2004 PSC to 2007 PSC batch including A/T Assistant Executive Engineers of
Zones I to VI prepared in accordance with Hon'ble High Court orders dated
22.11.2019 in W.P. No. 37131 of 2017 and batch of WPs – Objections Submitted

With reference to the Engineer-in-Chief Circular Memo 4 th cited,


I, G. V. Ganesh Babu, (D.O.B. 27 -08 -1976, EMP ID - 1409286) Deputy Executive
Engineer (zone-II), working in O/o. Chief Engineer, Central Designs Organisation,
Vijayawada, submit that the provisional seniority list kept in website contains several
irregularities and the following few lines for consideration and taking necessary action.

In the presidential order vide reference 1 st cited, Reservation in the matter of


Direct Recruitment 8 (3) which reads as follows:

60 % of the posts to be filled by direct recruitment at any time in


any local cadre under the State Government comprising posts belonging to
the categories of Tehsildars, Assistant Executive Engineers, Assistant
Agricultural Officers, Inspector of Police and Motor Vehicle Inspectors shall
be reserved in favour of local candidates in relation to the local area in
respect of such cadre.
In the reference 2nd cited, paragraph 3 of Annexure III of Procedure for
Implementation of the Reservation in favour of Local Candidates provided under the
Andhra Pradesh Public Employment which reads as follows:

The number of posts reserved in favour of local candidates in


relation to the local area in respect of each category of post in each of the
local cadres shall be determined ; this number in each case being the
prescribed percentage, applicable to the relevent category, of the vacant
posts to be filled by direct recruitment in respect of that category any
fraction of a post being counted as one ; provided that there shall at least
be one post left un-reserved in each such cadre.

Further, the Government of Andhra Pradesh amended the procedure prescribed


in Annexure III of G.O. vide reference 3rd cited and which reads as follows:

"3: The provisional list shall be divided into two parts. The first
part shall comprise 40% of the posts consisting of combined merit lists of
locals as well as non-locals and the remaining second part shall comprises
the balance 60% of the posts consisting of locals only and the posts shall
be filled duly following the rule of reservation."

It is submitted that there was no General Recruitment in between 1985 PSC and
2004 PSC Batches. In the provisional seniority list many recruits of 1989 PSC, 1992
PSC and 1993 PSC belongs to other zones repatriated to zone II and placed in between
1985 PSC and 2004 PSC Batches in the wake of the implementation of six point
formula / GO 610.
In this regard, we would like to know that there were any combined seniority list
prepared, for PSC Batches, based on GO reference 3 rd cited for 40% of the posts
consisting of combined merit lists of locals as well as non-locals before taken up
implementation of six point formula / GO 610.

Further, some persons were repatriated on the basis of the clause of


presidential order Rule 5 (2) (c) and which reads as follows:

c) the transfer of a person from one local cadre to another local


cadre where no qualified or suitable person is available in the latter cadre
for where such transfer is otherwise considered necessary in the Public
interest.

It is further submitted that all repatriations implemented after recruitment of 2004


PSC Batch then how was the above clause arisen for the inter zonal repatriations.

Further, it is submitted that As seen from the provisional seniority list of AEEs of
Zone-II, communicated as Batch-1, it is observed that out of total No. of 590 AEEs, out
of which, the A/T AEEs are 73 Nos. and AEEs are 517. Similarly, in Batch-2, there are
38 No. of A/Ts, against 127 No. of AEEs, which is not in accordance with the ratio 10 in
1 as per the Note 2 of G.O.Ms.No.32, Dt.12.04.2010.

It is further submitted that we would like to know that whether, in Zone - II, the
2004 PSC batch was recruited by the arising vacancies after 1985 PSC batch or not.

It is also submitted that APPSC conducted recruitment in different branches such


civil, Mechanical, Electrical, Agricultural branches. When merit is taken into
consideration in the next level promotions, how could be choosen the marks of different
branches in to same merit list. I think this is violation of Fundament rules of the
constitution under Article 14 and 15 which says it means that equals should be treated
equally and unequals should be treated unequally. So, we are requesting to
consider promotions for different branches according to their share of recruitment
percentage. It would be more justifiable then combing all of them.

Hence, in view of the above circumstances, we are kindly requesting the


Engineer-in-Chief (Admin) for consideration of the following points in finalizing the
seniority of Engineers of Water Resources Department and do the justice for 2004 PSC,
2005 PSC, & 2007 PSC Batches etc.
1. to review all the repatriations and prepare a combined Non Local merit list
and publish the same before taken up for finalization.
2. to place the repatriated AEEs in their respective zones from where they
have repatriated to zone-II
3. to revise the seniority list of AEEs with Direct recruitment AEEs and A/T
AEEs, duly maintaining the ratio of 10 in 1
4. ensure 2004 PSC Batch recruitment is based on the arising vacancies after
the 1985 PSC Batch.
5. Taken up the promotions for different branches according to their share of
recruitment percentage
