Nov 4, Court Procedural ORDER

Judge Spencer changed the trial date to a Motions Hearing instead. Attending for the Respondents were Mr. Matt Grove and Mr. Christopher Jackson of the Colorado Attorney Generals Office for "The Judicial Branch," Mr. David Broadwell from the Denver County Attorneys Office for the 7 Denver County Judges, and Ms Martha Tierney for Colorado Broadcasters Association and 104.3FM The Fan, radio station. The only other person I recognized on their side of the aisle was Mr. Kent Wagner, Director of the Colorado Judicial Performance Commission. I still don't have the names of the other radio stations that have aired the radio spot and I will make a Motion Monday. I have a CD of the the proceeding but it is in a format that is 10 years old. PROCEDURAL ORDER
This matter involves Complainants allegation that the activities of the
Commission on Judicial Performance, members of the Colorado judiciary, and related
individuals and groups, violated Colorados fair campaign practice laws.
All
respondents filed motions to dismiss, which were scheduled for oral argument on
November 4, 2016. However, prior to the motions hearing, Complainant filed an
amended complaint. Therefore, the ALJ converted the motions hearing to a scheduling
hearing setting deadlines for further briefing. The following deadlines were ordered:
Redline of amended complaint. Due to the length and complexity of the
complaint, Complainant shall file with the court and serve upon the parties a redline
version of the amended complaint identifying the changes made from the original
complaint. The changes may be identified by underlining, highlighting, or other method
sufficient to make it immediately clear what changes have been made. The redline
version shall be filed and served by close of business on Monday, November 7, 2016.
Supplements to motions to dismiss. Any respondent wishing to file a supplement
to its previously filed motion to dismiss, responding to changes made in the amended
complaint, may file and serve such supplement by close of business on Thursday,
November 10, 2016.
Responses to motions to dismiss. Complaint shall have until close of business
on Thursday, November 17, 2016 to file his responses to the motions to dismiss.
Additional court dates. No additional courts dates have been set. Ruling upon
the motions to dismiss will be based upon the parties written briefs, unless the ALJ
deems oral argument would be helpful. If any motion to dismiss is denied, the case will
be set for a hearing on the merits.
Responses to motion to intervene. A non-party, Campaign Integrity Watchdog,
has filed a motion to intervene. Complainant states he has no objection to the motion.
Any respondent wishing to respond to the motion may do so in writing by close of

business Wednesday, November 16, 2016. Respondents may file a joint response, if
they wish.
