Social Security Organizations
In order to administer social security schemes and fund them, the central government
shall constitute various organization in accordance with the provisions of chapter – II of the
code.
Central Board of Trustees of Employees’ Provident Fund (Sec. 4)
The central govt. is empowered to constitute the Board of Trustees of Employees’ Provident
Fund. All the fund in relation to chapter III shall vest in, and be administered by the board of
trustees constituted under this section.
Constitution:
a) a Chairperson and a Vice-Chairperson to be appointed by the Central Government;
(b) not more than five persons appointed by the Central Government from amongst its
officials;
(c) not more than fifteen persons representing Governments of such States as the Central
Government may specify in this behalf, to be appointed by the Central Government;
(d) ten persons representing employers of the establishments to which the Employees'
Provident Fund Scheme applies, to be appointed by the Central Government after consultation
with such organisations of employers as may be recognised by the Central Government in
this behalf;
(e) ten persons representing employees in the establishments to which Employees' Provident
Fund Scheme applies applies, who shall be appointed by the Central Government after
consultation with such organisations of employees as may be recognised by that
Government in this behalf; and
(f) the Central Provident Fund Commissioner, ex officio.
Judicial Personality of Board:
The Central Board shall be a body corporate by the name of Board of Trustees of the
Employees' Provident Fund, having perpetual succession and a common seal and shall by
the said name sue and be sued.
Powers of the Board:
The Central Government may, by notification, constitute, an Executive Committee
from amongst the members of the Central Board to assist the Central Board in performance
of its functions in such manner as may be prescribed by the Central Government.
The Central Board may, by order, constitute one or more committees of such
composition as may be specified in the order to assist it in the discharge of its functions.
The Central Board or state board may delegate to its Chairperson or to its Executive
Committee or to any of its officers its power to and functions under this Code as it may deem
necessary for efficient administration of the schemes.
Constitution of Employees’ State Insurance Corporation (Sec. 5)
The central govt. is empowered to constitute Employees’ State Insurance Corporation. All
the fund in relation to chapter IV shall vest in, and be administered by the board of trustees
constituted under this section
Constitution:
a) a Chairperson and a Vice-Chairperson to be appointed by the Central Government;
b) not more than five persons appointed by the Central Government from amongst its
officials
c) one person representing each of such States in such manner, as may be prescribed by the Central
Government;
d) one person to be appointed by the Central Government to represent the Union territories;
e) ten persons representing employers of the establishments to which the Employees State
Insurance applies, to be appointed by the Central Government after consultation with such
organisations of employers as may be recognised by the Central Government in this behalf;
(e) ten persons representing employees in the establishments to which Employees' State
Insurance is applies, who shall be appointed by the Central Government after consultation
with such organisations of employees as may be recognised by that Government in this
behalf;
f) two persons representing the medical profession to be appointed by the Central
Government in consultation with such organisations of medical practitioners as may be
recognised for the purpose of ESI by the Central Government;
g) three members of Parliament of whom two shall be members of the House of the People
(Lok Sabha) and one shall be a member of the Council of States (Rajya Sabha).
h) the Director General of the Corporation, ex officio.
Judicial Personality of Corporation
The Corporation shall be a body corporate by the name of Employees' State Insurance
Corporation, having perpetual succession and a common seal and shall by the said name
sue and be sued.
Formation and function of Standing Committee
The central govt. is empowered to constitute a standing committee from amongst the
members of the Corporation through notification. standing committee is an excutive body for the
purpose of ESI.
Subject to the general superintendence and control of the Corporation standing committee
- shall administer the affairs of the Corporation and may exercise any of the powers and
perform any of the functions of the Corporation in such manner as may be prescribed
by the Central Government;
- shall submit for the consideration and decision of the Corporation all such cases and
matters which is required as per regulations made by corporation.
- Standing committee can also submit other cases for the decision of the Corporation if
required. It is dictionary authority of the committee.
Formation and function of Medical Benefit Committee
- Medical Benefit Commitee is an advisory body on matters related to the
administration of medical benefit under the ESI Scheme. The council is constituted
by the Central Govt. for a specific term and consists of :
1. The Director General, Health Services, ex officio, as Chairman
2. A Deputy Director General, Health Services, to be appointed by the Central
Government
3. The medical commissioner of the Corporation, ex officio
4. One member each representing each of the States (other than Union Territories) in
which this Act is in force to be appointed by the State Government concerned
5. Three members representing employers to be appointed by the Central Government
in consultation with such organizations of employers as may be recognized for the
purpose by the Central Government
6. Three members representing employees to be appointed by the Central Government
in consultation with such organizations of employees as may be recognized for the
purpose by the Central Government; and
7. Three members, of whom not less than one shall be a woman, representing the
medical profession, to be appointed by the Central Government in consultation with
such organizations of medical practitioners as may be recognized for the purpose by
the Central Government.
National Social Security Board (Sec. 6)
The National Social Security Board is a crucial body in India responsible for
coordinating and monitoring the implementation of social security schemes. The
Board is composed of several members, each with a distinct role and representation.
The National Board comprises the following members:
The Union Minister for Labour and Employment serves as the Chairperson of
the board in an ex-officio capacity.
The Director-General (Labour Welfare) also holds a position on the board as
the Member-Secretary, ex officio.
The Central Government nominates 40 members, who represent various
sectors and groups. These include:
o Seven members representing workers in the unorganised sector.
o Seven members representing employers in the unorganised sector.
o Seven members who are eminent personalities from civil society.
o Three members from the Parliament, two from the Lok Sabha and one
from the Rajya Sabha.
o Ten members representing various Central Government Ministries and
Departments.
o Five members representing different State Governments.
All members except Chairperson of the National Social Security Board shall
be from amongst persons of eminence in the fields of labour welfare, management,
finance, law and administration.
Tenure: 3 years
Meetings: The National Social Security Board shall meet at least thrice a year, at such time
and place prescribed by central govt.
Functions:
- recommend to the Central Government for framing suitable schemes for different
sections of unorganised workers, gig workers and platform workers;
- advise the Central Government on such matters arising out of the administration of
this Code as may be referred to it;
- monitor such social welfare schemes for unorganised workers, gig workers and
platform workers as are administered by the Central Government;
- review the record keeping functions performed at the State level;
- review the expenditure from the fund and account; and
- undertake such other functions as are assigned to it by the Central Government from
time to time
