💡 Why do some employers push drivers to incorporate? As Ritesh Kotak, an Ontario lawyer, told the Transport, Infrastructure and Communities Committee: “It’s 30% cheaper to have incorporated drivers. When you circumvent the system, all those protection mechanisms, such as severance, common law, notice periods all go out the window.” 🚩 🚩 Employers who use the Driver Inc. model are cutting their own costs by reclassifying drivers as independent contractors. This means skipping out on mandatory payroll taxes like CPP and EI, as well as employer health tax and WSIB premiums. But the real price is paid by drivers themselves. Forced incorporation strips away basic workplace protections: if a driver is let go, they lose out on severance pay, notice periods, and legal recourse under common law. Sick days, overtime, and paid leave become elusive or non-existent. This is a systemic problem that rewards those who break the rules and undermines honest carriers who play by them. When bad actors avoid obligations, responsible businesses are forced to compete on an uneven playing field, and drivers are left vulnerable in an industry that should value their essential work. 🚨 If we want safer roads, fair competition, and secure jobs, we need coordinated enforcement, proper driver classification, and strong penalties for misclassification. Big news for trucking enforcement. 🚨 Last week’s federal budget set the stage for long-awaited action on Driver Inc, tax evasion, and misclassification — a major win for drivers and compliant carriers. With Budget 2025 passed, CTA and provincial associations are now working with CRA and ESDC on new enforcement measures, including T4As and coordinated national oversight. 🚩 🚩 Universal training standards matter for truck safety. 🚚 Cecilia Omole from the Insurance Bureau of Canada recently told the Transport, Infrastructure and Communities Committee: “We would like to see government harmonize training regimes across Canada. We’ve seen some provinces implement mandatory introductory training, but at this point in time, standards are very fragmented.” 🚨 While some provinces have taken steps to introduce mandatory entry-level training for truck drivers, the required hours and curriculum modules still vary widely. The Driver Inc model pushes drivers into false “independent” status, stripping them of basic workplace protections and benefits. It’s predatory and lawless –and 8 out of 10 drivers looking for work are pressured toward it. That means vulnerable workers are exploited, honest carriers are undercut, and public revenues and road safety suffer.
