1. MINERAL LEGISLATION
A. Amendments/Notifications:
1. Ministry of Mines, G.S.R. 710 (E): In exercise of the powers conferred by Section 13 of the Mines and
Minerals (Development and Regulation) Act, 1957 (67 of 1957), the Central Government, hereby, makes the
following rules further to amend the Mineral Concession Rules, 1960, namely:1.
(1) These rules may be called the Mineral Concession (Second Amendment) Rules, 2014.
(2) They shall come into force on the date of their publication in the Official Gazette.
2. In the Mineral Concession Rules, 1960 (hereinafter referred to as the principal rules) for rule 24A, the
following rule shall be substituted, namely:24A. Renewal of mining lease.- (1) An application for the renewal of a mining lease shall be made to
the State Government in Form J, at least twenty four months before the date on which the lease is due
to expire, through such officer or authority as the State Government may specify in this behalf:
Provided that in cases where the mining lease is due to expire on or before the 7th January, 2017, the
application for renewal shall be made at least twelve months before the date on which the lease is due
to expire.
3. In the principal rules, for rule 33, the following rule shall be substituted, namely:33. Survey of the area leased.- When a mining lease is granted by the State Government,
arrangements shall be made by the State Government at the expense of the lessee for the survey and
demarcation of the area granted under the lease and the survey of the area leased is to be conducted
by the Total Station and Differential Global Positioning System.
4. In the principal rules, in Schedule I, in Form K, in Part VII relating to the Covenants of the
Lessee/Lessees,(a) in paragraph 2, for the words boundary marks and pillars, the words boundary pillars shall be
substituted;
(b) after paragraph 2, the following paragraph shall be inserted, namely:2A. Manner of construction and upkeep of boundary pillars:(a) each corner of the lease area shall have a boundary pillar (corner pillar);
(b) there shall be erected intermediate boundary pillars between the corner pillars in such a way that
each pillar is visible from the adjacent pillar located on either side of it;
(c) the distance between two adjacent pillars shall not be more than fifty meters;
(d) the pillars shall be of square pyramid frustum shaped above the surface and cuboid shaped below
the surface;
(e) each pillar shall be of reinforced cement concrete;
(f) the corner pillars shall have a base of 0.30 m X 0.30 m and height of 1.30 m of which 0.70 m shall be
above ground level and 0.60 m below the ground;
(g) the intermediate pillars shall have a base of 0.25 m X 0.25 m and height of 1.0 m of which 0.70 m
shall be above ground level and 0.30 m below the ground;

(h) all the pillars shall be painted in yellow colour and the top ten centimeters in red colour by enamel
paint and shall be grouted with cement concrete;
(i) on all corner pillars, distance and bearing to the forward and backward pillars and latitude and
longitude shall be marked;
(j) each pillar shall have serial number in a clockwise direction and the number shall be engraved on the
pillars;
(k) the number of pillar shall be the number of the individual pillar upon the total number of pillars in the
lease;
(l) the tip of all the corner boundary pillars shall be a square of 15 centimeters on which a permanent
circle of 10 centimeters diameter shall be drawn by paint or engraved and the actual boundary point
shall be intersection of two diameters drawn at 90 degrees;
(m) the lease boundary survey shall be accurate within such limits of error as the Controller General,
Indian Bureau of Mines may specify in this behalf;
(n) the location and number of the pillars shall also be shown in the surface and other plans maintained
by the lessee; and
(o) in case of forest area within the lease, the size and construction and colour of the boundary pillars
shall be as per the norms specified by the Forest Department in this behalf.

2. Ministry of Environment, Forests and Climate Change, S.O. 2601(E): In exercise of the powers conferred
by sub-section (1) and clause (v) of sub-section (2) of section 3 of the Environment (Protection) Act, 1986 (29 of
1986) read with sub-rule (4) of rule 5 of the Environment (Protection) Rules, 1986, the Central Government
hereby makes the following further amendment to the notification of the Government of India, in the Ministry of
Environment and Forests number S.O. 1533(E) dated the 14th September, 2006 after having dispensed with the
requirement of notice under clause (a) of sub-rule (3) of the said rule 5 in public interest, namely :
In the said notification, in the Schedule, for item 1(a) and entries relating thereto, the following items and
entries shall be substituted, namely :

3. Ministry of Coal, S.O. 2770 (E): In exercise of the powers conferred by clause (a) of sub-section (1) of
Section 26 of the Mines and Minerals (Development and Regulation) Act, 1957 (67 of 1957), the Central
Government hereby makes the following further amendments in the notification of the Government of India in the
Ministry of Coal number S.O. 2155(E), dated 21st September, 2011, namely:

4. Ministry of Mines, Resolution No. 31/49/2014-M.III: The Government had set up a Committee for review and
restructuring of the functions and role of IBM in 2009. The Committee submitted its report to Government in
May, 2012. The Committee has, interalia, suggested the renaming of the Mines Control & Conservation of
Minerals Division and Ore Dressing Division as under:i.

Mines Control & Conservation of Minerals Division:- The Committee felt that the role of Mines Control
& Conservation of Minerals (MCCM) Division of IBM is not limited to ensuring conservation of
minerals but will also encompass functions like National body for formulation of regulatory
standards for sustainable development of mineral resources in the country, to provide support for
the capacity building for creation and improvement of State level regulatory systems. Apart from
regulatory functions, the division performs various roles as facilitator to the mining industry.
Therefore, the Committee recommended renaming of the Division as Minerals Development and
Regulation Division.
Ore Dressing Division:-The expression Mineral Processing is more contemporary and would be an
accepted phrase world over and would be more relevant to the existing and envisaged functions &
activities of the Ore Dressing Division of IBM. The Committee therefore recommended that the
appellation Mineral Processing be adopted and the Division be renamed asMineral Processing
Division instead of the existing Ore Dressing Division.
The Government of India have carefully considered the suggestions of the Committee and decided to
rename the Mines Control & Conservation of Minerals Division as Minerals Development & Regulation Division
and the Ore Dressing Division as Mineral Processing Division.
ORDER
Ordered, that this resolution be communicated to all State Governments and Central Ministries of the
Govt. of India, Prime Ministers Office, Cabinet Secretariat, Ministry of Parliamentary Affairs, Planning
Commission and Comptroller and Auditor General of India, Indian Bureau of Mines, Geological Survey of India
and Department of Atomic Energy.
Ordered, also that this resolution be published in the Gazette of India for general information.
------F.No. 31/49/2014-M.III- The Indian Bureau of Mines (IBM) functions today under a charter that was
issued vide Government Resolution no.35/1/2002-M.III dated 6th March, 2003, and published in the Gazette of
India on 22nd March 2003.
There have been numerous developments since that date which now necessitated a review of the role
and scope of the functions of the IBM to make the IBM a competent instrument for the implementation of the
National Mineral Policy, 2008, and to bring its charter in line with the contemporary situation.
Accordingly, the Government had set up, in 2009, a Committee for review and restructuring of the
functions and role of IBM. The Committee submitted its report to Government in May, 2012. The Committee
has, inter alia, suggested that the functioning of the IBM should be under a redefined charter, and has,
accordingly, provided a draft of the same.

The Government of India have carefully considered the suggestion of the Committee and decided that
the present charter of IBM should be modified, taking into account the draft suggested by the Committee.
In supersession of all of earlier resolution in this regard, Government have decided that the charter of
functions of IBM will be as follows:
CHARTER OF FUNCTIONS OF INDIAN BUREAU OF MINES
The objective of the IBM will be to promote systematic and scientific development and optimum
utilization of mineral resources of the country (both on-shore and off-shore).
In order to achieve this objective the IBM will:
1. Collect, collate, and organize into a database, all information on exploration, prospecting, mines and
minerals in the country in the shape of a National Mineral Information Repository and take steps to
publish and disseminate the same;
2. Function as the National Technical Regulator in respect of the mining sector, and lay down regulations,
procedures and systems to guide the State Governments (first tier of regulation);
3. Build up capacity in the system, both for regulatory as well as the developmental work, at the central
level as well as at the level of the States;
4. Establish institutional mechanisms of coordination between the Centre, the States, mineral industry,
research and academic institutions, and all stake holders, so as to proactively develop solutions to the
demands and problems faced by the industry;
5. Promote research on all aspects of practical relevance to the industry and to act as a bridge between
research institutions on the one hand and user industry on the other;
6. Provide technical consultancy services;
7. Participate in international collaborative projects in the area of regulation and development of the
mineral sector;
8. Advise Government on all matters relating to the mineral industry; and
9. Undertake any such other activity as has become necessary in the light of developments in the field of
geology, mining, mineral beneficiation and the environment.
ORDER
Ordered, that this resolution be communicated to all State Governments, Ministries of the Government
of India, Prime Ministers Office, Cabinet Secretariat, and Comptroller and Auditor General of India.
Ordered, also that this resolution be published in the Gazette of India for general information.
5. Ministry of Commerce and Industry (Department of Commerce), S.O. 2842(E): In exercise of powers

7. Ministry of Steel, S.O. 3065(E): In exercise of the powers conferred by Section 14 of the Bureau of Indian
Standards Act, 1986 (63 of 1986), the Central Government, after consulting the Bureau of Indian Standards,
hereby makes the following order further to amend the Steel and Steel Products (Quality Control) Second Order,
2012, namely :

1. (1) This order may be called the Steel and Steel Products (Quality Control) Second (2nd Amendment) Order,
2014.
(2) It shall come into force on the date of its publication in the Official Gazette.
2. In the Steel and Steel Products (Quality Control) Second Order, 2012 (hereinafter referred to as Second
Order) in paragraph 2, in clause (b), after sub-clause (iii), the following clause shall be inserted, namely:
(iv) Appropriate officer nominated by Director General, Bureau of Indian Standards.
3. In the Second Order, in the Schedule, against Indian Standard number 1786, ITC (HS) codes 72279090,
72283029, 72286099, 72285090 and 72286012 shall be inserted at the end under column (3).
4. In the Second Order, in the Schedule, for Explanation, the following shall be substituted,
namely:
Explanation 1. The provisions of this Order shall apply to the products described under column (2) of the

8. Ministry of Labor and Employment, S.O. 3113(E): Whereas, the Central Government having been satisfied
that the public interest so requires that in pursuance of the provisions of sub-clause (vi) of the clause (n) of
Section 2 of the Industrial Disputes Act, 1947 (14 of 1947), declared by the Notification of the Government of
India in the Ministry of Labour and Employment, dated 27.05.2014 the service in the Iron Ore Mining Industry
which is covered by item 16 of the First Schedule to the Industrial Disputes Act, 1947 (14 of 1947) to be a Public
Utility Service for the purpose of the said Act, for a period of six months from the 18th June, 2014.
And whereas, the Central Government is of opinion that public interest requires the extension of the
said period by a further period of six months.
Now, therefore, in exercise of the powers conferred by the proviso to sub-clause (vi) of clause (n) of
Section 2 of the Industrial Disputes Act, 1947, the Central Government hereby declares the said industry to be a
Public Utility Service for the purposes of the said Act, for a period of six months from the 18th December, 2014.

9. Ministry Of Commerce And Industry, S.O. 3203 (E): In exercise of the powers conferred by Sub-section (1)
of Section 7 of the Export (Quality Control and Inspection) Act, 1963 (22 of 1963) read with sub-rule (2) of rule 12
of the Export (Quality Control and Inspection) Rules, 1964, the Central Government hereby recognises M/s
Intertek India Private Limited, No. 46, West Madha Church Road, 2nd Floor, Royapuram , Chennai- 600 013, as
an agency for a period of three years from the date of publication of this notification, for the inspection of
Minerals and Ores (Group I) namely, Iron ore and Group II, namely Barytes as specified in the Schedule
annexed to the notification of the Government of India in the erstwhile Ministry of Commerce, vide number S.O.
3975, dated the 20th December 1965,and S.O 3978, dated the 20th December, 1965 respectively, prior to export
of the said Minerals and Ores at Chennai, subject to the following conditions, namely: 7
(i) that M/s Intertek India Private Limited, No. 46, West Madha Church Road, 2nd Floor, Royapuram ,
Chennai- 600 013, shall give adequate facilities to the officers nominated by the Export Inspection Council in
this behalf to examine the method of inspection followed by them in carrying out the inspection under rule 4
of the Export of Minerals and Ores, Group-I (Inspection) Rules, 1965 and the Export of Minerals and Ores,
Group- II(Inspection) Rules, 1965 and;
(ii) that M/s Intertek India Private Limited, No. 46, West Madha Church Road, 2nd Floor, Royapuram,
Chennai- 600 013, in the performance of their function under this notification shall be bound by such
directions as the Director (Inspection and Quality Control), Export Inspection Council may give in writing
from time to time.

11. Ministry of Labor and Employment, S.O. 602(E): Whereas, the Central Government having been satisfied
that the public interest so requires that in pursuance of the provisions of sub-clause (vi) of the clause (n) of
Section 2 of the Industrial Disputes Act, 1947 (14 of 1947), the services in Industry Copper Mining Industry
which is covered by item 13 of the First Schedule to the Industrial Disputes Act, 1947 (14 of 1947 ) to be a Public
Utility Service for the purpose of the said Act, as was notified for a period of six months with effect from 26th
August, 2014 vide this Ministrys Notification dated 25.08.2014.
And whereas, the Central Government is of opinion that public interest requires the extension of the said
period by a further period of six months.
Now, therefore, in exercise of the powers conferred by the proviso to sub-clause (vi) of clause (n) of Section
2 of the Industrial Disputes Act, 1947, the Central Government hereby declares the said Industry to be a Public
Utility Service for the purpose of the aforesaid Act, for a period of six months with effect from 26th February,
2015.

12. Ministry of Labor and Employment, S.O. 652(E): Whereas, the Central Government having been satisfied
that the public interest so requires that in pursuance of the provisions of sub-clause (vi) of the clause (n) of
Section 2 of the Industrial Disputes Act,1947 (14 of 1947), the service in Industry Manufacturing of alumina and
Aluminium and Mining of Bauxite which is covered by item 30 and 31 of the First Schedule to the Industrial
Disputes Act, 1947 (14 of 1947) to be a Public Utility Service for the purpose of the said Act, as was notified for a
period of six months with effect from 23rd September, 2014 vide this Ministrys Notification dated 23.09.2014.
And whereas, the Central Government is of opinion that public interest requires the extension of the
said period by a further period of six months;
Now, therefore, in exercise of the powers conferred by the proviso to sub-clause (vi) of clause (n) of
Section 2 of the Industrial Disputes Act, 1947, the Central Government hereby declares the said industry to be a
Public Utility Service for the purposes of the aforesaid Act, for a period of six months with effect from 23rd March,
2015.

BE it enacted by Parliament in the Sixty-sixth Year of the Republic of India as follows:

1. (1) This Act may be called the Mines and Minerals (Development and
Regulation) Amendment Act, 2015.
(2) It shall be deemed to have come into force on the 12th day of
January, 2015.
2. In the Mines and Minerals (Development and Regulation) Act, 1957
(hereinafter referred to as the principal Act), in section 3,
(i) after clause (e), the following clause shall be inserted, namely:
(ea) notified minerals means any mineral specified in the Fourth
Schedule;;
(ii) after clause (g), the following clause shall be inserted, namely:
(ga) prospecting licence-cum-mining lease means a two stage
concession granted for the purpose of undertaking prospecting operations
followed by mining operations;;
(iii) in clause (hb), the word and, occurring at the end, shall be omitted;
(iv) after clause (hb), the following clause shall be inserted, namely:
(hc) Special Court means a Court of Session designated as Special
Court under sub-section (1) of section 30B; and.
3. In Section 4 of the principal Act, in the second proviso to Sub-section
(1), for them words and figures section 617 of the Companies Act, 1956,
the words, brackets and figures clause (45) of section 2 of the
Companies Act, 2013, and any such entity that may be notified for this
purpose by the Central Government shall be substituted.
4. In Section 4A of the principal Act, in sub-section (4), for the provisos,
the following provisos shall be substituted, namely:

Provided that in respect of any mineral specified in Part A and
Part B of the First Schedule, no reconnaissance permit, prospecting
licence or mining lease shall be granted except with the previous approval

(B) in sub-section (2),
(i) for clause (a), the following clause shall be substituted, namely:
(a) there is evidence to show the existence of mineral contents in
the area for which the application for a mining lease has been made in
accordance with such parameters as may be prescribed for this purpose
by the Central Government;;
(ii) after clause (b), the following proviso shall be inserted, namely:
Provided that a mining lease may be granted upon the filing of a
mining plan in accordance with a system established by the State
Government for preparation, certification, and monitoring of such plan,
with the approval of the Central Government..
6. In Section 6 of the principal Act, in sub-section (1), in clause (b), for the
proviso, the following proviso shall be substituted, namely:
Provided that if the Central Government is of the opinion that in the
interest of the development of any mineral or industry, it is necessary so
to do, it may, for reasons to be recorded in writing, increase the aforesaid
area limits in respect of prospecting licence or mining lease, in so far as it
pertains to any particular mineral, or to any specified category of deposits
of such mineral, or to any particular mineral located in any particular
area..
7. For Section 8 of the principal Act, the following section shall be
substituted, namely:

(4) On the expiry of the lease period, the lease shall be put up for auction
as per the procedure specified in this Act.
(5) Notwithstanding anything contained in Sub-sections (2), (3) and Subsection (4), the period of lease granted before the date of commencement
of the Mines and Minerals (Development and Regulation) Amendment
Act, 2015, where mineral is used for captive purpose, shall be extended
and be deemed to have been extended up to a period ending on the 31st
March, 2030 with effect from the date of expiry of the period of renewal
last made or till the completion of renewal period, if any, or a period of fifty
years from the date of grant of such lease, whichever is later, subject to
the condition that all the terms and conditions of the lease have been
complied with.
(6) Notwithstanding anything contained in Sub-sections (2), (3) and subsection (4), the period of lease granted before the date of commencement
of the Mines and Minerals (Development and Regulation) Amendment
Act, 2015, where mineral is used for other than captive purpose, shall be
extended and be deemed to have been extended up to a period ending
on the 31st March, 2020 with effect from the date of expiry of the period
of renewal last made or till the completion of renewal period, if any, or a
period of fifty years from the date of grant of such lease, whichever is
later, subject to the condition that all the terms and conditions of the lease
have been complied with.
(7) Any holder of a lease granted, where mineral is used for captive
purpose, shall have the right of first refusal at the time of auction held for
such lease after the expiry of the lease period.
(8) Notwithstanding anything contained in this section, the period of
mining leases, including existing mining leases, of Government
companies or corporations shall be such as may be prescribed by the
Central Government.
(9) The provisions of this section, notwithstanding anything contained
therein, shall not apply to a mining lease granted before the date of
commencement of the Mines and Minerals (Development and Regulation)
Amendment Act, 2015, for which renewal has been rejected, or which has
been determined, or lapsed. .

and procedure, subject to which the auction shall be conducted, including
the bidding parameters for the selection, which may include a share in
the production of the mineral, or any payment linked to the royalty
payable, or any other relevant parameter, or any combination or
modification of them.
(6) Without prejudice to the generality of Sub-section (5), the Central
Government shall, if it is of the opinion that it is necessary and expedient
to do so, prescribe terms and conditions, procedure and bidding
parameters in respect of categories of minerals, size and area of mineral
deposits and a State or States, subject to which the auction shall be
conducted:
Provided that the terms and conditions may include the reservation of
any particular mine or mines for a particular end-use and subject to such
condition which allow only such eligible end users to participate in the
auction.
(7) The State Government shall grant a mining lease to an applicant
selected in accordance with the procedure laid down in this Section in
respect of such notified mineral in any notified area.

12A. (1) The provisions of this Section shall not apply to minerals
specified in Part A or Part B of the First Schedule.
(2) A holder of a mining lease or a prospecting licence-cum-mining lease
granted in accordance with the procedure laid down in Section 10B or
Section 11 may, with the previous approval of the State Government,
transfer his mining lease or prospecting licence-cum-mining lease, as the
case may be, in such manner as may be prescribed by the Central
Government, to any person eligible to hold such mining lease or
prospecting licence-cum-mining lease in accordance with the provisions
of this Act and the rules made there under.
(3) If the State Government does not convey its previous approval for
transfer of such mining lease or prospecting licence-cum-mining lease,
as the case may be, within a period of ninety days from the date of
receiving such notice, it shall be construed that the State Government
has no objection to such transfer:
Provided that the holder of the original mining lease or prospecting
licence-cum mining lease shall intimate to the State Government the
consideration payable by the successor-in-interest for the transfer,
including the consideration in respect of the prospecting operations
already undertaken and the reports and data generated during the
operations.
(4) No such transfer of a mining lease or prospecting licence-cum-mining
lease, referred to in Sub-section (2), shall take place if the State
Government, within the notice period and for reasons to be
communicated in writing, disapproves the transfer on the ground that the
transferee is not eligible as per the provisions of this Act:
Provided that no such transfer of a mining lease or of a prospecting
licence-cum-mining lease, shall be made in contravention of any
condition subject to which the mining lease or the prospecting licencecum-mining lease was granted.
(5) All transfers effected under this section shall be subject to the
condition that the transferee has accepted all the conditions and liabilities
under any law for the time being in force which the transferor was subject
to in respect of such a mining lease or prospecting licence-cum-mining
lease, as the case may be.
(6) The transfer of mineral concessions shall be allowed only for
concessions which are granted through auction.
14. In Section 13 of the principal Act, in Sub-section (2),
(i) after clause (j), the following clause shall be inserted, namely:
(jj) parameters of existence of mineral contents under clause (a) of Subsection
(2) of Section 5;;
(ii) in clause (qq), the word and occurring at the end shall be omitted;
(iii) after clause (qq), the following clauses shall be inserted, namely:
(qqa) the amount of payment to be made to the District Mineral
Foundation under Sub-sections (5) and (6) of Section 9B;

B. Court Decision:
1. M/s. Sukhdev Prasad Goenka, Appellant v. M/s. Olpherts Pvt. Ltd. and others, Respondents, AIR 2014,
Madhya Pradesh, 148, Vol.101, Part 1210, October, 2014.
Subject: Appeal against the judgement dated 14.3.2014, wherein the learned single judge rejected the claim of
the appellant for grant of fresh mining lease.
Facts: The learned single Judge found out that the appellant had failed to furnish No Dues Certificate in spite of
being given opportunity to do so before 21.06.2004 vide notice dated 11.06.2004. In fact, the appellant failed to
produce No Dues Certificate even at the time of hearing of the proceedings before the Authority on 03.09.2004.
On this indisputable fact, the learned single Judge rejected the claim of the appellant for grant of fresh mining
lease.
The appellant argued that the learned single Judge has misinterpreted the provisions of Sub-Rule (2) of
Rule 26 of the Mineral Concession Rules, 1960 (hereinafter referred to as the Rules). It is further argued that as
per the said Sub-Rule, non-compliance of Clause (d) of Sub-Rule (3) of Rule 22 cannot be made basis for
rejection of the application. Further, the learned single Judge has overlooked the legal position expounded by the
Apex Court in the recent decision- Kalpnath Singh v. Udai Nath and others (AIR 2011 SC (Civ) 924).
Decision: The High Court has referred to rule 22(3) of the Rules and stated that on conjoint reading of proviso
under Sub-Clause (d) of Sub-Rule (3) of Rule 22, it is amply clear that the exception so provided obtains only for
a period of 90 days from the date of application. On expiry of 90 days' period, by legal fiction the application
becomes invalid and ought to be treated as disposed of on that basis. The High Court further stated that if at all
the application for grant of mining lease of the appellant could be processed in spite of the mandate of third and
fourth proviso of Rule 22(3) of the Rules because of the liberty granted in terms of the directions issued by the
Apex Court in the case of M/s Olpherts Pvt. Ltd. (supra), the appellant having failed to produce the No Dues
Certificate, in any case before 03.09.2004 until the date of final hearing of the proceedings, had disentitled
himself for grant of subject mining lease.
Accordingly, the High Court has dismissed the appeal.

2. M/s. G H Vijapura & Co. & another, Petitioners v. The State of Assam & others, respondents, AIR 2014,
Gauwahati 165, Vol.101, Part 1211, November, 2014.
Subject: Question involved in the writ petition is whether royalty can be demanded from the customers for
ordinary earth utilized in levelling the low lying areas, in execution of the contracts.
Facts: The Airport Authority of India (AII) entrusted the work for levelling the low lying areas and development of
internal drainage system for the runway extension in the LGBI Airport, Guwahati. To execute the contract, the
petitioner made agreements with owners of private patta lands for extracting earth therefrom, to execute the
work. The Addl. D.M., Guwahati accorded permission for earth extraction after concurrence of the Forest
Department and accordingly the contract was being executed with ordinary earth collected from private patta
lands. While the work was on, the notice dated 6.4.2009 (Annexure-9) was issued by the AAI, whereby the
contractor was asked to submit documents to confirm that royalty was paid for the extracted earth and failing
this, withholding of Rs.75,10,000.00 from their running bills was threatened. Aggrieved by this threat, the
contractor filed the Writ Petition.
The petitioners contended that the demand of royalty must be authorized by law and in the absence of
any legislative sanction, the levy cant be imposed through executive authorization or through interpretive
exercise. The demand for royalty addressed to the contractor by the AAI is inconsistent with the contract terms.
Learned Council for the respondents contended that the demand on the contractor has the requisite
statutory support. Moreover, since earth was extracted for commercial exploitation, the extraction is not
exempted under Rule 48 and therefore, the Government Advocate argues that State is competent to ensure
recovery of royalty. Learned Council for the respondents further contended that the contractor is responsible for
depositing the royalty for the materials utilized by him in execution of contract and therefore the demand for
royalty from them by the AAI as the principal employer, is supported by the contract terms. It is also contended
that the Central Government through the notification dated 3.2.2000 had declared ordinary earth used for filling
or levelling purpose in construction works, to be a minor mineral in the category of any other mineral. Thus,
ordinary earth was bracketed with ordinary clay, ordinary sand, etc. which were already categorized as minor
minerals, under Sub-Clause (e) of Section 3 of the MMDR Act, 1957. The Assam Minor Mineral Concession
Rules was notified on 21.1.1995 and in exercise of powers conferred by Rule 28, the Assam Governments
Mines & Mineral Department through their notification dated 7.3.2005 amended the 2nd Schedule of the Rules
and replaced the original entry 12, i.e., Brick by Earth and also stipulated the rate of royalty at Rs.15.00 per cu m
for the new entry.
Point of issue: Whether the contractor can be fastened with royalty demand for such extracted material from
private patta land, when it is the statutory responsibility of the land owner to deposit the royalty.
Decision: The High Court has referred to Rule 28 of the 1994 Rules, the conditions of contract and the Second
Schedule of the 1994 Rules and stated when the rate is unspecified in the 2013 Rules, the demand for royalty
cant be considered legal. It is further stated that the 1994 Rules permits realization only from the lessee and not
from the contractor. The High Court held that when the demand cant be traced to a statutory enactment and the
contract conditions too doesnt enable the principal employer to demand royalty form the contractor, it has to be
declared that payment of royalty for ordinary earth is not an obligation to be discharged by the contractor.
Therefore, the decision of the principal employer to deduct royalty from the contractors bills is found to be
without any legal basis.

The High Court has directed/ordered to the respondent that to free the contractor from royalty deduction from
their contractual due. Consequently, for the concluded contracts, the earnest money/Bank Guarantee be
discharged but for the unfinished contract, the contractual payment be disbursed without deduction of royalty.

3. S.K. Suresh, Petitioner v. The Principal Secretary, Department of Mines & Geology, Bangalore and
others, Respondents, AIR 2014, Karnataka 179, Vol.101, Part 1212, December, 2014.
Subject: Challenging the notice, dated 10.5.2013 for cancellation of quarry lease and demanding payment of
penalty.
Facts: The petitioner is holder of Quarry Lease No.447, dated 10.11.2010 granted for quarry of a minor, nonspecified mineral steatite, valid for five years, executed as per the Karnataka Minor Mineral Concession Rules,
1994 (hereinafter referred to as KMMC Rules). Admittedly, before execution of the quarry lease, Senior
Geologist (3rd Respondent) had asked the petitioner to submit an affidavit, which the petitioner executed on
16.9.2009, according to which the petitioner undertook to utilize the extracted mineral only for cottage industry
and not for any other purpose or any big factory (industry).
While the petitioner was paying royalty and working the lease, the 3rd respondent, upon a spot
inspection conducted on 18.3.2013, discovered that large decorative blocks were being extracted by the
petitioner in violation of KMMC Rules. Therefore, he issued notice, dated 25.3.2013 stating that conditions of the
aforementioned affidavit were violated, as steatite mineral was being utilized for purposes other than cottage
industry and also that minerals had been dispatched to granite cutting and polishing units in Tamil Nadu.
In their reply, dated 6.4.2013, the petitioner claimed to have conducted all transactions with the
knowledge of 3rd respondent who had issued regular dispatch permits and pointed out that KMMC Rules did not
restrict excavation of minerals in bigger size. The petitioner claimed that the industries, he transported the
excavated steatite mineral to, were producing household articles and utensils which was permissible under
KMMC Rules and claimed to have not violated any terms of the lease or KMMC Rules.
In the meantime, 3rd respondent had issued another notice, dated 5.3.2013, when 50 allegedly
unlawfully mined, large designer blocks were discovered, and a criminal case in Crime No.53/2013 was filed
against the petitioner at Ajjampura Police Station. Petitioner gave replies, dated 6.4.2013 and 17.4.2013.
However, final notice, dated 24.4.2013 was issued by 3rd respondent that there was no prescribed size for the
extraction of steatite mineral in KMMC Rules and stated that he had voluntarily discontinued quarrying work,
thereby incurring loss.
Eventually, the order bearing No.127/10-5-13, dated 10-5-2013, which is impugned herein, came to be
passed, cancelling the petitioners quarry lease, which was obtained for the purpose of extracting steatite mineral
for cottage industry usage, since mining was carried out to extract blocks exceeding 0.04 cubic meters in size
allegedly violating KMMC Rules and Government notification.
Also, notice bearing No DMG/CKM/QL/2013-14(A), dated 10.5.2013 was issued by 3rd respondent to
the petitioner, which is also impugned herein, demanding from him payment of Rs.1.43,34,000/- for unauthorized
mining carried out to extract large size decorative/ornamental blocks of 3 to 16 cubic meters size and transported
to industries other than cottage industries in violation of the affidavit/undertaking given by him.

Learned counsel for the petitioner contended that there was grave violation of principles of natural
justice as the petitioner had been denied an opportunity of a personal hearing by 3rd and 4th respondents and that
revisional authority passed order, dated 21.9.2013 in great haste without due application of mind.
It is further contended that the affidavit, dated 16.9.2009 executed by the petitioner is not part of the
lease deed, hence there could be no requirement of use of steatite mineral for cottage/small scale industries
only. Moreover, as petitioner only supplied the extracted steatite to industries, which used them for making
household articles and utensils, he was well within the prescription of KMMC Rules as regards usage of steatite.
It was argued that the Government notification prescribing 0.04 cubic meter size for the mineral
extracted was applicable to ordinary building stones and not steatite, hence there being no requirement to
adhere to the size mentioned therein, and as such the cancellation of lease based on alleged extraction of large
blocks for decorative purpose and transportation to industries other than cottage/small scale industries was
illegal.
It is also contended by the petitioner that such penalty could be levied if there was breach of the lease
deed and not for the alleged breach of an affidavit and even if he is found liable to pay penalty, the applicable
rate would be five times of Rs.20 per mt as per ScheduleII to KMMC Rules and not five times of Rs.1200 per
cubic metre as is applied, wrongly treating steatite as an ornamental/decorative building stone, It is prayed that
the impugned cancellation order 10-5-2013, impugned notice for demand of arrears dated 10-5-2013 and the
order dated 21-9-2013 of revisional authority in RP No.81/2013 may be quashed.
Per contra, learned AGA appearing for the respondents submitted that the application dated 20.8.2009
for grant of quarry lease was submitted by the petitioner to Senior Geologist with the understanding that it was
for steatite, which was non-specified minor mineral that could only be used for making household articles as per
KMMC Rules. He submitted that petitioner voluntarily executed the affidavit, dated 16.9.2009 and undertook to
utilize the mineral only for purpose of cottage industry, which was actually a pre-condition for sanction of the
quarry lease, forming part of the terms of lease. It was clearly deposed in his affidavit that he even acceded to
cancellation of the quarry lease if he utilized the mineral for any other purpose and thus, he was stopped from
challenging the order of cancellation. As for the demand notice dated 10-5-2013 for Rs.1,43,34,000/- learned
AGA submitted that it was consequential upon the breach of conditions of lease and was in consonance with
Rule 44 of KMMC Rules and Section 25 of the Mines and Minerals (Development and Regulation) Act, 1957 (for
short MMDR Act).
Decision : The High Court has referred to Rule 6(3) of the KMMC Rules, Government Notifications I, II and III,
Miscellaneous Publication No.30, Geological Survey of India, Government of India, 2006 and stated that usage
of the extracted steatite mineral for purposes other than cottage industries and that too by transporting to cutting
and grinding units situated outside the State of Karnataka, constitutes breach of the contractual obligations
undertaken by the petitioner voluntarily, at the time of grant of the quarry lease. Therefore, impugned notice
dated 10-5-2013 cancelling the petitioners quarry lease is not illegal.
The High Court has further stated that as regards the issue of demand notice dated 10.05.2013 issued
to the petitioner for payment of penalty to the tune of Rs.1,43,34,000/-, the petitioner contended that the rates
applicable to ornamental/decorative building stones @ Rs.1200/- per mt were wrongly applied to large dimension
steatite blocks extracted by him under the quarry lease. Larger blocks of steatite extracted by the petitioner
from the lease area were outside the purview of non-specified minor minerals and fell within the categories of
specified minor minerals under Notification-I. The applicable rates of royalty and penalty, if any, would have to
be calculated as per classification in Notifications-I and II and the rates prescribed under KMMC Rules (Schedule
25
II). In view of serious controversy about the rate for calculating the additional amount of royalty and penalty, if
any, as applied in the impugned notice dated 10.5.2013 of the Senior Geologist and no opportunity of hearing
having been granted to the petitioner, the petitioner is ordered to be afforded an opportunity of being heard by
the competent authority. Accordingly, the petitioner will be at liberty to make appropriate representation in
respect of the rates of royalty and penalty applied in the impugned notice on or before 15.9.2014, which may be
considered and decision thereon may be communicated to him by the 3rd respondent within a period of one
month from the date of receipt of the representation, if any, submitted by the petitioner as aforesaid.
Thus, the High Court has dismissed the writ petition without any order as to costs.
Petition dismissed.
4. M/s. Kuber Associates & Others, Appellants v. State of Rajasthan & Others, Respondents, AIR 2014,
Rajasthan 191, Vol.101, Part 1212, December, 2014.
Subject: Challenging the Rejection of Mining Lease.
Facts: The offers invited for grant of mining lease for excavation of bajri from rivers, drains, etc. in gair mumkin
land of various villages of Tehsil Jaitaran, District Pali. The appellant, M/s. Kuber Associates, describing itself as
a partnership/association of persons (AOP) is said to have made an offer pursuant to the NIT, dated 21.11.2012
and its offer was at Rs.8.65 crores. However, the tender submitted by the appellants was rejected for not
conforming to the requirements of Rule 35(vi) of the Rajasthan Minor Mineral Concession Rules, 1986 (the
Rules) inasmuch as the tender was not found accompanied by the power of attorney in favour of the person
signing the documents by the other persons of the AOP. The petitioner-appellant preferred the writ petition
questioning the order, dated 26.4.2013 issued by the Superintending Mining Engineer in compliance of the order,
dated 17.4.2013 as issued by the Directorate of Mines for issuance of fresh NIT for grant of the lease in
question on account of rejection of the appellants bid as invalid.
During the course of consideration of these matters, it had transpired before the learned single Judge
and was duly taken note of that in the fresh process of NIT; the highest bid received had been of Rs.13.78 crore.
The learned counsel submitted that apart from the other arguments sought to be raised in this regard,
the fact remains that the particulars of the offerer of Rs.13.78 crore had not been supplied to the appellant nor
the said offerer has been a party to the petition. The learned counsel submitted that to the best of his
information, the process has not been finalized yet and else, during the pendency of the writ petition, there was
an undertaking on behalf of the respondents not to finalise the same.
Decision: After considering such submissions and examining the records, the High Court felt inclined to issue
the notices in the matter but on the condition of the appellants coming out with a matching bid so that interest of
revenue is safeguarded, particularly when there is a substantial difference in the offer made by the appellant, i.e.,
at Rs.8.65 crore as against the new bid received by the Department at Rs.13.78 crore.
The High Court took the view that irrespective of the arguments sought to be raised, if the appellants
are not forthrightly and clearly in a position to make an offer at the present stage to match the higher bid already
received by the department, it could only be seen as an attempt to make a claim for the contract in question at
the offer made by them, i.e., at Rs.8.65 crore. The arguments of the appellants even if to be considered, cannot
ultimately lead to issuance of a writ, order or direction because writ being an equitable and discretionary
remedy, mere submissions of some legal issues may not suffice in a given case.

The High Court has stated that in the present case, the reluctance on the part of the appellants to make
an offer at the present stage in order to match the highest bid already received by the Department, in our view, is
sufficient to non-suit the appellants because no writ, order or direction could be considered in this matter in the
manner that it would stand contra the interest of Revenue.
Lastly, the High Court has dismissed this appeal.
Appeal dismissed.
5. State of NCT of Delhi, Appellant v. Sanjay, Respondent, with Jausukh Bavanji Shingalia v. State of
Gujarat and another, with Malabhai Shalabhai Rabari & Ors v. State of Gujarat and ors., with Kalubhai
Dulabhai Khachar v. Sate of Gujarat and another, and Sondabhai Hanubhai Bharwad v. State of Gujarat
and another, AIR 2015, Supreme Court 75, Vol.102, Part 1213, January, 2015.
Subject : The principal question arises in these appeals is whether the provisions contained in Sections 21, 22
and other sections of Mines and Minerals (Development and Regulation) Act, 1957 operate as bar against
prosecution of a person who has been charged with allegation which constitutes offences under Section 379/114
and other provisions of the Indian Penal Code.
Facts: Criminal Appeal No.499 of 2011 arose out of an order passed by the Delhi High Court on an application
under Section 482, Cr.P.C. seeking quashing of the FIR registered at Police Station Alipur under Sections
379/114/120B/34 I.P.C. on the allegation that appellant was involved in illegal mining of sand from the Yamuna
basin. An FIR was registered by the Police suo motu having come to known that some persons were removing
and selling sand from the Yamuna basin for the last so many days. On receipt of such information, the police
officers committed raid and visited the site where they found one dumper filled with sand. Because of nonproduction of any documents and valid papers, the digging equipment were seized and taken into possession
and persons were arrested. An FIR was registered on the charges of illegal mining under Section 379/114
I.P.C., besides being cognizable offence under Section 21(4) of the Mines and Minerals (Development and
Regulation) Act, 1957 (in short the MMDR Act).
Similarly, the case Criminal Appeal No.2105 of 2013, arose out of an order passed by the Gujarat High
Court on an application filed by the appellant seeking quashing of the FIR on various grounds inter alia that
Section 22 of the MMDR Act put a complete bar on the registration of FIR by the Police. The allegation inter alia
in the FIR was on illegal mining in those areas where mining lease was already revoked.
In the cases Criminal Appeal No. 2108-2112 of 2013 appellants are the owners of Murlidhar Stone
Industries and were granted quarry lease in the seam of village Thoriwari for excavation of mines and minerals
on payment of royalty. The appellants challenged the legality and validity of mining complaint lodged by the
State geologist against them for offences under Section 379/114 of IPC and under Section 21 of the MMDR Act.
The appellants sought an appropriate writ or direction to quash and set aside the criminal proceedings on the
same ground that Section 22 of the Act prohibits registration of FIR with respect to offences punishable under the
said MMDR Act.
Similarly, the Criminal Appeal No. 2107 of 2013 arose out of the order passed by the High Court of
Gujarat on the application challenging the legality and validity of criminal complaint filed before Bhuj Taluka
Police Station for the alleged illegal mining and transporting a dumper loaded with black trap stone. A complaint
was made with the police for the commission of offence under Section 379 read with Section 114 of the IPC and
under Section 21 of the MMDR Act.

The Criminal Appeal No. 2106 of 2013 arose out of a complaint filed before Sayla Police Station by the
Incharge Mines Supervisor, alleging offence punishable under Sections 4(1) and 21(1) of the MMDR Act. No
charge-sheet has been filed in this complaint so far.
Decision: The Supreme Court has referred to Sections 4, 21, 22, 23B, 23C of Mines and Minerals (Development
and Regulation) Act, 1957, Sections 2(c),2(d), 2(h),41 of the Code of Criminal Procedure, 1973, Sections
149,150 151,152 of the Indian Penal Code, various decisions given by the Apex Court in the cases Centre for
Public Interest Litigation v. Union of India (AIR 2012 SC 3725); intellectuals Forum v. State of A.P. (AIR 2006 SC
1350); Manohar Lal Sharma v. Principle Secretary (AIR 2014 SC 666); State of Bihar v. Murad Ali Khan and
others (AIR 1989 SC 1); etc. and ordered/opined that the ingredients constituting the offence under the MMDR
Act and the ingredients of dishonestly removing sand and gravel from the river beds without consent, which is
the property of the State, is a distinct offence under the IPC. Hence, for the commission of offence under
Section 378, Cr.P.C. on receipt of the Police report, the Magistrate having jurisdiction can take cognizance of the
said offence without awaiting the receipt of complaint that may be filed by the authorized officer for taking
cognizance in respect of violation of various provisions of the MMDR Act. Consequently, the contrary view taken
by the different High Courts cannot be sustained in law and therefore, overruled. Consequently, the Apex Court
disposed of these criminal appeals with the direction to the concerned Magistrates to proceed accordingly.
Order accordingly.
6. State of Rajasthan & Others, Appellant v. Hari Singh, Respondent, AIR 2015, Rajasthan 21, Vol 102,
Part 1214, February, 2015.
Subject: Challenging the order, dt.26.9.2006 for rejection of an application submitted for extension of lease term.
Facts: By an order, dated 11.12.1985, a mining lease for excavating minor mineral lime stone was sanctioned in
favour of the respondent petitioner as per provisions of the Rajasthan Minor Mineral Concession Rules, 1986
(hereinafter referred to as the Rules of 1986). The lease at the first instance was for a period of ten years and
was further extended for ten years w.e.f. 1.4.1986. The term of lease came to be expired on 31.3.1996 and on
3.4.2006 possession of the leased area was taken over by the Department of Mining as no application was
preferred for further extension of lease term. On 10.8.2006 the respondent petitioner submitted an application
for extension of lease term but that came to be rejected vide order, dated 26.9.2006 passed by Additional
Director (Mines), Jodhpur. The Additional Director while rejecting the application stated that after expiry of the
lease term on 31.3.2006 possession of the area was taken on 3.4.2006 and the lessee did not submit any
application for renewal within the period prescribed under the Rules of 1986.
Being aggrieved by the order, dated 26.9.2006 the respondent petitioner preferred a revision petition
before the State Government but that too came to be rejected vide order, dated 24.4.2007. The revisional
authority noticed that the application for renewal of the mining lease was submitted on 10.8.2006, i.e., after a
lapse of about one year and four months from the date on which application for renewal should have been
moved. The revisional authority also could not find any sufficient reason to condone a huge delay in submitting
renewal application. To challenge the order passed by the revisional authority and the order passed by the
Additional Director (Mines) dated 26.9.2006 the respondent petitioner approached this Court by way of filing a
petition for writ that came to be accepted by judgment, dated 04.02.2013.
In said appeal, the argument advanced on behalf of the appellants is that learned single Bench
committed a factual error by treating the delay in filing renewal application for a period of four months, which as a

matter of fact was of more than one year and four months. It is stated that Rule 17 of the Rules of 1986 provides
a complete mechanism for entertaining applications for renewal of mining lease, but the respondent petitioner did
not act in accordance with the Rules and as a matter of fact no reason was prescribed by him for causing delay
of more than a period of one year in submitting the application, dated 10.8.2006.
Decision: The High Court has referred to sub-rule (2) of Rule 8 and Sub-rule (2) of Rule 17 of the Rules of 1986
and stated that a lessee is required to submit application for renewal of lease at least one year in advance from
the date of expiry of the lease term, and if for any reason delay occurs in submission of renewal application then
it can be condoned by imposing penalty, but no condonation can be made after expiry of lease.
The High Court has further stated that in light of the provisions aforesaid the respondent petitioner could
have submitted an application for renewal prior to 31.3.2005 and up to 30.3.2006. Under the Rules of 1986 no
power is available to the competent authority to renew mining lease by acting upon a renewal application
submitted after expiry of the lease.
The High Court also stated that the appellant respondents had no power to renew the lease after its
expiry on 31.3.2006. At the cost of repetition, it shall be appropriate to mention that the application for renewal
was submitted on 10.8.2006, i.e., after expiry of lease. In our considered opinion learned Single Bench erred in
examining the correct scope of Rule 8(2) and Rule 17(2) of the Rules of 1986. The condonation of delay in filing
renewal application is available to a lessee under the Rules of 1986 before expiry of lease and not subsequent
thereto. As such, the finding given by learned Single Judge that Rule 17(2) of the Rules of 1986 prescribes that
an application for renewal received after the period prescribed under Rule 8(2) can be entertained on payment of
penalties, is nothing but misreading of provision.
The High Court opined that learned single Judge erred while accepting the writ petition preferred by the
respondent petitioner giving challenge to the orders passed by the Additional Director (Mines), Jodhpur dated
26.9.2006 and the order dated 24.4.2007 passed by the revisional authority. The appeal, thus, deserves
acceptance, hence is allowed. The judgement passed by learned single Judge dated 4.2.2013 is set aside and
the orders dated 26.9.2006 and 24.4.2007 passed by Additional Director (Mines) and the revisional authority
respectively are restored.
Thus, the High Court has allowed the appeal without any order as to costs.
Appeal allowed.

During the period under review, the information pertaining to the grant of 134 leases covering an area of
about 694.83 hectares was received. Of these, China clay accounted for 21 leases, followed by Silica sand 18,
Laterite 7, Soapstone 6, Kaolin 4, Quartz 3, Dolomite & Red ochre (2 each ) and Ball clay, Limestone, Selenite &
White clay (1 each). In addition to these, 67 mining leases were granted in respect of two or more minerals in
association.
Reviewing areawise, mining lease granted for selenite accounted for 90.49 ha, followed by China clay
87.36 ha, Silica sand 72.17 ha, Limestone 34.30 ha, Soapstone 28.00 ha, Laterite 21.27 ha, Kaolin 16.07 ha,
Quartz 12.28 ha, Red ochre 9.15 ha, Dolomite 6.80 ha, Ball clay 4.25 ha and White clay 4.04 ha. Mining leases
granted in respect of two or more minerals covered 308.65 ha.
Reviewing statewise, number of Mining leases and area granted in Rajasthan 109 with 569.96 ha,
followed by Madhya Pradesh 2 with 45.29 ha, Telangana 9 with 38.27 ha, Uttarakhand 6 with 28.00 ha, Kerala 6
with 7.11 ha, and Chhattisgarh & Gujarat (1 each) with 4.08 ha, & 2.12 ha, respectively.

Highlights
A. DOMESTIC
Centre asks States to expedite 64,000 pending mining leases
Concerned at the slow pace of clearance of mining concessions, the Centre has asked the States to
expedite disposal of about 64,000 applications for leases pending with them.
As many as 63,949 applications for various mining concessions are pending with States like Karnataka,
Andhra Pradesh, Rajasthan, Chhattisgarh, Goa, Gujarat, Jharkhand, Madhya Pradesh, Maharashtra, Odisha and
Tamil Nadu. These States have been asked to fast-track disposal of these leases.
The Ministry has already asked these States to apply provisions of the Mines and Mineral Development
and Regulation Act (MMDR Act) to dispose the cases, besides putting in place a transparent lease diposal
system.

SAIL, Tata Steel hit mining hurdle in Jharkhand
The Jharkhand Government has demanded a heavy price estimated at ` 6,000 crore from Tata Steel
and SAIL, for operating iron ore mines in the State without proper lease renewal.
SAIL may have to pay around `2,000 crore before it could execute a fresh lease agreement for its Gua
Mine, while Tate Steel may be required to fork out upwards of ` 4,000 crore for the Noamundi Mine.
Though the lease agreement for both the mines expired some years ago, they were operating on
deemed extension granted by the State Government, following the old versions of the mining norms (Mines and

Hindustan Zinc sets up waste treatment plant.
Seeking to take the Swachh Bharat campaign of Prime Minister Narendra Modi to another level,
Hindustan Zinc has set up a waste treatment plant in Udaipur that handles 30 per cent of the sewage generated
in this lake city of Rajasthan.
A part of the Vedanta Group, engaged in zinc, lead and silver business, the companys plant treats 20
million litres of sewage each day, against the 70 million generated in the city.
This sewage treatment plant has been built at a cost of ` 170 crore and has been constructed and
commissioned on design-build-own-operate-transfer mode in association with the Government of Rajasthan the
company said.

India to remain worlds 4th largest steel maker in 2014 World Steel
World Steel Association said that India will remain the worlds fourth largest steel maker this year even
as its production growth outpaced the global average in the first 11 months. India has produced 76.19 million
tonnes steel in the January - November period compared to 74.37 million tonnes during the same period last
year, clocking 2.4% growth and positioned itself again at the fourth slot.

NMDC targets sales of 38 mt of iron ore in 2015-16
State-owned iron ore mining major NMDC Ltd has set a production target of 35 million tonnes and sales
target of 38 mt for 2015-16 and three fold increase in production by 2021-2022.
The miner, which is in the process of diversifying into couple of new areas, including steel production,
coal mining and manufacture of potash for fertilisers, through joint venture entities, is planning a major production
boost targeting volumes of 65-75 mt by 2018-19 and 100 mt by 2021-22.

Steel consumption up 3 pc during Apr. Feb. imports jump 67 pc
Indias steel consumption in the first 11 months of current fiscal grew by just 3 per cent to 69.21 million
tonnes on poor economic growth even as imports jumped by 67.3 per cent making the country a net importer.
Indias consumption of total finished steel saw a growth of 3 per cent in April - February at 69.218 million
tonnes over same period of last year, data compiled by Joint Plant Committee, a unit under the Steel Ministry,
showed.
Domestic real consumption of total finished steel at 6.4 million tonnes in February was up 1.2 per cent
against the same month last year, while compared to January this year, consumption decreased by 4.5 per cent.

More steel plant on menu
The Central Government is planning to set up four major steel plants in state endowed with rich
resources of iron ore and the process will begin soon.
This was announced by the Union Minister for Steel Shri Narendra Singh Tomar..
He said, we plan to set up steel plants in iron ore rich states of Odisha, Chhattisgarh, Jharkhand and
Karnataka. These four plants will initially have installed capacity of 20 million tonnes per annum. They will also
contribute to the countrys aim of achieving 300 million tonnes production capacity by 2030.

Gujarat NRE Coke Ltd. held a two-day event Global Steel 2014, with the theme Steeling Recovery.
The mine to be opened in the Bailadila sector in Chhattisgarh is in the Deposit-11B Iron Ore Project
while the one in Karnataka is part of the Kumaraswami Iron Ore Mines.
In his Key-note address at the Conference, Shri Kothari said despite Maoist challenge, NMDC was able
to produce 65 per cent of its target last year.

India eyes diamond market
India wants to leverage long-term buys of rough diamonds worth billions of dollars with the worlds
biggest diamond miner-Alrosa of Russia- to help turn Mumbai into a rival diamond trading hub to Europes
Antwerp.
Alrosa, which accounts for 30 per cent of the worlds diamond mined and sends about half of its output
to India through diamond bourses in Antwerp and Dubai, wants to do business directly.
We get better margins and have stabler production regimes if we can get into long term purchase
agreements with Indian diamantaries. We used to have three such deals 4 years back, whereas, this year we
are increasing it to 12, said Andrey Polyakov, vice president of the $5 billion mining giant, which has
overshadowed De Beers in the diamond market.
India sees this as a big opportunity to turn Mumbai into a rival to Antwerp and Dubai.
We are talking to the government to give us a tax regime for diamond traders similar to Antwerp, which
has a small presumptive tax on trading profits and allows miners to bring sparklers here, sell whatever they can
and take back unsold stones without taxes and hassles, said Pankaj Parekh, vice chairman of the Gems &
Jewelry Export Promotion Council.

States can acquire mining leases sans Centres nod
The central government has relinquished its right to accord prior approval to any proposal of granting
mining leases to the states and has empowered the state governments to process the leases on their own in the
mining ordinance promulgated.
This is considered a significant move as it abolishes decades-old system of allowing the Centre the right
to veto any proposal deemed unworthy. Hitherto, in respect of ten minerals including iron ore, bauxite and
copper, the states were mandated to process only those proposals for mining leases which have been vetted by
the union mines ministry.
Further, central government has been given powers to intervene where state governments do not pass
orders within prescribed time lines.
To encourage deeper exploration of minerals, the ordinance has proposed setting up of a National
Mineral Exploration Trust to be created out of contribution from the lease holders.

Centre hints at giving nod for privte players in mineral exploration
The centre is keen to get private sector into mineral exploration as government agencies entrusted with
the job are unable to meet desired output levels.
This was stated by Union Steel and Mines Minister Shri Narendra Singh Tomar at an interactive session
on Development of Mineral-Based Industries in Vidharbha organized by Manganese Ore India Ltd. (MOIL).
We have plenty of natural resources and sufficient manpower but exploration has not been to the
desired extent all these years. Therefore, private players would be entrusted with the job of mineral exploration,
he said.
Mineral exploration in the last 66 years had been quite meagre in India. Therefore, there was a need for
carrying out more exploration in near future, the minister said. He said his ministry is setting up a Natioal Mineral
Exploration Fund from the royalty collected from respective states and some money will also be allocated from
the Union Budget.

Gold, iron ore will extend loss on strong dollar, glut
Gold and iron ore will extend losses into 2015 as the dollars strength hurts bullion and a global glut
pushes down the raw material used to make steel, Morgan Stanley said, listing the two as its least preferred
metals.
Expectations of rising US interest rate will generate considerable headwinds for gold, wrote Joel
Crane, an analyst based in Melbourne. Average prices will decline each quarter, reaching $1,165 an ounce in
the three months to September, the bank said. Commodities will continue to face the twin headwinds of a rising
dollar and mounting concerns over the health of the Chinese economy, Crrane wrote.

Rio Tinto snubs Glencore
Rio Tinto had rejected a merger approach from smaller rival Glencore Plc to create a $160 billion mining
and trading giant in August just as the price of its most profitable product, iron ore, slid toward a five-year low.
The miner said Glencore had contacted it about a potential merger in July, adding that it turned
Glencore down in August and there had been no further contact between the companies on a deal. A merger
would have created the worlds biggest miner, supplanting BHP Billiton.
The Rio Tinto board, after consultation with its financial and legal advisers, concluded unanimously that
a combination was not in the best interests of Rio Tintos shareholders, Rio Tinto said in a statement to the
Australian stock exchange.

NMDC led Team Eyes Stake in Russian Co Acrons Potash Mine
A consortium led by NMDC is eying a 30% stake in Talitsky potash mine in Russias Urals region, as the
countrys biggest iron ore miner seeks to diversify into the fertilizer sector, according to informed sources.
The Talitsky mine is owned by Acron Group, one of Russias major mineral fertilizer producers.
NMDC is planning to buy the stake in consortium with four other public sector fertiliser companiesRashtriya Chemical & Fertilizers (RCF), National Fertilizers Ltd. (NFL), KRIBHCO and Fertilizers and Chemicals
Travancore (FACT). The Hyderabad - based miner will own 50% stake in the consortium, with RCF and NFL
holding 15% each and KRIBHCO and FACT picking up 10% each, the sources added.
