
Licensee only.
(8) It is also agreed that the Electricity Bill of the said premises will be paid by
the Licensee only and such duly paid bills will be submitted to the Licensor for
his/her information and record.
(9) It is also agreed that the Gas Bill and maintenance cost of Gas Stove of the said
premises shall be paid by the Licensee only and such a duly paid bills will be
submitted to the Licensor for Information and record.
(10) It is also agreed that the EMI of Gas Connection is to be paid by the Licensor
Only.
(11) It is also agreed that the Licensee shall pay the parking charges ie. Rs. 50 for
two wheeler, parking space is used by him/her and the Licensee shall give the
copy of its Vehicle's Document to the Licensor. if the documents are not given
by the Licensee to the Licensor, the Licensee wont be allowed to park its
Vehicle in the society premises provided by the Society.
(12) This License Agreement and the use of the licensed premises hereby
allowed is and shall always be construed as per and governed by the provisions
of Section 24 read with Chapter VII of the Maharashtra Rent (Control) Act,
2000 as amended upto date shall and this Agreement shall be conclusive
evidence of the facts mentioned herein The Licensee shall not be entitled to
challenge the jurisdiction of the Competent Authority constituted under the
aforesaid Act in any manner whatsoever. The Licensee hereby confirm that
they are not entitled to protection under any of the provisions of the Act and
agree and undertake not to claim any protection thereunder (notwithstanding
any new law change in law or judgment, decree or order of any court).
(13) The Licensee shall deposit with the Licensor on or before execution of this
Agreement, a sum of Rs. 50,000/- (Rupees Fifty Thousand only) being the
Security Deposit, FREE OF INTEREST, which will be returned to the Licensee
on the expiry of this agreement or on notice of one month in advance for
vacation of premises and against vacant and peaceful possession of the said
premises, after deducting the cost of the damages, if any, to the fixtures /
fittings and outstanding Electricity Bils/Telephone Bills, if any.
(14) The Licensee will not make any structural alterations/ repairs/ modification
in the said premises without the written consent of the Licensor/Society.
However, he/she is allowed to carry out colour wash in the said premises as
per his/her choice and cost. During the expiry of said period the licensee shall
keep the said premises as it is as it was handed over to him
(15) That the Licensee shall not do anything which is not permissible or is
prohibited under law or is in contravention of bye-laws, rules and regulations
of Co-operative Housing Society Ltd., or any orders of Central/State
Government/s or local authorities. Also shall not store any narcotic such a
liquor, bhang, RDX, crackers or any type of fire arms etc. which are prohibited
by any laws of the government and the Licensee shall not allow any people or
immoral reputation or allow any immoral reputation or allow any immoral
business in the premises.
(16) The Licensee, his/her family members, servants and agents will abide by the
rules and regulations for the time being in force of the said Society. Where the
said premises are situated.
(17) That the Licensor or his agent got every right to inspect the said premises at
any time for which the Licensee shall have no objection whatsoever.
(18) That the day to day and minor repairs such as fuses, leakage of water taps,
maintenance etc. to be done by the Licensee at his/her own cost. The Licensee
further hereby agrees and confirms that in case of any breakage, damage, loss
to existing fittings/fixtures in the said premises, he/she shall make good these
articles and/or repay the cost of the damage incurred to these articles as my be
mutually decided by parties hereto.
(19) The Licensee hereby admits and acknowledges that it is the express intention
of the parties to this agreement that the relationship of the landlord and tenant
shall not be deemed to be created hereby or otherwise between them under
any circumstances whatsoever. This agreement merely confirms bare
permission of Leave and License and does not create any interest into or upon
the said premises s or any part thereof in favour of the Licensee. It is not
intended by this Agreement to create any lease/s or any part thereof in favour
of the Licensee. It is not intended by this Agreement to create any lease sub-
lease or any other Rights, Titles and Interests into or upon the said premises in
favour of the Licensee and the Licensee hereby agrees that under no
circumstances the Licensee shall claim any right to tenancy, sub-tenancy or any
other right to any nature into or upon the said premises.
(20) The Licensee shall give one month prior notice to licensor before vacating
the premises and the licensor shall give one month prior notice to Licensee if
he have to vacate the said premises.
(21) The Licensee hereby agrees to hand over the mail that may be received at the
abovesaid premises to the Licensor without any delay.
(22) That notwithstanding anything hereinabove contained to the contrary, if the
Licensee fails to use the said premises for bonafide residential purposes,
and/or commits any breach of the terms and conditions of this Agreement,
then on happening of any such events, the Licensor shall have the right to
withdraw, terminate, and revoke.
(23) This Leave & License Agreement shall be subject to jurisdiction of Courts in
the City of Kalyan, Maharashtra, India
IN WITNESS WHEREOF the parties hereto have hereunto set and
subscribed their respective hands on the day and the year first
hereinabove written:

I Mr. Akshay Suresh Darekar RECEIVED from the within named LICENSEE, a
sum of Rs. 50,000/- (Rupees Fifty Thousand Only) being the SECURITY
DEPOSIT, FREE OF INTEREST, to be returned at the time of vacation of the
abovesaid premises, as mentioned in Clause No. 13 hereinabove.
