Registration of ships
The ship is a property.
Being a property, it becomes necessary to
keep a record and to achieve this
purpose, the register of Indian ships has
been created.
This is used as an evidence to fly the flag
of the state as well as of the right of
ownership and mortgages, in just the
same way a as in the case with the
registration of title to land.

Ownership of merchant ships is usually
divided into shareholdings, that of Indian
ships being divided into 10 shares.
Every Indian ship unless it is a ship which
does not exceed 15 tonnes net and is
employed solely in navigation on the
coasts of India, shall be registered under
the merchant shipping act 1958.

Register books are open for inspection
against payment of a fixed fee.
Thus, anybody who desires to deal with
the owner of a ship can satisfy himself
about the property or encumbrances.
Obviously the register should therefore
record meticulously all details of the
vessel as well as its owners.

When the ship is registered as an Indian
ship, it has an entitlement to all the
privileges under the merchant shipping act
1958.
However, an owner cannot avoid payment
of dues and taxes on such ships by failing
to register his ship.
Actually, one of the primary purposes of
registration is to enforce the payment of
dues.

Registration - evidence as proof of Title.
In India, registration of ships is done in
Mumbai, Kolkata, and Chennai and such
other ports in India as notified by the
government under the merchant shipping
act 1958.
The port at which a ship is registered is
her Port of Registry and the port to which
the ship belongs.

The principal officers of the mercantile marine
departments of Mumbai Kolkata and Chennai
are the Registrars of Indian ships of the ports.
Under the law of the flag a vessel and its crew
are subject to a country whose flag (nationality)
the ship is flying and the conduct of the affairs
on board is governed by the law of that country.
The members of the crew are not in any way
controlled by the laws of the country of which
there are subjects.
