23 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF ARKANSAS:

25 SECTION 1. REGULAR SALARIES - OPERATIONS. There is hereby established for
26 the Cossatot Community College of the University of Arkansas for the 2010-
27 2011 fiscal year, the following maximum number of regular employees whose
28 salaries shall be governed by the provisions of the Uniform Classification
29 and Compensation Act (Arkansas Code 21-5-201 et seq.), or its successor,
30 and all laws amendatory thereto. Provided, however, that any position to
31 which a specific maximum annual salary is set out herein in dollars, shall be
32 exempt from the provisions of said Uniform Classification and Compensation
33 Act. All persons occupying positions authorized herein are hereby governed
34 by the provisions of the Regular Salaries Procedures and Restrictions Act
35 (Arkansas Code 21-5-101), or its successor.

28 SECTION 2. EXTRA HELP - OPERATIONS. There is hereby authorized, for the
29 Cossatot Community College of the University of Arkansas for the 2010-2011
30 fiscal year, the following maximum number of part-time or temporary
31 employees, to be known as "Extra Help", payable from funds appropriated
32 herein for such purposes: one hundred (100) temporary or part-time
33 employees, when needed, at rates of pay not to exceed those provided in the
34 Uniform Classification and Compensation Act, or its successor, or this act
35 for the appropriate classification.

8 SECTION 5. SPECIAL LANGUAGE. NOT TO BE INCORPORATED INTO THE ARKANSAS
9 CODE NOR PUBLISHED SEPARATELY AS SPECIAL, LOCAL AND TEMPORARY LAW.
10 PRIORITIES. High priorities of the Cossatot Community College of the
11 University of Arkansas shall be the development and implementation of
12 technical programs designed to:
13 (1) upgrade skills of current employees in service area businesses and
14 industries,
15 (2) to combat illiteracy and English language deficiencies,
16 (3) to increase the number of skilled workers available for employment,
17 (4) to provide leadership for school-to-work programs including cooperation
18 with area public schools, businesses, industries, and labor groups, and
19 (5) to provide the first two years of baccalaureate education transferable to
20 colleges and universities in the general community area of the College and
21 the State of Arkansas.
22 The provisions of this section shall be in effect only from July 1, 2007
23 2010 through June 30, 2009 2011.

25 SECTION 6. SPECIAL LANGUAGE. NOT TO BE INCORPORATED INTO THE ARKANSAS
26 CODE NOR PUBLISHED SEPARATELY AS SPECIAL, LOCAL AND TEMPORARY LAW. FUND
27 BALANCES. The Board of Trustees in its official governing capacity charged
28 with the management or control of the institution of higher learning and the
29 President or Chancellor as the Chief Executive shall certify to the Chief
30 Fiscal Officer of the State and the Legislative Council that as of December
31 31 of each year that sufficient appropriations and funds are available, or
32 will become available, to meet all current and anticipated obligations during
33 the fiscal year for the payment of the obligations when they become due.
34 This certification, signed by the Chair of the Board of Trustees and the
35 President or Chancellor will be forwarded by February 28 of each year or upon
36 release of the previous year's audit by Legislative Audit to the Chief Fiscal

1 Officer of the State and the Legislative Council accompanied by the Board
2 approved published annual financial statement for the preceding fiscal year.
3 The provisions of this section shall be in effect only from July 1, 2007
4 2010 through June 30, 2009 2011.

6 SECTION 7. COMPLIANCE WITH OTHER LAWS. Disbursement of funds authorized
7 by this act shall be limited to the appropriation for such agency and funds
8 made available by law for the support of such appropriations; and the
9 restrictions of the State Procurement Law, the General Accounting and
10 Budgetary Procedures Law, the Revenue Stabilization Law, the Regular Salary
11 Procedures and Restrictions Act, the Higher Education Expenditures
12 Restrictions Act, or their successors, and other fiscal control laws of this
13 State, where applicable, and regulations promulgated by the Department of
14 Finance and Administration, as authorized by law, shall be strictly complied
15 with in disbursement of said funds.

17 SECTION 8. LEGISLATIVE INTENT. It is the intent of the General Assembly
18 that any funds disbursed under the authority of the appropriations contained
19 in this act shall be in compliance with the stated reasons for which this act
20 was adopted, as evidenced by the Agency Requests, Executive Recommendations
21 and Legislative Recommendations contained in the budget manuals prepared by
22 the Department of Finance and Administration, letters, or summarized oral
23 testimony in the official minutes of the Arkansas Legislative Council or
24 Joint Budget Committee which relate to its passage and adoption.

26 SECTION 9. EMERGENCY CLAUSE. It is found and determined by the General
27 Assembly, that the Constitution of the State of Arkansas prohibits the
28 appropriation of funds for more than a one (1) year period; that the
29 effectiveness of this Act on July 1, 2010 is essential to the operation of
30 the agency for which the appropriations in this Act are provided, and that in
31 the event of an extension of the legislative session, the delay in the
32 effective date of this Act beyond July 1, 2010 could work irreparable harm
33 upon the proper administration and provision of essential governmental
34 programs. Therefore, an emergency is hereby declared to exist and this Act
35 being necessary for the immediate preservation of the public peace, health
36 and safety shall be in full force and effect from and after July 1, 2010.
