ADDENDUM
B1. Probable Cause Statement
ON 05/13/2016 AT APPROXIMATELY 1633 HOURS I RESPONDED TO A PRIORITY 1 RADIO CALL
IN REGARDS TO AN ASSAULT THAT JUST OCCURRED LOCATED AT 8028 S CENTRAL AVE. WHILE
ENROUTE THE CALLER STATED HE WAS PUNCHED IN THE NOSE BY AN ADULT MALE AND THAT
THE MALE FLED NORTHBOUND ON CENTRAL AVE. THE CALLER ALSO STATED HE WAS FOLLOWING
THE MALE SUSPECT AND PROVIDED A DESCRIPTION AS A HISPANIC MALE, APPROXIMATELY 20
YEARS IN AGE, SHOULDER LENGTH HAIR, WEARING A GRAY LONG SLEEVE BUTTON UP SHIRT
WITH BLACK SHORTS AND WHITE TENNIS SHOES.PRIOR TO ARRIVING IN THE AREA, THE
CALLER STATED THEY WERE NOW IN THE CIRCLE K PARKING LOT LOCATED AT 7601 S CENTRAL AVE. AS I ARRIVED IN THE PARKING LOT, I OBSERVED A MALE MATCHING THE DESCRIPTION RUN FROM THE PARKING LOT OVER TO THE CIRCLE K PAY PHONES WHICH WERE
LOCATED ON THE EAST SIDE OF THE BUSINESS.I CONTACTED THE MALE WHO WAS IDENTIFIED
AS GABRIEL CORONADO AND PLACED HIM IN HANDCUFFS. I THEN CONTACTED THE CALLER WHO
WAS STANDING IN THE PARKING LOT OF THE CIRCLE K AND HE WAS IDENTIFIED AS THE
VICTIM RICHARD NINO. I OBSERVED RICHARD TO HAVE BLOOD DRIPPING FROM HIS NOSE AND
SAW BLOOD ON HIS HANDS AND CLOTHING. I ALSO OBSERVED RICHARDS NOSE WHICH APPEARED TO BE BROKEN.I ASKED RICHARD IF HE NEEDED MEDICAL TREATMENT AND HE STATED
YES.PHOENIX FIRE RESPONDED AND TREATED RICHARDS NOSE. THEY ADVISED HIM HIS NOSE
IS BROKEN. AFTER BEING EVALUATED, RICHARD STATED HE WAS WALKING FROM HIS APARTMENT TO THE DOLLAR STORE A FEW BLOCKS AWAY. AS HE WAS WALKING SOUTHBOUND ON THE
WEST SIDE OF CENTRAL ROAD, HE OBSERVED GABRIEL RUN ACROSS THE STREET FROM THE
EAST SIDE OF THE ROAD TO WHERE HE WAS AT. RICHARD THEN STATED GABRIEL ASKED HIM
IF HE COULD USE HIS CELL PHONE, WHEN RICHARD STATED HE DID NOT HAVE ONE. AFTER
TELLING HIM HE DID NOT HAVE A PHONE, GABRIEL STARTED GRABBING AT HIS POCKETS.
RICHARD STATED HE JUMPED BACK AND SAID I DONT KNOW YOU WHAT R U DOING. AT THAT
TIME AFTER JUMPING BACK, RICHARD STATED GABRIEL BALLED UP HIS RIGHT HAND AND
MADE A FIST. AFTER MAKING THE FIST GABRIEL SWUNG AND PUNCHED RICHARD ON THE LEFT
SIDE OF HIS FACE ONE TIME, WHICH CAUSED HIS NOSE TO BLEED IMMEDIATELY.I ASKED
RICHARD IF HE BLACKED OUT AND HE STATED NO BUT HE WAS DAZED FOR A FEW SECONDS.I
ASKED RICHARD IF HE KNEW GABRIEL AND HE STATED NO HE HAS NEVER SEEN HIM PRIOR TO
TODAY.I ASKED RICHARD IF HE DESIRED PROSECUTION AND HE STATED YES.OFFICER LINKER
TOOK PHOTOS OF THE INJURY.I TRANSPORTED GABRIEL TO THE SOUTH MOUNTAIN PRECINCT
FOR THE BOOKING AND INTERVIEW PROCESS.AT 1715 HOURS, I READ GABRIEL HIS MIRANDA
RIGHTS STRAIGHT FROM THE STANDARD ISSUED MIRANDA CARD IN WHICH HE REPLIED I DO
TO UNDERSTANDING HIS RIGHTS AND NO TO GIVING HIS RIGHTS UP AND SPEAKING TO ME.NO
FURTHER QUESTIONS WAS ASKED.I CONTACTED THE ADULT PROBATION OFFICE AND THEY CONFIRMED GABRIEL WAS CURRENTLY ON PROBATION FOR POSSESSION OF DANGEROUS
DRUGS.GABRIEL WAS THEN TRANSPORTED TO THE SOUTHERN COMMAND STATION FOR BOOKING
PHOTOS AND FINGERPRINTS. WHILE SEATED IN A JAIL CELL, GABRIEL COMMITTED AGGRAVATED ASSAULT AGAIN BY KICKING ANOTHER PRISONER BY THE NAME OF DALYS KEZAR IN THE
HEAD 10-15 TIMES. DURING THE ASSAULT, DALYS STATED HE LOST CONSCIOUSNESS AND WAS
ALSO BLEEDING FROM THE NOSE. DALYS WAS TREATED BY PHOENIX FIRE. GABRIEL WAS THEN
TRANSPORTED TO THE 4TH AVE JAIL AND WAS BOOKED ON THE LISTED CHARGES.
