An-Naẓm Al-Bayyin fi’l-Fiqh Al-Mutaʿayyin

Translator’s Introduction
‫سم اﷲ ا ﺮ ن ا ﺮﺣيم و ه ستع‬

This is an English rendition of the poem ‘An-Naẓm Al-

Bayyin fi’l-Fiqh Al-Mutaʿayyin’ penned by Shaykh Dr. ʿĀmir
Bahjat (may Allah preserve him), which addresses
furūḍu’l-ʿayn, i.e., individual obligations which are
incumbent on every Muslim to know. This poem is from
the most succinct and accessible in Ḥanbalī
jurisprudence, ideal for beginners due to the simple
language employed by the Shaykh. I hope that this
translation serves as a helpful primer for those preparing
to delve into classical books of the madhab. I have
attempted to convey the meanings from the source text in
a straightforward manner whilst adhering to the structure
of the poem, and without dri ing too far from literal
equivalence. I relied extensively on the author’s own
commentary, Bidāyat Al-Dayyin bi-Sharḥ An-Naẓm Al-
Bayyin, in order to understand the source text correctly. I
further added annotations from this explanation, as well
as various other books of the madhab to clarify difficult
lines only when deemed necessary. For teachers or
students revising this text, useful appendices are provided
at the end. As with many law manuals, this poem is highly
concise in its wording and requires the guidance of a
qualified teacher to fully conceptualise the issues
mentioned therein correctly. Shaykh ʿĀmir Bahjat’s own
lessons, as well as those of Ustādh Abu Taymiyyah in the
English language, are available online. I have further
included the original Arabic text for those who wish to
memorise it.

dropped by forgetfulness in this case, and both are obligatory.”
(Bidāyat Al-Dayyin bi-Sharḥ An-Nadhim Al-Bayyin, p.7)

bodily passages, not a small amount, so it is not nullified except if it 6
is urine or faeces.” (Bidāyat Al-Dayyin bi-Sharḥ An-Nadhim Al-Bayyin
p.7). Examples of najāsah exiting the body include vomit, pus or
blood. (See Ḥāshiyah Akhṣar Al-Mukhtaṣarāt, p.79).

27
[TN:] An example of incomplete possession is waqf which is
designated to other than an individual, such as waqf designated for
the poor. Zakāh is not obligatory in such a case due to missing the
condition of complete possession. (See Bidāyat Al-Dayyin bi-Sharḥ
An-Nadhim Al-Bayyin, p.20)
28
[TN:] That which comes out of the earth consists of 1. Seeds and
fruits, 2. Precious metals, 3. Honey, 4. Buried treasure. (ibid, p.21) 15
29
[TN:] i.e., the offspring of freely grazing animals. The date on which
zakāh is due on the offspring is the same as the aṣl (i.e., the group of
animals from which the offspring originates from), provided that the
aṣl has reached the nisāb. (ibid.)

scholars] explained it as: That which wavers between two
possibilities, and neither are more apparent than the other.” (Al-
Fawāʾid Al-Muntakhabāt, 2/662). The ġharar sale has various forms
such as the sale of fish while in water, or milk while in the udder, or a 20
