GUIDELINE ON MANDATORY SAFETY STANDARDS FOR TOYS 2010

Introduction
The main purpose of this guideline is to help the businesses that supply toys in Malaysia to comply with the legislation and requirement imposed by the Ministry of Domestic Trade, Co-operatives and Consumerism (MDTCC). This guideline will assist the industry to understand the main features of the legislations and the requirements in order to conform to the prescribed safety standards. Those affected by this guideline should refer to the relevant Regulations for a full statement of the legal requirements and in case of doubt, seek advice on questions of interpretation. The industry is advised to refer to the definitions attached for further understanding on terms being used in this guideline (See Annex A).

Relevant National Law


For the purpose of this guideline, the relevant legislations are as below:(i) (ii) (iii) (iv) Consumer Protection Act 1999 [Act 599]; Consumer Protection (Safety Standards for Toys) Regulations 2009 [Toys Regulations]; Consumer Protection (Certificate of Approval and Conformity Mark of Safety Standards) Regulations 2009 [Safety Regulations]; and Customs (Prohibition of Import) Order.

General Requirements
The product owner is responsible to make declaration to MDTCC which states that (i) (ii) (iii) (iv) the toys supplied in Malaysia are safe; the toys are tested and conformed to the prescribed safety standards for toys (See Annex B); the test report from accredited laboratory for the particular toys will be produced upon request by the enforcement authorities; and the toys have complied to other requirements as prescribed under Clause 2.1.

The declaration made must be in the form of Certificate of Conformance (COC) based on the format determined by MDTCC (See Annex C); Any person or business that supply, or offer to or advertise for supply toys must ensure that:(i) the toys complies with prescribed safety standards for toys; (ii) the COC is issued by the product owner; (iii) a copy of the COC is to be kept for record and enforcement purposes;

(iv) the toys is marked or affixed with the conformity mark ( ) together with the registration number determined by MDTCC either on the product or packaging; (v) the toys is marked and affixed with the name and address of the manufacturer, importer or distributor; and (vi) the toys must be accompanied by warnings and information on precautions where necessary. These must be either in Malay language or/and English language. As an addition other languages may also be used. 3.4 Any toys which are a counterpart of a product shall conform to the prescribed safety standards for toys. (i) The product owner is responsible to define the purpose of the product to the Ministry as it is important to rationalise whether it is intended for play or has a play value elements to the product. (ii) Test report from accredited laboratory shall be produced for the particular toy that complements the product. 3.5 Starting 1 July 2010, only toys that have test reports are allowed to be sold in Malaysia. This is applicable to all toys either new or existing products.

When To Declare?
The importer shall do the declaration for every consignment or shipment. The manufacturer shall do the declaration for every production. The supplier who conducts repackaging activities shall do the declaration for every supply.

What To Declare?
The following details are required to be stated in the COC for declaration purpose: (i) 1SKU No. (ii) SKU Description (iii) Test Report No. (iv) Test Report Issuance Date (v) Testing Laboratory (vi) Place of Manufacturing (vii) Year of Manufacturing/Import

How To Declare?
Step 1: Registration of business activity prior to declaration

The product owner is required to register its business activity of supplying or offering to or advertising for supply or importing any toy with MDTCC prior to declaration. A registration number shall be assigned to the product owner upon registration and marking. the number shall be used for the purpose of The completed Registration Form (See Annex D) shall be submitted to the Ministry accompanied with a copy of the followings:(i) Memorandum and articles of association (for company); (ii) Form 9 Certificate of Incorporation (for company); (iii) Form 13 , if applicable; (iv) Form 24 Return of Allotment of Shares (for company); (v) Form 32A Form of Transfer of Securities, if applicable; (vi) Form 49 Return Giving Particulars In Register Of Directors, Managers and Secretaries and Changes of Particulars (for company); (vii) Form D Certificate of Registration (for business); (viii) Form E , if applicable; (ix) Latest computer print out of company profile from Companies Commission of Malaysia (photocopy shall not be accepted); (x) Consent letter from owner of copyright or trademark or exclusive licensee, if applicable; (xi) Companys catalogue, if applicable.

When necessary, the product owners may be required to furnish any other additional information or documents within the time specified by the Ministry. The product owners shall provide assistance and clarification on technical matters pertaining to the toys as may be required by MDTCC from time to time. Step 2: Declaration

7.2.1 Part I : Declaration of New Products The requirements stated below are applicable for the declaration of new imported toys, new manufactured toys and for new repackaging activities:(i) The product owner is required to submit the COC to MDTCC through online system. (ii) The COC is only complete when a reference number is stated. Therefore, upon receipt of the COC, MDTCC shall send a reference number for each COC to the product owner. (iii) All product owners can only give a copy of the COC to their clients or distributors once the reference number has been stated.

A. Declaration for New Imported Toys (i) The importers can start doing importation once they receive the reference number from MDTCC. (ii) The importers are responsible to state the reference number in the customs form and submit relevant documents as determined by Customs prior to clearance at the point of entry. (iii) The importers are responsible to produce the COC and test report when requested by Customs or MDTCC. (iv) The importers must ensure that the imported toys are to be marked or affixed with: marking together with the registration number; and name and address of the manufacturer and imported or distributor

before exit point of entry B. Declaration for New Manufactured Toys (i) The manufacturers can start doing the declaration once they receive the reference number from MDTCC. (ii) The manufacturers are responsible to produce the COC and test report when requested by MDTCC. (iii) The manufacturers must ensure that the toys are to be marked or affixed with: marking together with the registration number; and name and address of the manufacturer and importer or distributor

at the manufacturing site. C. Declaration for Repackaging Activities (i) The suppliers can start doing repackaging activities once they receive the reference number from MDTCC. (ii) The suppliers are responsible to produce the COC and test report when requested by MDTCC. (iii) The suppliers must ensure that the toys are to be marked or affixed with: marking together with the registration number; and name and address of the manufacturer and imported or distributor

at the repackaging site.

D. Declaration for the purposes of sample, demonstration or research and development (i) Any person who import toys for the purposes of sample, demonstration, research and development shall adhere to the following: complete and submit the Toy Declaration Form (TDF) (See Annex E) that is placed at customs point; declare the purpose of the toys brought into Malaysia; notify the duration the toys will be in Malaysia, if applicable; and notify how and when the toys will be shifted out of the country again, if applicable.

(ii) Any foreign importer or manufacturer that would like to bring in toys for the purpose of sample, demonstration or research and development shall provide a referee details in Malaysia. E. (viii) The toys shall be marked or affixed visibly, intelligibly and indelibly with the following particulars: marking of a minimum size of 5mmx5mm as specified in Second Schedule of the Safety Regulations together with the registration number which is to be placed below the conformity mark; the name and address of the manufacturer, importer or distributor of the goods either in the Malay language or English language. marking is as shown in diagram 1 below. (x) Marking or affixing the conformity mark to goods other than those being granted under these Regulations is an offence. F. Testing Requirements (i) The product owners must first obtain the test report by sending sample of toys to any accredited laboratory. A full range of test that applicable to the toys must be conducted according to the prescribed safety standards. (ii) The product owners must ensure COC is produced only for toys that fully comply with the prescribed safety standards. (iii) Product owners shall maintain record on the test reports. (iv) For the purpose of declaration, only test report that has been issued not more than 5 years will be accepted. 7.2.2 Part II : Declaration for Existing Products The requirements stated below are applicable for the declaration of existing toys in the market:(i) The product owner is required to submit the COC to MDTCC. (ii) The COC is only complete when a reference number is stated. Therefore, upon receipt of the COC, MDTCC shall send a reference number for each COC to the product owner.

(iii) All product owners can only give a copy of the COC to their clients or distributors once the reference number has been stated. (iv) The product owners are responsible to declare toys that have been imported, manufactured and sold in Malaysia for past 5 years. (v) The product owners can start doing the declaration for existing toys in the market starting from 1 March 2010 until 30 June 2010. A. Conformance of Safety Standards (i) The product owners shall be responsible to declare that the particular existing toys conform to a particular standard and are safe. (ii) MDTCC accepts ISO 8124 series and EN 71 series as equivalent standards. Meanwhile, recognise ASTM F963 2008 as an international de facto safety standard for toys. (iii) However, toys that are manufactured based on ASTM F963 before the year of 2008 (i.e. which states requirements for migration of certain elements for lead surface coating is 600ppm), those toys shall be removed from the market starting 1 July 2010. B. Marking Requirements (i) marking is not a requirement for existing products. However, the product owners are required to make declaration that the product conforms to any equivalent standard and are safe.

(ii) Any international safety mark or safety declaration shall be accepted. C. Test Report (i) The product owner shall maintain record on the test report. (ii) The test report may be issued by in-house laboratory, non accredited laboratory or any accredited or recognized laboratory under ILAC and APLAC or any laboratory recognized by MDTCC. (iii) For existing products, the test report issued from 1 January 2003 onwards shall be accepted. Note : Part II of this guideline is only applicable until 1 January 2012. Within the given period, the product owners are required to take measures in order to ensure that the existing toys will be in full compliance with the regulation requirements.

What are the obligations of the product owners?


Declaration for COC The importer/ manufacturer shall assist and cooperate with retailers to identify the toys that are sold or supplied in the market. In order to verify the declaration that has been made by importer/ manufacturer, it shall be the responsibility of the retailers to contact or trace the importer/ manufacturer. If the retailers may have undeclared products in their inventory list, the retailer shall inform the importer/ manufacturer. It shall be the duty of the importer/ manufacturer to make the declaration. If the importer/ manufacturer cannot be traced, it is the responsibility of the retailers to declare their products. However, if the toys do not have test report it shall be removed from the market. If the importer engages a logistic company to bring in their product into Malaysia, the importer can provide the COC to its logistic company. However, the importer is responsible for the product declared in terms of conformance to the safety standards and the accuracy of the information given. Maintenance of Records The product owners shall ensure that all relevant records of its products and supply chain are according to the requirements as stipulated in the regulation. The product owners shall be responsible to maintain records and technical file on the followings:(i) COC; (ii) test report; (iii) any document or information that is traceable to the product owner; (iv) any document or information that is traceable to the chain of distribution along the supply chain; (v) non compliance notice issued by MDTCC, if applicable; (vi) corrective action plan taken, if applicable; (vii) recall action taken, if applicable.

The product owners shall have procedures in place to ensure the continued conformance of the products as delivered or accepted with the stated requirements of the declaration of conformity. The product owners shall have procedures in place to re-evaluate the validity of the declaration of conformance, in the event of:(i) changes significantly affecting the products design or specification;

(ii) changes in the standards to which conformity of the product is stated; (iii) changes in the ownership or structure of management of the supplier, if relevant, or (iv) relevant information indicating that the product may no longer conform to the specified requirements

Compliance Notices
When there is a case of non compliance, the Ministry shall issue a non-compliance notice to the product owner as an opportunity to explain the non-compliance and also to produce a corrective action plan proposal such as:(i) (ii) (iii) (iv) stop the selling; do not continue with distribution/importation; stop from committing the same action in future; or will be charged in the court of law.

10.2

In relation to non compliance, enforcement will be imposed based on Section 19 Safety standard and Section 23 Prohibition against unsafe goods of Consumer Protection Act 1999 [Act 599]. Upon the product owners own discretion, if the product owners find out that non compliance occurs and has caused injury or likely to cause injury and it involves safety issues, the affected product owners must: inform to MDTCC within the specified timeframe of the corrective action plan that has or will be taken; if it is required, the supplier at their own cost must conduct any or all of the requirement stipulated under Section 19 Safety standard and Section 23 Prohibition against unsafe goods of Consumer Protection Act 1999 [Act 599];

Upon market surveillance, and it is found that non compliance occurs and has caused injury or likely to cause injury and it involves safety issues, the affected product owners must:1. respond to the non compliance notice issued by MDTCC by producing corrective action plan within the specified timeframe; 2. if it is required, the supplier at their own cost must conduct any or all of the requirement stipulated under Section 19 Safety standard and Section 23 Prohibition against unsafe goods of Consumer Protection Act 1999 [Act 599];

Upon receiving a complaint, and it is found that non compliance occurs and has caused injury or likely to cause injury and it involves safety issues, the affected product owners must: respond to the non compliance notice issued by MDTCC within timeframe specified; the supplier at their own cost must immediately conduct any or all of the requirement stipulated under Section 19 Safety standard and Section 23 Prohibition against unsafe goods of Act 599;

MDTCC shall take any or all of the following actions as precautionary measures:(i) Market surveillance will be conducted to ensure the products have been removed from the market during the occurrence of non compliance; (ii) MDTCC will monitor the progress of the corrective action plan that has been taken into place; (iii) If required, the supplier must produce progress report on quarterly basis to MDTCC until the issues are completely resolved.

10.7

In relation to toys recalled by other countries, the product owners are required to take similar action as taken by the other country if the affected toys are supplied in the Malaysian market inline with:(i) toy safety standard regulated in Malaysia; or (ii) national interest, if required

Other Responsibilities
The product owner must always keep track on the current updates of (i) any information on product safety, standard compliance and product recall notifications; and (ii) any revision of standards by Department of Standards Malaysia as well as any new development of the existing law by the Government.

ANNEX A

DEFINITIONS
1. Accredited Laboratory An accredited laboratory means laboratory accredited by competent agency or is a signatory to the Asia-Pacific Laboratory Accreditation Cooperation (APLAC) or International Laboratory Accreditation Cooperation (ILAC) Mutual Recognition Agreements (MRA). 2. Certificate of Conformance (COC) COC is a document of declaration produced by the product owner according to the format as determined by the Ministry of Domestic Trade, Co-operatives and Consumerism 3. Competent Agency Competent agency means Department of Standards Malaysia. 4. Conformity Mark Conformity mark means the mark prescribed in the Second Schedule under the Safety Regulations. 5. Goods Goods means the product category as specified in column (1) under First Schedule of the Safety Regulations. 6. Importer Importer means any person/business that is responsible for placing the imported toys in the Malaysian market. The importers must be incorporated in Malaysia. 7. Manufacturer The manufacturer may be established in Malaysia or in another country. For overseas manufacturer, they may appoint a representative (i.e. must be incorporated in Malaysia) to act on his behalf or form a business or company that is incorporated in Malaysia. 8. Mother SKU Mother SKU refers to products that has associated child SKUs 9. Product Owner Product owner refers to the first person, importer, manufacturer or supplier who conducts repackaging activities, who supplies the toys into Malaysian market. 10. SKU SKU refers to stock keeping units (the way SKU is determined may vary from one company to another) 11. Single SKU Single SKU refers to products that do not have any associated child SKUs in which it is a stand alone SKU

12. Supply Supply in relation to goods means to supply, or resupply by way of sale, exchange, lease, hire or hire-purchase. This includes any activity of offering to supply or advertise for supply. 13. Supplier Supplier means any manufacturer, importer, distributor, wholesaler or retailer that supplies toys in Malaysian market. 14. Toys Toys means any goods designed or intended for use in play by children less than fourteen years of age but does not include the goods specified in the Second Schedule under the Toys Regulations as in Annex F. 15. Test Report Test report means report issued by the accredited laboratory.

In connection with this application, I, hereby: (a) undertake to supply all information required by Ministry of Domestic Trade, Co-operatives and Consumerism (MDTCC) for the purpose of company registration inline with the toy safety standards requirements for Malaysia; undertake that the submitted documents are true; agree to make declaration based on the format determined by MDTCC for the purpose of supply, or offer to or advertise for supply toys in Malaysia; understand the Ministry has the right to revoke the application in the event of any non compliance with regards to the toy safety standards; agree to maintain record by keeping a technical file with regards to the toy safety standards; agree to produce test report as determined by MDTCC upon request by Customs and / or MDTCC; undertake to be responsible and liable on the declaration made; agree that MDTCC may not process the application due to insufficiency and / or untraceability of the documents submitted; agree that MDTCC may revoke the application due to untraceability of the test report submitted; and understand that MDTCC may release information obtained in the course of processing the application to the public or government authorities so far as is prudent to warn in the opinion of MDTCC.
