DEF CON Legal Update

lawsuit update

If you're an avid docket watcher, you may have noticed that we filed a motion for summary judgement in Chris Hadnagy's defamation suit against DEF CON . Summary judgement was granted with prejudice May 11, seemingly closing the case. To our surprise, Hadnagy filed an appeal in June. Then, less than 2 weeks later, he filed for a dismissal of that appeal. We accepted it. It's time for an update!

The complete dismissal of his defamation case was yet another moment where Chris was pursued by an opportunity for personal growth. Again, Chris was too fast.

Instead, he filed an appeal. We may never know exactly why he thought this might be a winning strategy, but he did release a confusing LinkedIn video where he blamed his lawyers. He was never going to win. After a dismissal like this you can't introduce new facts or arguments, only argue that the law was misapplied.

The mistakes were made by Chris, not his lawyers. Every time, and by his own sworn testimony. There were many points in this saga where Chris could have chosen a different adventure, but did not. Now it is game over for him, and we are excited to return our full attention to moving on.

See you soon in Las Vegas!

Chris Hadnagy vs. DEF CON Lawsuit update

DEF CON legal update

It's been a while since our last update - a lot has been going on behind the scenes - and with the discovery phase complete we have filed a motion for summary judgement asking the court to dismiss his lawsuit. In it we reveal some of the identities of those who testified regarding their experiences with Chris, and I would like to personally thank them for standing up for our community when remaining silent would have been easier.

The legal standard for evaluating a summary judgement motion means giving the benefit of the doubt to the nonmoving party (Hadnagy) on all disputed facts. Because of this we focused on the undisputed facts, including the documents and deposition testimony, that Chris can't deny.

Should this motion fail then we would start preparing for trial, and end up arguing over the disputed facts as well. Both sides will be done with briefing in approximately one month. After briefing is complete we expect the judge to rule on the motion within a couple weeks to a couple months.

Thank you everyone for continuing to support DEF CON, and a special thank you to all those who came forward in the ongoing lawsuit.

Jeff Moss, President, DEF CON Communications.
