JOSEPH COREY FRANCIS RESPONDENT.
Comes the Petitioner, the Kentucky Education Professional Standards Board
(hereinafter “the Board”), by counsel, and the Respondent, Joseph Corey Francis
(hereinafter “Francis”), and both parties being duly informed, state as follows
1. Francis is a certified teaches in the Commonwealth of Kentucky, having been
issued certificate number|
2, Pursuant to Kentucky Revised Statutes (*KRS") 161.120 and 161.028, the
Board is authorized to issue and control all matters related to teacher certifcation net
otherwise delegated to another agency in the Commonwealth, The Board has the
sate esponsibility to protect the public from unprofessional conduct on the part of
certified teachers and administrators.
3, By letter dated February 27, 2004, Gary N. Seabome, Superintendent of Taylor
County Schools, reported Francis to the Board due to allegations that Francis, a teacher et
Taylor County School, had an inappropriate romantic relationship with a female student
4. Francis acknowledges that his conduct constitutes a violation of KRS 161 120
and 16 KAR 1:020, the Professional Code of Ethics for Kentucky School Certified
Personnel,
5. Francis and the Board agree to address this matter by Agreed Order. After
being signed by Francis, this Agreed Order shall be presented to the Board with a
recommendation for approval from the Board’s chief prosecuting attorney, or her
designee, at the next scheduled meeting of the Board following reccipt of the Agreed
Order. The Agreed Order shall not become effective until it has been approved by a
majority of the Board and signed by the chair of the Board,
Francis understands the Board is free to accept or reject this Agreed Order.
Francis hereby agrees to waive any right he may have to challenge, based solely on the
presentation of the Agreed Order to the Board, the impartiality of the Board to hear the
administrative action if, ater review by the Board, this Agreed Order is rejected.
Ifthe Agreed Order is not accepted by the Board, it shall be regarded as null and
void. Representations and/or admissions by Francis in this Agreed Order, or other
settlement proposals, will nt be regarded as evidence against Francis at any subsequentdisciplinary hearing. Francis shall be free to defend himself and no inference will be made
against Francis for his willingness to enter into this Agreed Order.
$. Following review by the Board of the facts and circumstances associated with
the case against Francis,
IT IS HEREBY ORDERED THAT:
Certificate numb is Fevoked for a period of fifteen (15) years
from the date this order is approved By the Board.
Furthermore, Francis is admonished for violating the Professional Code of
Ethies by engaging in an inappropriate and immoral relationship with a fifteen year
pid female student. This Board reminds Francis that og a teaching professional, he
has a duty to uphold the dignity and integrity of his Profession and to maintain a

on his behalf, at the conclusion of the fifteen (15) year revocation period is expressly

On January 28, 2004, I received a report from Gaylon Yarberry, the Principal of
Taylor County High School, that you were engaged in an inappropriate relationship with

grade, In the presence of Mr. I. jm oi mother, you admitted on
January 28, 2004 that you had driven ‘ome, that you had been alone wit in
Your apartment, and that you had held hands, hugged, and Kissed fIMMbon numero
occasions. Despite your behavior, parents have requested that you be permitted
to complete the 2003-04 schoo! year at the High School as long as you have no contact
with outside of her activities as a member of the band.
