On 03-21-2013, Company "B" Texas Ranger James B. HOLLAND
responded to the scene of an officer involved shooting in
Wise County, Texas. Evidence was discovered that the
suspect in said shooting had previously murdered the
Colorado Department of Corrections Prison Director and a
Dominos Pizza delivery person. Ranger HOLLAND ensured all
evidence was photographed, marked, collected, and ensured
all pertinent witnesses and suspects were interviewed.
Subsequent interviews by Ranger HOLLAND showed that the
murder of the Colorado Department of Corrections Director
was ordered by hierarchy of the "211" prison gang. Ranger
HOLLAND forwarded all garnished information and evidence to
Colorado law enforcement authorities.

Ranger HOLLAND retains no custody of evidence requiring
disposition. In the absence of additional requests for
investigative assistance, this file is closed.
DETAILS:
1.1 On 03-21-2013, at approximately 11:25 AM, Company "B" Texas
Ranger James B. HOLLAND was advised by Texas Department of
Public Safety Communications personnel that Wise County
Sheriff's Department Deputies and Texas Highway Patrol
Troopers were in pursuit of a suspect vehicle, where the
driver had shot a Montague County Deputy, multiple times.
Ranger HOLLAND was further advised that said suspect had
repeatedly shot at pursuing law enforcement officers.
Ranger HOLLAND immediately entered his patrol vehicle and
traveled toward the Wise County Sheriff's Department, the
last known location of the pursuit.
1.2 On 03-21-2013, at approximately 11:30 AM, Ranger HOLLAND
arrived at the intersection of Business 380 and United
States Highway 380 in the city of Decatur, Wise County,
Texas. Ranger HOLLAND observed a dark colored 1991 Cadillac
four (4) door sedan bearing (NN registration i,
near the inside shoulder of United States Highway 380.
Ranger HOLLAND observed a white male lying on his back near
the vehicle. Said individual displayed a gun shot wound to
his temple area, just above and between both of his eyes.
Said subject was still breathing, but appeared to have a
mortal injury. Wise County Emergency Medical Services
personnel began providing medical attention to the subject.
Ranger HOLLAND observed a semi-automatic nine (9) millimeter
pistol magazine laying next to the subject. Ranger HOLLAND
observed a nine (9) millimeter Smith and Wesson semi-
automatic handgun laying approximately twenty (20) feet from
said individual in the grassy bar ditch area of United

States Highway 380. Ranger HOLLAND instructed Texas Highway
Patrol Trooper William COOPER to travel with the subject to
Wise Regional Hospital by ambulance. Ranger HOLLAND was
later advised the subject was transported by Life Flight to
John Peter Smith Hospital in Fort Worth. Ranger HOLLAND
instructed Wise County Sheriff's Department personnel and
Texas Highway Patrol Troopers to set up crime scene tape
around the immediate vicinity, and to limit access to the
crime scene.
1.3 On 03-21-2013, at approximately 11:35 AM, Ranger HOLLAND
made contact with Wise County Sheriff's Department
Lieutenant Art FERGUSON. Lieutenant FERGUSON advised that
multiple Sheriff's Deputies and Highway Patrol Troopers had
been involved in the pursuit, and that the suspect ran into
an eighteen wheeler as it entered the intersection of
Business 380 and United States Highway 380. Lieutenant
FERGUSON advised that the suspect had fired a round at his
(Lieutenant FERGUSON) patrol vehicle that struck inches
above his head. Lieutenant FERGUSON displayed glass
shrapnel cuts to his forehead area. Ranger HOLLAND observed
Lieutenant FERGUSON'S patrol vehicle to display a single gun
shot hole in the center of the driver side front window
Lieutenant FERGUSON advised that Wise County Sheriff's
Department Deputies Christopher HODGES and Cavin RIGGS had
fired multiple rounds at the suspect. Ranger HOLLAND
requested Lieutenant FERGUSON travel to the Wise County
Sheriff's Department and await Ranger HOLLAND'S arrival.
1.4 On 03-21-2013, at approximately 11:40 AM, Ranger HOLLAND
made contact with Wise County Sheriff's Department Deputy
Christopher HODGES. Deputy HODGES confirmed that he had
fired his duty weapon at the suspect multiple times. Ranger
HOLLAND requested Deputy HODGES travel to the Wise County
Sheriff's Department and wait for Ranger HOLLAND.

made contact with Wise County Sheriff's Department Deputy
Cavin RIGGS. Deputy RIGGS confirmed that he had fired his
duty weapon at the suspect multiple times. Ranger HOLLAND
requested Deputy RIGGS travel to the Wise County Sheriff's
Department and wait for Ranger HOLLAND.
1.6 On 03-21-2013, at approximately 11:50 AM, Ranger HOLLAND
made contact with Wise County Sheriff's Department Crime
Scene Technician Cori HARRIS. Ranger HOLLAND requested
Technician HARRIS begin photographing the crime scene.
1.7 on 03-21-2013, at approximately 12:00 PM, Ranger HOLLAND
made contact with Wise County Sheriff's Department Captain
Kevin BENTON. Captain BENTON advised that his personnel
would assist the Ranger's investigation of the crime scene,
collection of evidence, and photographing of the crime scene.
1.8 On 03-21-2013, at approximately 12:05 PM, Ranger HOLLAND
made contact with Decatur Police Department Chief Rex
HOSKINS. Chief HOSKINS advised that the suspect had shot at
him (Chief HOSKINS) and struck his patrol vehicle during the
pursuit. Chief HOSKINS further advised that one of his
patrol officers had shot at the suspect vehicle with a
shotgun. Ranger HOLLAND arranged for Decatur Police
Department patrol officers to mark and scale the crime scene
with a laser transit, as soon as the scene was photographed.
1.9 On 03-21-2013, at approximately 12:30 PM, Company "B" Texas
Ranger Tony BRADFORD arrived at the crime scene. Ranger
HOLLAND directed Ranger BRADFORD to take control of the
crime scene, direct the photographing, marking, and
collection of all pertinent evidence.
1.10 On 03-21-2013, at approximately 1:05 PM, Ranger HOLLAND made
contact with Wise County Sheriff's Department Deputy
Christopher Michael HODGES at the Wise County Sheriff's
Department in the conference room. Deputy HODGES advised he

(Deputy HODGES) fired multiple shots at the suspect driver,
after the suspect driver engaged him with gun fire.
1.11 On 03-21-2013, at approximately 1:16 PM, Ranger HOLLAND
secured Deputy HODGES issued Sig Sauer P-226 .357 Sig
pistol, serial number U777-534. Ranger HOLLAND removed one
(1) Gold Dot .357 Sig live round from said weapon's chamber
and removed said weapon's magazine. The magazine contained
nine (9) live .357 Sig Gold Dot rounds. Deputy HODGES
advised that when he loads his weapon, he places twelve
rounds in the magazine and then cycles a round into the
chamber. Deputy HODGES stated that he does not upload
another round into the magazine after initially cycling the
weapon's slide. Deputy HODGES concluded that he fired two
(2) rounds at the suspect, based on his (Deputy HODGES) live
round count. Ranger HOLLAND inspected two (2) spare
magazines that Deputy HODGES had on his duty belt. Both
magazines contained twelve rounds each. Ranger HOLLAND
photographed all items.
1.42 on 03-21-2013, at approximately 1:41 PM, Ranger HOLLAND
packaged, marked, and initialed the following items taken
from Deputy HODGES by Ranger HOLLAND:

1.43 On 03-21-2013, at approximately 2:08 PM, Ranger HOLLAND made
contact with Wise County Sheriff's Department Deputy Cavin
Paul RIGGS at the Wise County Sheriff's Department in the
conference room. Deputy RIGGS stated that he (Deputy RIGGS)
fired approximately five (5) rounds at the suspect, after

the suspect fired at responding officers, and turned to fire
at Deputy RIGGS.
1.14 on 03-21-2013, at approximately 2:21 PM, Deputy RIGGS
surrendered his department issued Sig Sauer .357 Sig Model P-
226 pistol, serial number U786-489, to Ranger HOLLAND. Said
weapon had one (1) live Speer Gold Dot .357 Sig round in the
chamber and five (5) live rounds in the weapon's magazine.
Deputy RIGGS believed that he had either ten (10) or eleven
(11) rounds in his magazine and stated that he does not load
his magazines to capacity and does not upload a round after
initially cycling his weapon. Ranger HOLLAND inspected two
(2) spare magazines that Deputy RIGGS had on his duty belt.
One (1) magazine had ten (10) Speer Gold Dot .357 Sig live
rounds in it, and the other magazine had eight (8) Speer
Gold Dot .357 Sig live rounds in it. Deputy RIGGS stated
that he did not load another magazine into his weapon at the
time of the shooting. Ranger HOLLAND photographed all items.
1.15 on 03-21-2013, at approximately 2:21 PM, Ranger HOLLAND
packaged, marked, and initialed the following items taken
from Deputy RIGGS by Ranger HOLLAND:

1.16 On 03-21-2013, at approximately 3:00 PM, Ranger HOLLAND
received a phone call from £1 Paso County Colorado Sheriff's
Department Inspector John SAN AUGUSTINE. Inspector SAN
AUGUSTINE advised that the suspect vehicle matched the
description of a vehicle that was utilized in the murder of
the Director of the Colorado Department of Corrections,

Thomas Lynn CLEMENTS, W/M, DOB: 10-02-1954, on 03-19-2013.
Inspector SAN AUGUSTINE requested Ranger HOLLAND wait on the
processing of the suspect vehicle until Colorado authorities
arrived in Decatur. Ranger HOLLAND advised that he would
wait to process the suspect vehicle until Colorado
authorities arrived.
147 on 03-21-2013, at approximately 3:20 PM, Captain BENTON
advised that he received a telephone call from the Denver
Colorado Police Department Homicide Division, and that they
believed the suspect vehicle may have been utilized in the
murder of a Domino's Pizza delivery person, Nathan Collin
LEON, W/M, DOB: 09-19-1985, in Denver, Colorado. Captain
BENTON further advised that Denver authorities had requested
that the suspect vehicle not be processed until they also
arrived in Decatur. Ranger HOLLAND advised Captain BENTON
that he had observed a Domino's Pizza hat and shirt in the
trunk area of the suspect vehicle. Ranger HOLLAND requested
Captain BENTON to communicate to Denver authorities that the
suspect vehicle would not be processed until they arrived in
Decatur.
1.18 on 03-21-2013, at approximately 3:47 PM, Ranger HOLLAND met
with Texas Highway Patrol Sergeant David CRAMER at the Wise
County Sheriff's Department conference room. Sergeant
CRAMER advised that he was involved in the pursuit of the
suspect vehicle, but did not fire his duty weapon. Ranger
HOLLAND advised Sergeant CRAMER he would contact him, at a
later date, to take a written statement from Sergeant CRAMER.
1.19 on 03-21-2013, at approximately 3:48 PM, Ranger HOLLAND met
with Texas Highway Patrol Sergeant Lloyd MCKINNEY at the
Wise County Sheriff's Department conference room. Sergeant
MCKINNEY advised he was involved in the pursuit of the
suspect vehicle, but did not fire his duty weapon. Sergeant
MCKINNEY advised he observed the suspect driver exit his
vehicle and fire a pistol at responding deputies. Sergeant

MCKINNEY provided Ranger HOLLAND with a digital video disc
(EXHIBIT 1.7) removed from Texas Highway Patrol Trooper Fred
THORTON'S in-car video recording device. Ranger HOLLAND
advised Sergeant MCKINNEY he would contact him, at a later
date, to take a written statement from Sergeant MCKINNEY.
1.20 On 03-21-2013, at approximately 3:52 PM, Ranger HOLLAND met.
with Texas Highway Patrol Trooper Fred THORTON at the Wise
County Sheriff's Department conference room. Trooper
THORNTON advised that he was involved in the pursuit of the
suspect vehicle, but did not fire his duty weapon. Trooper
THORNTON advised that he observed the suspect driver fall to
the ground after being shot, but did not actually observe
anyone shooting. Ranger HOLLAND advised Trooper THORNTON he
would contact him, at a later date, to take a written
statement from Trooper THORNTON.
1.21 On 03-21-2013, at approximately 3:56 PM, Ranger HOLLAND met.
with Texas Highway Patrol Trooper James BACON at the Wise
County Sheriff's Department conference room. Trooper BACON
advised that he was involved in the pursuit of the suspect
vehicle, but did not fire his duty weapon. Trooper BACON
advised that he observed the suspect driver exit his vehicle
and fire a pistol at responding deputies. Trooper BACON
provided Ranger HOLLAND the digital video disc (EXHIBIT 1.8)
removed from Trooper BACON'S in-car video recording device.
Ranger HOLLAND advised Trooper BACON he would contact him,
at a later date, to take a written statement from Trooper
BACON.
1.22 on 03-21-2013, at approximately 4:38 PM, Ranger HOLLAND
delivered EXHBITS 1.1, 1.2, 1.3, 1.4, 1.5, and 1.6 to Wise
County Sheriff's Department Property and Evidence Manager
Sendy REYNOLDS.
1.23 on 03-21-2013, at approximately 5:00 PM, Evidence Technician

(EXHIBIT 1.9), which contained downloaded media from the
digital camera Ranger HOLLAND had previously utilized to
obtain photographs of Deputies HODGES’ and RIGGS' duty
weapons, magazines, and bullets.
1.24 on 03-21-2013, at approximately 5:20 PM, Decatur Police
Department Sergeant Michael RANGE provided Ranger HOLLAND a
computer compact disc (EXHIBIT 1.10) containing photographs
Sergeant RANGE took of the crime scene.
1.25 on 03-21-2013, at approximately 7:30 PM, Ranger HOLLAND
completed a written statement (EXHIBIT 1.11) for Deputy
HODGES based on statements Deputy HODGES made to Ranger
HOLLAND. Deputy HODGES was represented by Christopher D.
LIVINGSTON, Attorney at Law, during the interview. Said
statement was as follows:
"In the late morning of 03-21-2013, I, Wise County Sheriff's
Department Deputy Christopher Michael HODGES was on patrol
in Wise County on State Highway 287 approximately one (1)
mile south of the Montague/Wise County line. I was dressed
in my issued department uniform and operating my assigned
marked patrol unit equipped with overhead lights and an in
car camera recording system.
I received radio communication that the driver of a black
Cadillac with Colorado license plates had assaulted a
Montague County Sheriff’s Department deputy. A short time
later I heard a Highway Patrol Trooper advise that he was
behind the suspect vehicle on State Highway 287 south of my
location. I then heard an officer advise that a pursuit of
the suspect vehicle had been initiated and that the suspect
vehicle had fired a weapon at pursuing law enforcement
officers. I activated my patrol vehicle’s emergency
equipment and proceeded toward the pursuit to assist the
officers. I then heard Wise County Sheriff’s Department
Lieutenant Art FERGUSON advise that he had been hit."

1.26 Deputy HODGES' statement continued:
"As the pursuit traveled south on State Highway 287 toward
Decatur, I continued southbound on State Highway 287 in an
attempt to catch up to the pursuit. I then heard radio
traffic indicating that the suspect vehicle had exited the
Farm to Market Road 51 ramp and turned right onto Business
380 West.
At this time I exited State Highway 287 southbound and
entered United States Highway 380 westbound. As I
approached the Wise County Sheriff's Department Office I
observed the suspect vehicle and pursuing law enforcement
vehicles traveling west on Business 380 approaching the
intersection of United States Highway 380 and Business 380.
I observed gray smoke coming from the suspect vehicle; and
the suspect vehicle failing to yield to pursuing law
enforcement vehicles which had their overhead lights
activated.
As the suspect vehicle entered the intersection it struck
and drove underneath an eighteen wheeler. I observed the
suspect vehicle to be dragged by the eighteen wheeler, and
then observed the eighteen wheeler drive over the suspect
vehicle. The suspect vehicle came to rest near the outside
shoulder of United States Highway 380, partially in the east
barrow ditch."
1.27 Deputy HODGES' statement continued:
"After seeing the collision I advised dispatch of the
collision, TI then turned left at the intersection of
Business 380 and United States Highway 380. I positioned my
patrol vehicle in the intersection facing eastbound
approximately twenty yards from the suspect vehicle, and
facing toward the rear of the suspect vehicle.

I observed the suspect vehicle to be partially engulfed in
flames; I did not believe the driver survived the
collision. As I was placing my vehicle in park, I observed
the driver of the suspect vehicle, a white male, exit the
vehicle, turn toward me, and square his body in my
direction. I then observed the suspect driver to have a
black handgun in his right hand.
As I was attempting to exit my patrol vehicle, I observed
the suspect driver stare directly at me, point the black gun
directly at me, and fire multiple rounds directly at me. As
the suspect driver fired his weapon at me I knew I was going
to die. I observed the suspect driver’s pistol recoil as I
ducked while exiting my patrol vehicle.”
1.28 Deputy HODGES' statement continued:
"After avoiding the suspect’s attempt to shoot me by
ducking, I continued exiting my patrol vehicle and then
immediately drew my issued Sig Sauer P-226 service pistol.
As I was drawing my issued service pistol I feared for my
life and safety, and knew that I had to stop the driver’s
assaultive actions before he killed me or someone else.
As I was continuing to exit my vehicle, clearing my patrol
vehicle's driver side door, and bringing my weapon up toward
the suspect driver, I observed the suspect driver standing
directly in front of me. At this time I began engaging the
suspect driver by firing my issued service pistol two (2) or
three (3) times at the suspect driver.
After I fired my issued service pistol I observed the
suspect on the ground. At this time I observed Wise County
Sheriff’s Department Deputy Cavin RIGGS approaching the
suspect driver from my right. Both Deputy RIGGS and I
cautiously approached the suspect driver with our weapons

1.29 Deputy HODGES' statement continued:
"As I approached the suspect driver I observed the suspect
driver to have a black semi-automatic pistol clenched in his
hand. I observed the weapon’s slide to be locked to the
rear. I immediately grabbed the suspect's weapon and threw
it to my left away from the suspect. I observed the suspect
driver to have a single gunshot wound to the middle of his
forehead.
I observed Texas Highway Patrol Troopers approaching the
suspect driver and I backed away from the suspect driver.
Lieutenant Art Ferguson then removed me from the immediate
scene and I was eventually placed in Wise County Sheriff's
Department Lieutenant Chuck GOMEZ’ vehicle.
A short time later Texas Ranger James B. HOLLAND advised me
to travel with Wise County District Attorney’s Office
Investigator Wes WALLACE to the Wise County sheriff’ s
Department and standby until Ranger HOLLAND was able to meet
with me."
4.30 Deputy HODGES' statement continued:
"Ranger HOLLAND later met with me in the Sheriff's
Conference room and secured my service pistol, my service
pistol’s magazine, and the rounds that were inside my
service pistol at the time of the incident. A short time
later I was advised by Wise County Sheriff’s Department
Captain Kevin BENTON to go home and standby for Ranger
HOLLAND to contact me. Ranger HOLLAND then contacted me to
come to the Texas Ranger office and prepare this statement.

1.82 on 03-21-2013, at approximately 8:26 PM, Ranger HOLLAND
spoke with Company "BY Texas Ranger Eisenhower UPSHAW by
telephone. Ranger HOLLAND had previously requested Ranger
UPSHAW travel to John Peter Smith Hospital and attempt to
identify the suspect and secure any evidentiary items
removed from the suspect. Ranger UPSHAW advised that the
suspect's fingerprints had been taken and submitted to the
Federal Bureau of Investigation. Ranger UPSHAW advised he
received a fingerprint "Hit confirmation" (EXHIBIT 1.15)
from the Federal Bureau of Investigation Special Processing
Center that identified the white male suspect as Evan
Spencer EBEL, W/M, DOB: 08-16-1984.

1.33 On 03-21-2013, at approximately 11:00 PM, Company "B" Texas
Ranger Anthony BRADFORD provided Ranger HOLLAND an Affidavit
for Search Warrant (EXHIBIT 1.16) and a Search Warrant
(EXHIBIT 1.17) prepared by Ranger BRADFORD, and signed by
271st Judicial District Judge John FOSTEL, authorizing a
search of the suspect vehicle, a 1991 black Cadillac four
(4) door sedan bearing [NNN registration NM. Said
vehicle had been removed to and secured at the Wise County
Sheriff's Department.
1.34 On 03-22-2013, prior to processing the suspect vehicle,
Ranger HOLLAND met with Texas Department of Public Safety
Crime Laboratory Garland personnel, 1 Paso County Sheriff's
Department Inspector San AUGUSTINE, Montague County
Sheriff's Department Detective Jack MCGUINN and Denver
Colorado Police Department Homicide Detective Joel HUMPHREY
at the Wise County Sheriff's Department. Detective HUMPHREY
advised that EBEL matched the description of an individual
that murdered a Domino's Pizza delivery person in Denver,
Colorado. Detective HUMPHREY advised a nine (9) millimeter
handgun was utilized to murder the victim, and that the
victim's Domino's Pizza uniform had been taken during the
murder. Inspector SAN AUGUSTINE advised that EBEL was the
primary suspect in the murder of the Colorado Director of
Prisons, which occurred in Colorado springs, Colorado
Inspector SAN AUGUSTINE advised that a nine (9) millimeter
pistol was utilized in said murder. Both Inspector SAN
AUGUSTINE and Detective HUMPHREY requested to be present
during the processing of the suspect vehicle.
1.35 On 03-22-2013, at approximately 10:00 AM, Rangers HOLLAND
and BRADFORD executed the search warrant of the suspect
vehicle. Texas Department of Public Safety Criminal
Laboratory Garland personnel photographed and processed the
suspect vehicle for fingerprints and DNA evidence. Ranger
HOLLAND observed the following items of interest while the
vehicle was being processed:

A Domino's Pizza hat, shirt, and pizza box, a shovel with
apparent human hair, a bag of lime, drain cleaner, zip ties,
two (2) walkie talkies, a video surveillance device, gun
powder, bombing making materials including two (2) partially
assembled pipe bombs, electronic detonation (timer and
circuitry) devices, nine (9) millimeter pistol ammunition,
philosophical books, literature on bomb making and white
supremacy, surveillance type photographs, directions to
various Colorado official's residences, including the
Colorado Prison Director's residence, colored contacts, face
masks, multiple items of clothing, including bloodied pants
and a bloodied shirt. (See Texas Department of Public
Safety lab report and inventory of collected items for
specific details.)
1.36 On 03-22-2013, Ranger HOLLAND assisted laboratory personnel
in removing a black LG cellular telephone (EXHIBIT 1.18)
from the front passenger area of the suspect vehicle. Said
phone was photographed by laboratory personnel.
1.87 On 03-22-2013, at approximately 2:29 PM, Ranger HOLLAND
submitted EXHIBIT 1.18 (LG cellular telephone) to Federal
Bureau of Investigation Special Agent Fernando BENAVIDES for
forensic examination.
1.38 On 03-22-2013, at approximately 2:45 PM, Federal Bureau of
Investigation Assigned Special Agent Terry LAMBETH provided
Ranger HOLLAND information that

MMMM Ranger VANCE advised gm stated he had no knowledge
of the Colorado murders, but that EBEL had contacted him and
stated he (EBEL) was in trouble and needed to stay at J
residence. Ranger VANCE advised that [ stated he told
EBEL to stay away and that EBEL was not welcome at [i
residence. Ranger VANCE advised that jg had consented to
a forensic examination of his MMM cellular phone. Ranger
VANCE advised MM stated he had erased all of the contacts
in his phone, including incoming and outgoing calls, from
individuals he knew were associated with "211."
1.40 on 03-22-2013, at approximately 3:51 PM, Ranger VANCE
electronically mailed Ranger HOLLAND an electronic message
that contained electronic media (EXHIBIT 1.19) retrieved
from MMM cellular telephone.
1.41 On 03-22-2013, at approximately 7:03 PM, Texas Department of
Public Safety Criminal Laboratory Forensic Scientist Jack
FLANDERS provided Ranger HOLLAND the following items:
(EXHIBIT 1.20) A computer compact disc that contained
digital images that had been taken of the suspect vehicle
and items removed from the suspect vehicle.
(EXHIBIT 1.21) An inventory and description of items
removed from the suspect vehicle and transferred to the El
Paso County Colorado Sheriff's Department.
(EXHIBIT 1.22) An inventory and description of items
removed from the suspect vehicle and transferred to the
Denver Colorado Police Department.
(EXHIBIT 1.23) An inventory and description of items
removed from the suspect vehicle and retained by Texas

1.42 On 03-22-2013, at approximately 10:44 PM, Ranger HOLLAND
received electronic communication (BXHIBIT 1.24) from
Special Agent BENAVIDES which stated the following: An
initial forensic examination of the cellular phone
discovered in the suspect vehicle did not show any incoming
or outgoing phone calls. The forensic examination showed
the cellular telephone to be registered to phone number
(719) 337-3582. Two (2) digital photographs (EXHIBIT 1.25
and EXHIBIT 1.26) were successfully downloaded from the
telephone's "SD" card.
1.43 on 03-25-2013, at approximately 9:00 AM, Ranger HOLLAND
completed a written statement (EXHIBIT 1.27) for Deputy
RIGGS based on statements Deputy RIGGS made to Ranger
HOLLAND. Said statement was as follows:
"On 03-21-2013, at approximately 11:00 AM, I, Wise County
Sheriff's Department Sergeant Cavin Paul RIGGS, was parked
at the Wise County Sheriff’s Department parking lot
attempting to fix my in-car computer. At this time I was
dressed in my issued uniform and seated in my marked patrol
unit with overhead lights.
A short time later I heard radio communication that a
Montague County Sheriff's Department Deputy had been shot
and that the suspect vehicle was fleeing south on State
Highway 287. I immediately traveled to State Highway 287
and drove north toward the suspect vehicle. I then heard
radio traffic that the suspect was shooting at pursuing law
enforcement officers."
1.44 Deputy RIGGS' statement continued:
"As the pursuit approached the Dubb Johnson Arena north of
Decatur, I crossed the grassy median of State Highway 287
and entered the pursuit of the fleeing black Cadillac, now
southbound on State Highway 287. The pursuit continued

south into Decatur at a high rate of speed. In the vicinity
of State Highway 287 and Farm to Market Road 1810, I
observed a large ploom of white smoke emanate from the
fleeing suspect vehicle. The suspect vehicle continued
southbound on State Highway 287 and took the Farm to Market
Road 51 South exit and then turned right onto Business 380.
The suspect vehicle continued west on Business 380 at a high
rate of speed. As the suspect vehicle approached United
States Highway 380, I observed the suspect vehicle disregard
the red light at the intersection of Business 380 and United
States Highway 380. As the suspect vehicle entered the
intersection of Business 380 and United States Highway 380,
I observed the suspect vehicle strike an eighteen wheeler.
The suspect vehicle came to rest on the east shoulder of
United States Highway 380, partially in the grass barrow
ditch."
1.45 Deputy RIGGS' statement continued:
"I immediately pulled onto the right shoulder of Business
380 and exited my vehicle with my issued service pistol
drawn. At this time I observed a white male open the driver
side door of the suspect vehicle and exit the suspect
vehicle. I then observed the white male suspect to have a
black handgun in one of his hands. The white male suspect
immediately fired one (1) round from said pistol in the
direction of Wise County Sheriff’s Department Deputy
Christopher HODGES. At this time Deputy HODGES was located
in the center of the intersection of United States Highway
380 and Business 380.
Fearing for the life of Deputy HODGES, and other responding
law enforcement officers, I fired two (2) rounds from my
issued service pistol at the white male suspect. I observed
the white male suspect buckle and slightly fall forward.
The white male suspect then stood back up, and looked in my

direction. I observed the white male suspect to be bleeding
from his forehead. I then observed the white male suspect
attempting to bring the black pistol up toward me. At this
time, fearing for my life, I fired three (3) rounds from my
issued service pistol at the white male suspect. The white
male suspect immediately fell to the ground landing on his
back."
1.46 Deputy RIGGS' statement continued:
"I approached the white male suspect with my weapon drawn.
I observed another law enforcement officer approach the
suspect and remove the suspect’s weapon from on or around
the suspect. This officer then threw the weapon in the
grassy barrow ditch. After I observed other officers
securing the suspect I advised communications that shots had
been fired and requested medics to the scene.
Wise County Sheriff’s Department Lieutenant Art FERGUSON
then approached me and advised me to wait by my vehicle
until the Texas Ranger arrived. A short time later Texas
Ranger James B. HOLLAND arrived and advised me to go to the
Wise County Sheriff’s Department and standby until Ranger
HOLLAND had time to talk to me. Wise County Sheriff's
Department Detective Anissa SATTERFIELD then drove me to the
Wise County Sheriff’s Office."
1.47 Deputy RIGGS' statement continued:
"Approximately forty five minutes later Ranger HOLLAND
arrived and secured my issued service pistol and counted the
number of rounds in my service pistol and issued magazines.
Shortly after this Wise County Sheriff’s Department Captain
Kevin BENTON advised me to go home and wait for Ranger
HOLLAND to contact me.

1.52 On 03-25-2013, at approximately 7:09 PM, Ranger HOLLAND made
contact with the New Mexico State Police (based on multiple
examinations of the photographs retrieved from EBEL'S
cellular telephone) and requested that the photographs
retrieved from EBEL'S cellular telephone be disseminated to
New Mexico authorities in an attempt to ascertain the
location of the photographs.
1.53 On 03-26-2013, at approximately 12:11 PM, Ranger HOLLAND met

the Smith County Sheriff's Department located in Tyler,
Texas.
1.54 On 03-26-2013, at approximately 12:45 PM, Ranger HOLLAND

MMMM subsequently surrendered his Apple cellular telephone
and signed a consent to search electronic media form
(EXHIBIT 1.35). The phone was transferred to Company "B"
Texas Ranger Brent DAVIS for a forensic examination. At the
conclusion of the interview, Ranger DAVIS returned J
phone to [MMM and provided Ranger HOLLAND a digital storage
device (EXHIBIT 1.36) containing information captured from
MMMM cellular phone. Said device contained phone numbers,
contacts, texts, incoming calls, and outgoing calls that
MMMM hed previously deleted. yy stated the following:
A) MMM met "EVIL" while incarcerated in the Colorado
Department of Corrections. jj and "EVIL" were
incarcerated in the same unit in 2010 or 2011. [My was
never in the same "pod" as "EVIL" but did share an adjacent
wreck yard with "EVIL." | communicated with "EVIL" on a

B) MMMM descrbed "EVIL" as a "stand up guy" that did not
lie, steal, use drugs, and could hold his own in a fight.
MMMM stated that both he and "EVIL" were "foot soldiers" in
the "211" prison gang. Neither nor "EVIL" ever held a
position of rank in "211."
C) QMlMMstated "EVIL" was initially engrossed in the white
supremacy movement and "211." However, as "EVIL" came
closer to his release date, he moved away from his “hard
core" Aryan/Nazi beliefs and from "211." (M described
"EVIL" as not being a true believer in the Aryan way of life
because "EVIL" would communicate with other races and had a
"Mexican" uncle.
D) NM stated th because of "EVIL’S" lack of rank in
"211," "EVIL" could not order"stomping." MM advised that
only a member of "211" with rank could order any type of
action. [JM stated "EVIL’S" interaction with the "211"
hierarchy would have been extremely limited while in prison,
but that I knew "EVIL" was well liked by the "211"
hierarchy.

E) [MMMM described “EVIL” as being extremely paranoid and
very guarded in his conversations. [MM advised he never
heard “EVIL” talk about killing anybody, but stated he was
quite philosophical.
F) [MMMM stated that three (3) weeks prior to his release
in April of 2012, he was charged with a crime in the
Colorado prison system. “EVIL” spoke with his father

from prison, “EVIL” contacted [MM by telephone. “BVIL"
advised that his father had gotten him a job in a law firm,
secured him an apartment, and was helping him secure a driver

J) [MMMM advised that he spoke to “EVIL” on a regular basis
and often received calls from and called "EVIL'S" place of
employment (law firm) to facilitate conversation during "EVII
3" lunch hour.
K) MMMM advised that “EVIL” was not using drugs anwas
avoiding contact with other “211” gang members in the Denver
area, duc to their propensity to utilize drugs.
L) [MMMM advised that “EVIL” was having an extremely

told him that all of his struggles were caused by “Ad Seg.”

evolved around “EVILS” struggles to adjust to society and“

positive “EVIL” was not doing drugs, and that “EVIL,” as
more time passed, appeared to be doing better with his
transition to the “free world.”
N) MMM stated “SVIL” told him he (“EVIL”) was “fucking”
two (2) or three (3) different “chicks,” but was not

Q) [MMM stated he routinely spoke to “211” hierarchy
member Hog - Chris MIDDLETON.” stated MIDDLETON was
released to Colorado Springs, and had been staying out of
trouble. [MJ stated MIDDLETON told him he had been
routinely communicating with “EVIL.” [J stated “EVIL”
told him he had spoken to MIDDLETON on one (1) or two (2)
occasions. MJ concluded that MIDDLETON would have had
nothing to do with “EVIL” if he knew “EVIL” was planning a
murder. [MMM believed MIDDLETON had stepped away from his *
211” ties.
R) MMMMMstated his communication with “EVIL,”
approximately two (2) weeks prior to “EVIL" death was
random, but probably occurred every day to every three (3)
days, occasionally with multiple conversations in the same
day.
S) [MMMM did not find out about the CLEMENT’S murder until
several days after it happened, and believed that his father
told him and sent him an e-mail link. [gM believed, based
on initial news stories, that the “Sand Nigger Prince”
ordered the hit. [MM stated it never crossed his mind that
“EVIL” had done it. [MM stated he was incarcerated in the
same unit as the “Sand Nigger Prince,” but did not recall
any direct contact. [JM stated he did not believe “EVIL”
knew or had contact with the “Prince,” and that he would not
think so because the “Prince” surrounded himself with “
Nigger Muslims.” However, [ll stated that “EVIL”
communicated with “Niggers and Mexicans” on a regular basis
in prison because “EVIL” was not a true Aryan.

EVIL" was not out of the ordinary, and that "EVIL" was “
hanging with a chick,” and trying to get his license. [ml

MMMM stated, due to “EVIL'S” extreme paranoia, he rarely

of the Texas shooting. | believed he received the call
approximately one (1) hour before “EVIL” was killed, and
after “EVIL” shot the Montague County Deputy. [NN based
his conclusions on the fact that this was the first time ™
EVIL” displayed a change in behavior or seemed excited.
MMMM stated he spoke to “EVIL” for approximately 45
seconds. MJ stated he did not hear any police sirens or
shooting in the background. [lJ believed the call came
from a “719” area code. j) stated “EVIL” said, in an
extremely excited manner, that he was in a bind and needed
to go to [NNN house. [MM stated that he asked “BVIL"
four (4) times what “EVIL” did. [J stated that “EVIL”
would not answer him and that he finally heard a click and
the call went dead. jy stated it sounded like “EVIL” was
ina car at the time of the phone call. [i stated “EVIL”
knew that MM lived in JNM, but did not know J
address.

X) [NNN stated “EVIL” would not have been able to find
anyone dumb enough in “211” to commit the murders with him.
MMMM stated he knew of multiple “stompings” that “211” had
ordered, but never knew of an actual murder “211” ordered.
MMMM stated that “EVIL” was “fucking 211” and that “211”
would not go after the Director because it would be “bad for
business.” MM) stated “211” would not order the Director's
“hit” because the Director had just gotten there. mM did
not believe “211” really ordered “hits,” and because no one
in their right mind would carry out such an order. [i
stated if something like this was ordered, only “211 General”
Ben DAVIS could order it.
Y) [NE stated there was no legitimacy to "211" ordering
the Directors “hit.” jg stated “EVIL” was too paranoid to
work with anyone else, and that “EVIL” would not trust
anyone that much.
2) (MMMM stated any information “EVIL” would have garnished
about making bombs would have come from literature readily
available in the prison. [jl knew of no specific “211”
members “fucking with bombs,” but did know that people that
made bombs were “there.”

211,” but not a “General.” gM stated “THOR” was a fifteen
year old kid that "211" members visited out of respect for
his father, who was serving a life sentence. [J stated he
communicated with “THOR” often. [jj stated “THOR” called
him twice after learning of “EVIL'S” death. [jg stated *
THOR” was extremely disturbed by “EVIL'S” death and that “
EVIL" had been spending a lot of time with “THOR.” [i
stated he also spoke to “THOR’S” mother, who was a former
“skinhead.” jl stated “THOR” was with “EVIL” when a gang
task force “kicked in” “EVIL'S” door. [jg told “THOR” that
the police would be coming to see him. stated “THOR”
never told him he knew anything of “EVIL'S” plans or
assisted “EVIL” in anyway. |) surmised that if anyone
assisted "EVIL" with anything other than the actual murder,
it would be “THOR.” However, IM did not believe "THOR"
had any involvement.

DD) MMMM stated he knew of no set code that “211” was
using. [MMM stated “211” learned their lesson after
multiple members were indicted in 2005, in reference to
standard codes. [MM stated most codes used by “211” are
individual to the two (2) people communicating. [iil
indicated orders came down from above ordering communication
and codes be limited to individual communication in order to
avoid communication being deciphered or intercepted.

photographs, and that when “EVIL” wanted pictures sent to
him he would have [MJ send them to the cell phone of
someone “EVIL” was with, at the time. [MM stated if law
enforcement wanted to know who “EVIL” was with, they should
examine pictures that were sent to phone numbers that were
labeled “SVIL picture #1,” and EVIL picture #2” on his phone
and outgoing message list. [J did not know who those
phones belonged to, only that “EVIL"was with them when the
pictures were sent.
FF) [NNN stated that when his boss called him and told him
the Texas Rangers were looking for him, he erased all
outgoing and incoming phone calls, messages, and texts on
his phone that involved “EVIL” and any “211” member or
associates. [JM stated some of the contacts he erased, at
this time, were "EVIL'S,” Crystal LNU (712 number), and
Chris MIDDLETON. stated he erased said contacts,
incoming calls, outgoing calls, messages, and texts so that
law enforcement would not find them and to keep himself out
of trouble.
1.64 SN interview continued:
At the conclusion of the interview, NN refused to take a
polygraph. Ranger HOLLAND later spoke to NNN counsel,
who stated that he would allow gy to take a polygraph. On
03-27-2013, NNN attorney contacted Ranger HOLLAND and
advised that he had spoken to jj, at length, about the
investigation. INN attorney advised that [MM had
provided all pertinent information and that J would not
submit to a polygraph. Said attorney stated J would
continue to cooperate with Ranger HOLLAND, if Ranger HOLLAND

1.65 On 03-26-2013, at approximately 6:26 PM, Ranger HOLLAND
spoke to Detective HUMPHREY by telephone. Detective
HUMPHREY advised he had interviewed Brandi SMITH, W/F, DOB:

MEN, 2s former girlfriend of Evan EBEL. Detective
HUMPHREY stated SMITH provide the following information
during said interview:
A) EBEL was stepping away from "211," and had cut his ankle
monitor off after getting in an altercation with a counselor
at a required anger management class.
B) SMITH saw EBEL prior to the Dominos Pizza delivery
person murder. Later that same date (after the murder),
SMITH again saw EBEL. At this time, EBEL had changed his
shirt and had moved all of the luggage in his vehicle from
the trunk to the back seat area of the vehicle.
C) EBEL contacted SMITH by telephone and requested SMITH to
check the internet to see if he (EBEL) was listed as a
wanted person.
1.66 Information regarding Brandi SMITH interview continued:
D) EBEL told SMITH that he had made plans "to make his mark
on the world," prior to ever meeting SMITH.
E) On 03-15-2013, SMITH observed EBEL to possess a pistol,
gun magazines, and bullets. On 03-16-2013, EBEL purchased a
bag of lime and a bottle of lye. Around 03-10-2013 to 03-17-
2013, EBEL purchased gun powder.
F) In March, EBEL began talking about his desire to kill a
"stripper" named Crystal LNU. In March, EBEL had wired
$180.00 to a different state. At this same time, SMITH
observed correspondence that stated, "it ships tomorrow."
1.67 Information regarding Brandi SMITH interview continued:
G) EBEL had made comments to SMITH that he was trying to
"get to Costa Rica." Approximately a week prior to EBEL'S

death, EBEL had purchased a security camera and a web
camera. EBEL returned the web camera to Best Buy because he
could not figure out how to use it.
H) EBEL did not use drugs or alcohol. EBEL made comments
that he would never use anything that would "alter" his
mental state.
1.68 On 03-27-2013, at approximately 10:00 AM, Ranger HOLLAND
received a digital video disc (EXHIBIT 1.37) from Montague
County Sheriff's Department Detective Jack MCGUINN. Said
disc contained video footage captured from Montague County
Sheriff's Department Deputy James BOYD'S in-car video camera
recording device. The footage showed BOYD stopping the
suspect vehicle, approaching the suspect vehicle, and then
BOYD being shot.
1.69 On 03-27-2013, at approximately 10:45 AM, Ranger HOLLAND
received an electronic message from Detective HUMPHREY.
Said message contained an audio file (EXHIBIT 1.38) that was
retrieved from a digital recorder discovered in the suspect
vehicle. The recording can best be described as some type
of manifesto that discusses the evils of the Colorado prison
system.
1.70 on 03-27-2013, at approximately 1:50 PM, Crime Scene
Technician Cori HARRIS provided Ranger HOLLAND a detailed
inventory (EXHIBIT 1.39) of all items that were removed from
the suspect vehicle and retained by the Wise County
Sheriff's Department.
1.71 On 03-28-2013, at approximately 8:00 AM, Ranger HOLLAND was
contacted by Inspector SAN AUGUSTINE and advised that EBEL
had been utilizing the identity of Dustine Paul MCKAY, W/M,

received a work up (EXHIBIT 1.40) on MCKAY from the Texas
Department of Public Safety Intelligence and
Counterterrorism Division. Ranger HOLLAND subsequently
forwarded said information to Company "B" Texas Ranger
Stacey MCNEAL, and requested Ranger MCNEAL interview MCKAY
(SXHIBIT 1.44).
1.73 on 03-28-2013, at approximately 9:15 AM, Ranger HOLLAND
received information from Inspector SAN AUGUSTINE he had
discovered phone records that showed EBEL had made phone
calls to (MMMM (Houston phone number) and EBEL had
correspondence with a Jack ZABRINSKI of Lubbock, Texas,
while he (EBEL) was incarcerated in prison. Ranger HOLLAND
subsequently contacted Company "C" Texas Ranger Tony ARNOLD
and Company "A" Texas Ranger Jeff OWLES, requesting they
investigate said information.
1.74 On 03-28-2013, at approximately 12:35 PM, Ranger HOLLAND
received electronic correspondence from Special Agent
BENAVIDES, which included an electronic file (BXHIBIT 1.41)
that contained phone records for telephone number (303) 882-
2130, a cellular phone utilized by EBEL.
1.75 On 03-28-2013, at approximately 5:16 PM, Ranger HOLLAND was
advised by Special Agent BENAVIDES that Colorado authorities
had mistakenly requested phone records (the cellular
telephone retrieved from the suspect vehicle) for February
2013, instead of March 2013. Special Agent BENAVIDES
advised that said cellular telephone had not been activated
until March 2013, and that AT&T had responded to Colorado
authorities request for information with no phone records
found.
1.76 On 03-28-2013, at approximately 6:00 PM, Ranger HOLLAND made
an Exigent Circumstances request (EXHIBIT 1.42) to AT&T for
subscriber information and call records with location, for
cellular telephone number (719) 337-3582 (the cellular

1.77 On 03-28-2013, at approximately 6:44 PM, Ranger HOLLAND
received (via electronic mail from AT&T) phone records and
cell tower locations utilized for phone number (719) 337-
3582 (EXHIBIT 1.43). Ranger HOLLAND subsequently forwarded
said information to the Texas Department of Public Safety
Fusion Center and requested a geographical overlay map for
the location all calls were made from.
1.78 on 03-28-2013, at approximately 7:53 PM, Ranger HOLLAND
spoke with Detective HUMPHREY reference an interview he had
conducted with Crystal WALOR, W/F, DOB: _—_—//.
Detective HUMPHREY advised his investigation had determined
that WALOR was the female (known as Crystal) that EBEL had
made statements about wanting to kill. Detective HUMPHREY
stated he had garnished information that WALOR had been
involved in a sexual relationship with both Evan EBEL and
Jack BBEL. Detective HUMPHREY advised that WALOR provided
the following information in said interview:
A) WALOR was married to a "211" member, Dennis SIMONTON,
who was currently incarcerated in the Colorado Department of

described Evan EBEL as a crazy, psychotic, paranoid
individual that hated everyone and did not trust anyone.
WALOR had observed Evan EBEL, on multiple occasions, to pace
back and forth while making psychotic indiscernible
statements. WALOR knew Evan EBEL to not partake in smoking,
drinking of alcoholic beverages, or using illicit drugs.
B) Evan EBEL had requested WALOR purchase a pistol for him
(Svan EBEL). WALOR described an incident, after she tried
to distance herself from Evan EBEL, in which both Evan and
Jack EBEL had waited for WALOR to leave her residence, and
then followed WALOR around Denver for an entire day.

MMMM stated no other conversation occurred regarding this
call. (MMM stated he knew EBEL from approximately 2009-
2010. (NNN stated he was confined in an aggravated
segregated unit and only spoke to EBEL, on occasion, through
the wall. [NM stated EBEL was unpredictable and
constantly caused trouble. [MMM stated EBEL did not
reveal any information during the conversation indicating
EBEL was planning on hurting anyone. [NNN did not know
the current status of BBEL and acted very surprised when
Ranger OWLES explained EBEL’S recent criminal episode.
MMMM stated while incarcerated he belonged to the “211”
gang. [MMMM stated he was “jumped out” of the gang, prior
to being released to prison, as he was trying to remove
himself from gang life. [NNN] gave some history concerning
the “211” gang. [NNN stated the gang was similar to the
Aryan Brotherhood, and focused on “white supremacy.” [ml
stated that the gang was unpredictable and after he was
jumped out” he lost the ability to learn of sensitive
information concerning the gang.

was featured concerning his involvement with the “211”
gang. [NNN stated the “211” name came from the offense
code for Robbery, because most of the original members were
incarcerated for Robbery.

1.83 On 03-29-2013, at approximately 4:00 PM, Ranger HOLLAND
received an electronic message from Ranger ARNOLD describing
Ranger ARNOLD'S efforts to track down a Lubbock phone number
EBEL had called multiple times. A synopsis of Ranger
ARNOLD'S investigation follow:
On Thursday, 03-28-2013, at 10:00 AM, Ranger ARNOLD traveled
to 12004 County Road 1800 in Lubbock County, Texas, and
located the Marietta Assisted Living Center. The facility
was actually located at 11902 CR 1800 (Frankford & 121st
Street) and is a single-story residence, transitioned into
an assisted living facility.
Ranger ARNOLD met with Patricia LOPEZ, H/F, D0}: i!
a 5 (five) year employee. LOPEZ viewed a mug shot of
suspect, Evan EBEL, and indicated EBEL had not been to the
facility, and they had no visitors fitting his description.
LOPEZ indicated she was unsure if they had a resident named
Jack ZABRINSKI (or variance of the name); however, LOPEZ
remembered a resident who passed away three (3) years ago,
who was a veteran, who may have had a name similar to
ZABRINSKI.

On Friday, 03-29-2013, at 9:45 AM, Ranger ARNOLD
telephonically contacted LOPEZ. LOPEZ checked with the
owners and determined their prior resident (veteran) was not
ZABRINSKI. LOPEZ recalled approximately four (4) years ago,
two (2) females worked at their facility and they had a
white male associate who appeared to be similar to EBEL.
LOPEZ indicated the two (2) females were Katrina FARRIS
(from Hawaii and Dallas) and Viviane LNU (from Lubbock) .
1.84 On 03-29-2013, at approximately 7:57 PM, Ranger HOLLAND
received electronic correspondence from the Texas Department
of Public Safety Fusion Center, which contained a map
overlay of the locations EBEL made cellular telephone calls
from (EXHIBIT 1.45). Said media displayed EBEL'S movements
on 03-19-2013 (the date of the CLEMENTS' murder), in
Colorado Springs, Colorado, and EBEL'S subsequent movements
from Colorado through New Mexico, and finally terminating
with the last location on 03-21-2013, in Montague/Wise
Counties, Texas. Ranger HOLLAND subsequently forwarded the
map overlays pertaining to New Mexico to the New Mexico
State Police.
1.85 on 03-29-2013, at approximately 3:00 PM, Ranger HOLLAND
contacted Company "F" Texas Ranger Gary PHILLIPS and
requested Ranger PHILLIPS to investigate phone calls EBEL
made to telephone number (512) 789-4393.
1.86 On 03-30-2013, at approximately 8:42 AM, Ranger HOLLAND
spoke to New Mexico State Police Sergeant Ben ROMERO by
telephone. Sergeant ROMERO advised New Mexico authorities
had located the location of the two (2) photographs taken by
EBEL in New Mexico. Sergeant ROMERO further advised both
locations would be searched for any pertinent evidence by
New Mexico authorities. Sergeant ROMERO later advised, both
locations had been searched and no evidentiary items were
discovered.

1.90 on 04-02-2013, at approximately 4:53 PM, Ranger HOLLAND
received electronic correspondence from the Texas Department
of Public Safety Intelligence and Counterterrorism Center,
which included an "I2" chart (EXHIBIT 1.49) displaying Texas
phone calls made to and from Evan EBEL'S cellular phone.
1.91 on 04-03-2013, at approximately 9:27 AM, Ranger HOLLAND
received electronic correspondence from The Texas Department
of Public Safety Intelligence and Counterterrorism Center,
which included a analytical report (EXHIBIT 1.50) for Ruben

received electronic correspondence from Ranger PHILLIPS
describing Ranger PHILLIPS' efforts to track down an Austin
area phone number EBEL called multiple times. A synopsis of
Ranger PHILLIPS' investigation follows:
On 04-02-2013, Ranger PHILLIPS followed up on information
regarding telephone communications that occurred between
EBEL (303-881-2130) and cellular telephone (512-789-4393).
With the assistance of Texas Department of Public Safety
criminal analysts, the subscriber of 512-789-4393 was
identified as Norma Raven DIVINE, W/F, DO; [of
4605 Tobago Cove, Austin, Texas. Ranger Phillips traveled
to DIVINE'S residence and contacted her husband, Thomas Lynn
DIVINE, W/M, DOB [Ranger Phillips later
interviewed Norma DIVINE and determined her nephew, Ruben
Paul SUSTAITA, H/M, DOB NNN, of Waco, Texas, had
previously contacted her via EBEL’S cellular telephone, upon
SUSTAITA'S release from custody at a Colorado State
penitentiary, on 02-12-2013.
Ranger Phillips interviewed SUSTAITA, and learned he had
befriended EBEL while incarcerated. According to SUSTAITA,
EBEL met him at a bus stop in Denver, Colorado, on the date
of SUSTAITA'S release, and provided SUSTAITA with money for
food and a warm jacket. SUSTAITA later traveled to his home
town in Waco, Texas, and continued contact with EBEL, via
his personal cellular telephone (254-400-0899), over the
next few weeks. SUSTAITA moved in temporarily with DEVINE
on 03-20-2013, in order to attend culinary school in Austin,
Texas. SUSTAITA, last spoke with EBEL, approximately one
(1) week prior to moving to Austin. SUSTAITA saw EBEL'S
picture on the news and learned of his death. (See report

for specific details of interview.)
1.93 on 04-03-2013, at approximately 11:55 PM, Ranger HOLLAND

Ranger HOLLAND admonished J that he did not have to speak
to Ranger HOLLAND. | stated he would be willing to
provide information about CLEMENTS' murder to Colorado
authorities in consideration for assurances that | would
not be prosecuted. [ggg stated he knew, through direct
communication, that "LOHR," a "211" General, ordered the
murder of CLEMENTS and that "LOHR" had ordered I to
assist EBEL in Texas. MM stated that his information
could be corroborated through phone records that would show
his communication with "LORH," and "Hog," a "211" Captain.
(MMM stated he would provide specific information that could
be corroborated to Colorado officials in consideration for
not being prosecuted. J stated he had no prior knowledge
of CLEMENTS' murder and was not involved in the plot to
murder CLEMENTS. [MMM stated EBEL had "fucked up," and
"pissed off" "211" General Ben DAVIS, and that EBEL had to
murder CLEMENTS because of a debt he (EBEL) owed DAVIS.
1.94 On 04-04-2013, at approximately 10:00 AM, Ranger HOLLAND
received a parcel package from Detective HUMPHREY that.
contained the black LG brand cellular telephone (EXHIBIT
1.18) that was recovered from the suspect vehicle.
1.95 on 04-05-2013, at approximately 10:00 AM, Ranger HOLLAND
delivered the black LG brand cellular telephone (EXHIBIT
1.18), that was recovered from the suspect vehicle, to
United States Secret Service Special Agent Jeffrey SHAFFER
for forensic analysis.
1.96 on 04-10-2013, at approximately 10:00 AM, Ranger HOLLAND
spoke by telephone to El Paso County Colorado District
Attorney's Office Chief Deputy District Attorney Jeffrey
LINDSEY. Chief Deputy LINDSEY requested Ranger HOLLAND make

B) EBEL had gotten into trouble with Ben DAVIS, a "211"
General, while passing on communication from a "211" General

because EBEL had written his own opinions on "211"
communication. Because of EBEL'S actions, BBEL "had to do
something" for DAVIS.

EBEL'S release from prison. The majority of phone calls
were non-relevant communications, which [MM described as
simply normal communication between friends. However, [ll
did recall specific communication in which EBEL spoke of.

did not know what he had to do for DAVIS, only that it would
be "wild shit."
5) Prior to CLEMENTS' murder, EBEL telephoned [gg and
stated that he (EBEL) had to get a hold of "Hog." EBEL
stated that he needed a place to stay in Colorado Springs.
(MM subsequently called "Hog" and advised "Hog" to call
EBEL.
F) Sometime after CLEMENTS' murder, | noticed a missed
telephone call from a number he recognized as "Hog's"
cellular phone. Approximately thirty minutes after said
call, MM called the phone number back. A male answered
the phone and identified himself as "Jimbo." J
immediately recognized the voice to be that of "Jimbo."
"Jimbo" asked if had scen or heard from EBEL, and
stated that EBEL was heading south because he (EBEL) had
done something. "Jimbo" asked if he had seen the news
about the murder of CLEMENTS. jl responded he had heard
of the murder. "Jimbo" stated, "I had him (EBEL) do that."

G) [MMM asked "Jimbo" why he had EBEL murder CLEMENTS.
"Jimbo" responded, "don't worry about it." "Jimbo" informed

because "Hog" needed to talk to JM. "Hog" then got on the
phone and spoke to MN MMMM informed "Hog" that he had to

H) Later that evening, around 9:00 PM to 10:00 PM, [i
called "Hog," utilizing JM roommate's cellular
telephone. "Hog" was "freaked out" and stated, "shit is
fucked up." "Hog" stated that EBEL was staying at his
brother's house in Colorado Springs, and that "Hog" had
arranged for EBEL to stay there. "Hog" stated that he was
"pissed off" that he arranged for EBEL to stay with his
brother, because "Hog" did not know what EBEL was going to
do.
I) MMMM received a telephone call from EBEL after CLEMENTS!
murder. EBEL stated he was "migrating south," and asked
MM if he knew of any "211" members that lived in Pueblo,
Colorado. [MM advised that he did not know of anyone, and
advised EBEL to stay in a hotel. ggg noted that EBEL was
not "freaked out," and acted like nothing had happened.
1102 SN interview continued:
J) The following night, [jl received a phone call from
EBEL. EBEL stated he was in New Mexico or West Texas, near
Amarillo. EBEL advised jg he wanted to stay at J!
residence. [MMM told EBEL that he could not stay at his
house. EBEL responded that he was not mad at [, because
he needed to travel south, not East. EBEL stated that he
would get a hotel in Amarillo, and then travel to the "DFW"
area and "post up" there for a while, before traveling south.
K) The following morning, EBEL telephoned I Mill
believed this was right after EBEL shot the Montague County
Deputy because EBEL was "freaked out." EBEL requested Jl

system, and believed that he was only a "Wood" and not.

attempted to secure employment for SUSTAITA in the oil
fields, but eventually lost contact with SUSTAITA.
M) While in prison with EBEL, EBEL requested Ig to buy
him a mask when he was released. EBEL stated he wanted the
mask because he had a "fascination with masks." After

showed the telephone number returned to Ruben SUSTAITA.
1.107 On 04-26-2013, at approximately 10:00 AM, Ranger HOLLAND
received an electronic message from the Tarrant County
Medical Examiner's Office. Said message contained the
Autopsy Report (EXHIBIT 1.55) for Evan Spencer EBEL. Said
report showed the Cause of Death as "Gunshot Wound of
Forehead," and the Manner of Death as "Homicide." Said
report showed the "bullet entered the cranium through the
mid-frontal bone, traveling front to back direction and
leftwards, passing through the left frontal lobe and
terminating in the lateral aspect of the left temporal."
Said report showed a negative drug screen for all tested
substances, with the exception of a "Positive" result for
Benzodiazepines Elisa. (See Tarrant County Medical

3.1 on 07-29-2013, Company "B" Texas Ranger James B. HOLLAND
received a National DNA Index hit confirmation (EXHIBIT #
3.1) from the Texas Department of Public Safety Crime
Laboratory. Said confirmation was in reference to a profile
taken from the swabbing of a steel galvanized pipe (pipe
bomb) discovered in the trunk of Evan EBEL'S vehicle. The
Combined DNA Index System showed that the DNA removed from
the galvanized pipe matched DNA recovered by the Colorado
Springs Metro Crime Laboratory during a homicide
investigation conducted by the Colorado Springs Police
Department in 2013.
41 on 10-23-2013, at approximately 10:00 AM, Company "B" Texas
Ranger James B. HOLLAND received the Texas Department of
Public Safety Crime Laboratory Supplemental Latent Print
Examination Report (EXHIBIT #4.1) reference latent prints
that were removed from EBEL'S black Cadillac. Said report
showed latent prints removed from the hood, trunk lid
exterior, and rear trunk exterior of the black Cadillac were
identified from FBI exemplar files as belonging to Evan
Spencer EBEL. Said report showed that EBEL was excluded as
the source of a latent print removed from the driver's side
exterior rear of the black Cadillac
5.1 On 12-12-2013, Company "B" Texas Ranger James B. HOLLAND
received the Texas Department of Public Safety Crime
Laboratory Supplemental Latent Print Examination Report
(EXHIBIT # 5.1). Said report showed that fingerprints
removed from the "Rear trunk exterior " of BBEL'S vehicle
were identified to the right middle finger on "the exemplars
from FBI files for NNN bearing the name
Christopher Preston MIDDLETON."
