AFFIDAVIT AND INDEMNITY UNDERTAKING

We, RITA SIOK KING CO NG, NELSON CO NG, GOLDWYN SIMEON CO NG, CASTROL CO NG, and KAREN NG YAP, Filipinos, of legal ages, with residence and postal address at 52 Biak na Bato Street, Brgy. Sto. Domingo, Sta. Mesa Heights, Quezon City, after having been duly sworn to in accordance with law, hereby depose and say: 1. That the above-named persons are the only compulsory heirs, surviving spouse and son of the late LIAM PONG NG who died on 21 April 2012 at _______________________. Attached hereto are copies of the Death Certificate of the late LIAM PONG NG and our valid IDs and birth certificates, all of which are true and correct; 2. That the deceased, the late LIAM PONG NG, at the time of his death left bank accounts deposited at Citibank, N.A. Philippines; 3. That the deceased died intestate and left no will and that he has no known debts whatsoever; 4. That the above-named parties intend to request for bank certifications as to the deceaseds account balance which we will provide to Bureau of Internal Revenue. We also intend to file the estate tax return and pay the taxes (if any) to the Bureau of Internal Revenue; 5. That we hereby appoint ________________________ as our attorney-in-fact for the purpose of requesting for and receiving a certification of the balance of the bank accounts of the deceased for the above-stated purpose; 6. We authorize you to disclose the requested information to third parties in relation to the account of LIAM PONG NG with Citibank, N.A. Philippines; 7. We waive the confidentiality of deposits under Republic Act No. 1405, as amended, Republic Act No. 6426, as amended, Section 55 of Republic Act No. 8791 and any and all other laws on the confidentiality of bank deposits; 8. Further, we hereby hold Citibank, its employees, officers, directors, and agents free and harmless against any loss, damage, or liability (including legal fees on a full indemnity basis) arising from or as a result of the execution of this request; and 9. That we are executing this Affidavit as compulsory heirs in order to attest to the truth of the above-mentioned facts and for Citibank, N.A. Philippines to issue said certification of the balance of the bank accounts of the deceased for the above-stated purpose. FURTHER AFFIANTS SAYETH NAUGHT.
