I want to ensure that each and every one of my students is successful on district and state assessments as well as prepared for college and
the work force. ( Life outside and after high school)
2. How will ( do) you find out about students' attitudes and feelings about your class?
Every student is free and has the right to voice their opinion in an organized fashion to the teacher about the instruction and classroom
management. I will also personally always ask for feedback regarding how the class is functioning for everyone throughout the year.
Honestly, at this point in my teaching career I have a fairly good idea of what teaching work and which do not. However I do
understand that every individual and every individual classroom is unique and may need a different strategy than the norm or what I' m
accustomed to.

The Office of Human Resources has received service records verifying your previous creditable
experience. Based on records now on file, your salary is being adjusted to reflect credit as
follows:
If you submit service records verifying additional years of creditable experience, any resulting
change in salary will be applied retroactive to the beginning of your appointment for the
current school year. However, such documentation must be received in the Office of Human
Resources by no later than June 30, 2013. Service Records received after this date will be

for the same assignment in the prior school year. This 3% salary increase is NOT

Re: Request for Attorney General Opinion Pursuant to Texas Government Code,
Section 552.101, 552.107; AG Letter; #R000208-091824
On September 18, 2024, the Austin Independent School District (“the District” or “Austin ISD”)
received a Public Information Act request from Crissie Ballard for records pursuant to the Texas
Public Information Act. This request is attached and marked as Exhibit A.
The District is currently withholding access to responsive documents it believes are excepted
from disclosure. Accordingly, the District seeks a determination from your office as to whether
this information is subject to public disclosure under the Texas Public Information Act, Chapter
552 of the Texas Government Code. The responsive documents are attached as Exhibits B-E.
This request is timely filed. The original request for information was received by the District on
September 18, 2024 after business hours. Therefore, the tenth business day following receipt of
the request is October 3, 2024.
The Texas Education Code section 21.355 states that “[a] document evaluating the performance
of a teacher or administrator is confidential.” The Attorney General’s office has interpreted this
section broadly, deciding that it protects any document evaluating the performance of a teacher
or administrator under the ordinary meaning of the words. Open Rec. Dec. No. 643(1996); Open
Rec. Ruling 2010-12342.
The Attorney General’s office has determined that for purposes of section 21.355, the word
"teacher" means a person who is required to and does in fact hold a teaching certificate under
subchapter B of chapter 21 of the Education Code or a school district teaching permit under
section 21.055 and who is engaged in the process of teaching, as that term is commonly defined,
The documents attached as Exhibit B evaluate the performance of Ramon Nazario. The District
further argues the documents in Exhibit B contain specific information evaluating Mr. Nazario
in his capacity as a teacher, which this section of the education code is deemed to protect and
keep confidential. As stated above, the Attorney General’s office has interpreted this to apply to
any document evaluating the performance of a teacher or administrator. Because public school
teacher and administrator evaluative documents are granted statutory confidentiality under Texas
Education Code 21.355, the District is of the position that release of the performance evaluations
is not required at this time. Please see Exhibit C attached for Mr. Nazario’s certification. He is a
certified teacher and was acting within his professional capacity as a teacher when his
performance was evaluated. Although Exhibit C is public information, it was not part of the
request.
Section 552.107(1) excepts from disclosure "information that the attorney general or an attorney
of a political subdivision is prohibited from disclosing because of a duty to the client under the
Texas Rules of Evidence or the Texas Disciplinary rules of Professional Conduct.” In Open
Records Decision No. 676 (2002), the Attorney General interpreted section 552.107 to protect
the same information as protected under Texas Rule of Evidence 503.
Thus, the standard for demonstrating the attorney-client privilege under the act is the same as the
standard used in discovery under Rule 503 and requires that the governmental body demonstrate
the necessary facts to demonstrate the elements of the attorney-client privilege. Open Records
Decision No. 676 at 6. Specifically, the governmental body must demonstrate that: (1) the
information constitutes or documents a communication; (2) the communication was made to
facilitate the rendition of professional legal services; (3) the communication was between or
among clients, client representatives, lawyers, and lawyer representatives; and (4) the
communication was and has remained confidential. Open Records Decision No. 676 at 7-11.
In this case, the information contained in Exhibit D consists of employee relations records for
Ramon Nazario that are to remain confidential according to the last page of the agreement
(Exhibit E). The District has not disclosed the excepted information to third persons or
otherwise waived its attorney-client privilege with regard to the information. Therefore, the
information is excepted from disclosure under section 552.107.
Conclusion
We believe that the responsive documents in Exhibits B-E may be withheld in its entirety from
this requestor under the Public Information Act, Texas Government Code Chapter 552 at this
time for the reasons cited herein. On behalf of Austin ISD, I respectfully request that the
Attorney General’s office render a decision in support of the position that the document be
withheld and determine that the information requested is not subject to disclosure.
