CONTRACT OF USUFRUCT

KNOW ALL MEN BY THESE PRESENTS:


This CONTRACT OF USUFRUCT made and entered into
by and between:
THE LOCAL GOVERNMENT UNIT OF TANAUAN, LEYTE,
as represented by the Municipal Mayor HON. PELAGIO R.
TECSON, JR., of legal age, Filipino, married, with office address
located at the Municipal Hall, Real St., Tanauan, Leyte, and
hereinafter referred to as the LGU;

_____________________, likewise of legal age, Filipino,


resident of Brgy. ______________, Tanauan, Leyte, and hereinafter
referred to as the BENEFICIARY;
W I T N E S S E TH :

WHEREAS,
the LGU is a political sub-division organized
and existing under the laws of the Republic of the Philippines, is
an owner in fee simple of that Relocation Facility, herein-after
referred as the FACILITY, located at Brgy. Pago/Maribi, Tanauan,
Leyte, consisting of a residential house erected on certain
parcel of land, designated as Lot No. ____containing a total area
of ____ hectares, more or less, covered under Transfer
Certificate of Title (TCT) No. ________________ registered in the
name of LGU Tanauan, Leyte, and covered under Tax
Declaration No. ______, which serves as a permanent housing
unit for dwelling purposes and exclusively for the family use
only by the victims of Typhoon Yolanda who were relocated;
WHEREAS,
the BENEFICIARY is a resident of the coastal
area of Tanauan, Leyte as a bonafide independent family
primarily residing for at least one (1) month prior to the
occurrence of the Super Typhoon Yolanda within the 50-meter
No Build Zone, thereby expressing his/her desire to utilize the
RELOCATION FACILITY for purposes of his/her respective
permanent dwelling in the exercise of usufructuary rights;
WHEREAS,
the LGU is willing and generous to extend the
assistance to the BENEFICIARY covering under this contract of
usufruct by allowing his/her family to occupy and use the
RELOCATION FACILTY, without any rental, fees or charges
whatsoever shall be collected, subject however of the
GUIDELINES, TERMS and CONDITIONS herein-below
indicated;:

WHEREFORE, premises considered, the parties hereby


stipulate to undertake to carry into effect this CONTRACT OF
USUFRUCT UNDER THE FOLLOWING COVENANTS:
1. That the RELOCATION FACILITY will remain owned
by the LGU;
2. The BENEFICIARY will not be allowed to have the
RELOCATION FACILITY rented, sold or release to
other individuals;
3. No extensions nor expansions would be allowed;
4. Vandalism is strictly prohibited;
5. No clothes line in front of the RELOCATION
FACILITY would be installed;
6. Commercial structure would be allowed only in a
designated commercial area of the FACILITY;
7. No pigs/chicken nor any astray domesticated
animals be allowed;
8. Dogs/Pets should be controlled (Tinali or Inside
the dwelling unit);
9. The beneficiary (until the 4 th degree of
consanguinity/affinity) can use the facility as long
as the beneficiary wants to and remains to
comply with the foregoing guidelines, as well as,
the terms and conditions hereunder stipulated,
to wit:
a) Comply the Kapit Bahayan Membership
Training;
b)

Has no delinquencies in the payment of


the water and electric bills for one (1)
month;

c)

Remains to use the facility as their


housing

ordinary diligence of a good father of the

family in the care and maintenance of the


facility;
d) Participates

10. Failure to comply any of the foregoing


covenants, rules or regulations promulgated by
authority, constituting as a violation of this
Contract, shall be dealt accordingly, and in the
manner following:
a)

First Offense - Sternly warning

b)

Second Offense - Cite in Contempt

c)

Third Offense - Ejectment

This Contract shall be binding and obligatory on the part of the


heirs/administrators of the parties.
That this Contract has been read and translated into waray-waray, the
dialect which the parties have understood.
IN WITNESS WHEREOF, the parties hereto have executed this
instrument and signed this ________________________________ at Tanauan, Leyte,
Philippines.
