Spouse Consent for Conjugal Property Sale

Blogging (4) 1) Either spouse requires the written consent of the other spouse to dispose of or encumber conjugal/common property according to Articles 96 and 124 of the Family Code. 2) The Supreme Court has ruled that one spouse needs court authorization to dispose of or encumber common property if the other spouse is incapacitated and does not provide written consent. 3) One exception is if a spouse unjustifiably refuses consent to the sale of property, such as refusing the sale of land to pay for medical expenses as occurred in Estela Costuna versus Laureana Domondon.
