AFFIDAVIT
I, ARTURO BARIQUIT LASCANAS, Filipino, married, of age, a resident
of Davao City, Philippines, after being duly sworn, hereby depose and state that:
1. Lam a retired officer of the Philippine National Police (PNP). I retired in
December 2016 with the rank of Senior Police Officer III (SPO3).
Throughout my career in the police I was stationed in Davao City.

.. Lwas one of those who was named by EDGAR MATOBATO when he
testified before the Senate in September 2016. I was also one of those
who was summoned to appear before the Senate in October 2016.

. When I appeared before the Senate, I denied the accusations made by
EDGAR MATOBATO about the extrajudicial killings in Davao City and
the Davao Death Squad. I was forced to deny what MATOBATO said,
even if most of it was true, because | was afraid for the safety and
security of my loved ones in Davao City. The truth is that most of what
MATOBATO told the Senate is true. It’s just that MATOBATO was
because the operations were compartmentalized.

5. Twas a major player in the group that came to be known as the Davao
Death Squad or DDS. | was present when then MAYOR RODRIGO
ROA DUTERTE of Davao City ordered the killing of numerous men and
women, and gave us reward money after we executed them. I was
responsible for the killing of many men and women, and at least one
child, upon the instructions of MAYOR DUTERTE.
6. I regret what I did and I know I have to answer for all my misdeeds
before the people, the law, and before God.

. When RODRIGO DUTERTE was elected Mayor of Davao City in 1988,
he organized the Anti-Crime Task Force and designated his very close
friend, MAJOR ERNESTO MACASAET, to head it. At the start,
MAYOR DUTERTE was serious in going after criminals, especially
organized crime. I was a member of this Task Force. Because of the work
of the Anti-Crime Task Force, and with the cooperation of the otherpolice units and the Davao Metropolitan District Command, the crime
rate in Davao City went down.
8. It was at this time that MAYOR DUTERTE began organizing liquidation
| squads that later became known as the Davao Death Squads or DDS. In
the beginning, we targeted and killed drug addicts, drug pushers,
snatchers, holduppers and other criminals. Later on, however, we were
ordered by MAYOR DUTERTE to go after and kill his personal and
political enemies. We became like hired or contract killers who killed not
only criminals but innocent people.
Origins of Davao Death Squad
9. At that time one can say that our group was already the Davao Death Squad
but we were not known as DDS until the raid on the residence of ALAN

assault.
: the name of the NPA because they would deny it and it might irritate
MAYOR DUTERTE. So MAJOR ASENTISTA and CRIS LANAY
inserted another name - the DAVAO DEATH SQUAD.
12. The assault was executed. No firearms or illegal drugs was recovered. No
arrest was made. ‘The whole house was peppered with bullets from M16
and M14 rifles. There was no exchange of fire since no armed person was in
the house. The only occupant, a house maid, was shot and killed, On the
side of the assault team one of our force multiplier was wounded due to
accidental firing, We left the note (signed - DAVAO DEATH SQUAD),
and evacuated immediately on board our white Toyota van issued by City
Hall and headed back to the Laud quarry for safety and instructions. Thus
was born what has became infamously known and feared as the “DAVAO
DEATH SQUAD” ot “DDS” for short.
13. The name “Davao Death Squad: or DDS spread like wild fire. DDS
became a household name in Davao City. Print media, radio and TV in
Davao City highlighted the name DDS everytime there was gunshot victim
or shooting incident in Davao City.Patasaja Massacre
14-There was one incident in particular involving the DDS that I cannot
forget. It involved the family of a person we had abducted because we
suspected he was involved in the kidnapping of a prominent person from
Davao City, a certain Mrs. Abaca. Her husband was Mr. Dante Abaca,
who was then a local banker in Davao City if I remember correctly.
15.We (MAJOR ERNESTO MACASAET, MAJOR ASENTISTA, SPO4
DICK CLORIBEL, SPO4 FULGENCIO PAVO, SPO3 GERRY
BAGUHIN, and SPO3 TEODORO PAGUIDOPON, SPO4 BEN LAUD.
and myself) were the lead group of the Davao City policemen tasked and
instructed personally by MAYOR DUTERTE to conduct investigation,
follow-up operations and pursue the suspects in the said kidnapping
incident in Davao City. Our team leader for this case was SPO4
DESIDERIO “DICK” CLORIBEL.
16.Our initial investigation led to the identity of one EDWIN ANGELES, a
half Muslim and half Christian, He was believed to be the leader of an
organized Kidnap for Ransom Group from Basilan Island and
Zamboanga Peninsula. We exhausted all our best efforts and ability, at
times operating twenty-four hours a day seven days a week, even
reaching the provinces of South and North Cotobato, with no positive
result. Several months later, Mrs. Abaca was freed by her abductors
somewhere in General Santos City, allegedly after payment of an
undetermined amount of money as ransom.
17.Then SPO4 DICK CLORIBEL informed our group that he received A-I
information coming from his classmate in police schooling, a certain
INSPECTOR PATAYAN of Gen, Santos City Police Office regarding
the kidnap for ransom case of MRS. ABACA. SPO4 CLORIBEL also
informed MAJOR ERNEST MACASAET, who was then Anti-Crime
‘Task Group Commander, of the said lead in the case.
18.SPO4 CLORIBEL together with SPO3 TEODORO PAGUIDOPON and
myself then personally informed MAYOR RODRIGO DUTERTE of the
A-1 information from INSPECTOR PATAYAN. MAYOR DUTERTE
immediately ordered us to proceed to Gen. Santos City and determine the
veracity of INSPECTOR PATAY AN’:
information about the case.
19.We went to Gen. Santos City and met with INSP. PATAY AN near the
General Santos City Hall building. He told us that a certain MR.
PATASAJA or PASAJATA (hereafter referred to as MR. PATASAJA
for brevity) was involved in the kidnapping of MRS. ABACA. I have
forgotten the first name of this person and I am not also sure if | am
correct with the spelling of his surname, but if not, it sounds similar.
INSP. PATAYAN also identified the alleged financier of the kidnapping
group as a certain EDWIN ANGELES.20.INSP. PATAYAN also informed us that MR. PATASAJA who was from
Zamboanga posed as a barter trader in Gen Santos City, and that he was
the possible mastermind of the MRS. ABACA kidnap for ransom case.
We then returned to Davao City and personally reported what we learned
to MAJ. MACASAET and MAYOR DUTERTE. If I recall correctly,
INSP. PATAYAN was with us when we went to MAYOR DUTERTE.
21. day later, MAJOR MACASAET ordered our group, namely: SPO4
DICK CLORIBEL, SPO4 BEN LAUD, SPO4 FULGENCIO PAVO,
SPO3 GERRY BAGUHIN, SPO3 TEODORO PAGUIDOPON and
myself to abduct PATASAJA and bring him in person to MAYOR
DUTERTE in Davao City. MAJ. MACASAET informed us that
MAYOR DUTERTE already cleared the operation.
22,We proceeded immediately to General Santos on board two vehicles: one
four-door Toyota pick-up color gray, and one Toyota van-type color
white. We met INSP. PATAYAN at Gen. Santos City and he told us that
MR. PATASAJA and he were neighbors or lived near him. He also told
us that we could post ourselves in a place where PATASAJA would be
passing later that day and that he would alert us by radio when
PATASASJA would be passing there.
23.It was about 2 or 3 pm that we (SPO4 LAUD, SPO3 BAGUHIN, SPO3
PAGUIDOPON and myself) posted ourselves using the Toyota van type
at the place where the vehicle of PATASAJA would pass on his way
home. After sometime, INSP. PATAY AN called us thru handheld radio
and told us that Mr. PATASAJA was on his way to our position on board
his dark blue Ford Fiera closed van type vehicle.
24.Upon seeing PATASAJA’s vehicle as described by INSP. PATAYAN
we immediately flagged it down by flashing our police I.D.s and badges.
We got MR. PATASAJA but to our surprise, he was not alone. His entire
family was with him in the vehicle: his wife, a Muslim convert who we
leamed later was seven months pregnant; his son who was four or five
years old; his seventy year old father-in-law; a male relative helper; and
their housemaid.
25.We transferred his wife and son to the back of their vehicle; the wife’s
father, the house maid and male helper at the back seat. SPO3
BAGUHIN AND SPO3 PAGUIDOPON guarded them. We handcuffed
MR. PASAJATA and made him sit between us in the front. I drove their
vehicle. Upon reaching the boundary of of Gen. Santos City and
Malungon, Sarangani, we parked in a secluded area along the highway.
There we unloaded the entire PATASAJA family from their vehicle and
made them board the Toyota pick-up. We then left their vehicle hidden in
a grassy and bushy area.26.We arrived in Davao City around 9 pm and proceeded directly SPO4
LAUD’s quarry along the Diversion Road in Davao City, Ma-a area. We
secured the PATASAJA family inside a small house at the quarry where
“Miguel” (I do not know his sumame), SPO4 LAUD’s trusted man,
stayed.
27.We (CLORIBEL, PAGUIDOPON and myself) left the PATASAJA
family at the quarry and reported to MAJOR MACASAET and MAYOR
DUTERTE at an eatery in Ecoland, Davao City, where we had dinner
together. We informed him that we had abducted the whole family and
gave him the details of the operation and the initial report of Mr.
PATAJASA’s involvement in the kidnapping of MRS. ABACA. When
someone asked what was to be done with MR. PATASAJA and his,
family, MAYOR DUTERTE asked MAJ. MACASAET what is best to
do. MAJ. MACASAET advised that since subject is positive he should
be erased, and that his entire family should also be erased. MAYOR
DUTERTE gave the go ahead and said in Bisaya, “Sige, limpyo lang.”
28,We went back to the quarry and continued the tactical interrogation of
MR. PATASAJA, his father-in-law and their male relative-helper. MR.
PATASAJA denied any participation in the kidnapping and persistently
asserted his innocence in the kidnapping of MRS. ABACA and in kidnap
for ransom cases in Southern Mindanao.
29.While the tactical interrogation was on-going, I was able to talk to MR.
PATASAJA’s wife, who was with their four or five year old son, in a
bamboo hut. MAJOR MACASAET arrived with pansit, bread and soft
drinks. He had a brief conversation with SPO4 CLORIBEL then left. I
offered the wife pansit but she refused because the pansit had pork and
she was a Muslim convert. I gave their son bread as he was already very
hungry.
30.Past midnight SPO4 CLORIBEL received a call. After he ended the call,
CLORIBEL reminded us of the orders of MAJOR MACASAET and
MAYOR DUTERTE to erase or kill the entire family of PATASAJA. I
and SPO3 BAGUHIN protested to killing the wife who was seven
months pregnant, the child, and the others when the target was only MR.
PATASAJA. I told the group that we should just bring the child to
Butuan and leave him at the bus station. But one member of the group
said that when the child grows up he will recognize us, but we will no
longer recognize him. And he will eventually seek vengeance for the
killing of his family. After that no one anymore supported me.
31.SPO4 CLORIBEL again reminded us that the decision to erase and kill
the entire family was cleared by “SUPERMAN” which was the code
name our group gave to MAYOR DUTERTE.
32.After a while I heard several muffled gunshots of a firearm with a
suppressor coming from the small house where MR. PATASAJA, hisfather in law and male helper and house maid were located. I then heard
the loud screams of the wife and then silence after several gunshots were
fired. I did not then know how the child was killed because it was dark.
33.AfRer that all the bodies were lined up on the ground. Their personal
‘belongings were removed and burned, including the Quran of the wife.
Al the bodies were then loaded into two vehicles and brought deeper into
the Laud quarry where Miguel and two other trusted men of SPO4
LAUD stripped them naked before burying them.
34.After several days MAJ. MACASAET gave us P200,000 as reward
money from MAYOR DUTERTE, and instructed us to go back to the
Laud quarry to check the area where the bodies were buried. We returned
to Laud quarry and brought used oil which we put on top of the places
where the bodies were buried to keep the flies away.
Bombing of Davao Mosques
35.TThere was also another incident where we were ordered by MAYOR
DUTERTE to bomb several mosques in retaliation for the bombing of a
Catholic church. In December 1993 the St. Peter’s Cathedral in Davao
City was bombed. Seven people were killed and many others were
injured. Soon after it happened, then MAYOR DUTERTE went to our
Anti-Crime office to discuss the bombing incident. I was present at the
meeting, together with COL. ERNESTO MACASAET, SPO4 DICK.
CLORIBEL, MAJOR ILDEFONSO ASENTISTA, SPO4 GERRY
BAGUHIN, SPO4 TEODORO PAGUIDOPON, SPO2 JUN NARESMA
and $P04 BEN LAUD
36.During that meeting, MAYOR DUTERTE told us that the ones who were
responsible for the cathedral bombing were radicals and extremists from
the Muslim community. He was very angry at them and said that he
‘would not tolerate their act of bombing the cathedral. He then ordered us
to retaliate by bombing several mosques. We were each given specific
assignments and were provided with hand grenades. DICK CLORIBEL
and I were ordered to bomb the Kama Mara Mosque located at the
Diversion Road in Davao City. The others who were present in the
meeting were assigned to bomb other mosques.
37.DICK CLORIBEL and |, together with SPO4 BOY PAVO and an asset
‘whose name I can no longer remember, carried out MAYOR
DUTERTE’s orders. It was our asset, on a motoreycle, who threw the
grenade at the mosque. CLORIBEL and I acted as perimeter security. We
saw that the grenade exploded in a basketball court near the mosque.
38.After several mosques were bombed as instructed by MAYOR
DUTERTE, I saw then SEN. NENE PIMENTEL being interviewed on
television. He expressed concern about the Davao bombings and said that
there was a state of anarchy in Davao. Soon after that, COL.MACASAET called us and told us to stop the bombings and to “lie low”
‘because there might be a Senate inquiry.
39.EDGAR MATOBATO was also involved in the bombing of one of the
mosques. As far as I can remember, it was SPO4 TEODORO
PAGUIDOPON who supervised him,
Jun Bersabal Murder
40.Over time, it became our practice to bring the persons we would capture
to MAYOR DUTERTE, especially those who committed heinous crimes,
before we would kill them, During the many years that we operated the
DDS, we brought many persons to MAYOR DUTERTE, sometimes in
his house and sometimes in other places. One of those who we brought to
MAYOR DUTERTE before we killed him was a notorious ex-PC soldier
named JUN BERSABAL, who led a group of ex-PC soldiers that
engaged in various criminal activities including akyat bahay, rape, and
robbery.
41.In or about 1993, I was instructed by MAYOR DUTERTE (in the
presence of BAGUHIN and PAVO) to locate and capture JUN
BERSABAL. MAYOR DUTERTE told us that some mayors had
complained to him about BERSABAL, and that BERSABAL had a
‘warrant of arrest which he gave to us. With the help of EDGAR
MATOBATO, who acted as our spotter, we were able to capture
BERSABAL while he was playing mahjong in Kaputian, Samal Island.
After we caught BERSABAL we brought him to the Kaputian Police
Station and the arrest was recorded at the police station. From there we
proceeded to MAYOR DUTERTE in his residence in Central Park. Our
team that operated on BERSABAL was headed by SPO4 BOY PAVO.
42.When we presented BERSABAL to MAYOR DUTERTE, the Mayor
asked him what was the cause of his latest dismissal. BERSABAL
answered that it was because of AWOL. DUTERTE cursed BERSABAL.
‘After BERSABAL was taken away, DUTERTE advised us not to take
him to Davao Oriental because he might escape, and ordered us to kill
him, He told us in Cebuano “Luba na ninyo” (“You kill them”).
43.To cover up the killing of BERSABAL, I went to see INSP. ROMMEL
MITRA of Sigaboy police, who was then the station commander of the
Sigaboy police station, and we agreed that MITRA would sign our
logbook stating that he had “received the living body of Bersabal,” and
that he would make it appear that BERSABAL “escaped” that night.
44.After that, we salvaged BERSABAL and disposed of his body in what is
now Compostela Valley.
45.Later there was a complaint filed by the relatives of JUN BERSABAL
against EDGAR MATOBATO, ROMMEL MITRA, myself and anotherpoliceman, with the Commission on Human Rights (CHR), We were
investigated by the CHR but we were absolved after we showed them the
logbook showing that INSP. MITRA had received the living body of
BERSABAL.
46.Before the CHR investigation, I brought INSP. MITRA and the other
policeman to MAYOR DUTERTE. In my presence, MAYOR
DUTERTE told them don’t worry, if anything happens I'll take care of
you. When the CHR came out with its Resolution, MATOBATO,
MITRA and I were exonerated but as I recall the policeman who was
supposed to be guarding BERSABAL when he allegedly escaped was
recommended for suspension/disciplinary action.
Jun Pala Assassination
47. Another person murdered upon instructions of MAYOR DUTERTE was
a very popular radio broadcaster and commentator in Davao named JUN
PALA.
48.In the beginning, JUN PALA was an avid supporter and close friend of,
MAYOR DUTERTE. But there came a time when their friendship soured
because of personal and political bickering,
49.When they parted ways, JUN PALA started attacking and lambasting
MAYOR DUTERTE daily, on air, on political and personal issues which
seriously affected his political career. PALA also attacked MAYOR
DUTERTE’s son, PAOLO DUTERTE, on the air, on personal issues.
50.One day, sometime in 2003, SPO4 SANSON "SONNY"
BUENAVENTURA (now retired), the bodyguard and driver of MAYOR
DUTERTE, who was also a very close friend of mine, called me thru
cellphone and requested that the two of us only meet on a very important
matter.
51.When we met, SPO4 SONNY BUENAVENTURA opened up to me
about JUN PALA’s continued attacks on air on MAYOR DUTERTE.
‘According to BUENAVENTURA, MAYOR DUTERTE was very angry
at JUN PALA for attacking him.
52.SONNY BUENAVENTURA told me that MAYOR DUTERTE asked
hhim (Sonny) to look for a hitman for a hit job against JUN PALA.
SONNY suggested my person to MAYOR DUTERTE to do the hit job
against JUN PALA. According to SONNY BUENAVENTURA,
MAYOR DUTERTE agreed and offered Three Million Pesos
(PhP3,000,000.00) as pot money (reward).
53.1 accepted the contract (hit job) to kill JUN PALA. I asked SONNY
BUENAVENTURA for a iogistic fund to start the assassination planagainst JUN PALA. Two days later SONNY gave me Five Hundred
‘Thousand Pesos (PhPS00,000.00) as expenses for our operations.
54.1 immediately contacted SPO1 JIM TAN of the Sta. Ana Police Station.
‘POL JIM TAN was the brother of my classmate in Police Training, the
late Patrolman JART TAN. SPO! JIM TAN at that time was a new
member of our group (the Heinous Crime Group of the Davao City
Police). He was accepted into our group because he maintained some
“players” (hitmen) from the Rebel Returnees Association (RRA) in the
Mandug area.
'55.$PO1 JIM TAN agreed to work with me on the contract to kill JUN
PALA. I told him that SONNY BUENAVENTURA offered Two Million
Pesos (PhP2,000,000.00) for JUN PALA’s head and that Five Hundred
‘Thousand Pesos (P500,000.00) was given as operational fund.
56.SPO1 TAN then contacted his “players” (hitmen) consisting of the
DUHILAG brothers from the Mandug area. They were - VALENTIN
aka “VAL”, ALAN AND ROLAND all surnamed DUHILAG and one
known as “JOY” of Bacaca Heights, Davao City.
57.We collectively planned the operation to kill JUN PALA. We executed
the assassination plot against JUN PALA twice through ambush. In both
attempts we failed.
58. The first attempt was done in the Circumferential Road near Davao
Medical School Foundation. The second attempt was done at Mamay
Road near Davao International Airport.
59.We relaxed for a couple of months looking for the right time and place
where to execute the plan again. It was during this period while I was at
Café Iustrado in J.S. Gaisano along Tlustre Street, Davao City, that I was
surprised to see MAYOR DUTERTE alone near the children’s section of
the J.S. Gaisano Mall. I approached him and saluted him, and greeted
him - “Good afternoon Sir!”
60. MAYOR DUTERTE came closer to me and to my recollection
whispered to me in Bisaya ~ “Naunsa man to pag ambushed ninyo kang
Pala?” (“What went wrong with the ambush of JUN PALA”) I simply
replied in English - “I’m sorry sir.” To this MAYOR DUTERTE replied
“Take time...ayaw pagdali” (“Take your time”). He then just walked
away and I retumed to Café Hustrado.
61.Then one morning SONNY BUENAVENTURA called me for a meeting,
in a retaurant somewhere in Ecoland, Matina, D.C. It was there that
SONNY introduced me to JERRY TROCIO, a former NPA.

‘Anti-organized Crime Task Force. SONNY told me that JERRY
TROCIO was a part-time security bodyguard of JUN PALA.10
62.SONNY told me that JERRY TROCIO (Jery) was already briefed about
‘the contract (hit job) and that JERRY agreed to be our intelligence inside
the group of JUN PALA. JERRY would be given Three Hundred Fifty
‘Thousand (PhP350,000,00) as reward for information as tothe weakest
spot of JUN PALA for purposes of our lethal strike. SONNY gave
JERRY TROCIO an initial Twenty Thousand Pesos (P20, 000.00) for
‘operational expenses and instructed Jer to buy a new cellphone and to
take note of my cellphone number so that I and JERRY could directly
‘communicate with each other.
{63,About two months later, to my recollection, JERRY was able to zero in
‘on a patter a to the whereabouts and exact location of JUN PALA
during nighttime, This consisted of an almost regular card game (Tong-
its) that JUN PALA played at his neighbor's house. [immediately called
‘SPOIL JIM TAN fora meeting where we finalized the

'PALA had a scheduled card game session atthe residence of JUN,
ALA's neighbor at 7 pm that day. As previously agreed JERRY

the group of the DUHILAG Brothers who were tasked to execute the
armed assault on JUN PALA. They were positioned along the National
Highway (Diversion Read) near the Quiboloy Church, more or less 1,000
meters ftom the residence of JUN PALA, on board a Toyota van type
four doors colored dark blue. I was on board my City Hall issued light

{66.At around 8 pm more or less, as expected, JERRY TROCIO missed
«alled my cellphone twice. This was the previously agreed signal that
JUN PALA was now about to go home. Right then and thee, I called
JIM TAN and said “I's showtime”, JIM TAN with hs team immediately
proceeded tothe place where JUN PALA would pass-by on foot going to
his residence. After 40 minutes more oF less, a they say the rest is

BUENAVENTURA thru cellphone and told him that “showtime was
over”. Before reaching my residence I told VALENTIN DUHILAG to
dismantle the M16 he used to kill JUN PALA which he carried inside my
vehicle. I also told him to remove his bonnet and jacket and leave it
together with the M16 inside my vehicle. I gave VAL DUHILAG a new

69.Several days later SONNY called me for a meeting. We met and with
him was the Three Million Pesos (PhP3,000,000.00) reward money from
MAYOR DUTERTE. I and SONNY divided the One Million Peso
between us, P500,000.00 for each of us. I brought the Two Million
(P2,000,000.00) to SPOI JIM TAN. JIM TAN gave me One Million
Pesos as my, SONNY and JERRY TROCIO’s share of the reward
money. JIM TAN kept the other One Million as his and his players
(hitmen) share.
70.About a month later, SONNY called me and told me to proceed to the
house of MAYOR DUTERTE’s girlfriend, to get a bonus of 1M for the
Pala killing. | proceeded there. When I entered the house, MAYOR
DUTERTE saw me and pointed to the one million cash in a plastic bag
and he said “1M.” I got the money, thanked him and left.
71.The Davao City Police Office, the CIDG XI, and our unit the Heinous
Crime Group, to which I and JIM TAN were assigned, conducted an
intense investigation regarding the ambush killing of broadcaster JUN
PALA. The Result: Unsolved.
72.Today JUN PALA’S death can be considered SOLVED. JUN PALA was
murdered by us at the instance and behest of then MAYOR DUTERTE,
for Three Million Pesos (PhP3,000,000.00)
73.1 do not expect forgiveness from the families and relatives of the people
we killed. I do hope that they would at least find comfort in knowing
what really happened to them and who was truly responsible for their
disappearance and murder.
74.1 know it is not enough to say sorry, but I am truly sorry for what I have
done, and I am ready to face the consequences of my actions.
75. The above incidents are just some of the many incidents that I have
personal knowledge of which involved MAYOR DUTERTE. The events
in this affidavit are some of the most significant killings that I, together
with other police officers, rebel returnees and others did with the prior
knowledge, direct orders, consent, tolerance, or acquiescence of then2
