VIKAS SARMA aged 31Years, S/o Aricarevula Srinagesh, (Aadhar No.6946
2467 7719) (PAN No. BEEPA1498H) residing at Flat No 15A, Tower 6, Beverly
park, Sector-14,Opp:IndiraGandhiCollege,Koparkhairane, Navi Mumbai,
Thane, Maharashtra-400709 hereinafter called the “PURCHASER” which
term wherever the context so occurs shall mean and include his legal
representatives, administrators and assigns:
WHEREAS the Vendor is the absolute owner of the Agricultural Dry Land
measuring Ac.45.00cents or 18.225 Hectors covered by [Link].2/9 of Relli
Revenue Village, Appannadorapalem Panchayat, Kothavalasa Mandal,
Vizianagaram District, which was contributed as capital vide partnership
deed dated 15-3-2010 by its partners namely [Link] Reddy,[Link]
Lakshmi,[Link], [Link] and [Link], who have purchased the lands
under 6 Sale Deeds vide document Nos. 2917/2009, 2918/2009, 2916/2009,
2915/2009,2914/2009,2919/2009 respectively from their respective owners
and registered in the office of the Sub Registrar, Kothavalasa. Subsequently
the partners entered in to a Development Agreement with Power of Attorney
with Visakha Valley Resorts & Estates Pvt., Ltd herein after called the
Developer, on 23rd September, 2011 for development of the land of
Ac.45.00cents and the said Development Agreement with Power of Attorney
was registered as Document No.3976/2011 in the office of the Sub Registrar,
Kothavalasa. Subsequently
Document No.3976/2011 was rectified and registered as Document No.:
1245/2016 Dated 02.03.2016, in the office of the Sub Registrar, Kothavalasa
adding the Vendor as the owner of the land.
And whereas the Vendor has entered into Supplement Agreement on Dt. 02-
03-2016 registered as Document No.1246/2016 in the office of the Sub
Registrar, Kothavalasa demarcating the Vendor share 121 Plots in Zones 5 in
the plan attached with the said Supplement Agreement and the remaining 46
plots in zone-5 belongs to Developer.
And whereas the Vendor and the Developer converted the Zone-5 in the
name “KOHINOOR HILLS” into Layout and got it approved by VUDA vide
[Link].57/2015 and the Vendor intends to sell the Plots in the said Zone to
the intending purchaser.
And WHEREAS, the Purchaser herein, is interested in purchasing Plot No.
158 measuring [Link] in Zone-5 in the name of KOHINOOR HILLS
which is more fully described in the Schedule hereunder and hereinafter

referred to as the Schedule Property from Vendor and negotiated with them
and finalised the transaction.
Accordingly the Vendor has agreed to sell the Schedule Property and the
Purchaser herein offered to purchase it for a total sale consideration of
Rs.7,50,000/-(Rupees Seven Lakh fifty Thousand Only) which offer the
Vendor has accepted as fair, reasonable and reflecting the true and correct
market value prevailing in the locality and agreed to sell the same to the
Purchaser.
Whereas the Purchaser has paid the total sale consideration of Rs.7,50,000/-
(Rupees Seven Lakh fifty Thousand Only) to the Vendor in the following
manner:
Rs. 4,80,000/- : Paid by way of Online Account Transfer RTGS No.
ICICR12023121501406978. Dt. 15.12.2023 to VIJAYA LAKSHMI ENTERPRISES

Rs .20,000/- : paid by way of Online Account Transfer Reference
No:CLO5987584. Dt. 20.12.2023 to VIJAYA LAKSHMI ENTERPRISES (A/c No.
860220110000369)

Rs.2,50,000/-:Paid by way of DD payment of ICICI Bank with DD No 500639,

Now this deed of Sale Witnesses.


1. That in consideration of payment of Rs.7,50,000/-(Rupees Seven Lakh
fifty Thousand Only) paid by the Purchaser to the Vendor in the
aforesaid manner the receipt of which the Vendor hereby acknowledged.
The Vendor hereby sells, conveys, transfers and assigns unto the
Purchaser all its rights, title and interest, claim and demand whatsoever
in the schedule mentioned property and delivers vacant possession
thereof to the Purchaser at the time of execution of this deed, to hold the
same with absolute rights of sale, mortgage, gift etc., forever free from all
encumbrances, together with all water sources, privileges, easements,
appurtenances belonging to or appurtenant thereto.
2. The Vendor hereby assures the Purchaser that the said property is free
from all encumbrances and all kinds of mortgage, charges, agreements to
sell, court litigations and any other statutory charges.
3. The Vendor further covenants with the Purchaser that knowingly or
otherwise it has not caused or allowed any distress to be levied on the
said property.
4. The Vendor further assures the Purchaser that it has got a clear, effectual
subsisting and marketable title to the said property and absolute
authority to sell the same in the manner aforesaid.
5. The Vendor further covenants with the Purchaser that if there remains
any undisclosed and undischarged liability in respect of the said
property, then he shall clear the same and the Purchaser is free
therefrom.
6. The Vendor further agrees to indemnify the Purchaser and keep them
free from disputes if any raised or objections made to this conveyance by

any one and further should any claim be made or dispute raised at
anytime
by any one in regard to this sale, the Vendor hereby undertakes that he
shall at his own cost settle the same and execute or cause to be executed
such further acts, deeds and things as to more fully effectively convey
title to the property hereby sold and conveyed to the Purchaser.
7. The Vendor also assures the Purchaser that if there remains any liability
of tax or taxes for the said property to the Panchayat, or other
government or statutory authorities up to the date of this conveyance,
the Vendor shall clear the same and in case the same are collected from
the Purchaser the Vendor shall reimburse the same to the Purchaser.
8. The Vendor further assures and covenants with the Purchaser that the
Purchaser and his heirs in interest are entitled to peacefully and
absolutely enjoy the said property without let or hindrance from any
person claiming through them or in trust for them.
9. The Purchaser is hereby entitled to get the said property transferred in
his name in all Panchayat and other statutory records and enjoy the
same with absolute rights for ever. This is not an Assigned Land.
