B. Utilities Director
1. Bid Award: ¾ Ton Service Truck Authorize the City Manager to sign a purchase order and supporting documents
for the procurement of (1) ¾ Ton Utility Service Truck from Redwood Ford, the
lowest bidder, for an amount not to exceed $32,078.68.

Any person may speak for three (3) minutes on any agenda item; however, total public input per item is not to exceed 15 minutes, extended at the discretion of the
City Council. This rule does not apply to public hearings. Non-timed items may be taken up at any unspecified time.
I. CALL TO ORDER & ROLL CALL: Mayor Turner called the meeting to order at 6:00 p.m., with Council Members
Barnes, Mattina, Parlet, Spurr, and Mayor Turner present.
II. PLEDGE OF ALLEGIANCE: The Pledge of Allegiance was led by Nick Walker.
III. ACCEPTANCE OF AGENDA/ URGENCY ITEMS: A motion was made by Council Member Mattina, seconded by Council Member
Spurr, and unanimously carried by voice vote to accept agenda as posted.
IV. CONSENT AGENDA: The following Consent Agenda items are expected to be routine and noncontroversial. They will be acted upon by
the Council at one time without any discussion. Any Council Member may request that any item be removed from
the Consent Agenda for discussion under the regular Agenda. Removed items will be considered following the
Consent Calendar portion of this agenda.

F. Letter of Support: Approve sending a letter in support of the relocation of the headquarters of the
National Institute of Food and Agriculture and the Economic Research Service to
Lake County, California, as proposed in an expression of interest submitted by
the Lucerne Area Revitalization Association.
Vote on Consent Agenda: A motion was made by Council Member Spurr, seconded by Council Member
Barnes, and unanimously carried by voice vote to approve the Consent Agenda,
items A-F.
V. PUBLIC PRESENTATIONS/REQUESTS:
A. Citizen Input: Ruby Jones asked when crosswalks on 11th Street would be completed as she had
observed unsafe crossings. Community Development Director Ingram stated he
would get the schedule for the striping project and provide it to her.
Wilda Shock announced the new art exhibit in City Hall from the Resilience
Project from the Middletown Art Center.
B. Lakeport Main Street Association: Panette Talia from the Lakeport Main Street Association presented the “Business
of the Quarter” Awards for the second quarter to O'Meara Brothers and the Gas
Light Grill for the third quarter. Ms. Talia presented the “People’s Choice”
Awards from the Taste of Lake County event which included the favorite
restaurant award to Mi Chelas and the favorite beverage award to Kelsey Creek
Brewery.
1. Bid Award: As staff report was presented by Parks Supervisor Ron Ladd.
A motion was made by Council Member Mattina, seconded by Council Member
Parlet, and unanimously carried by voice vote to move to approve and authorize
the City Manager to execute a professional services agreement with Foster
Morrison Consulting for the development of the Hazard Mitigation Plan.
VII. CITY COUNCIL COMMUNICATIONS:
A. Miscellaneous Reports, if any: City Manager Silveira reported that the employee appreciation event will be held
November 9, 2018.
City Attorney Ruderman will be absent at the next meeting, but will send a
colleague in his place.
Public Works Director Grider was absent.
Finance Director Walker had no report.
Administrative Services Director/City Clerk Buendia extended an invite to the
Council for the employee appreciation event.
Police Chief Rasmussen reported that the Police Sergeant and Officer
recruitments are going well, and he thanked the Council for the contract with the
LPOA which helped with recruiting.
Community Development Director Ingram advised that Engie has put in sample
lights on Main Street and in Library Park with varying degrees of intensity that
the City can choose from for the project.
Council Member Spurr had no report.
Council Member Parlet had no report.
Council Member Mattina reported that she attended the Safety Night event at
the school and mentioned that Officer Rico is doing a great job as the School
Resource Officer.
Council Member Barnes extended an invite to attend the last performance of the
Lake County Theatre Company’s production of Oklahoma!.
Mayor Turner thanked Wilda for sending economic development alerts.
IX. ADJOURNMENT: Mayor Turner adjourned the meeting at 6:27 p.m.

RE: Continuation of Local Emergency Declaration MEETING DATE: 11/06/2018
BACKGROUND/DISCUSSION:
On July 28, 2018, the Director of Emergency Services for the City of Lakeport declared a local State of
Emergency in connection with the conditions of extreme peril to the safety of persons and property
within the city as a result of the River Fire, re-named the Mendocino Complex fire in combination with
the Ranch Fire. In accordance with the Emergency Services Act Section 8630(b) and Lakeport Municipal
Code section 2.28.130, the City Council ratified the declared emergency on July 30, 2018 under
Resolution 2679 (2018). Under Lakeport Municipal Code section 2.28.150, the City Council shall review,
at least every 14 days, the need for continuing the emergency declaration until the local emergency is
terminated.
The City Council, at a Special Meeting on August 13, 2018, continued the emergency declaration via
Resolution 2680 (2018). The City Council subsequently continued the emergency declaration on August
21, 2018, September 18, 2018, October 2, 2018 October 16, 2018, and November 6, 2018. Since a need
still exists for the declaration, Council is asked to review and continue the declaration. Should the need
continue, staff will return this item at the next regularly scheduled City Council meeting.

Mendocino Complex fire; or proclaim the termination of the Local State of Emergency

Municipal Sewer District (CLMSD) and Municipal Financing
Agency of Lakeport (MFAL) Investment Policy
BACKGROUND/DISCUSSION:
The City Council/ Board annually reviews the investment policy of idle funds, pursuant to California State
Government Code 53601 and 53601.1. As stated in the policy, its purpose is to "…invest public funds in a
manner which will provide the highest return with the maximum security while meeting the daily cash flow
demands…” Policy also requires quarterly reporting of all investments to the City Council and Boards.
The investment policy provides specific guidelines for the City to follow in pursuing different investment options,
including holding the majority of cash in LAIF.
Significant tenets of the policy include:
• capital preservation and prudent cash management
• maximization of the rate of return of idle funds
• emphasis on ensuring sufficient liquidity to meet operational needs
• clearly defining roles and responsibilities
• establishing reporting requirements and updates by the Finance Director
• emphasis on significant oversight by the City Council and RDA Board of Directors, and
• Suitable investment guidelines based on statutorily defined parameters.
As these CDs mature the Investment Committee will consider reinvesting principle amounts in new CD’s and
investigating other investment opportunities according to the policy.
While the policy requires quarterly reporting to the council, a policy which will be adhered to going forward.

POLICY
It is the policy of the City of Lakeport, the City of Lakeport Municipal Sewer District (CMLSD) and the
Lakeport Municipal Financing Agency (LMFA)to invest public funds in a manner which will provide the
highest investment return with the maximum security while meeting the daily cash flow demands of the City
of Lakeport and conforming to all state and local statues governing the investment of public funds.
The City of Lakeport shall strive to maintain the level of investment of all idle funds as near 100 percent as
possible, through daily and projected cash flow determinations. Idle cash management and investment
transactions are the responsibility of the City Finance Director or his/her designee.
SCOPE
The City of Lakeport pools all cash for investment purposes, and this policy is applicable to all current City
funds or any new funds created. These funds include: The General Fund, capital projects funds, special
revenue funds, enterprise funds, fiduciary funds, and Successor Agency funds. Exceptions to pooling of
investments are bond fund reserves
• Bond fund reserves have conditions imposed by bond indentures which require a segregation of funds.
Bond fund reserves accrue investment earnings directly to the reserved funds as required by the bond
prospectus. For bond fund reserves, the investment policy is stipulated by the bond indenture.
PRUDENCE
Under all circumstances, the “prudent investor rule” shall apply. Investments shall be made with judgment
and care, under circumstances then prevailing, which persons of prudence, direction, and intelligence exercise
in the management of their own affairs, not for speculation, but for investment considering the probable
safety of their capital as well as the probable investment earnings to be derived.
The Finance Director and/or his/her designee, and other individuals assigned to manage the investment
portfolio, acting within the intent and scope of the investment policy and other written procedures and
exercising due diligence, shall be relieved of personal responsibility for an individual security’s credit risk or
market price changes, provided deviations from expectations are reported in a timely manner and appropriate
action is taken to control adverse developments.
OBJECTIVES
1. Safety of Principal
Safety of principal is the foremost objective of the City’s investment policy. Each investment transaction
shall seek to ensure that capital losses are avoided, whether from securities default, broker-dealer default, or
erosion of market value. The City shall seek to preserve principal by mitigating credit risk and market risk.

Credit risk, defined as the risk of loss due to failure of the issuer of a security, shall be mitigated by investing
in high investment grade securities and by diversifying the investment portfolio so that the failure of any one
issuer would not unduly harm the City’s cash flow.
Market risk, defined as market value fluctuations due to overall changes in the general level of interest rates,
shall be mitigated by: (1) limiting the average maturity of the City’s investment portfolio to three years, (2)
limiting the maximum maturity of any one security to five years, and (3) structuring the portfolio based on
historic and current cash flow analysis. This policy eliminates the need to sell securities prior to maturity and
avoids the purchase of securities for the sole purpose of short-term speculation. It is recognized, however,
that in a diversified investment portfolio, occasional measured losses are inevitable and must be considered
within the context of the overall investment return and current economic circumstances.
2. Liquidity
The City’s investment portfolio will remain sufficiently liquid to enable the City to meet all operating
requirements reasonably anticipated. Historical and current cash flow needs are analyzed continually.
3. Return on Investment
The City’s investment portfolio shall be designed to attain a market-average rate of return through economic
cycles.
The City shall not knowingly make any investments in any institution, company, corporation, subsidiary or
affiliate that practices or supports directly or indirectly through its action’s discrimination on the basis of race,
religion, color, creed, national or ethnic origin, age, sex, sexual preference or physical disability.
The City shall strive to make investments that benefit the local area and are consistent with the City’s plans
and policies. Priority shall be given to investments that promote community economic development, for
example, by doing business with local banks provided that the criteria for safety, liquidity and yield are met.
DELEGATION OF AUTHORITY
The City Council, by Resolution, assigned the responsibility of investing idle funds to the City Manager. The
Finance Director and/or his/her designee shall have day to day responsibility of the investment program and
shall establish procedures for routine operations consistent with this investment policy. The City Manager or
designee shall review and render quarterly reports to the City Council, as set forth by the California Government
Code.

SAFEKEEPING OF SECURITIES
The City shall endeavor to ensure safety of principal invested to the maximum extent possible. This may
include procuring an insurance policy for accounts maintained by broker/dealers, such as those offered by
the Security Investor Protection Corporation (SIPC).
INTERNAL CONTROL
The Finance Director shall establish procedures that separate the internal responsibility for management and
accounting of the investment portfolio. An independent analysis by an external auditor shall be conducted
annually to review internal control, account activity, and compliance with policies and procedures.
An investment committee consisting of no less than the City Manager, the Finance Director, and two Council
Members, shall meet regularly to review both the investment policy of the City of Lakeport, CMLSD and the
LMFA and/or investment strategies and practices to determine appropriate improvements. Two additional
committee members may be added at the recommendation of the City Manager and approval by Council. A
staff report by the Finance Director consisting of the committee’s review, comments, and/or
recommendations will be presented to the full Council annually, no later than the first regularly scheduled
Council meeting in October.
REPORTING
Under the provisions of Section 53646 of the California Government Code, the Finance Director shall render a
quarterly report to the City Council showing the types of investments, institutions, rates of interest, maturity
dates, amounts of deposit, and current market values of securities with maturity in excess of twelve months.
The market values of all investments shall be reported quarterly.
DIVERSIFICATION
The purpose of diversifying is to reduce the overall portfolio risk while attaining an average market rate of
return. Diversification needs to be conceptualized in terms of maturity, instrument types and issuer. The
portfolio shall consist of a mix of various types of securities, issuers, and maturity dates. Diversification of
investment funds among a variety of securities offers an independent return.
COLLATERALIZATION
The California Government Code requires California banks and savings and loans to secure the City’s deposits by
pledging government securities as collateral. The market value of the pledged securities must equal at least
110% of the City’s deposits. California law also allows financial institutions to secure a city’s deposits by
pledging first trust deed mortgage notes at least equal to 150% of the City deposits. Collateral requirements
may be waived for deposits which are fully insured up to $250,000 by the Federal Deposit Insurance
Corporation (FDIC).
AUTHORIZED INVESTMENTS
The City is governed by the California Government Code, Sections 53600 et. seq. Within the context of the
California Government Code, the following investments are authorized:

2. Bankers Acceptance
As authorized in Government Code §53601(g), up to 40 percent of the City's portfolio may be invested in
bankers’ acceptances (BAs) that are eligible for purchase by the Federal Reserve System, although no more
than 30% of the portfolio may be invested in BAs with any one commercial bank. Additionally, the maturity
period cannot exceed 270 days.
3. Commercial Paper
As authorized in Government Code §53601(h), up to 15 percent of the City's portfolio may be invested in
"prime" quality commercial paper (CP) as rated by Moody's or Standard & Poor's. The amount may be
increased to 30 percent if the dollar weighted average maturity does not exceed 31 days. Issuing corporations
must be organized and operating in the U.S., have $500 million total assets, and have an "A" or better rating
for other debt. The City cannot purchase more than 10 percent of the outstanding CP of an issuing
corporation, with maturities not to exceed 180 days.
6. Medium-Term Notes
As authorized in Government Code §53601(k), up to 30 percent of the City's portfolio may be invested in
medium-term notes issued by corporations organized and operating within the United States and with a
maximum maturity of five years. Medium-term notes shall be rated "A" or better by a recognized rating
service. A maturity limitation of five years is applicable.
7. Mutual Funds
As authorized in Government Code §53601(l), up to 20 percent of the City's portfolio may be invested in shares
issued by diversified management companies, as defined in §23701(m) of the Revenue and Taxation Code, which
invest in securities complying with this article. Diversified management companies must either attain the
highest rating by two of the three largest nationally recognized rating agencies, or have an investment advisor
registered with the SEC with not less than five years' experience in local agency investments and with assets
under management in excess of $500 million.

POLICY REVIEW
The City’s investment policy shall be reviewed at least annually to ensure its consistency with the overall
objectives and preservation of principal, liquidity and yield, and its relevance to current law and financial and
economic trends. Any State of California legislative action that further restricts allowable maturities or
percentage allocations will be incorporated into the City’s investment policy and supersede any and all
previous applicable language. Amendments to the policy shall be forwarded to the City Council for approval.

to dealerships in accordance with the bid process. The City received five bids meeting our specifications for a ¾
ton utility truck as outlined below.
There are also appropriations of $30,000 in the 2018/2019 budget to replace an existing vehicle with a Small
Pick-up Truck. The City also received three bids meeting our specifications for this vehicle as outlined below.

RE: LIBRARY PARK SEAWALL REPLACEMENT DESIGN MEETING DATE: 11/20/2018
BACKGROUND/DISCUSSION:
During January and February 2017, flooding and storm wave action damaged the Library Park Seawall. Approval
and funding has been obtained to replace the existing CMU seawall with a sheet pile wall placed just to the
lakeside of the existing wall, thus allowing the existing wall to remain in place. The approved preliminary budget
is $522,000. This is a FEMA funded project which will be reimbursed actual costs.
The selected engineering firm will prepare plans and specifications for the construction of the seawall
replacement. City staff prepared and advertised the RFP, it was sent to the local news sources and plans rooms
following our standard procedures. The City received no responses to the RFP. It was decided to advertise the RFP
a second time to insure the City met all of the FEMA RFP requirements. Staff composed a list of all engineering
firms that perform the required type of engineering for the seawall, a list of 30 firms was complied. Staff contacted
all of the firms on the list and sent them the RFP as well as our standard advertising.
The second Request for Proposal (RFP) was issued on October 15, 2018, with a due date of November 5, 2018.
The City received proposals from two (2) firms: MGE Engineering Inc. and GHD Inc. A bid selection panel reviewed
and scored the proposals based on 4 criteria (see attachment 1). Staff is in negotiations with the top ranked firm
MGE Engineering Inc., at this time and will have staff recommendation presented at the Council meeting.

Background

Seawall. Approval and funding has been obtained to replace the existing CMU seawall with a
sheet pile wall placed just to the lakeside of the existing wall, thus allowing the existing wall to
remain in place. The approved preliminary budget is $522,000. This is a FEMA funded project
which will reimburse actual costs.
Approximately 525 lineal feet of seawall supporting a concrete promenade and handrail is to be
replaced. The existing sidewalk is to be removed to reveal voids. Voids under the existing
footings will be backfilled with pumped grout or controlled low strength material (CLSM). Voids
under the sidewalk available to equipment will be backfilled using aggregate base. The top of
the existing wall is to be removed.

Scope of Work
A. Topographic Survey
Provide a survey of the existing seawall and adjacent area. The minimum area shall be
20-25 feet on the west of the existing wall and 10-15 feet on the lake side. The south limit is the
southern edge of the 1st street boat ramp. The north limit is 20 feet north of the southern edge
of the 3rd street ramp. No driplines required, only tree trunk locations including diameter waist
high. Locate and label all improvements. Topographic lines shall be on 0.5 foot intervals in the
promenade and park areas and 1 foot intervals elsewhere. The City will provide benchmarks. At
least one cross section will contain both USGS elevations and Rumsey elevations. Provide
AutoCAD 3D -2013 electronic file, hardcopy print and .pdf file on 22”x34” format.
B. Geotechnical Testing
Provide sufficient testing to determine soil type and classification. Provide soil design
parameters for design of sheet pile wall. Provide investigation, testing and recommendations in
a letter type report signed by either a CA registered civil or geotechnical engineer.

D. 90% Design
Provide 90% design based upon preliminary design submittal comments. Provide detailed
technical specifications, quantity estimate details, and engineer’s cost estimate. Provide written
technical specifications in either Caltrans formatting or CSI formatting. The City will coordinate
front end documents including Notice to Bidders, Bid Documents, General Conditions, etc. Include
required code references beyond the 2010 Caltrans Standard Specifications.
E. Final Design
Provide completed design submittal of plans, specifications and estimate incorporating
design review comments by the City. Review front end contract documents provided by the City.
F. Construction Support
Anticipated construction support services include site meetings, submittal reviews, on site
observations, and field testing.
All work shall become the property of the City including electronic documents. A single hard copy
of reports, plans, specifications, etc. shall be provided. Electronic documents shall be provided
in Microsoft Word or Microsoft Excel 2010 versions as applicable as well as .pdf. Drawings shall
be provided in AutoCad 2013-3D as well as .pdf. Electronic copies of photographs shall also be
provided in a mutually agreeable format.
Provide one hard copy with wet signature and one .pdf electronic copy. Provide the following
information with your SOQ:
• Cover letter indicating that you agree to supply the required insurance and sign the
professional services agreement (see Attachment E)
• Company Background and History ( 2 pages maximum)
• Similar Reference Projects (2 pages maximum)
o Provide current contact information for each reference
o Provide cost data where available
• Resumes of proposed lead personnel – provide resumes of only persons who will be
directly involved in project. ( 4 pages maximum)
• Provide a narrative description of project approach for each phase covered in the scope
of work at a minimum. (4 pages). Provide schedule for work including completion dates
for each task including City review times.

cost proposal in a separate sealed envelope from the SOQ. Only the cost proposal from
the most qualified consultant will be opened to begin cost negotiations.

All submittals will be evaluated by the City of Lakeport’s Consultant Selection Committee.

submittals and will rank the proposers. The evaluation of the proposals shall be within the
sole judgment and discretion of the Committee. The Consultant will be selected based on
the following criteria:
Interviews may be required of the top two ranked candidates. Negotiations will take place with
the most qualified firm. If failing to agree on a fair and reasonable price, the City will conduct
negotiations with successive offerors in descending order until contract award can be made.
