Republic of the Philippines DEPARTMENT OF THE INTERIOR AND LOCAL GOVERNMENT ‘A Francisco Gold Condominium Il, EDSA, Diliman, Quezon City OFFICE OF THE SECRETARY February 17, 2011 MEMORANDUM CIRCULAR NO. 2011-24 To : ALL PROVINCIAL GOVERNORS, CITY MAYORS, MUNICIPAL MAYORS, PRESIDING OFFICERS OF THE SANGGUNIANG PANLALAWIGAN, SANGGUNIANG PANLUNGSOD AND SANGGUNIANG BAYAN, PUNONG BARANGAYS, REGIONAL GOVERNOR OF THE ARMM, DILG- ARMM REGIONAL SECRETARY AND DILG REGIONAL DIRECTORS SUBJECT —: DUTIES AND FUNCTIONS OF THE PROVINCIAL, CITY AND MUNICIPAL PEACE AND ORDER COUNCILS, AND BARANGAY PEACE AND ORDER COMMITTEES The establishment of a Peace and Order Council in every province, city and municipality finds its legal authority in Section 116 of the Local Government Code of 1991 and Executive Order No. 309, s. 1987, as amended. Executive Order No. 366, s. 1996, also mandates the organization of a Barangay Peace and Order Committee in every barangay. In this regard, all Local Chief Executives and Sanggunian Members at all levels are hereby reminded of the duties and functions of the Peace and Order Council, inviting attention to its significant role in maintaining peace and order and public safety, in dealing with criminality and insurgency, and in curbing illegal gambling activities. Duties and Functions of the Peace and Order Council 1. The Provincial, City or Municipal Peace and Order Council (POC) shall: (a) Formulate the Provincial, City or Municipal Peace and Order and Public Safety Plan, which shall be incorporated in the Comprehensive Development Plan; (b) Provide for a forum for multi-sectoral dialogue and deliberation of major issues and problems affecting peace and order, including insurgency; (c) Recommend measures aimed at improving or enhancing peace and order and public safety, including anti-insurgency measures; (4) Recommend measures to converge and orchestrate internal security operations efforts of civil authorities and agencies, military and police; (e) (f) (e) (h) . The Barangay Peace and Order Com Apply moral persuasion to and/or recommend sanctions against a local chief executive for providing material and political support to the communist rebels; Monitor the provision of livelihood and infrastructure development programs and projects in remote rural and indigenous population areas to isolate them from the communist rebels’ ideological, political and organization works; Develop and monitor anti-illegal gambling activities, such as: i. Development _of a quick response mechanism (e.g. hotline, online services, etc.) where the public can report jueteng-related acti concerns, for plementation in every LGU; ii. Close coordination between the LGUs and the Anti-Money Laundering Council (AMLC) in the investigation and prosecution of jueteng-related money laundering cases and establish AML Desk in every LGU; and iii, — Conceptualization of alternative activities, among others; Take decisive action in emergency situations, through the creation of Special Action Committee, composed of the regional, provincial, city or municipal officers or counterparts, if any, of the Department of the Inte Government, Department of National Defense, Department of Social Welfare and Development, Department of Justice and the Armed Forces of the Philippines; and Perform such other functions as may be assigned by law, the President or the National Peace and Order Council. ies or rand Local 2 (BPOC the implementing arm of the City or Municipal POC and, as such, shall (a) (b) () (a) (e) ( (8) (h) (0) (i) Formulate the Barangay Peace and Order and Public Safety Plan, which shall be incorporated in the Barangay Development Plan, and recommend measures to improve or enhance peace and order and public safety in the community; Monitor and coordinate the implementation of peace and order programs and projects at the barangay level, including anti.illegal gambling activities; Serve as an information-gathering mechanism; Establish and maintain profile of all residents in the barangay; Monitor and check the nefarious activities of criminal elements; Identify barangay constituents with strong deviant behavior for referral to appropriate author Maintain continuing dialogue, close coordination and rapport with the higher POC and law enforcement units; Monitor, coordinate and supervise the operation of all community-based anti- crime movements within the barangay; Make periodic assessment of the prevailing peace and order situation in the barangay, and submit a report, to include an assessment and situation report on illegal gambling, with appropriate recommendations to the higher-level POC; and Perform such other functions which may be assigned by the higher-level POC. ‘The Peace and Order and Public Safety Plan Every Provincial, City and Municipal POC, and BPOC shall formulate a Peace and Order and Public Safety Plan. Below is the suggested outline: |. Mission Statement Il. Objectives lll. Key Strategies IV. Critical Activities and Timelines V. Funding Requirements VI. Plan Monitoring and Evaluation VII. Communicating Results to the Public, briefly explained, or provided with examples, as follows: 1. The Mission Statement for a 5-year plan can be expressed as: Peaceful and Safe Community; 2. Each of the Objectives has to have a defined period. Thus, guided by the Mission Statement, a 5-year plan has to have five (5) core objectives, with each succeeding objective building from the objective of the immediately preceding year; 3. As used in this Memorandum Circular, Strategies refer to approaches. Strategies are linked to the core objective(s) and may be stated as: Engaging the Pillars of the Criminal Justice System, Building Partnership with the Civil Society, Partnering with the Private Sector, Mobilizing Support Systems In Disaster Risk Management, Ensuring Public Safety-Compliant Infrastructure and Civil Works, and the like; 4, Critical Activities and Timelines must be in sync with a Key Strategy; 5, The successful execution of the plan, on an annual basis, depends on the provision of a Dedicated Fund; 6. A major pitfall in a plan is the lack of a conscious assessment effort. Monitoring and Evaluation must be an integral part of the plan; and 7. Communicating Results to the Public is in keeping with the principals of transparency, accountability and participation.
