EQUITY AIDS THE VIGILANT NOT THE INDOLENT

INTRODUCTION:

Equityalways assist those who are active in respect of


their rights. It does not assist those who are careless
regarding their rights. If a person delay regarding his right
then only conscience, good faith and diligence can assist
him. If all these essentials are not present then Court
cannot do anything in his favour.
Basis of this maxim:
This maxim is based on latin maxim;
vigilentibus non dormientibus jura subveniunt which
means
equity aids the vigilant not the indolent or delay
deafeat equity
Meaning of this maxim:
The meaning of this maxim is that if a person is indolent
to claim a remedy for a wrong committed to him
