Currently, two floating stcirpBgs of VLGC in Kalbut-Situbondo, East Java, lndonesia serves this LPG
distribution requirem'ent. Cun'dnt average distribution volume is approximately'153,000 MT. Each VLGC
possesses a,gfgrthg capaoity of 44,000 MT.
The Projectis aimed to replace this existing temporary solutions to address growing regional demand by: (i)
developing..aii,LP@ Refrigerated Terminal (the "Terminal") and (ii) optionally locking longrterm LPG Supply
from thp Terminal to Pertamina. To this end, Pertamina is seeklng to solicit Proposals from Qualified
Applicantstorbe the Prolect Sponsor to cover either one of the following scopes:

Upon such announcement, the First-ranked Bidder shall promptly extend its Proposal Security until
signing of the Project Agreement.

Prior to the execution of the Project Agreement, and as a condition thereto, the SPC shall provide evidence
to Pertamina that it has established and funded the Project Development Equity Account which shall solely be
used to fund the development phase of the Project to be financed by the SPC's equity.
The Project Agreement will be signed by the SPC, the Sponsors and Pertamina no later than sixty (60) Days
subsequent to the date of issuance of the Letter of Appointment.
Upon execution of the Project Agreement, Pertamina will promptly inform the remaining Qualified Bdders that

power from the generator for a few days.
Moreover, fire water is available even when power failure occurs, since two (2) out of
three (3) fire water pumps (P-506A/B/C, P-507A/B and P-508A/B) are driven by diesel
engine.

referred to as the "Confidential lnfonnation") may be disclosed by PT Pertamina (Persero) (the "Pertamina'
or "Disclosing Party'') to the Bidder.

The Receiving Party agrees that the Confidential lnformation of the Dsclosing Party shall be kept strictly
confidential and shall only use or,permit the use of the Conf dential lnformation to evaluate the Project, and shall
not be sold, tradedi published or otherwise disclosed to anyone in any manner whatsoever, induding, but not
limited to, by means of creating copies, reprodudion or electronic media, without the Disclosing Party's prior
written consent.

The Receiving Party shall be responsible for ensuring that all persons to whom the Confidential lnformation is
disclosed under this Agreement shall keep such Confidential lnformation confidential and shall not disclose or
divulge the same to any unauthorized person.

The Receiving Party shall acquire no proprietary interest in, or right to, the Confidential lnformation.
6.
The Receiving Party shall indemnify and keep indenrnified and hold harmless the Disclosing Party on demgnd
and in full from and against any expenses (including litigation expenses), claims, demands, adtral loss, su'ts,
actions, proceedings, Iiabilities or damages of every description (including, without limitation, any readq.nablelegal
and other professional advisers fees) resulting, caused or arising from or incuned by the Dischsing Party in
