Box 7459 Jackson, Mississippi 39282-7459 MEMORANDUM To: Captain Jeff Palmer Date: April 6, 2006 From: Marshall Fisher M12 Director Subject: Disciplinary Action Enclosure (1) is a listing of the.charges made against you. After carefully reviewing these documents it is my duty to inform you that I consider the charges [Enclosure (1)] to be of a serious nature. Accordingly, under the provisions of MBN General Order 1-17 dated September 1, 2000, I am considering issuing punishment to you. The punishment may include a written reprimand and/or suspension without pay for not less than one (1) nor more than six (6) work ‘weeks, demotion, or dismissal. You are hereby notified you are suspended with pay from your employment with the Mississippi Bureau of Narcotics until such time as a hearing can be held in this matter. Your suspension is effective April 6, 2006. You are advised of the following: 1 You will immediately turn in all Bureau property issued to you or in your possession. a In the event you are subpoenaed to testify in court after your suspension, you will notify Major Nelson Tate immediately. 3. You are reminded, that effective immediately, you do not have the authority to represent yourself as a Bureau employee or to act on behalf of the Bureau in any capacity whatsoever. Under policies issued'by the State Personnel Board and MBN General Order 1-17 you have the following due process rights: (1) At least ten (10) working days prior to any suspension without pay, demotion, or dismissal of a permanent state service eniployee, the employee shall be given written notice of the reason(s) for such action and shall be given an opportunity for a hearing with the Director or designated representative and to respond in writing. This memorandum constitutes your written notice and begins the ten 2) @) @ (10) working day period. Enclosure (1) to this memorandum provides the reasons for my action. ‘The Director may choose to convene an Internal Administrative Hearing Board to hear charges when the violation can result in suspension without pay, demotion, or dismissal. I have chosen not to convene an Internal Administrative Hearing Board, ‘The Director shall establish the date, time, and place of a hearing and notify the affected employee of same. The affected employee shall be notified in writing at Teast ten (10) working days prior to the hearing. The employee shall have the right to consult with counsel at his expense during the hearing and will be afforded the opportunity to present witnesses (non Bureau employee witnesses will be at the employee's expense) and/or documents and offer an oral or written statement in his behalf. The hearing will be held at Bureau Headquarters, Jackson, Mississippi on April 21, 2006 at 11:00 am. To receive a copy of any documentation to be placed in your personnel fil. Enclosure (2) will provide you with an opportunity to exercise or waive your rights as you deem appropriate. By signing enclosure (2) you will acknowledge receipt of this memorandum. Your actions were done in such a manner to conceal in the case management system ‘who was in fact the case agent. Further, you were insubordinate by not performing your duties as a Captain and managing your District rather than opening cases in other Agents names. Your actions compromise the integrity of the individual case file as well as the agency asa whole. ‘Your conduct constitutes insubordination, a Group Two Offense in violation of MBN Manual of Policies and Procedures, General Order |-17 (1)(2)(a) as well as Mississippi State Employee Handbook, Section 10, Schedule of Offenses and Authorized Disciplinary Action (B)(1), a Group Two Offense. Further, your conduct isa violation of MBN Manual of Policies and Procedures, General Order 2-1; and, falsification of records, vouchers or other official state documents in violation of General Order 1-17 (I1)(A)(3)(@) and Mississippi State Personal Handbook Section Group Three Offenses (10)(C) (4), CHARGE I During a period of time, including but not limited to, beginning in January 2005 through November 2005, you falsified and forged the following Vouchers for Purchase of Information and Evidence, to wit: Voucher# B4-025.
