1. Session was called to order by the Presiding Officer, Hon. Hadji Bonso S. Barabag, at 9:05 oclock
in the morning, followed by a prayer led by Hon. Sani C. Hanani, singing of the National Anthem and
the Provincial Hymn, and the recitation of the Councilors Creed by the members.

the Minutes and Journal of Proceedings of the previous session.

12. Hon. Suso Assalam Alaikum, to our Hon. P.O. Hadji Bonso Barabag, our honorable colleagues of
this august body, to the secretariat Maam Sharon, to the staff and all of us, good morning. I would like
to appraise this body in relation to the continuing implementation of IPRA Law in this locality. May I
cite two points within our tribe, one is the ancestral domain though we have already submitted request
for that and we have to submit the resolution for defining of the ancestral domain of the Kalagan tribe
of this municipality. Along that line the provincial office already given us

15. Hon. Maralit, Jr. May I request the speaker to speak slowly.

16. Hon. Barabag (P.O.) Slowly not very fast because we are not Americans.

17. Hon. Suso Second development along that line honorable members in this committee that on Section
16 of Republic Act 8371 or the IPMR in the barangay level. Allow me to inform that on August 5
Brgy. Poblacion had already have the selection of the barangay IPMR and its Mr. Umbra Paradan was
the one being selected. In the afternoon time in Brgy. Ilangay, Mr. Al Abdul Akib Suangga was
selected. Now, on September 12 in Brgy. Bagumbayan, Mr. Mujibar Alilian has been selected and in
Brgy. Macangao, Datu Samuel Mangulayon had been selected. The remaining barangay to which the
selection process had been rescheduled taking upon the availability of the Barangay IPMR focal
person may reschedule probably next week in Brgy. Langka. To all of us, thank you and good
morning.

Before going to the Committee Report Mr. Chairman since our visitor came late. So may I request for
a reconsideration in order that she will be given a time to say something of her purpose of coming. So,
Mr. Chairman, I move for the suspension of rules.

33. Ms. Chona Joy Alejandrino A beautiful Monday morning to all of us. My sincerest apologies for
interrupting your agenda. First, because we came late because we have courtesy to the Office of the
Mayor. But, I would like to thank you so much for accommodating us. I am representing the Supreme
Student Government of Macangao Agricultural Vocational High School. Last week we sent a letter to
our Hon. Mayor requesting for support regarding for our fund raising campaign for the coming World
Teachers Day. Now please allow me to read my activity design submitted to our Mayor. (Ms.
Alejandrino read the entire content of the letter specifically the activity design.). So here with me are
the officers of the Supreme Student Government with their nilagang saba and ginamos. I hope you will
understand also na it has been a habit and a custom already of many of us including our school that in
every major activity that we have we always approach the respective offices and the respective
Honorable Councilors for financial support and I am very much thankful for that availability of your
assistance. However, as their adviser I know that it is not a good habit to be fully dependent in all our
activities for financial support. Thats why po I am using this occasion to also teach our future leaders,
this Supreme Students Government of Macangao Agricultural Vocational High School as I said in the
activity design to inculcate values of industry and honest earnings. I know it might not be enough to
raise the needed amount. However, this activity hopefully will help them see that its not just easy to

raise fund and not to depend on solicitation but to work for it. And with this we are here with the
nilagang saging na saba and the ginisang uyap hoping that you would patronize our product in order to
raise our fund in leau of solicitation. Thank you very much and hoping for your most kind assistance
and support.

34. Hon. Barabag (P.O.) Thank you Maam, youre welcome always. The Sangguniang Bayan of Lupon
is very accommodating anytime you will come to us, we will always accommodate you Maam.

35. Ms. Alejandrino If you will allow us, so we can go back to our school. Will you allow our students

resolution authorizing the Hon. Mayor Erlinda D. Lim to enter into and sign for and in behalf of the
Municipal Government of Lupon, Davao Oriental the Memorandum of Agreement with the D New
Orleans Training Center Philippines Incorporated, Cainta, Rizal for the conduct of training course on
slaughter operations NCII at the Lupon Municipal Slaughter in this municipality. And also Mr. Chair
I have also another resolution for inclusion. A resolution authorizing the Honorable Mayor Erlinda D.
Lim to enter and sign for and in behalf of the Municipal Government of Lupon, Davao Oriental the
Memorandum of Agreement (MOA) with the Department of Environment and Natural Resources
through the Environmental Management Bureau, Regional Office XI, Davao City and the Aroma

unit the deed of sale for the purchase of the portion of real property in the amount of Three Hundred
Thousand (P300,000.00) Pesos

52. Ms. Secretary Ref.# 2437 Veto letter from the Office of the Municipal Mayor, this local unit, dated
September 14, 2017, RE: SB Resolution No. 2017-115, entitled: A resolution earnestly requesting the
Honorable Joel Mayo Z. Almario, Representative, 2nd Congressional District of Davao Oriental, to
kindly extend financial assistance in the amount of Three Hundred Twenty-nine Thousand (P
329,000.00) Pesos as appraised by the Provincial Appraisal Committee of Davao Oriental, for the
acquisition of lot located in Barangay Ilangay, this municipality, containing an area of three hundred
twenty-nine (329) square meters for the purpose of establishing access road leading to Lupon National
Comprehensive High School, this municipality. (The Secretary read the entire content of the Veto
letter.)

amount that we will be authorizing the Hon. Mayor. So, I believe that this veto will not be subjected

This is A resolution favorably endorsing the poultry farm application of Mr. Tiangue, located at Prk.
Cawayan Brgy. Ilangay this municipality. Since there is already a barangay resolution for the
endorsement and I believe documents attached to the request could satisfy us that they are eligible to
construct or to establish this poultry farm. So therefore Mr. Chairman, premises considered, I move for
the approval of the resolution.

Office XI, Davao City, dated September 4, 2017, RE: The Bureau will be conducting an activity
enhancing awareness and advocacy on Mineral Resources and Geosciences (MRGS) laws and policies
on September 25, 2017 with the SB members.

- Another information I have a copy here of the postponement or the official


declaration of the Commission on Election pertaining to the conduct of Barangay and SK elections. So
this is very important, Im sorry I just got hold of this information this morning from the COMELEC
downstair. So, this is resolution EM No. 17-003 by the Commission on Election En Banc. In the matter
of whether or not to postpone the 23 October 2017 Barangay and Sangguniang Kabataan Elections or
BSKE in Mindanao. So this is a little bit lengthy resolution I will just be reading the important parts.
May 23, 2017, President Rodrigo R. Duterte issued Proclamation No. 216 placing the entirety of
Mindanao under Martial Law on account of lawless violence and rebellion for a period of 60 days. On
29 May 2017 and 31 May 2017, a majority of both the Senate and the House of Representatives,
respectively decided not to revoke the declaration of Martial Law. So those are the premises. Based on
all attendance circumstances, including the opinions and views of the interested parties during the
hearing, the public hearing for this was conducted in Davao City if can still remember, and the
respective positions papers filed for this purpose. The Commission En Banc finds sufficient basis to
postpone the 2017 Barangay and Sangguniang Kabataan in all barangays in Mindanao pursuant to
Section 5 of OEC. So the deposition goes like this; Wherefore, all the foregoing premises considered,
the Commission resolves to postponed the 2017 Barangay and Sangguniang Kabataan Elections in the
entirety of Mindanao, subject to the following conditions: No. 1 The commission shall immediately
conduct the Barangay and Sangguniang Kabataan Elections not later that 30 days from the cessation of
the cause of postponement of elections. So, we know the cause of poseponement is the declaration of
martial law which will end on December 31. Another condition: In the event Congress enacts or passes
a law providing for the postponement of the Barangay and SK elections this said law shall take
precedence. So meaning to say if the National Government or if the Senate its already approved in the
level of the Conggress in the House of Representative. If the Senate will also pass their counterpart bill
postponing the elections then that declaration, if signed by the President, that law will supercede this
resolution. Meaning to say mo prevail to siya, matuman to siya. In the event the National Government
will not be able to enact its national law this resolution prevails. So, meaning to say the conduct of
election will really have to take place 30 days or not later than 30 days upon the cessation of the
declaration of martial law. Meaning to say if martial law will end on December 31 this year the
election will ensue on January not later than January 30 of next year or maybe February or March
depending on the COMELEC but the Resolution says its 30 days after the cessation of the cause of
postponement. So Calendar of activities for the COMELEC to this effect will really go on. The filing
of the Certificate of Candidacy will resume, will still continue this coming September 23. So please be
guided, the calendar of activities, the gun ban, the period of election will ensue as normally as
scheduled by the COMELEC. Because the postponement only affects to the conduct of election. The
filing, the election period will go on as scheduled. So please be guided. Thank you very much Hon.

participate sa ilaha. Sa SMX, so ang uban man gud ilang gi-anticipate ang ilahang 4th assembly sa
Vigan, December 5 magsugod. So, kung willing mo mag-adto sa Vigan advice nako pagpa-book na
mo daan karon og ticket kay barato pa. Kay pag-abot man gud sa on that day ka mahal na kaayo unya
fully booked pud na siya kay peak season. So kinsa tong willing ongoing karon ang start sa SMX
starting today until Wednesday Eleven (11) minimum na siya wala pay labot ang kuan ana ha ang
