THE SITE
The site of the Works is situated on PEMBINAAN
JEJANTAS PEJALAN KAKI DI HADAPAN SEKOLAH RAJA
PEREMPUAN TAAYAH, IPOH, DAERAH KINTA, PERAK
DARUL RIDZUAN
The Contractor is referred to the Site Plan for the exact
location, dimensions and area of the site.
The Contractor shall be deemed to have visited the
site and satisfied himself as to the means of
communication, access site, the extent and nature of
work and the site, the nature of sub-soil, the conditions
under whichthe work shall be carried conditions
affecting the supply of labour, materials and goods
matters which might effect the Contract, as no claims
on the grounds of knowledge in this respect will be
entertained.
POSSESSION OF THE SITE
Possession of the site shall be given to the Contractor
in accordance with the Letter of Acceptance of Tender.
The Contractor shall accept the site as found on the

Materials, goods and workmanship shall be of the best
quality respective kinds, and those for which there is
an British Standard Code of Practice shall comply
therewith unless otherwise stated. Preambles and
descriptions of materials, goods and workmanship
given in any one section or trade shall apply
throughout this Document unless otherwise stated
describe.
Figured dimensions shall be followed in preference to
scaled and all dimensions and particulars shall be
taken from the actual where possible.

The Contractor shall allow for access to and on the site
necessary temporary roads, tracks, hardstandings,
crossings, for meeting the requirements of the
Authorities including paying and for removal and
reinstatement of any fences, hedges, etc. original

be situated approved positions and the Contractor
shall allow for dismantling, and re-erecting them in
new positions, during the execution of if necessary.
The Contractor shall provide the following :
(i)Proper sheds, etc. for the storage of materials,
goods,
and for the execution of work which may be prepared
(ii)The contractor shall note that workers are not
permitted
overnight at the site. In this respect, the contractors
shall arrange alternative accommodation for the work
people.
(iii) All necessary sanitary accommondation for the
workpeople
site staff and the Contractor shall deodorise the
ground removal. Portable toilet cubicles would be
preferred.
PLANT AND MACHINERY
The Contractor shall provide and install at plant and
machinery proper carrying out of the Works including
all necessary hoists, cranes, ladders, staging, tackle,
tarpaulins, tools, vehicles and (mechanical and
otherwise) and allow for altering, adapting and them
as necessary and eventually removing and making
good.

All insurance policies shall be effected with Berjaya
Sompo Insurance and all insurance policies together
with all receipts for premiums shall be submitted and
deposited with the Employer before the
commencement of the Works.
i)Insurance against injury to persons
Without prejudice to his liability to indemnity the
Employer under Clause 18 of the Conditions of
Contract, the Contractor shall be responsible for
obtaining such insurance policies cover all his
liabilities.
The contractor shall maintain and shall cause any
subcontractor to maintain a Workmen's Compensation
Insurance Policy in accordance with the Workmen's
Compensation and the Workmen's Compensation
(Amendment) Act.
"Employer Liability Insurance Policy" shall be effected
maintained by the Contractor and any sub-contractor
of personal injuries or death to employees who are
"Workmen" within the meaning of the Workmen's
Compensation Ordinance or Enactment or alternatively
endorsement Workmen's Compensation Insurance
Policy shall be cover these employees without
diminishing the Contractor's liabilities.
The Workmen's Compensation Insurance shall be
subject the Architect's satisfaction that the wages
declared are and adequate.
Notwithstanding anything stated to the contrary,
nothing the said policies or any endorsement therein
shall effect right of any person entitled to
compensation by virtue Workmen's Compensation Act
or Legislation of the Government of Malaysia.

SETTING OUT AND LEVELLING
The contractor shall engage a licensed Surveyor in
establishing and setting out the works and pay all fees
in connection herewith. Before commencement of the
Works the Contractor shall submit Engineering two (2)
copies of certified setting out plan prepared by
licensed Surveyor.
WATCHING
The contractor shall allow for all necessary watching
for the security of the Works and the protection of the
public including shelter watchmen so required.
MAINTENANCE AND PROTECTION OF PUBLIC
PROPERTY,ETC
The Contractor shall maintain and protect public and
private carriageways, footways, kerbs, pipes, ducts,
sewers, service overhead cables, etc. and keep
approaches to the site clear of throughout the
execution of the Works, and make good or pay
reinstatement of any damage caused thereto directly
or indirectly the execution of the Works.
The Contractor shall allow for taking all responsible
precautions ensure the efficient protection of all drains
and waterways against pollution arising out of or by
reason of the execution of the Works.

A ANNOYANCE TO NEIGHBOURS, ETC.
The Contractor shall stop executing any work which is
likely to annoyance or inconvenience to occupants in
the vicinity and carry such works at such times during
normal working hours as the may direct and shall
organise his work so as not to provide grounds for
complaint.
The Contractor shall carry out the Works in such
manner to mininise inconvenience and nuisance to
persons living in neighbouring and to the public.
The Contractor shall take the utmost precautions in
minimising arising from the works. The Contractor shall
indemnify the Employer respect of any claims or
proceedings arising out of his neglect care to ensure
the noise from the work does not constitute a
nuisance.
Immediately upon receipt of any form of complaint,
from adjoining property owners or Authorities, the
Contractor shall notify the of the nature of such
complaint and submit corrective measures intends to
employ. The Contractor shall be held solely responsible
any damage caused to the adjoining and adjacent
properties through the carrying out of the works under
this Contract and shall make and compensate such
damage to the satisfaction of such adjoining owners
and tenants to the satisfaction of the Architect.
The Contractor shall indemnify the Employer against
any claim injunction arising from interference to the
adjoining owners.

A TEMPORARY SCAFFOLDING
The Contractor shall provide all temporary standing
scaffolding, approved type, erected to the approval of
the Architect and in with the relevant Bye-laws with
staging, planked footways, guardrails the like, as
required.
Tubular scaffolding if deemed necessary, shall be steel,
light pre-fabricated of 38mm nominal bore, with clamp
type fittings, equivalent to the requirements of BS :
1139.
Scaffolding shall be arranged so as to allow adequate
working between the surface to be worked and the
scaffolding.
The Contractor shall be fully responsible for the design
and the of the scaffolding and obtain approval from the
relevant Authorities and for submitting design details if
required.
TEMPORARY ELECTRICITY SUPPLY
The Contractor shall arrange seperate metering
system for assessing the charges for testing and
commissioning of mechanical and installations.
If temporary power supply is unavailable from TNB or
the available is not sufficient to meet the requirements
of this project the Contractor shall use Generator Set
subject to the approval of TNB and Chief Electrical
Inspectorate of Malaysia.

completion.

A
Contrary to the Standard Method of Measurement
Building Works, precast reinforced concrete piles in
this Bill will be described, measured and valued in
accordance with these definitions, rules and
statements set out in the following paragraphs
i)The supply of piles shall be in linear metre
as actual length delivered to site.
ii)The handing, transporting and pitching of
piles shall be enumerated.
iii)The dirving of piles shall be measured in
linear metre from the shoe point when set i.e. the
dirven end of the pile to the shoe point when pitched.
iv)Joints between pile lengths shall be
enumerated.
v)All basic piles shall be in lengths of 6.00
metre unless otherwise instructed by the Engineer and
extension piles in lengths
exceeding 3.00 metre but not exceeding 6.00 metre
and only one joint shall be
measured for every extension pile. All extension piles
used shall be endosed by the Clerk-of Works.
vi)Cutting off tops of piles at required cut off
level shall be enumerated.
