Lucian C. James, Jr. v. Joseph Henneberry, Director, Patuxent Institute, Attorney General of The State of Maryland, 23 F.3d 401, 4th Cir. (1994)

Lucian C. James Jr. appealed the district court's denial of his petition for habeas corpus relief under 28 U.S.C. § 2254. The Fourth Circuit Court of Appeals reviewed the record and district court opinion and found the appeal lacked merit. The Fourth Circuit denied a certificate of probable cause to appeal and dismissed the case, agreeing with the reasoning of the district court that denied habeas corpus relief. The Fourth Circuit found oral arguments were not necessary as the facts and legal issues were adequately explained in the court materials.

Lucian C. JAMES, Jr., Petitioner Appellant,

v.
Joseph HENNEBERRY, Director, Patuxent Institute, Attorney
General of the State of Maryland, Respondents Appellees.
No. 92-7143.

United States Court of Appeals, Fourth Circuit.

Submitted April 22, 1993.
Decided May 5, 1994.

Appeal from the United States District Court for the District of Maryland,
at Baltimore. John R. Hargrove, District Judge. (CA-92-1393)
Lucian C. James, Jr., appellant pro se.
John Joseph Curran, Jr., Attorney General, Kreg Paul Greer, Assistant
Attorney General, Baltimore, Maryland, for appellees.
D.Md.
Before WIDENER and PHILLIPS, Circuit Judges, and BUTZNER,
Senior Circuit Judge.
PER CURIAM:

Lucian C. James, Jr., seeks to appeal the district court's order refusing habeas
corpus relief pursuant to 28 U.S.C. Sec. 2254 (1988). Our review of the record
and the district court's opinion discloses that this appeal is without merit.
Accordingly, we deny a certificate of probable cause to appeal and dismiss the
appeal on the reasoning of the district court. James v. Henneberry, No. CA-921393 (D. Md. Oct. 16, 1992). We dispense with oral argument because the facts
and legal contentions are adequately presented in the materials before the Court

and argument would not aid the decisional process.
